Complaint: Lendmark Financial is a corrupt company. They have change a bogus loan amount on my credit report more than 5 times, took me to court in both XXXX XXXX and XXXX XXXX XXXX XXXX, marked my credit report as sold then said it was n't and most recently added a bogus amount to my credit report again after it 's been disputed and marked as sold to a collection agency. They have attempted to collect money that I do not owe them for the final time. I will obtain a lawyer because they sued me twice for the same bogus loan in the same state just XXXX different counties. They also reported that I opened up this fraudulent loan on a Sunday, XXXX/XXXX/2013, which I did n't and I would remember that because it 's the day before my Birthday, and they are not even open on weekends. They are not only attempting to get what I do n't owe them but are even reporting incorrectly and but pursuing illegally by suing me twice for something I do n't owe them. My wife and I are currently in the market to purchase a home, this stunt of adding a debt onto my credit could severely hurt our chances of doing that and I 'm livid! I 've had enough of creditors being able to do what they want, when they want and we are to just take it because they say we owe them? I am suppose to be protected from double prosecution, I 'm suppose to be protected through the FCRA and the FDCPA. I ex cerise my right as a consumer to apply these laws to my case and I want this fraudulent account removed from my credit report immediately or I will sue for Fraudulent Credit Damages, Violation of the FCRA and the FDCPA and also for suing me twice the the same fraudulent account.

Complaint: Went to a local auto sales lot and picked out a car and applied for a auto loan through their website. Loan vendor is Lendmark Financial Service located in XXXX, MD. Asked for $ XXXX. Was approved for the full amount at an ridiculous rate of 21.99 APR. I have good credit, great work history and well above avg salary. Later that same day I applied at my local credit union and was approved for the same loan at 3.99 APR. I am complaining because I want this type of predatory practice stopped.

Complaint: My husband and I were approved for a car loan from Lendmark Financial. We signed the loan documents and did what we were instructed to do, but the title was misplaced and we had to get another copy from the dealer. The dealer contacted the previous owner and it took the owner some time to give the dealer a copy. Once the dealer received the copy we processed the title immediately, but Lendmark Financial had to update their information with the Virginia DMV in order to get the title. Lendmark claimed they could n't get in touch with the DMV and did not know what to do. I got in touch with the DMV and found out what to do, sent the form to Lendmark and processed a title copy for the third time. I did not miss a payment and I kept open communication through out the entire process. Lendmark Financial placed a judgment on my husband 's and my credit report. When I called to see if the title was received they confirmed that they had it. I then asked if the judgment could be removed since we made sure the company received the title. The branch manager ( XXXX ) was very rude and stated that the judgment would not be removed until the loan was paid in full. I replied that there were no payments missed and reminded her that I made sure they received the title. I also told her that I was not going to pay until they removed the judgment. However, I am still current on the payments and she filed a motion to garnish our wages, even though we have not missed a payment. I have proof from my checking account and my credit report shows on time payments as well.

Complaint: When working on building my credit, I took out a loan from Lendmark Financial in XX/XX/XXXX. I paid as agreed and on time until XX/XX/XXXX ( 12 months ), at which point they offered me a new loan and to consolidate the remaining balance of my old loan into the new one. Since 12 months of payment history was reported, I decided to do this to help my credit scores even more with another loan. I paid that loan off in XX/XX/XXXX. During this time, I had not missed a single payment on my loans, however, the original loan was never reported as closed, and shows a 90-day late payment in XX/XX/XXXX and two 30-day late payments as well. I have disputed this account several times with the credit bureaus, of which XXXX and XXXX WILL NOT remove the account, XXXX did on the first dispute. This account reports my ONLY late payment in my credit reports and is harming my credit scores and making me pay higher interest rates for all of my loans. The fact that XXXX and XXXX will not properly investigate the account is the primary issue. I 've contact Lendmark on multiple occasions and have received multiple verbal responses ranging from " I see the error and will get it corrected '' to, " we have no record of a late payment '' to " We do not show your other account with us ''.

Complaint: I got a personal loan to get my credit established and to get my car fixed from a certain loan company. I stayed caught up on my payments for as long as I had it, maybe 1 yr or little over and my payments came straight out of my bank on time. Then I get a letter about 2 months later stating that my payments was late and they could n't no longer get the payments from me because they sold my car title to another loan company and I had to sign papers so they can withdraw payments from my bank account again and then I ended up having to pay 2-3 months to catch up. I was n't notified and I did n't sign anything. Why? Because they did n't inform me until I was 2-3 months late. I could n't pay that much at one time because I 'm on a fixed income. Also the loan company they sold my title to another loan company that NEVER let me barrow anything from them when I asked in past. I am concerned, upset and overwhelmed from this. It is ruining my credit as I am trying to gain it back. I feel it is wrong that they DID NOT let me know nor did I sign papers for them to do so. I need some help in resolving the matter. Could someone at CFPB help me get through this?

Complaint: LendMark Financial Services recently acquired XXXX XXXX XXXX in XXXX 2016. Consumer is a XXXX XXXX loan customer. An original loan in the amount of {$2000.00} + {$1000.00} with XXXX were granted to consumer in XXXX, WV store. The loan are rated sub-prime and loans APR are 24 % - 27 % to consumers with limited or marginal credit. Or less credit than most. Since Lendmark acquired XXXX, all loan requirements and paperwork are different to the XXXX consumer ; if loan funds are added the consumer must comply with inflated APR 's in each state. The APR can increase from existing loan amount sto a maximum of 36 %. Consumers are held to LendMark standards and no longer to the XXXX requirements ; means if consumer needs additional funds all loans are under new rules and regulations. Consumer contends that LendMark offers predatory loans and should have grandfathered -- XXXX loans with similar rates to the contracts signed at the time of lending. And, due to acquistiion consumers facing inflated APR amounts is n't fair practice. In addition, if consumer chooses to re-finance and/or pay-off a loan from one store to another ; why is consumer being rated at higher inflated APR rates ; due to state by state laws. LendMark Finanacial Services should not be providing predatory loans and inflated amounts merely because of acquisition ; and the purpose to recover acquisitions losses ; whereas the consumer will eventually be a part of said purchase.

Complaint: On XXXX XXXX, I received a letter from Lendmark Financial stating that they had recently bought out XXXX who I originally took my loan out with. The letter stated that effective XXXX XXXX, my direct pay would be cancelled. All subsequent payments could be made online or by setting up direct pay with Lendmark. On XXXX XXXX, I spoke with the branch manager, who took my payment over the phone. She stated that she would send me forms to complete the XXXX XXXX enrollment process. I received the forms but have not signed and returned them to the branch. On XXXX XXXX, my account was debited for the monthly payment of {$240.00}. Given that Lendmark 's letter and website state that my direct pay was cancelled beginning XXXX XXXX, I was not expecting to have my bank account debited and was actually going to mail in my payment from another bank account that I wanted to use. On XXXX XXXX, I received a letter from Lendmark confirming my authorization for an electronic debit that was done on XXXX XXXX at XXXX which subsequently posted to my bank account in XXXX XXXX. I did not authorize that payment. I also called the XXXX branch and spoke to a rep who told me that because I previously had XXXX XXXX set up with XXXX, that they have a right to debit my account. I explained to her what the letter from Lendmark stated and what is listed on the website regarding the direct pay cancellation. She advised me that regardless of what the letter or website states my bank account can be debited. I again advised the rep that they do not have my signature authorizing the new direct pay enrollment. This unauthorized debit, cost me {$70.00} in overdraft fees. I have since mailed a letter to the XXXX, VA branch and the corporate headquarters revoking their right to debit my bank account.
