Complaint: Currently my husband and I have a car loan with Lendmark Financial Services. On Tuesday night, XX/XX/XXXX, Lendmark repossessed our vehicle. The payment for the loan was 45 days past due. When we called to make arrangements to get our car out of repo, the lending company proceeded to breakdown the fees we would need to pay to get the car back. Among the fees was our XX/XX/XXXX and XX/XX/XXXX payment ( understood ), a {$620.00} repo fee ( only {$300.00} of which goes to the repo company ) AND a demand that we make our XX/XX/XXXX payment ( obviously not even due yet ) before we could get the car. In researching their tactics, I 've found multiple people who are having similar issues with the same lending company ( same location actually - XXXX, GA ). We also found out ( from our repo company who are more honest and XXXX than anyone we 've dealt with to date at Lendmark ) that the terms of contract have been changed by Lendmark to 25 days past due considered default. Our loan was initiated in XX/XX/XXXX and we have never received an amended terms of contract from Lendmark with this information. Each individual I have spoken to in my research have had multiple repossessions, some not even 30 days delinquent and often with payment arrangements made. After speaking with Lendmark Wednesday morning to make arrangements for payment today, XXXX ( their crooked branch manager ) went ahead and sent a send to to sale notice to the repo man. Only because the repo company is run by decent human beings, they called to question the notice since they knew we were coming to get the car today and refused to process the send to sale command or our car would have gone to the sale. There is no limit to what these people at Lendmark will do to fleece hard working families in the XXXX Georgia area. They know what they are doing is wrong and will respond with " if you ca n't make your payment how are you going to hire an attorney to fight this '' this comment was actually made to us today when I brought up many of the points above. Lendmark did not send us a letter of intent or any warning before repossessing the car. These unscrupulous practices are costing families XXXX in fees they should not be forced to pay.

Complaint: I have an installment loan with Lendmark Financial and I experienced several issues with the company drafting the payment from my account when they were supposed to. This resulted in my account being delinquent. I then got my account back on track and the same issue occurred again. Lendmark Financial filed a court case against me and placed a judgment on my credit report. I feel that I have been paying the loan and should not have a judgment while paying. The judgment amount is inaccurate as well. The judgment is {$12000.00} and my balance is {$8400.00}.

Complaint: I have a vehicle loan with Lendmark financial. They call and harass me even if I 'm only one day late on my payment. Literally only 1 day. I was even called at my work place over {$40.00}. I made all of my payment except {$40.00} ( in advance ). And forgot about the remaining {$40.00} since I had paid so much in advance. When they called my job, they was extremely rude to my coworker, who answered the phone. After that incident I wrote a letter requesting that I not be called at any numbers listed on my paperwork any more due to the harassing calls. I requested that any contact be directly through mail. Which is my right. Since writing that letter I have been called several times. I spoke with a manager and that has not resolved anything. When I informed the calling associate of my written requested, I was asked " Why do n't you want us to call you ''. At this point the harassment is out of hand. I am almost ready to just turn my vehicle back into Lendmark to avoid all of their harassment.

Complaint: I took out a loan with this company and it has been a nightmare. My payments were due on the same time each month. If it was one day late they would call several times a day very rude and threatening. They even went as so far as to call one of my relatives. In XXXX I went in to make a payment which was about a week late ( they had called everyday and several times ). The branch manager XXXX refused payment if I did not make payment for the following month which was not even due and even going to the extent of showing me a list of people which included myself as too the reason she had to work on Saturday because of us.Upon calling corporate which still resulted in rudeness and being told that they it is up to the manager if they want to accept payment or not. So I contacted a debt collection attorney whom sent them notice that they were the Guardian of the case. I have constantly received calls from them ( unknown numbers and different numbers ) even though they know I am working with an attorney. I received a subpoena that they were seeing me that came to me instead of my attorney and they have called and left messages almost daily even after filing suite . Their collection practices are horrendous. After being harassed by them, I saw some very negative reviews and it turns out I am not the only one that has been subjected to this.

Complaint: I am just being made aware today of a lawsuit in which a judgment was entered in favor of the Creditor XX/XX/XXXX. The case was filed in District Court XX/XX/XXXX by Lendmark Financial Inc in XXXX XXXX MD and represented by Attorney XXXX XXXX XXXX, XXXX. On XX/XX/XXXX they filed to have my wages garnished. However, I was never, ever served with a summons even notifying me of this lawsuit, and never received any documentation thereafter until being notified TODAY by my Employer that the are attempting to garnish my wages. I called both the Attorney and the Creditor to obtain to get proof of Service and to get my payment history and have not received any response or help with this matter. This case has been sitting here for 8 YEARS and I was never notified, never properly served or given the fair chance to resolve a debt that was opened 11 years ago. I now run the risk of losing my pay when I feel like I was never given the chance to resolve this to begin with. I can not even tell if they filed the lawsuit within statutes because no one will provide the date I was in default.

Complaint: Recently my payments on my personal loan with Lendmark Financial has went into default. I still try to make at least one payment until I can get caught up on all payments. Recently I wrote Lendmark a letter asking them to stop contacting me by phone and to contact me by mail because the phone were 3 to 4 times a day every day after that I was served with XXXX Court Papers so now they are claiming no payments have been paid and they want the payoff balance. The only notification I received about this action was letter in the mail from the Court. Lendmark only sent me the next month statement and a letter to defer my account.
