Complaint: On XX/XX/XXXX I closed escrow on my property ( XXXX XXXX XXXX, XXXX, Az. ). The prior owner was in foreclosure, however funds from the sale of he property satisfying his outstanding principal balance were wired to his mortgage company ( Lakeview Loan Servicing ). Lakeview failed to advise the local trustee that the debt was satisfied, and the trustee subsequently executed a trustees sale. This act of foreclosure was taken against me even though I did not and had not owed a debt on the property that had defaulted. In XXXX of XXXX I was served with eviction orders by the third party who purchased MY property at trustees sale for about $ 170k. I was forced to engage counsel and defend my right to occupy the property I had purchased fair and square. At that time, I was forced to file a prior CFPB complaint in order to get someone from Lakeview to respond to my many inquiries. A compliance manager from Lakeview reached out to me, and for a short time it seemed like the mortgage company would be working to resolve an obvious error on their part. Fast forwarding to XXXX of XXXX, I am still in danger of being evicted from a property I purchased fairly because Lakeview Loan Servicing has been and continues to be incapable of giving the matter any reasonable attention. All I want is for Lakeview to PAY ATTENTION to my issue. I want them to work with the third party who purchased the property at the improperly executed foreclosure sale in XXXX, and get my name and my family out of the way of eviction proceedings. Ive been treated indifferently at best, and would say that Lakeviews negligent and inappropriate handling of my situation is the exact reason a body like the CFPB exists.

Complaint: I am currently in a chapter XXXX bankruptcy plan since XX/XX/XXXX. Lakeview Loan Servicing LLC is trying to take steps to foreclose on my primary residence. On XX/XX/XXXX, they filed a motion for relief from the automatic stay in bankruptcy court showing that I was 120 days past due and owed {$5700.00}. We have provided them evidence and proof of payments showing that I was less than 90 days past due and only owed {$4200.00} as of XX/XX/XXXX. We have also sent them proof that as of XX/XX/XXXX, I have brought my account current and am no longer past due. However, due to issues with their accounting systems, they continue to show that I am past due and continue to pursue the motion for relief so they can foreclose on my home. In my opinion, they intentionally mislead the bankruptcy court by submitting the motion for relief by showing that I was 120 days past due when I was not as the regulations set by the Consumer Financial Protection Bureau ( CFPB ) state that foreclosure proceedings should not begin until the consumer is 120 days or more past due. The CFPB also regulates how mortgage servicers use the suspense account. Lakeview Loan Servicing LLC is also abusing the use of the suspense account. The only time a payment is to be placed in the suspense account is if an underpayment is sent or overpayment is sent. However, ever since I have filed bankruptcy, according to the account ledger that the mortgage servicer sent us, every single payment that I have made, even if it was the exact dollar amount of my monthly payment, was placed in the suspense account instead of immediately being applied to my balance due. Furthermore, even when partial payments were sent and when there was enough funds in the suspense account to equal a full months payments, the funds were not immediately applied to my balance as the CFPB regulations require and were held in the suspense account for a extended period of time. Furthermore, while in bankruptcy, Lakeview Loan Servicing LLC increased my monthly payment without any notification to me, my lawyer, or to the bankruptcy trustee. That is a violation of bankruptcy laws as bankruptcy rule 3002.1 requires the mortgage servicer to provide at least 21 days notice to the consumer, their lawyer, and to the bankruptcy trustee regarding the increase in payment and the cause for the increase in payment. This notice was not provided by Lakeview Loan Servicing LLC and as of yet, they have not provided an explanation as to why they failed to provide this notice.

Complaint: On XX/XX/XXXX I received a letter from the town of XXXX NH XXXX stating my bi-annual taxes for XX/XX/XXXX have not been paid. I contacted LakeView ( mortgage company ) and sent via e-mail the Notice of Impending Tax Lien and the XX/XX/XXXX Tax bill. I sent several emails with no response. On XX/XX/XXXX I checked with the town and still no payment. I asked if I should pay the bill or wait, the town said it happens often and normally things are taken care of quickly and recommended i wait. I called LakeView on XX/XX/XXXX and was told a payment went out on the XX/XX/XXXX. I checked again with the town on the XX/XX/XXXX and still no payment. I received an e-mail on the XX/XX/XXXXfrom XXXX XXXX stating that a disbursement was made on the XX/XX/XXXX. I was told to not to pay the bill by the town on the XX/XX/XXXXsince a check is in route. On the XX/XX/XXXX the check failed to appear and a lien has been placed on my house and my credit has been affected. I work for the XXXX and am required to keep fiances in good standing due to security clearances. I have contacted LakeView Mortgage several times with little help and no follow up on their end. As of XX/XX/XXXX the bill is still outstanding. Per a conversation with a lawyer I was told not to make the payment on my own yet due to a double payment that may take even longer to be reimbursed. The lawyer I contacted suggested to try this process first. I have been with this mortgage company for 9+ years and always in good standing with no late payments. The Tax and insurance are paid through an escrow account that is paid monthly and is current with available funds.

Complaint: I submitted the proof that i have insurance for my house. However, lakeview Loan Servicing LLC who is the escrow agent, refused to refund the deduction which should not be supposed to do that. Our house loan has no escrow account and we handled our insurance. In XX/XX/2018, Lakeview Loan Servicing LLC suddenly open the escrow account and deducted {$2200.00} and deducted the amount from my back account by automatic payment. Later on, I submitted insurance company 's statement and showed them we have insurance. Lakeview loan LLC sold the loan to XXXX. Lakeview Loan LLC refused to refund me saying the account is sold and closed. I called Lakeview several times during the past few months and they said " the check is being processed '' but i never received the refund. Attached with the doc. Complaint: I am a successor to a property I inherited by my son. My son was XXXX XXXX in XXXX and I became the administrative of the estate and gotten the property probated. I provided the lender with the death certificate and the administrative of the estate paperwork. I began providing the lender with a modification application XXXX XXXXalong with my pension from the XXXX XXXX XXXX XXXX and my XXXX statement. The property is a duplex with me and tents living in the property. I also provided the lender with two leases in which I receive rental income. The lender filled a judgement stating that the property was empty but was not empty. I was told by XXXX XXXX XXXX XXXX XXXX to go file a some paperwork at City Hall for me to get into mediation court. I filed the paperwork 1 day after they placed a judgement on the property that has been listed for Sheriff Sale and postponed over 18 times. I have been in mediation court 18 times since submitting over 7 modification applications. I never once gotten an approval or a denial on any applications I submitted except for the last modification application in XX/XX/XXXX, XXXX.This is the first time I received a denial letter on XX/XX/XXXX at mediation court. I did not even receive one in the mail ; the attorney provided this letter to the Housing Counselor. Something does not look right with this letter. The letter does not have any letterhead on it and it does not discuss reasons on why the client was denied the modification. When the housing counselor questioned the attorney about the letter and asked the attorney to go back to the lender and give a more detailed letter, the attorney stated that the client needs to submit another application as if the denial letter did not come from the lender. I am very confused why every time I am in mediation court the home is listed for sheriff sale right after. I believe this lender does not want me to assume the property by any means. This lender continued drag this process out by the lender accruing fees for so long, also letting me rack up court fees, sheriff sale fees by continuing to list the property, and also by not following the FHA guidelines of a successor. I was scheduled to go in front of the judge on XX/XX/XXXX, but again the attorney asked me to submit another modification application. I feel like I have been harassed and treated unfairly as a successor of my sons property. I read the FHA guidelines about a successor and it states that I am supposed to be treated as if I am the owner of the property. I do not have all of my modification packages that I submitted because the housing counselor I was working with changed agencies and I have requested my records from the prior agency and I was not given all of my documents. I am seeking a lawyer to take on my case and I will request all of my records from the previous agency. I feel as though this lender is pushing me to file bankruptcy in order for me to save my home in which I live in. I now have to pay an attorney to take this lender to court and also pay an attorney to file bankruptcy before I lose the house to Sheriff Sale. They filed the judgement wrongly anyway saying that no one lived in the home. I provided utility bills to show that I and two other tenants live in the property. I felt they should have stayed the sheriff sale until I was done in mediation court. I am very concerned that this lender may do this to other successor or have done this to other successor. I would like to see this lender be investigated for wrongdoing. This has been a long journey in and out of court and I have been scared to death that my home would be sold to sheriff sale without me being reviewed fairly.

Complaint: The lender changed closing dates and times twice and did not communicate with closing company. They cost parties money by doing this. When getting confronted about closing changes they stopped a close date again. At closing the package that was emailed over was full of errors. Thankfully XXXX XXXX were able to find errors and fix. The closing was set for XXXX. By the time the lender sent over correct paperwork it was XXXX XXXX. All parties waited. Completely unprofessional.

Complaint: I did a refinance in XXXX of XXXX, to get a better rate and lower payment of {$970.00}. I got both up until they messed up on the escrow account, and in XXXX of XXXX they went up on the payment by {$92.00} per payment. Now the main complaint. In XXXX of XXXX they disbursed a payment to another customers account for insurance to the amount of {$1200.00}. It again threw my escrow account into a tail spin, so they have now increased my payment again by another {$150.00} per payment. I have called them repeatedly and they say they see the issue and are trying to get it worked out. Just to mention that it takes over an hour on hold each time I try to get an update. I held the line for over two hours on Monday XX/XX/XXXX and finally gave up, which brings me to you. In the mean time, I have a payment due in this larger amount and am waiting to pay until they get this straight. I have never been late and need to get this resolved. HELP.

Complaint: Lakeview loan servicing is who services my mortgage and escrow. In the first year of owning my first home they have changed my payments 3 times. Stating escrow balance has been to low or negative. I have my original escrow account disclosure and to my best knowledge it is accurate. They over estimated the amounts and I shouldve had a cushion at the end of the first year. Instead Im negative. Lakeview can not explain how this happened or when I talk to different departments they cant give me the same answer. One department says I was overcharged, the other says I owe. Wait times to speak to someone are routinely over an hour long. Ive called 6 times starting from XXXX. Im am on hold as I write this ( 1 hour & 35 minutes so far ). Ive asked for a new escrow analysis and was told 3 have been done so far. They also admitted to making a mistake on one by not including my hazard insurance, then charge me {$1300.00} for insurance that that has already been paid. Customer service department says the money was refunded to escrow, their collections department says it was not. Ive requested a new analysis so I can do their work for them and figure out where they are making the mistake. I asked on XX/XX/19 and today ( XX/XX/19 ) I was told there are no notes for a new escrow analysis or one in progress.

Complaint: Shortly after closing on my loan which took place approx. XX/XX/2016 my loan was sold and began Servicing with Lakeview who services through XXXX. I contacted the number on my statement back in 2016 to set up what I believed to be a bi-weekly payment structure. As evidenced by my withdrawals in my checking {$400.00} per month has been pulled from my account for quite some time. Today I contacted them and was told XXXX does not do bi-weekly payments they pay the investor which I understand to be Lakeview on a month to month basis. So they have been getting 1/2 of my payment then holding for the remaining and when a full payment is in hand then they make the payment. This is frustrating because this is not necessarily how this was explained back in 2016. I asked to reach Lakeview directly and was given an 800 # to contact them. This went to a different 3rd party company that promoted a equity excellorator program ( aka bi-weekly payment ) plan. They wanted {$290.00} enrollment fee and $ 5.40ish per month for a servicing charge. I asked them if they were either Lake View and or XXXX and a guy named XXXX stated they are neither. Reflecting back I think this also is the same procedure I went through in 2016 and have already paid this set up and servicing charges. I think there is something very strange in the way I keep getting bounced to XXXX, they don't acknowledge that they are in fact the ones pulling money from my account each month yet they are listed on each withdrawal. And now this 3rd company of which is neither XXXX nor Lakeview wants to reset this up with me again and can not find any record of my account anywhere. I can not seem to locate a direct phone contact number to Lakeview to discuss this, and keep getting rerouted back to XXXX. This feels very fishy and I feel the past 2+ year I have paid for a service that I am not getting and there is some sort of scam or fraud going on that I can not pin down and need help. I feel there has been a difference in the money I have paid out vs what has been correctly applied to my loan and would love to see this analyzed fully.

Complaint: I am writing to you in desperation. I am an XXXX Veteran of the United States XXXX and our home/mortgage is under a VA Home Loan/Mortgage. Our mortgage company is Lakeview Loan Servicing , LLC. A little background/timeline : I work for XXXX currently, am the sole bread-winner of a family of XXXX ( my wife can not work due to XXXX XXXX and my XXXX children live with us ). I suffered a XXXX XXXX injury in mid-XXXX of XXXX and had to go out on XXXX with my company until I returned to work around XXXX XXXX of XXXX. During that period, my pay was significantly reduced and we fell behind on utility bills and our mortgage. We sought the assistance of community services and received help. In particular, XXXX XXXX XXXX ( XXXX ) of XXXX XXXX, Texas graciously offered to catch our mortgage up-to-date by paying XXXX, XXXX and XXXX mortgage payments. We started this process with XXXX late XXXX and have been given continual resistance/run-around by our mortgage company. In order for XXXX to pay our 3 months and bring us up to date with our mortgage, they require certain forms be filled out and the mortgage company to register as a Vendor this allows XXXX to cut a check to pay. XXXX has tried paying by credit card our mortgage company refuses to take this kind of payment or ACH as well. And yet, our mortgage company refuses to work individually with XXXX to resolve their requirements and allow payment. This is putting us in a foreclosure state. The attached correspondence is only part of our frustration with our mortgage company there are additional hours and hours of phone calls that have been made to have a person assigned to our situation and resolve XXXXs requirements so that we can avert foreclosure! XXXX is ready and willing to pay, but our mortgage company refuses to work with them! Sadly, I contacted the Veterans Administration and they state to me that they have no power or jurisdiction/say in the matter. I have nowhere else to turn to PLEASE HELP!! I do not want to lose our home and have my family homeless because my mortgage company refuses to work with XXXX and accept a payment to bring us up to date. Additionally, every time we ( myself, my wife or XXXX ) attempts to call our mortgage company, we sit on hold in upwards of an hour-and-a-half, then get some customer service agent who refuses to escalate our request to speak to a manager or higher they always state I will send an e-mail AND NOTHING GETS DONE OR MOVES FORWARD! WE ARE BEING PURPOSELY STONEWALLED! And to top it off, my mortgage company keeps trying to force us into a forbearance or other time assistance plan I tell them over and over again that we do not need that we simply need them to complete whatever is needed by XXXX so that XXXX can cut a check to them and bring us up-to-date. If this happens, then we are back on track with paying our mortgage I am back to work and our financial stability is restored but I CAN NOT afford three months back-mortgage AND following one of my mortgage companys assistance programs will cost me additional fees plus the three months that I still can not afford!! We did a forbearance plan with them several years ago and [ unknown or not stated to me ] they tacked on attorney/processing fees plus the back mortgage payments! Complaint: Today XX/XX/XXXX I received a letter dated XX/XX/XXXX that my mortgage is increasing by {$74.00} per mom after an escrow analysis was done. The letter informed me that the increase is effective on XX/XX/XXXX. I immediately called XXXXhe servicing company XXXX number listed on the letter and was greeted by a young lady by the name of XXXX ID number XXXX who explained that since the letter was dated XX/XX/XXXX that there is nothing she could do to assist me in extending the effective date even though I was only notified 19 days prior. I asked her why nothing could be done, She told me that since I didnt seem to like her answer that I could with call Lakeview the Finance company or speak with her manager. She transferred me to a woman who claimed to be a manager by the name of XXXX ID number XXXX who stated that because the letter was dated XX/XX/XXXX theres nothing she could do to help me. She placed me on hold and came back and said that the letter was available to me online under my account on XX/XX/XXXX. I then asked her to confirm for me when they received my XXXX mortgage payment thats made online every month, she stated on XX/XX/XXXX. I asked her then how am I supposed to know as a first time homebuyer to look for such a letter AFTER Ive already made my XXXX payment, that I access my account when its time to make a payment and at that time there was no letter there. She then offered to transfer me to an escalation line. I asked if I would have to explain all this to yet another person, XXXX assured me that she would warm transfer me so that she could let the person who answered know what was going on. After being on hold a few minutes a person greeted me by the name of XXXX ID XXXX, she had no knowledge of what was going on and stated that no one told her that a call was being transferred to her so I had to explain all over again and to no avail I got nowhere with her. She stated that all she could do was waive a late fee if I needed to pay late. I explained to her how hard Ive worked on my credit, that my payments are always early for that very reason, that what Im asking is for a proper 30 day notice that a XX/XX/XXXX effective date would be fair ... she was no help AT ALL. I am now forced to try to figure out how I will be able to come up with the rest of the funds for this increase. The amount may not seem like much to most but to a single Mother, it means a great deal.

Complaint: Lakeview Loan Services, LLC acquired my loan from the original servicer several years ago. This loan is for an investment property I do not live in. Eighteen, months ago I called Lakeview Loan Services to advise them that I had moved from my old address, XXXX XXXX XXXX, XXXX, Ca. to XXXX XXXX XXXX, XXXX, Ca. XXXX. Upon their request, I had switched to paperless billing, so I do not get statements in the mail. I receive notifications each month that the servicer has received my payments. In the month of XX/XX/2018, Lakeview performed an analysis of my impound account and sent the analysis to my old address, not my email or my new address. The new analysis resulted in a rise of my payment of {$66.00} dollars per month. Because of the shortfall, Lakeview charged me three late payments and reported me to the credit bureau as late 3 months in a row. I have had several mortgages in my life and have never had a late payment ever. During this period Lakeview continued to send me emails verifying my payments were received but never contacting me by email or phone of the problem with my account. Upon applying for a new credit card, I was informed that I had 3 30 day lates on my credit reports, the only lates or unpaid bills I have ever had. I contacted Lakeview immediately and remedied the payments but they refused to reverse the late charges or the negative credit reports. I have appealed this with them but they have not replied. I have also contacted the credit bureaus and filed complaints but to date have had no success. Please help me to remedy this injustice. They failed to up [ date my mailing address, failed to call me. failed to email me of a problem even when they were emailing me every month advising that they received my payments.

Complaint: In XX/XX/XXXX I was notified by my mortgage company that they would disburse in excess of {$10000.00} for property taxes. My tax assessor sent the wrong tax amount initially and did not notify the mortgage company that a reassessment had been done making my tax liability {$3800.00}. I called the mortgage company and was told to e-mail the escrow department the updated tax assessment. I e-mailed escrow on XX/XX/XXXX explaining the mix up, providing the new assessment and requesting they not disburse more than the {$3800.00} owed to the tax assessor. I followed up on XX/XX/XXXX with a second e-mail and a phone call. I was told the {$10000.00} was already disbursed. I called multiple times to the mortgage company and tax assessor in XXXX to clear the situation up. I was told by the mortgage company there was nothing they could do since the money had already been disbursed and that the tax assessor would likely send the overage back. Despite the refund and providing the updated tax assessment, the mortgage company projected my upcoming taxes at over {$10000.00}. Therefore, when they did the escrow analysis at the end of XX/XX/XXXX, the calculated my new escrow payment to be {$1200.00} per month including a {$200.00} payment per month for an escrow shortage that doesn't exist. My total projected escrow disbursements is {$5500.00}, accounting for insurance and taxes. I called as soon as I got the letter. I was told the my inquiry would be sent to the escrow department for review. I called back a week later and asked for the status. I was told escrow looked at it and didn't see any reason to correct the payment. They were still showing my property tax would be over {$10000.00}. A very nice customer service representative realized that what I needed was the " tax line '' adjusted and my initial inquiry was sent to the wrong department. She stated she would get the taxes adjusted. She was true to her word and did that. I honestly thought the issue was resolved at that point. Despite the taxes being adjusted, my monthly escrow payment was not adjusted. I e-mailed the escrow department on XX/XX/XXXX, again, expressing my concern with the amount of my escrow account. I, again, requested an escrow analysis. I received an e-mail acknowledging my request and asking I give 5 business days for a response. I called back to check the status on XX/XX/XXXX. I e-mailed for a status on XX/XX/XXXX. I received an e-mail from the escrow department on XX/XX/XXXX stating my inquiry had been resolved and closed with no other explanation. I called on XX/XX/XXXX to ask about the closed inquiry. I was told that escrow was in the process of completing the analysis and these things " take time and we can't rush the escrow department. '' I have given the escrow department time. In fact, I have given the escrow department 4 months at this point to fix the problem. I asked to speak to the escrow department and was told there they had no way to take a phone call ( I guess there are no phones in the escrow department ). I asked what processes were in place to elevate this issue. I was told there were no elevation processes in place. I asked why the customer service rep couldn't call the escrow department since I couldn't. I was told she also had no way to call the escrow department and only a team lead or a supervisor could do that. I will admit to not being a patient with this rep as I could have been and I am sorry for that, but this is very frustrating. What kind of customer service industry company doesn't have an escalation process or a way to speak to someone who can actually help? I genuinely need this fixed. I am not in a position to pay an additional {$800.00} plus toward my mortgage payment each month? Does Lakeview want me to default? That seems to be the only explanation I can come up with to explain the complete disregard of my requests. At most, my escrow balance should be {$6500.00} per year or {$540.00} per month ( and that is high considering there is still over {$2000.00} currently in my escrow account ). This includes the XXXX cushion allowed by RESPA. To require me to pay {$14000.00} into escrow is a violation of RESPA.
