Complaint: On XXXX XXXX, XXXX I had a water back up into my home. XXXX XXXX XXXX, XXXX a remediation company removed sheet rock, took up floors, and determined cabinets would need to be moved from the home. They had fans in the home until XXXX XXXX. The insurance company wrote a check at this time for {$28000.00}. This was mailed to the mortgagee company on XXXX/XXXX/XXXX. An additional check from {$10000.00} was sent on XXXX/XXXX/XXXX. The only checks I have received to pay for my repairs was {$480.00} on XXXX/XXXX/XXXX and {$12000.00} on XXXX/XXXX/XXXX. I was told on XXXX/XXXX/XXXX they would pay XXXX out to the contractor and I and then XXXX at the halfway point and the remainder once it was finished unless I showed them paid in full invoices. I started sending paid in full invoices via fax and email on XXXX/XXXX/XXXX. The contractors estimate was sent on XXXX/XXXX/XXXX. I called every three days as instructed for status. They did not confirm receiving anything until XXXX/XXXX/XXXX at which point they acknowledged receiving the XXXX versions I sent. The girl promised she would upload my file for review herself. On XXXX/XXXX/XXXX this still had not been done. I spoke to a supervisor who spent over an hour stating what she was requesting be issued from my escrow funds. Long story short nothing has happened other then getting XXXX of my funds payable to me and the contractor. He has been paid in full and the XXXX was for more then what I owed him since I am supplying all the materials. I am unable to get the remaining funds even with a lien wavier signed and notarized by the contractor and paid in full receipts from the contractor and from the supplies. If you are not the correct person to complain to please let me know. I have a lot more information and dates just want to verify this is the correct place to file a complaint before I continue. I will attached a summary up until XXXX/XXXX/XXXX of my receipts and correspondence. I have the remaining information and supporting documents if required. I am truly at a loss on how to handle this.

Complaint: I fell behind on my mortgage by two months and I have been working on getting caught up. I plan to use my income tax return to do so and the money is due any day now. I sent my normal payment to the XXXX which is serviced by Dovenmuehle Mortgage. They rejected my payment and I have yet to speak with anyone that can actually tell me what XXXX is going on. How can they reject a payment? I am willing to make good on my loan but I will never use the XXXX again because of the experience I have had with the servicer. How can this company do this I wondered and then I started doing some research. I get the impression they are targeting veterans like myself by servicing loans for the XXXX and XXXX. I am worried they will XXXX and I do not know how to fight them.

Complaint: I received notice from Florida XXXX XXXX/Dovenmuehle mortgage that my loan was being transferred to them for servicing effective XXXX/XXXX/2016 and that my present service provider ( XXXX ) would no longer accept payments. So I stopped payment to XXXX ( cost {$25.00} ) and sent a new mortgage payment to XXXX/Dovenmuehle. When I called a week later to follow up on it, XXXX/Dovenmuehle HAS NO RECORD OF MY NEW ACCOUNT NUMBER!! Even though they printed it on the very letter they sent me. Then, customer service tells me that it will probably take them another week to establish my account! Are you serious? They assigned an account number in the late notice they sent to me but do n't have it set up?? WTH?

Complaint: I received a letter telling me my mortgage was going up to XXXX per month from XXXX. The reason I 'm being given is that my escrow was short. According to the servicer 's records, in XX/XX/XXXX, my starting balance in my escrow account was XXXX. I refinanced my home XX/XX/XXXX with XXXX XXXX, whom allows their mortgages to be serviced by Dovenmuehl. At that time, my interest dropped by .75 %, as well, my MIP went. From XXXX per month to XXXX. My previous mortgage had just gone up to around XXXX due to an increase in hazard insurance premiums from XXXX to XXXX, which was our reason for the streamline refinance outside of the obvious savings we would get with the lower interest and lower MIP. Further, once our refinance went through, we switched our hazard insurance to XXXX to get a lower premium of XXXX. This took place on XXXX/XXXX/XXXX. Our current policy expires in XXXX of XXXX. During our refinance, our HUD indicated that our taxes were XXXX. It apparently went up a bit. My issue is that the escrow department has miscalculated or someone has paid something from my escrow that should not have been paid and now, they want me to pay either XXXX to have my payment only go up approximately XXXX per month ( XXXX ) or to pay the higher monthly amount of XXXX. I 'm no XXXX .... And there is no way you can tell me that my MIP of XXXX ; county tax of XXXX ; and hazard insurance of XXXX totals XXXX, which is what my escrow balance would be before paying out MIP, tax, and hazard insurance .... What it appear occurred is that they are showing that my hazard insurance is due, which was already paid in full for the year, plus the difference in taxes paid compared to the amount showing on the HUD. Either way, in XX/XX/XXXX, my balance was XXXX. Deduct the XXXX for insurance in XXXX and my account would have been XXXX. Then, Add to that XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX escrow payments of XXXX ( XXXX x XXXX = XXXX ) and the total escrow would be XXXX. Reduce that amount by XXXX ( 3 months of MIP OF XXXX ) and the total is XXXX. Now take that amount and deduct the XXXX in taxes paid in XX/XX/XXXX and the amount is XXXX. Then, XX/XX/XXXX 's payment would bring the escrow balance to XXXX after deducting MIP. XX/XX/XXXX 's payment would bring it back to XXXX AFTER DEDUCTING MIP. We are now in XXXX. So, if you add the XXXX XXXX XXXX less MIP ) we are back up to XXXX. Since our hazard insurance is not up for renewal until XX/XX/XXXX, we would have 6 months paying XXXX after our MIP is deducted. This would get our escrow balance to XXXX. This more than covers our XXXX premium and leaves a balance of XXXX. Adding 3 months at XXXX per month again brings our balance back to XXXX. Since taxes are due before XX/XX/XXXX payment will be processed, we 'd still be negative, and I agree that we should not go too far negative. However Using the same math and having XXXX by XX/XX/XXXX if you added XXXX to our escrow payment every month, after insurance is deducted and once XX/XX/XXXX 's payment is received and after taxes were paid, you would have an excess balance of XXXX .... Our payment would be manageable and would be XXXX ( XXXX P & I + XXXX escrow ) ... .. In other words, there is absolutely no reason that some XXXX came up with a XXXX higher payment ....

Complaint: Miss appropriated payments : My wife and I have a mortgage on our house in Oregon that we purchased with a XXXX. It is being processed by Dovenmuehle. XXXX describes Dovenmuehle as a trusted third party. After about 2 1/2 years on the 15 year mortgage, and numerous disappointing experiences with Dovenmuehle customer service, my wife and I decided to pay off the mortgage early so we do n't have to deal with this dishonest and discourteous company any further. We have been sending in additional payments marked " Principal Only '' on a regular basis, every two weeks, and also larger amounts occasionally, when we can. Numerous times the " Principal Only '' payment is not posted to principal even though we have done what both institutions ask. The payments go to " XXXX - PRINCIPAL ONLY '' Our regular monthly payments have never been late. Our last payment of { {$1900.00} } was once again applied wrong. It was applied as an additional monthly payment instead of a payment to principal. This despite the facts that XXXX takes this money directly out of my account and sends it to the Dovenmuehle address for payments to principal. There is actually no physical check, the payments between XXXX and Dovenmuehle are electronic using the XXXX Bill Pay. I would like compensation for additional interest charged because of this intentional and repeated misappropriation of funds. I would also like compensation for the 17 hours and 20 minutes spent on the phone in the past 6 months trying to get Dovenmuehle to credit payments correctly. I am not the only customer with this complaint. Please refer to Complaint ID XXXX and XXXX. This is not an isolated incident. This is intentional misconduct and I request you fine XXXX and Dovenmuehle for willful disregard of banking regulations. I also request that The Consumer Financial Protection Bureau audit all loans serviced by Dovenmuehle for similar misconduct.

Complaint: My wife XXXX and I sold our house in XXXX ( NH ) on XXXX XXXX of this past year. The closing date was XXXX XXXX, 2015. At that time, {$1500.00} of the sale price was not returned to us due to a title issue, the funds being held in escrow by XXXX XXXX. The title company requested a corrective discharge from XXXX XXXX XXXX because they discharged the loan without having ownership of the it ( i.e., the loan ). They, in turn, have requested an assignment of mortgage from XXXX ( account # XXXX XXXX to XXXX XXXX XXXX in order to " make the discharge valid ''. Despite the many attempts by XXXX XXXX, Closing Coordinator at XXXX XXXX, all requests for action have gone unheeded. She was told in XX/XX/XXXX that there would be a resolution in 2-3 weeks, but nothing has happened. In the meantime, {$1500.00} of our money has been tied up for nearly eight months through no fault of our own. Complaint: Our servicer will not send us a monthly statement of our mortgage statement or allow us to log on online in order to see what our status us ( bal, pymt amount, whether we are current, past due, etc ). We were in a bankruptcy, but that ended in XXXX of XXXX. Dovenmuehl stated that because of the bankruptcy we were not allowed to see any current information. Since our bankruptcy discharged over 9 months ago, the servicer still ( as of today, XXXX/XXXX/XXXX ), will not let us obtain information on our mortgage.

Complaint: Continued attempts to illegally foreclose and violate CFPB Mortgage Servicer rules. I received the attached response from Dovenmuelhle in regards to my mortgage loan. They state that I was I was sent a notice of breach on XXXX XXXX, 2015, but just five days before that on XXXX XXXX, 2015 I had sent in a payment of {$820.00} via XXXX. The following month ( XX/XX/2105 ) I sent a payment of {$640.00} via XXXX and the following month ( XXXX XXXX, 2015 ) I sent a payment of {$550.00} via XXXX. ALL payments Dovenmuehle has neglected to credit to my account as well as other payments I have paid after this. In this attached letter from Dovenmuehle, they state they sent me XXXX refund checks ( {$800.00}, {$700.00} and {$710.00} ) ... I only received XXXX for {$710.00}. Conveniently the ONLY check they mention a check number for is the only check that I did receive. I have been making payments for the past year that Dovenmuehle has not credited to my account, which is a violation of CFPB rules. I have attached proof of payment from XXXX that I made payments at the time they are claiming I had a " notice of breach. ''

Complaint: During a recorded phone call on XXXX/XXXX/XXXX, a supervisor by the name of XXXX ( XXXX? ) in Dovenmuehle 's Loss Draft Department repeatedly stated that they follow " XXXX loss draft guidelines. '' In a subsequent call on the same day a representative named XXXX confirmed that XXXX 's statement is the same guidance that " they '' get. Presumably " they '' are the representatives in the loss draft department. However this can not be true. Per XXXX XXXX 's own website : " Consumers are sometimes mistakenly advised that because their government-insured or government-guaranteed loans XXXX serve as collateral for XXXX-guaranteed securities, XXXX XXXX determines servicing decisions regarding their loans. However, XXXX XXXX does not set standards for mortgages that are to be federally insured or guaranteed. Each agency that is providing the mortgage insurance or loan guarantee sets the standards for the mortgage originated and the approved lenders that participate in the XXXX XXXX program are responsible for ensuring those standards are met for consumers ' loans. These lenders have complete responsibility for servicing decisions. XXXX XXXX does not make any servicing decisions. XXXX Another supervisor by the name of XXXX the XXXX day confirmed that they in fact choose to follow XXXX guidelines XXXX not XXXX XXXX XXXX This was not the first time that I have spoken to someone in Dovenmuehle 's Loss Draft Department confused about what kind of loan I may or may not have and if they are following XXXX XXXX or XXXX rules. This is documented in a fax I sent to the Loss Draft Department on XXXX/XXXX/XXXX. Dovenmuehle 's business is mortgage servicing and therefore they should be able to provide more accurate information regarding mortgage servicing to consumers. This is an egregious misstatement of their own policy, but more importantly that of a wholly owned U.S. Government corporation. It is disingenuous and irresponsible for Dovenmuehle to pass off the responsibility of their own policies on another entity. It is also concerning that phone representatives and supervisors in a company dedicated to mortgage servicing are so mistaken about their own business, industry, and regulatory environment.

Complaint: In XXXX of 2014, the Consumer Finance Protection Bureau implemented rules for mortgage servicers that state that : " Periodic payments must be promptly credited as of the day of receipt. A periodic payment consists of the amount necessary to cover principal, interest, and escrow. '' My monthly mortgage payment according to my contract is {$610.00}. On XXXX XXXX, through XXXX I sent a payment of {$800.00} that was accepted by Dovenmuehle but never posted to my account. On XXXX XXXX, through XXXX I sent a payment of {$700.00} that was accepted by Dovenmuehle but never posted to my account. On XXXX XXXX, through XXXX I sent a payment of {$710.00} that was accepted by Dovenmuehle but never posted to my account. So for three months I made payments that were more than my required periodic payment amount but Dovenmuehle intentionally did not post them to my account in accordance with CFPB policy. Also, in the XXXX 2014 rules posted by the CFPB, it states : " You can not make the first notice or filing for any judicial or non-judicial foreclosure process until the consumer is more than 120 days delinquent. '' If Dovenmuehle had properly complied with the CFPB rules and credited my account, they would find that I am not, nor have I ever been 120 days delinquent. As a matter of fact, at the time I made my XXXX XXXX payment of {$710.00} that placed me roughly {$200.00} behind in payments plus some late fees. Not even a full periodic payment as stated in my contract. I have continued to reach out to XXXX and their representatives, advising them of their violations of CFPB rules but they insist on moving forward with foreclosure without properly posting my payments to my account and despite me not being 120 days delinquent.

Complaint: I purchased my home on XXXX XXXX, 2015. My first payment was scheduled for XXXX/XXXX/15 to be made to Primary XXXX Mortgage in the amount of {$890.00}. The first payment was deducted from my bank account on XXXX/XXXX/15 in the amount of {$900.00}. The second payment was made to the same servicer via a cashier 's check on XXXX/XXXX/15 in the amount of {$890.00}. I was notified in XXXX that my account was going to be service transferred to XXXX XXXX XXXX XXXX XXXX mortgage ) and the payment for XXXX/XXXX/15 was to be made to them. The account was transferred to XXXX XXXX XXXX XXXX XXXX XXXX as current, due for XXXX/XXXX/15. The XXXX payment was processed on XXXX/XXXX/15. The XXXX payment was also sent to XXXX and processed on XXXX/XXXX/15. I received a letter from XXXX XXXX XXXX at the end of XXXX advising that my XXXX payment had not been received. I called and spoke to an agent who advised that I must sent in proof of payment. The proof of payment was faxed on XXXX/XXXX/15. On XXXX/XXXX/15, I received a call from the servicer advising that they completed research and determined that all payments were posted accurately and the account was still delinquent. I spoke to a supervisor who advised that at the time of service transfer, the account was 30 days delinquent and due for XXXX/XXXX/15. I sent in an additional proof of payment for all XXXX payments, including a screenshot of my transaction history on XXXX/XXXX/15. I have called every other day since then and have yet to receive a response. My last conversation was on Monday, XXXX/XXXX/15, in which the agent advised that they are trying to get a hold of CHFA to see what happened. As they answered the phone as XXXX loan servicing, I was under the impression that they were doing the research. It has been almost 30 days and I have yet to receive a response. Additionally, on top of the dispute, I am currently accruing late charges and negative reporting to my credit. I would like to have this issue resolved as soon as possible as it has been over 35 days since the first dispute was sent in.
