Complaint: Called Dovenmuehle Mortgage on XXXX/XXXX/16 and requested to have our escrow account closed out since we were planning to pay the loan off shortly, and have the balance of XXXX sent to us, and was told that they had put a request in, and that it would take 15 days to process our request, and that they would then mail us a check for the remaining balance. What they failed to tell us, which we found out a few days later when we called in, is that they first had to send us a form to be filled out before they would even consider closing out our escrow account, and that it could take up to 7 days to receive the form. Although every time we called to check to see if the form had been sent out yet, and talked to countless supervisors, they claimed every time we called that the form had been sent out the day of our request on XXXX/XXXX/16. When we finally received the form over two weeks later though, it was postmarked for XXXX/XXXX/16, so had not been sent out on XXXX/XXXX/16 as they had claimed. Although we faxed the form to them to help speed up the process they still took several days to process the form, but finally approved our request on XXXX/XXXX/16, which is the date they are now claiming that the escrow check was mailed out to us. Although it is now XXXX/XXXX/16 we have still not received the escrow check, and doubt that it has even been mailed out yet, as this seems to just be another one of their delay tactics to hold onto our money as long as possible. And the only thing they will tell us when we call in is that if we 've not received our escrow check in 30 days that they will send another check, which is unacceptable. This is our money, not theirs, as it is from our escrow account. So we should not have to wait 2 to 3 months for them to send it.

Complaint: On Wednesday, XXXX XXXX we informed Dovenmuele Mortgage that we wished to pay off our mortgage, and was told by the representative we were talking to that we had to have a closing statement ordered before we could pay our loan off, which she told us she would order to be completed by Friday XXXX XXXX. When we called on XXXX XXXX though no closing statement had been prepared, and they could find no record of one having been ordered leaving us to attempt to our mortgage off online. But it would only allow us pay {$6600.00} toward the principal, and another {$760.00}, which we put in the other category, since it would not allow us to apply anymore toward the principal. As we had still not received a closing statement on Tuesday, XXXX XXXX, we called Dovenmuehle again at XXXX, and talked to a supervisor, who told us she would request that an expedited closing document to be prepared and faxed to us, that was supposed to only take from 2 to 4 hours, and that she would request that the additional {$760.00} that we paid on XXXX XXXX, which should have been applied toward the principal, but was n't, be applied toward our principal balance. On Wednesday afternoon, XXXX XXXX, a day after we were supposed to have received a closing statement, we finally received a closing statement from Dovenmuehle, although the payoff amount was incorrect, as they had still not applied the extra {$760.00} we paid toward our principal, as they were still holding it in a suspense account, and charging us interest on that amount. While talking to a supervisor later in the day on Wednesday XXXX XXXX she suggested that we wait until they apply the extra {$760.00} toward our principal, which she told us could take up to 5 days, and then request another closing statement to keep from confusing their accounting dept. Although we have called and talked to a supervisor every single day since XXXX XXXX, and even filed a complaint with the XXXX, they have still not applied the extra {$760.00} we paid on our loan toward our principal, and have still not provided us with an accurate closing statement. We simply wish for them to credit the {$760.00} we paid them toward our principal, provide us with an accurate closing statement so that we can pay our loan off, and take off any interest that they have charged us on the {$760.00} they have been holding in their suspense account.

Complaint: My wife and I purchased a home with assistance from the Maryland Department of Housing a few months before the real estate market crash. After house prices crashed as well as interested rates, and since our family grew my wife and I moved our family to a more appropriately sized house, in better neighborhood with better schools and with significantly better terms. We rented, maintained the home in a respectable manner and made all of the related mortgage payments. Four years later we were informed by the Maryland XXXX XXXX XXXX that we were required to sell the property because it was no longer our primary residence, at what was currently a significant loss. We could also move back in, though considering our situation was unreasonable. We are unable to pay into the loss on the property due to our financial situation. We requested a Deed In Lieu with the hopes of signing the house to the lender without a deficiency judgement, which we considered reasonable considering the situation. The mortgage insurance company requested an unreasonable sum of money in order to proceed with the Deed In Lieu, which we are unable to afford. We requested better terms, however, the mortgage company and Maryland Department of Housing has proceeded to foreclose on the property and has stopped working with us on better terms. We feel that they have negotiated in bad faith with us in settling this situation without a foreclosure.

Complaint: CFPB Complaint Against Dovenmuehle Mortgage I was caught in an unfortunate situation and in order to save my home, I found myself having to declare bankruptcy. This was due to a significant reduction in income. I filed for bankruptcy on XXXX XXXX, XXXX and received a discharge on XXXX XXXX, XXXX. Although I have continued to make payments on time, I have not received any statements from my mortgage company ( Dovenmuehle ) since I filed. So, I do not know how my payments are being applied, what goes to principal, what to interest, what to escrow for taxes and insurance. I did receive a letter from them in XXXX stating the my mortgage was going up to cover an escrow shortfall. Dovenmuehle has even stopped reporting my payments to the credit bureaus. I have called Dovenmuehle several times requesting that my statements and credit bureau reporting be resumed and online access be restored, but have been rudely denied these services each time. They claim that since I did not reaffirm the mortgage in the bankruptcy I have no legal right to have access to this information, yet they continue to expect on-time payments. I contacted my attorney on XXXX XXXX, XXXX regarding the situation and her response was : " They did not send me a reaffirmation agreement. The Bankruptcy Code does not require debtors to reaffirm debts in connection with real property ; therefore, lenders with liens on real property typically do not send reaffirmation agreements. They are not being truthful when they say that they can not send you a statement. They choose not to send you a statement. '' These are Texas laws maybe not Illinois laws. But I am governed by the laws of the state in which I reside. They want me to reopen my case so I can reaffirm the mortgage. Not necessary in my or my attorney 's opinion.
I have never been treated so rudely by any company as I have with Dovenmuehle. I am not the second-class citizen they would try to have me believe.

Complaint: I have received multiple letters from Dovenmuehle Mortgage demanding additional monthly payments of {$470.00} above my regular mortgage payment. The latest letter dated XXXX XXXX 2016 is hostile in tone with " COLLECT A DEBT '' and " BANKRUPTCY " repeated in the first paragraph.
The extra payment apparently is related to a mistaken belief that we have no flood insurance, despite the fact that we have provided a copy of our flood insurance declaration showing effective coverage paid through XX/XX/2016 and called Dovenmuehle on XX/XX/2016 and XX/XX/2016 ( spoke to XXXX ).
Dovemueller has acknowledged by letter and during telephone calls that we have flood insurance in effect but they continue to demand extra escrow payment. Can you assist in stopping this harassment?

Complaint: I had a flood in my home earlier this year due to refrigerator line leaking. I sent my insurance checks to Dovenmeuhle Mortgage company 3 MONTHS ago. For the past month, they have had all requested ( and needless ) paperwork completed and a promise to have their inspector set up an appointment so the repairs can be verified. One month and many conversations, and emails later, and I have yet to hear from an inspector. In the meantime, I 'm out $ XXXX, AND I 'm paying interest on my credit cards because of all the work performed.

Complaint: I filed an insurance claim and received a check for the repairs for over {$25000.00}. the check was issued to myself and my wife and my mortgage company Dovenmeuhle and my adjuster. My wife and I endorsed the {$25000.00} check and sent to Dovenmuehle. they returned the check and said all parties had to endorse. So I had my adjuster endorse and we sent to them. Dovenmuehle received the check and placed in an escrow and has not released any money at all. They sent us a letter we needed to file a certain documents including a proposal for repairs. We filed one and they did not accept cause the total amount of repairs was less than the amount of the loss. So we filed a second on for {$38000.00} and have waited for them to release part of the funds and they have not issued any money. Dovenmuehle have sent like XXXX letters telling me about the insurance loss and they I need to bring this matter to a close. How can I close this issue if Dovenmuehle is holding the money!! They send me from the loss draft department to the loss mitgagtion department and neither department has resolved our issue. I know our account is past due but we are unable to make the full payment. we had a business and has to close it down due to government intervention. so we lost all the revenue we had.
My wife and I had filed loss mitigation request to adjust our payment. Well the loss mitigation forms were filed last year. we sent them tax returns, bank statements and all items required. They tell me that the committee has to resolve the issue but they cant tell me when the committee meets and when the date the item will be resolved.
We have XXXX isssues - the loss on my home and the loss mitigation request. They have comingled both issue and have not issued any money to me. I have waited 5 months and nothing has been done. I have offered for them to take part of the proceeds and pay the past due amount but they refuse to do that. So basically they are telling me I cant get my money until the loan is paid off. My attorney sent Dovenmuehle a letter that we wanted to file a law suit to have the money sent to a court and the court resolve the distribution of money. However I do n't have money to file the law suit. Dovenmuelhe has not responded to any of my requests. They have not sent me any money at all. They are holding my money in escrow and cant pay the past due amount. That money is mine and I can do what I want with it.

Complaint: Mortgage PAID IN FULL on XXXX XXXX, 2016. Husband has called for return of original DEED OF TRUST, return of original PROMISSORY NOTE marked " paid-in-full '', and a RELEASE OF LIEN so we can file the appropriate documents with the county to show that there is no lien on our property. Basically, the mortgage company is lying to us already!! Customer Service says all this was sent by Certified Mail on XXXX XXXX, 2016. Postmaster says Certified mail is received in less than 5 business days. Mortgage company can not give us a tracking number for the Postmaster to trace this Certified mail. This is the LIE!!! I do n't want this situation to drag out over a long period of time and become an unsolvable " ISSUE '', requiring legal assistance ; even though my nephew is a lawyer. I can provide names and dates of phone calls to the mortgage company. I can provide copies if documents sent to the mortgage company, i.e., copy of the wire transfer where the credit union sent the payoff money to the mortgage company & the check where the mortgage company returned the escrow money to us because of the loan being paid off. I suspect the mortgage company has absolutely no idea where the Deed of Trust or the Promissory Note are physically located!! Probably, these documents have been LOST for years!! I expect the mortgage company to continue LYING by telling us that " we did this '' or " we sent that '' kind of XXXX. This is why I am asking for help from you. I am XXXX XXXX years old and want this situation completely settled and the proper paperwork filed at the county before I die! I have read the " complaints '' website on this mortgage company. It seems that this mortgage company will go as far as possible, evenly illegally, to hurt us. There is one complaint similar to ours where the homeowner has yet to receive documents after SEVEN years! There are many complaints alluding to payments being made on time, only to receive foreclosure notices. I expect to receive late-payment notices starting this month ( XXXX, 2016 ). There are complaints where this mortgage company receives insurance checks for repairs, ( i.e., windstorms or floods, etc. ) but does not release funds to pay contractors, leaving the homeowner responsible for all repair bills while trying to get the insurance payments " released ''. I feel as though I better start protecting myself from this under-handed mortgage company! This is why I am asking for your assistance right away.

Complaint: I purchased my home in XXXX XXXX. The house appraised above the purchase price. I put 10 % down and have been consistently making additional payments ( two full payments each year ). The principal is now at less than 80 % of the original purchase price. On XXXX XXXX, XXXX I filled out the paperwork to remove PMI and sent my lender the requested amount ( {$310.00} ) associated with the " required '' appraisal. The check was cashed shortly thereafter. I received a VM on XXXX/XXXX/XXXX stating that I should call back " in reference to [ my ] appraisal ''. I called the number provided back on that day and again the following week. Each time I was told that " systems were down and the representative could not help me ''. On XXXX I received a follow-up call. At that time I was told that the appraisal was going to cost {$180.00} more than originally stated. This brings the total to {$500.00}, which is more than any amount shown on the mortgage lender 's schedule of amounts owed for the appraisal. I arranged for payment and was then told that it would be another seven days before anyone could contact me to schedule the appraisal. It appears that this company is deliberately delaying the necessary steps to remove PMI in order to continue to charge the PMI ( {$180.00} per month on a loan of {$350000.00} at 3.65 apr ).

Complaint: This complaint relates to the final administration of a {$200000.00}, 15 year fixed interest rate conventional mortgage, # XXXX, most recently held by XXXX, hereafter referred to as XXXX. The mortgage originated with XXXX XXXX XXXX XXXX, Nebraska. The monthly payment of {$1500.00} was due beginning XXXX/XXXX/XXXX. In XXXX, the Office of Thrift Supervision closed XXXX XXXX. XXXX XXXX XXXX assumed the mortgage ; soon afterward the mortgage was transferred to XXXX against whom this complaint is lodged.
During the life of the loan, all payments were made on time, and additional payments were made toward the principle as permitted under the terms of the mortgage. However, when XXXX assumed the mortgage we stopped additional principle payments, having no personal connection to XXXX to track these additional payments. Our records agreed with the outstanding principle when XXXX assumed the mortgage. In XX/XX/XXXX we made what we believed was the final payment of {$1800.00} based on the amount shown on XXXX 's XXXX statement. However, in XX/XX/XXXX we received an additional statement showing we still owed {$7.00} plus {$0.00} interest - which we paid. It cleared our bank on XXXX/XXXX/XXXX, 4 days ahead of XXXX 's due date. Then, our loan balance should have been {$0.00} as indicated by XXXX 's own statement.
And then the problems began ...
After not hearing from XXXX concerning the release of the mortgage and deed, we contacted XXXX. After establishing the fact that this final payment had cleared our bank, XXXX told us that we still owned {$26.00} for filing fees plus a {$79.00} late fee on this filing fee. After discussion with an XXXX representative, we agreed to pay the {$26.00} filing fee ; the late charge on filing fees was waived. We agreed to pay the filing fees even though the original loan documents, which we hold, do not disclose any filing fees. When asked why we were not informed of these filing fees, we were told that " most people '' contact XXXX when they close their loan and they are disclosed at that time. We assume that a financial institution would recognize that a loan is closed when the loan balance goes to zero and then contact the client should any further issues require attention. Rather, XXXX demanded a filing fee that was never disclosed nor billed, plus a late fee for not paying a fee that was never disclosed. In any event, with the late fee waived, we mailed our check for the {$26.00} filing fee on XXXX/XXXX/XXXX.
Yet, on XXXX/XXXX/XXXX we received another statement showing the {$7.00} still outstanding in addition to another {$79.00} late charge. On the same date, under separate cover, we received another letter from XXXX abating the {$79.00} late charge with the strong warning that this was the only time it would be abated. Again, the {$7.00} cleared our bank on XXXX/XXXX/XXXX, 4 days ahead of XXXX 's due date. So, we called XXXX yet again to establish that the loan was closed.
And yet things got even worse ...
During the call, on XXXX/XXXX/XXXX, we were told not only do they not have a record of the {$7.00} being paid but that we owe another full month 's payment of {$1500.00}. Clearly a fraud was being perpetrated or their loan administration was grossly lacking.
We are well educated and financially savvy. Both of us are college educated with XXXX hours. We have successfully owned our own business for over 35 years. XXXX our children are XXXX educated. Given our educational background, I pity the less sophisticated, less educated, or more elderly having to deal with XXXX. The odds of this happening on just our mortgage are infinitesimal. Clearly, some sort of regulatory investigation and oversite is demanded.

Complaint: On XXXX/XXXX/16 XXXX payments ( Mortgage {$640.00} & Escrow Shortage {$190.00} ) was made at my local branch. I was told that the computer would not accept the XXXX payments because it has my mortgage payment at {$650.00} therefore the mortgage payment of {$640.00} was transferred into my savings account & the mortgage payment for the month of XXXX was paid by taken the difference that was needed ( {$16.00} XXXX & applying it to the mortgage ; I was also told that the payment for the escrow shortage in the amount of {$190.00} will be credited to my account.
On XXXX/XXXX/16 I notified customer services via telephone that the payment for my escrow shortage in the amount of {$190.00} was placed in a suspense account instead of applying it to the mortgage. Customer service informed me that the escrow payment in the amount of {$190.00} would be applied to my account within 24 hours. On XXXX/XXXX/16 I observed through online banking only {$180.00} was actually applied to the escrow shortage leaving {$18.00} still in the suspense account & I also noticed that my mortgage is still set at the old amount of {$650.00} ( pre escrow shortage amount ) instead of the new amount of {$640.00} after paying the escrow shortage off.
