Complaint: I was accepted to the XXXX XXXX XXXX XXXX program in 2003. I do not pay my property taxes until I pass away or sell my home as this helps me stay in my home while I'm XXXX. My mortgage company keeps paying my property taxes, then asking for a refund, and reapplying it to my escrow account. While this is happening my mortgage payment changes to {$1000.00} from the correct amount of {$690.00}. I have tried to stop the billing by XXXX XXXX XXXX program and was told that was not possible. I have made at least one call per month and often many more trying to get Ditech to reverse the payment, correct my escrow, and apply my house payments correctly. I have to Fax each item to them or Ditech just says they didn't receive the letters. They have destroyed my credit history. They reported that I was two house payments behind, when I had paid the correct amount on or before the 1st each month. They reversed the credit information, but several accounts had been closed due to the misreporting. XXXX XXXX XXXX XXXX program supervisor said as soon as they receive the request they will have the check back out in 1 week. Ditech Tax Department told me that when they receive the refund they have 60 to 90 days to correct the escrow. They have already taken my XXXX payment {$690.00} and applied it to the XXXX payment {$690.00} to cover the incorrect amount of {$1000.00} that I was billed for XXXX. So now it appears that I haven't paid my XXXX payment at all. I don't know what else I can do. I have to have escrow to cover my FHA insurance. As long as I have an escrow account they will continue to pay my suspended property taxes. I have been trying for 3 years to get this resolved. Please help me.

Complaint: In XX/XX/XXXX I attempted to make my mortgage payment online using the same savings account I had used every month and it was declined due to " invalid account. '' I verified the account number and it was correct. I contacted Ditech and they told me the only way I could use the account is by having the bank contact Paymentus, their online payment system and verifying the account. I was able to have a representative from my bank fax over a statement that the account number was valid and the Ditech Representative took the payment over the phone and waived the fees for making a payment over the phone.
XX/XX/XXXX I attempted to make my mortgage payment online and learned about a week later it was returned for the same issue. I contacted Ditech and they set up reoccurring payments using the savings account over the phone for the next 3 months ( XX/XX/XXXX-XX/XX/XXXX payments ) and waived the fees for paying over the phone XX/XX/XXXX and XX/XX/XXXX I made payments online using the same savings account with no issues.
XX/XX/XXXX- I made a payment using the same savings account on XX/XX/XXXX and only learned when i checked my balance on XX/XX/XXXX that my payment was returned for invalid account. They did not send me any notifications that this payment had been returned. I contacted Ditech and they told me they were not going to be waiving any more fees and I would need to take this issue up with Paymentus because it was a problem on their end or on my bank 's part. They refused to verify the account or routing number that I used and stated that I would either need to figure it out with Paymentus or pay them from another account. I have no other way to pay this bill and they are refusing to take my payment.

Complaint: In the process of trying to refinance my mortgage in XX/XX/XXXX, I was reviewing the details of my current mortgage with DiTech which is a HAMP. On the 3rd page of my trial period paperwork ( I will attach ) it states that I will receive {$1000.00} each year for 5 years for a total of {$5000.00} that will be applied to my principal balance each year after the anniversary date of the first trial period payment due date ( 1st trial payment was XX/XX/XXXX ). That 5 years would be XX/XX/XXXX-XX/XX/XXXX.This was never applied to my loan. I have contacted DiTech multiple times and have received many different answers from my HAMP originated with XX/XX/XXXX XXXX XXXX so it could be different to they needed a form back that was returned too late. None of which is stated in my paperwork of a form needed or my HAMP changing if the servicer changed. The 1st call into DiTech was on XX/XX/XXXX and the rep was very helpful in answering my questions and he sent an email to the appropriate department he said. A follow up call on XX/XX/XXXX with different answers saying I was no longer eligible for the incentive and was told to email them to request an exception. I emailed them the same request on XX/XX/XXXX and received an automatic reply. I called DiTech on XX/XX/XXXX and was told customer service had an extremely high call volume and I got to talk to someone but it ws someone who was helping out customer service and could not really answer my question. She did not see the email in my file that I had sent on the XXXX even though I had received a reply that DiTech had received it. She requested that I print my email out and fax it to them. I called back again on XX/XX/XXXX and talked to another rep who thought they saw a {$1000.00} payment but then transferred me to another rep who seemed very helpful and filed a request to research my incentive and lack of payment for it, but have still not received resolution.

Complaint: My then-wife ( now ex-wife ) XXXX and I had a first and second mortgage on a house we owned in XXXX XXXX, Colorado, several years ago. We purchased it in XXXX for approximately {$420000.00}. XXXX subsequently and irretrievably lost her job as a XXXX XXXX due to XXXX XXXX XXXX XXXX XXXX and we were unable to afford both mortgages. We applied for mortgage relief, including a negotiation for a short-sale on the second mortgage. The first mortgage company was going to be fully repaid regardless of the outcome, as the first mortgage balance ( {$310000.00} ) was well below the market value of the property at the time of resale ( {$370000.00} ). The second mortgage holder was unwilling to budge, despite the fact we received two real estate contracts to sell the property for significantly above the balance of the first mortgage ( contract amounts of {$370000.00} ), yet below the then-existing market value, which was at the depths of the mortgage valuation crisis in the U.S. We negotiated in good faith for over a year, which included paying the full monthly second-mortgage payment during the entire negotiation period, which they vaguely promised would result in a positive outcome. Yet, we had zero success in reaching an agreement with our second mortgage holder. The first mortgage holder, having no incentive to delay foreclosure, foreclosed, which under Colorado law, caused all junior liens to drop off as a matter of law, as though they had never existed. We then filed for chapter XXXX bankruptcy to discharge the then-existing unsecured debt, which was discharged in XXXX, including the prior second mortgage.
The second mortgage company, whose lien was removed as a matter of law at the public trustee 's sale in XXXX, and whose loan obligation was discharged at bankruptcy in XXXX, has now refused to deleted the {$170000.00} lien amount from my personal credit report. This has resulted in my inability to qualify for an otherwise attainable FHA loan.
I am requesting relief of the inaccurate credit report which shows a {$170000.00} balance to Ditech. The loan balance was discharged through bankruptcy, and the lien was removed as a matter of law. And we have no longer owned the subject property since the public trustee 's sale in XXXX.

Complaint: I sold my home in XXXX of 2018. I've been waiting for escrow reimbursement circa {$1800.00}. I've called several times and have not been paid the overage. Ditech advised that they would send me a check and I still haven't received it.
I've tried to escalate and was told they sent the check to the property address even after I supplied my forwarding address. I have been unable to reach anyone to resolve the issue. Ditech has been unfair and deceptive to say the least. The house was paid off in good faith and I want the money that I have paid into escrow that is owed to me.

Complaint: I paid off my mortgage with an insurance check due to a house fire, Ditech received my check as of XX/XX/XXXX. They have paid off my mortgage but I made my last payment on XXXX XXXX the regular payment due. On the payoff details they charged me {$11.00} late fee, nothing was late, and they charged me an additional {$250.00} interest charge though I just made a payment on XXXX XXXX and paid {$260.00} interest. it was like they took my payoff and paid it like it was the XXXX payment that I have already made. I am disputing the {$11.00} late fee and also the {$250.00} interest fee. They also told me my refund could take up to 30 days after payoff even though they have received their money and I am paid in full.

Complaint: My mortgage company has failed to make appropriate payments to my insurance company even though payments are made on time and homeowners insurance information has been provided. I provided payment information as requested. The homeowners insurance company resubmitted a bill. I called and uploaded a bill telling them the homeowners insurance company would cancel if they didnt receive payment by XX/XX/XXXX. They told me to expedite upload documents to their website and it would be handled right away. Payment was never sent and now my insurance is cancelled.

Complaint: Our mortgage is serviced by Ditech ( ditech.com ).
We carry a flood insurance policy on our home voluntarily. We are not required to carry flood insurance as part of our loan agreement.
When FEMA issued us a new flood insurance statement this year, they also sent a copy to Ditech. We are listed as the payer if we choose to pay for flood insurance. Ditech took it upon themselves to add the optional flood insurance policy to our escrow account, making it no longer optional.
I spoke to the flood insurance program on XX/XX/XXXX to ask if Ditech had the right to add the policy to my escrow and pay it automatically without my consent. I was told that Ditech is not listed as a payer on the policy and they only received a copy of the statement.
I spoke to Ditech on XX/XX/XXXX to request them remove the flood insurance policy and under no circumstances pay it, that we are the payer of the policy and we would pay for it directly if we decided to renew. I was told by Ditech that I had to fax them a letter stating I wanted it removed, because it was the law that if they received a statement for insurance they had to pay it.
I faxed them the requested letter on XX/XX/XXXX to the two fax numbers provided by Ditech. I followed up with Ditech on XX/XX/XXXXand was told they did receive the letter but it takes up to 10 days to process the request.
The next day the wired a payment for the flood insurance in the amount of {$2200.00} making my escrow account go into the negative that amount. By this point I had already renewed my flood insurance policy for a lower amount. I contacted the flood insurance program again and was told that they would not issue the policy twice so any payment Ditech sent would not be accepted.
I contacted Ditech back and told them that they sent that payment after I requested that they remove the account from my escrow, that they had no right to make the payment in first place, and they even sent the wrong amount. Their response was ... tough if the payment gets returned to them then they would credit my escrow account back.
Status as of XX/XX/XXXX, my escrow account is still negative from the {$2200.00} wire and the flood insurance policy is still listed on my escrow, now updated to be paid again next year and again for the wrong amount.
Our escrow is scheduled to be recalculated in XXXX and this issue is going to become a lot bigger if it is recalculated before our escrow account is credited back the {$2200.00} that should have never been sent out in the first place.
By Ditech putting the flood insurance policy into our escrow and paying it without our consent, they are effectively making a voluntary insurance policy and non-voluntary insurance policy.
Ditech has been no help, they just send you from on department to the next without changing anything.

Complaint: This is about predatory offers of home warranty insurance. I sent a card back that was sent in my mortgage statement, thinking it was a request for more info. I never heard anything more. Then recently I discovered that payment for the warranty has been being held out of my mortgage payment for a year.
I was never informed that the payment would come out of the mortgage payment, thus decreasing the amount I was paying on the mortgage and increasing the length of time that it will take me to pay it off and the amount of interest I'd pay. This is unfair.

Complaint: Diatech is trying to collect over 35 thousand dollars from me on a home that was foreclosed on in XX/XX/2009. I have heard nothing from them until recently when i received a letter stating they were going to garnish my pay. This was a " bad '' loan and i actually a letter the Missouri Attorney General. Complaint: Opened a HELOC with Ditech in 2007- set payment {$200.00}. Somewhere down the line it ended up with XXXX which was fine, then sold off to Greentree which was a constant problem so I started paying $ 1000-2000 a month just to get it over with but they refused to accept any more payments once I got 12 months ahead of the curve. Say what? You don't want my money? Anyways, Greentree apparently changed the terms of the loan and now I have an escrow account. Two years later I realized it wasn't going away because I was paying homeowners insurance and property taxes twice which ripped me off for over {$6000.00} cuz I wasn't looking. This is when I heard of Greentree / XXXX XXXX Class Action Lawsuit and suddenly I'm back with Ditech ( but with altered terms- escrow ). For the last 3 years I have tried to get Ditech to remove the escrow requirements since they are not my primary mortgage lender. Ditech finally did after some " legal intervention '' but now charge me a {$6.00} monthly " servicing '' fee and every year they force place insurance policies on my account and the phone calls start all over again. Hello year # 4. A simple XXXX search revealed a lot I did not know regarding how XXXX suddenly disappeared during the Class Action and is now Ditech. Thus why I join the ranks of the growing dis-contentment in a public forum. I just want my original terms which I have in writing from 2007 honored and stop all the shenanigans to score a few extra $ $ $ from people who thought they could trust a contract. -XXXX
