Complaint: in XX/XX/XXXX I knew I would have to be selling the home Husband had passed and I just couldn't afford anymore. they were to take the impound balance and add to the XXXX principal interest payment and stop my impounds per my request this was requested in XXXX for the XXXX payment and again in XXXX, the XXXX phone call end of the month they said I must fax in request so I did. at the time the impound balance in XXXX was XXXX or around there I didn't keep notes because I didn't think necessary but now I have been since they messed up in XXXX. I faxed in the request told to me in XXXX but not mentioned in XXXX attached is fax confirmation and letter. on XXXX they sent a pay off demand to escrow to pay off the loan house didn't sell until XX/XX/XXXX the could have amended if needed be they didn't to that. late XXXX received letter XXXX demanding pay off short and I called them that Monday XXXX spoke with XXXX who said they had enough funds to cover all and we still have impound balance I said ok and let go. Note : they were trying to say on an unpaid balance after impound account was credited if they were wrong I would be charged XXXX per DIEM on XXXX principal balance. XXXX said it was all an error this conversation is recorded and his ID number is XXXX. So I thought it was all resolved on XXXX I received a letter dated XX/XX/XXXX That stated XXXX was wrong and even again if he was wrong you should first credit the pay off amount. then impound account and then I I owe anything I should have been charged that balance plus interest at XXXX ( Note amount on the principal of approx. XXXX balance after all credits but instead they are still trying to charge me interest at XXXX per diem so since XXXX they say I still owe in excess of XXXX see all attached pay off demand, closing statement and letter confirming receipt of no impounds on XXXX letter stating all resolved on XXXX demands for XXXX per diem interst on a balance XXXX at most but should be zero and I should be getting impound account back.

Complaint: Hello CFPB, I am very appreciative that the agency exists to aid and empower consumers to protect our rights against these corporations that are on the verge of insolvency. Several mortgage servicing companies are underfunded due to the greed of the top stakeholders, and I have no choice in who services my mortgage. Therefore there is not a priority to provide centric customer service. I have been extremely patient with Ditech in hopes that whoever is reviewing my loss mitigation request determines that my case is acceptable mitigating circumstances, as the servicer is authorized to offer a mortgage loan modification outside of these requirements by submitting an application through XXXX XXXX XXXX XXXX XXXX XXXX for review and obtaining prior approval from XXXX XXXX. I sent a plea to Ditech on XX/XX/XXXX, and after several attempts to come to an acceptable resolution, the phone representative mentioned I could continue with escalating or submit a new hardship packet for review since 12 months have passed since my loan was modified XXXX. I sent my packet XXXX and did not receive a written acknowledgment, and when I do make contact with a phone rep, they mentioned they have received it but to give it time to confirm what is missing. More than 30 days have passed since the packet was sent and I do not know if it is complete or what status I am under and while my foreclosure is active. The last representative mentioned to me that I should be prepared for denial, because 12 months have not passed, which conflicted the information I acted on when moving forward with the loss mitigation package submission. I do not blame the individuals, because I understand they are overworked and the information is not properly transferred. Below is a copy of the request for an unusual hardship review sent for a plea for additional review : -- - Dear Sir or Madam, I feel that it is challenging for me to communicate by phone or the collection team thinks that there are no further options available for. I spent a significant amount of time researching my scenario so that I can accept the facts that and give me a piece of mind. I have attorneys contacting me, advising they can resolve my situation by force of litigation or bankruptcy, but require consultation with me. I do not want to go down a path that I feel is not necessary to resolve my matter. I am reaching out by the messaging center so that this written complaint can be routed appropriately, as I think the call center is unaware of exception reviews that my investor XXXX XXXX is open to review and consider. I would like Ditech to reconsider my situation and agree that it falls under an acceptable mitigating circumstance so that a request could be sent through XXXX XXXX XXXX XXXX XXXX for review. During the Trial Period Payment, I encountered life events that took their toll on me and impacted the performance of my payments. I can provide a detailed letter and supporting documents, but I am unable to upload within the message center. ( 1 ) XX/XX/XXXX, I learned that our {$19000.00} tax refund was compromised and is under investigation, as this classifies as identify theft. ( 2 ) My son was born in XX/XX/XXXX and my wife, and I began to have marital problems because no sight was going to receive our money. ( 3 ) XX/XX/XXXX, my wife and children left to live with my mother in law as the tension in our household increased. ( 4 ) XX/XX/XXXX, I became XXXX and applied for short-term XXXX with the state of California, I hope you also feel that there were some of the events were outside of my control. As of now, my family has returned home and now have the funds to make my last trial payment and first modified payment in XXXX. During the XXXX trial payment period, it was difficult to contact me because the medication needed to treat me made me very tired and dizzy. Therefore I was either sleeping or not in a position to hold a conversation. I returned the final modification agreement and was confirmed received on XX/XX/XXXX and during my phone call on XX/XX/XXXX I was not aware of the payment in XXXX NSF, as the represented call notes indicate he informed me. With a deeply heavy heart, I plea that Ditech and XXXX XXXX reconsider my denial and accept my final modification, under the condition I remit my XXXX trial payment and XXXX first modified payment. Kind Regards, -- - I can submit any documents upon request for review and I am available by phone anytime XXXX, thank you. The entire situation is causing me XXXX XXXX, please help.

Complaint: Consumer Financial Protection Bureau XXXX XXXX XXXX XXXXXXXX, IA XXXX To Whom It May Concern : My name is XXXX XXXX XXXX ; and I am submitting a complaint against Ditech Financial LLC, that holds the mortgage on my manufactured home. I began the purchase of my home in XX/XX/XXXX and made the first payment of {$170.00} in XXXX of the same year. Now, twenty years later, after having paid 237 of 240 payments, my loan is at maturation. One of those last three payments was deferred a few months ago. The other two, I have refused to pay, until I receive the fully itemized account of my payment history, including the amount of the loan ( {$17000.00} ), the fixed rate of interest of 9.5 % ( no idea as to how it has been compounded ) ) ; the amount that has been applied to the interest, and the amount that has been applied to the principal. I made three oral requests in XXXX, and then one by email ( sent XX/XX/XXXX ), as I was finally instructed. On that same day, I was sent a reply from Ditech that my request had been received, and a representative would be in contact with me. A representative did indeed call and simply started asking me questions for which the answers were in my written request. I told the representative that I wasn't answering any questions ; that everything was in the email. I then told the person to simply send me the information I had requested ; and then we would talk. This is XX/XX/XXXX, and I have yet to have that requested information sent to me. However, representatives from Ditech continue to call every day, sometimes twice a day. Since the date of my first payment, I have paid 237 payments at {$170.00} a payment, for a total of {$40000.00}. That is on a {$17000.00} loan. I would think that my debt would be satisfied ; but Ditech still has me owing {$3400.00}. ( Three home owner 's insurance premiums ( that's another story ) of {$84.00} each, are included in this amount. ) In conclusion, I am of the opinion that my debt has been more than satisfied. I can not know for a certainty, one way or the other, though, without the information I have repeatedly requested. Therefore, I submit this complaint to you in hopes that you will help me resolve this matter.

Complaint: Ditech Financial : After Hurricane Florence damaged our home we were forced to move out until repairs are complete. Insurance adjustors provided detailed information of the damage and the estimated cost of repair. In addition, we obtained estimates for the repairs and provided this information to Ditech as requested. The insurance check was mailed to us and we endorsed the check and then mailed the check to Ditech as required by XXXX XXXX. The cost to remove the old wet material was {$10000.00} which we paid for out our pocket as Ditech would not provide the funds designated by the insurance company. Ditech was provided with lien wavier, XXXX form, receipts. I have canceled checks for proof of pay yet Ditech continues to stall. The roof on our home was replaced with all required documentation provided to Ditech, Ditech will not release the any of the money to pay for the roof repair requiring me to pay for the roof repair out of pocket, this protects the collateral - again the insurance company provided sufficient funds but Ditech will not release the funds. I provided all required documentation for roof repair to Ditech and yet they refuse to pay. Next in line is the company that will install insulation and repair the drywall, ( {$15000.00} estimate ). Upon completion of insulation and drywall repair, we have a flooring contactor lined up to repair the flooring ( XXXX ). The last repair after the flooring is the kitchen cabinets and appliances ( {$32000.00} ). XXXX and I have provided Ditech with the required information to release 50 % of the funds upfront yet Ditech continues to stall. XXXX and I never missed a mortgage payment, never missed an insurance payment, and for XXXX NC insurance is not cheap. My complaint about Ditech is customer service and concern that the company is going bankrupt with my insurance money in some account that they refuse to release. We have provided Ditech with so much information, it appears to be a cash flow problem for the company and they release funds based upon their specific need and not in the interest of the collateral. Every time we comply with a request for information Ditech adds more requests ( stall tactic ). I have canceled checks where payment was made in full to contractors out of my pocket and they still will not release the money owed to me from the insurance that I paid for solely. They are hiding behind a claim that they must protect their investment this appears to be an excuse and is not an accurate picture. We live in the home and the repairs completed must meet a high standard, mine. I actually own more of the home than Ditech - Ditech will not send a person out to inspect, will not meet with me face to face. If they truly wanted to protect their investment they would inspect in person and meet face to face. This company is corrupt at the core and in financial trouble. Their CEO claims that great customer service is a strategic plan to increase revenues and avoid bankruptcy .not an ounce of truth or the plan is being implemented poorly. What I need from this agency is to contact Ditech Sr. Management and investigate - this is occurring to many individuals in NC that use Ditech . Other mortgage companies and credit unions are sending out folks to inspect the work and make the required payments for repair -

On XX/XX/2018, I received a letter saying I am ineligible for loss mitigation, then on XX/XX/2018, I received a letter saying why I'm ineligible and the other dated XX/XX/2018 saying I had until XX/XX/2018 to decide if I would be doing a short sale, as noted this is now too late ... I then call Ditech, XX/XX/2018 and tell them everything listed above and ask how to stop for closure and they tell me to pay {$1200.00}, then next day XX/XX/2018, I sent a check for {$1500.00} to the Illinois p.o box, the check was signed by my father in-law, with a note that has my name and account information so there wouldn't be a mix up..I then called ditech and talked to XXXX extension XXXX , and he noted check was on the way ... so to my surprise I received a letter on XX/XX/2018 saying I for closure proceedings may happen if I don't dispute and so I'm disputing ...

Complaint: Ditech bought my mortgage a few years ago. Since then I have had frequent problems with them. The most common problem is where they send two bills in a month. I have called them about this several times. They say it's an error and to ignore the second bill. This month, for the payment due XX/XX/18, I sent a check to them ( # XXXX ) on XX/XX/18 for the amount in full ( {$680.00} ). This check cleared with my bank ( XXXX XXXX ) on XX/XX/18. About two weeks ago I get a second bill as had happened many times before. Based on what they had told me, I ignored the bill after looking online to make sure that they had actually cashed my XX/XX/18 payment. I received a letter today stating that they had not received my XX/XX/18 mortgage payment and that they were assessing a late fee of {$34.00}. I am tired of struggling with their ineffective customer service. I am also starting to wonder if their double billing is not an accident, but in fact an unfair business practice designed to dupe customers into paying late fees. Please help me to resolve this issue so that others do not also have similar problems.
