Complaint: I refinanced my mortgage for the amount of {$120000.00} with XXXX XXXX XXXX on XX/XX/XXXX. Some time after that the mortgage went to a company called Greentree lending and after that was taken over by Ditech Financial, LLC. I made all of my payments to Ditech until the mortgage was paid in full on XX/XX/XXXX. I made NUMEROUS attempts to obtain a satisfaction of mortgage from Ditech but they repeatedly sent me the wrong one that was for the previous loan of {$80000.00} that I was refinancing onXX/XX/XXXX. After months and months of frustration and never being able to talk to the same customer service person and because the house was being sold I passed the job on to my lawyer. My attorney was not able to get any results either so they hired a company that specializes in these issues..Again no cooperation from Ditech. In the interim my house was sold and the title company witheld {$5000.00} from my sale proceeds due to the missing satisfaction of mortgage. My attorney tells me that now the title company is attempting to resolve this but I have not seen any sign of hope that Ditech will cooperate. It's been 2-1/2 years since I paid off the mortgage and have had to deal with the effect on my credit as well as not receiving my {$5000.00}. PLEASE HELP!!!

Complaint: We are in the process of refinancing our home. We have a relatively modest balance left on it, however, during a conversation with our loan service representative, we were informed that at the maturity of the loan after the principal was satisfied, a balloon payment attached to our modification could be requested to be paid in full. We felt we needed to refinance our mortgage with an instrument that had no unforeseen surprises.
With all the mortgage activity we are learning that this loan has incurred, we asked our current loan service representative, who holds the current mortgage and were informed that she could not disclose that information. We were even more compelled to refinance at this point. There are also many questions about the status of an original second loan with regards to Ditech saying they have a lien on our property. We never heard of them prior to either XXXX or XXXX. When I contacted them I was informed that they were not trying to collect a debt and that our second mortgage had been wiped out, dismissed. The Ditech representative did then say they have a lien on our property. I have searched our records and can find no mention of them in an assignment. We began researching our records and the company names affiliated with our mortgages and every single one of them have been revoked, shut down, filed bankruptcy and charged with illegal and unethical predatory practice and ordered by the courts to pay damages.. Our immediate concern is to secure the truth about the lien in the amount of our second mortgage ( {$30000.00} ) and of our mortgage currently serviced by XXXX XXXX XXXX XXXX XXXX. Please review the following information regarding our concerns. We highly appreciate any assistance you can provide in this matter.
On XX/XX/XXXX, we purchased our home. We were advised by our real estate representatives that the instrument we were best qualified for was a 20/80 loan with 20 % being a second loan of {$30000.00} and 80 % being the XXXX mortgage in the amount of {$120000.00}. On the second mortgage, XXXX XXXX XXXX XXXX, is listed as the ( lender ) with XXXX on the Security Deed. On the first mortgage, {$120000.00}, XXXX is listed as Lender or servicer ( " Lender '' ). Over the history of these loans, many transitions of servicers were made. We went from XXXX XXXX to XXXX to XXXX, we began to receive requests for payment on the second mortgage from XXXX XXXX, and Greentree. On XX/XX/XXXX, on one of our legal documents filed on record, a loan modification lists XXXX XXXX XXXX XXXX XXXX and XXXX on the first mortgage {$120000.00}. The loan modification came into play when we experienced a loss of clients during that tough financial period for mortgages and jobs. We eventually filed a chapter XXXX bankruptcy and included our arrears with the second mortgage and first mortgage as a part of the debt to be paid. We completed our bankruptcy plan which was discharged XX/XX/XXXX. According to our research of our records, XXXX XXXX XXXX was listed as the Grantor which is shown as XXXX XXXX XXXX XXXX XXXX recorded XX/XX/XXXX. Our mortgage was later turned over to XXXX XXXX XXXX, XXXX to whom we pay, but as I mentioned before they say they just service the loan and could not disclose to us who holds the mortgage. The first time we actually saw anything in writing about the {$30000.00} debt claimed by Ditech was when we received paperwork from the company that is in the process of refinancing the mortgage. One other thing, prior to Ditech contacting us, we received a legal notification that XXXX XXXX or XXXX XXXX XXXX had filed a chapter XXXX bankruptcy in Delaware. The creditor that Ditech says they are representing is listed as XXXX, XXXX, which is a privately owned start up company in Delaware whom we have never heard of or from. We would like to see/validate the current, official Deed to Secure Debt/Legal Document of legitimate assignments on all mortgages Ditech and XXXX we were/are connected to so we can be completely informed moving forward. Complaint: A missed payment in XX/XX/2018 resulted in being excluded from ACH payment process. Subsequent manual payments commenced. A missed payment in XX/XX/2018 was communicated by phone message and letter but not by email or even using the account holder message alert system. The mortgage company put in place delinquency notice and subsequently effected my personal credit score.
My issue is that this company actively makes it hard to comply on the basis of the following ; 1. If normal ACH is not possible no second or third attempt is made. It simply goes straight to a non-payment situation. Given the longevity of my payment record on this mortgage I find this approach completely unhelpful and is purely self serving on the part of the company.
2. Once issues with payment have occurred communication of same is very poor. Surely immediate email notification should be the communication of choice.
3. Once there has been an issue with an ACH payment your are locked out of any future ACH for a period of 12 months thus exacerbating the issue by having to return to old school manual payments.
Overall I feel the treatment of me, as a customer, is reprehensible by this company. If I could change companies, without incurring significant costs I would. The company is actively making it difficult by blocking the easiest payment route and I believe on the basis of securing additional revenue in the form of late fees exacerbated through subsequent bureaucratic red tape and probation periods for the accessing the easiest repayment routes.
Federal oversight should come down hard on companies that exploit such situations.

Complaint: We went through a foreclosure /modification under the auspices of XXXX County Court in XXXX XXXX New York . Several things happened during this process that we feel were not right. First off Di Tech had held 5 months of payments in Suspense while filing a foreclosure action against us. They did not acknowledge having the money until we brought it up in court. Then miraculously the money over ( 10,000.00 ) was returned to us. After much grief and stress we were finally offered a modification plan still with an exorbitant amount of interest for these times ( 5.375 % ) and we made our trial payments. The referee ruled we had to wait for the bank to put the mods in place a process delayed for no apparent reason by the bank for 2 months until the referee ordered someone to appear before her if this was not done later in XXXX I believe. Our modification period ended in XXXX and we were just making payments as we were told. All of a Sudden XXXX bill came in with additional charges of 300 plus dollars for " Legal Fees " we stated we were told that these fees were what was added into the loan because over 35K was added back to our loan. We were told in Court that these fees were the money we were waiting for them to add on to the mortgage to come up with final numbers. We got these final numbers which was not until XXXX or XXXX. Then in XXXX we get these additional charges and when we called Di Tech they said more would be added in XXXX. We have deducted this 600+ dollars from our payments and told them this money should have already been included in the numbers and at this point if it wasn't it was their loss.
Today I received a response from Di Tech and the Representative was nasty and said well then they will just add them on to the end number and I said they have already been added in and if they did we would surely be in court again.

I have previously made a request in writing as well as had an appraisal done by one an appraiser of their choosing. Complaint: I have been trying to get my Private Mortgage Insurance Removed from my mortgage since XX/XX/XXXX when my mortgage dropped below 80 % loan to value. Last year my mortgage was sold from XXXX XXXX ( Under mortgage # XXXX ) to Ditech Mortgage ( account # XXXX ). I reached out to Ditech via a email ( after being told to do so via phone representative ) request to remove my PMI on mortgage on XX/XX/XXXX and received no response at all from them, I even checked my junk box and nothing was there. My mortgage papers that I signed state an " Automatic Termination of PMI '' that states once my loan is below 78 % loan to value PMI will automatically terminate ( I have attached this document ). I reached out again today on XX/XX/XXXX to make this request via phone and was told initially to send the request that I already sent it too. I asked to speak with a supervisor and after being put on hold for about 30 minutes, I finally spoke to one. They told me that my loan to value must be under 70 % loan to value and that was their policy. After reading this document to the supervisor, I was told that " they don't have that document on file ''. She ( XXXX XXXX ) sent me a link to send her the form I have. I did so and just told me that I'll be hearing from them in 7-10 business days. Given their past history, I highly doubt that I will hear from them. I did mention to the supervisor and ask her why they weren't staying compliant to the homeowners protection act and she said nothing. From my understand this act requires mortgage companies to drop off PMI once loans are below 78 % LTV and the loan is current. I qualify for both of those items and don't understand why this is such a difficult task.

Complaint: In XX/XX/XXXX I submitted a complaint explaining that when my loan was transferred in XX/XX/XXXX from Green Tree to Ditech, I was told that I was {$20000.00} behind on payments and Ditech refused to take my payment of {$990.00} causing me to default on my loan. Ditech responded that Green Tree Servicing LLC only changed its name to Ditech Financial LLC. They also stated that their records show that my total monthly payment amount has never been {$990.00}. I submitted a complaint with Illinois Attorney General XXXX XXXX because I needed to know why Ditech continued to take my monthly {$990.00} payment without EVER contacting me about delinquency, nor did I receive a mortgage statement reflecting a higher payment. I also asked if they would modify my loan, but they denied me despite my stable income. Ditech issued a sale date on my home in XX/XX/XXXX and has not responded to XXXX XXXX yet.

Complaint: Di-Tech Holdings claims that I foreclosed on a home loan in XX/XX/XXXX. The home was taken back by bank Green Tree Services for {$620000.00} in XX/XX/XXXX, which more than covered the note. I don't know who Di-Tech Holdings are but they have put a negative note on my credit report with the major agencies. They have the date wrong and since they made money there should not be a negative mark on my credit report.

Complaint: In XX/XX/XXXX, we lost our home to foreclosure. The home was sold for the debt and it was paid. There was a second mortgage of XXXX that was written off and we paid federal taxes on this as income in XX/XX/XXXX. Ditech has been sending letters to my husband about this for years, attempting to collect, but the case was closed. Now, they are sending letters to me, and my name was never on this loan. Complaint: My regular monthly Mortgage payment is {$1500.00}.

On XX/XX/2018 I made my Regular monthly payment of {$1500.00} for the Month of XX/XX/2018.
Along with that I made additional Payment of {$3500.00} towards my principal.
The Company did not credit the additional payment of {$3500.00} to my account. Instead they transferred to Unapplied Funds.
2. Similarly, I made my Regular payment of {$1500.00} on XX/XX/2018 towards my XXXX Payment. The Company did not credit this amount also to my account and transferred to Unapplied Funds Thus, my Total {$5000.00} has been sitting in Unapplied Funds without being credited towards my Mortgage Loan. They keep charging me interest on this amount.
I called them twice before and also sent an email on XX/XX/2018, but till today, this has not been settled.

Complaint: I sent in a {$2000.00} mortgage payment to my old servicer ( di-tech ) and the check was cashed XXXX18. Upon realizing I sent to wrong servicer ( my correct and current service is XXXX XXXX ), I called di-tech to initiate a refund. I was transferred around, spoke to numerous supervisors, and have still not received my XXXX back after 30 days now. I had been promised calls back, gave them my checking account info to refund the , but have still not received my money back. I'm getting the run around, not being assisted, the wait times are extremely long on calls, and the customer service and problem resolution is terrible.

She has continually been asking about postponing the foreclosure sale date, but Ditech keeps saying they are missing documents even though my agent has sent them in repeatedly. when she called in today she was told they couldn't review the offer until they had a postponement of the sale date, which is THIS FRIDAY!
