Complaint: I submitted a check for the XX/XX/XXXX payment to Ditect on XXXX-18. The check was in the amount of {$270.00} but was never posted to my account. I have talked to several Ditect reps about the issue and faxed in proof that the check was processed from my bank. They have failed to apply it to the mortgage account. According to one Ditect service rep, issues like this happen often. I fear that this has happened to many of their clients and they are taking advantage of other customers.

Complaint: I had a flood in my basement and recieved a check for the damages, which was also written out to the mortgage company DITECH, I have made several attemts to call them to see what I need to do with the check as they need to sign it as well. I have waited between 15 and 55 minutes on hold with out ever getting through, and it even went so far as when I told this to regular customer service and asked to speak to a supervisor, his rude response was I have other customers and rudely hung up on me I even went on their website and filled out the form to have them contact me but to no avail Please help me All i want and need is a response

( XXXX ) XXXX XXXX Mortgage Company in Question : Ditech Servicing Account # XXXX To Whom ever it may Concern : I being Mrs . XXXX XXXX would like to File a Formal Complaint against the name Mortgage Company above Ditech.
Accordingly, On XX/XX/XXXX I initiated a Bankrupsy that did not include my home. ( will explain Further on ) It pertained Primarily to Credit Cards. Accordingly, I was with XXXX XXXX XXXX at the time Nevertheless, Both Mortgage Companies have appeared to have Presented a violation to this Consumer.
The situation became Damaging when XXXX XXXX for no apparent reason changed my Mortgage to a Servicing Company ( Ditech ) without warning and without my Consent. Additionally, I was never Provided any Documents to Sign or review. We were never late or in Default with XXXX XXXX yet, with Ditech I had to do a Modification. Such presented itself to be atleast {$100000.00} difference between the ( 2 ) loans .Nevertheless, after many years have Passed it was recently Discovered that my Mortgage is not being Reported to The Credit Bureaus. Our Credit is Important to us and we would like to see our Tradeline for Ditech on our Report .Although, many feel that they dont have to Report The FCRA provides Consumers with the prospect of what is Fair and Accurate .Otherwise the Mortgage Company can do as they feel and charge excessive amounts of money to the Consumer and there would be no verification .And the Consumer would be left to fend for themselves.
As Previously stated I did a Bankrupsy in XXXX I was not with Ditech at the Time and my Bankrupsy was only Cards notmy Home. When I phoned Ditech on XX/XX/XXXX as to why they were not reporting the Mortgage.They Stated it was because of the Bankrupsy and I would need a Bankrupsy Law to reestablish a loan with them we are still making the normal Payments and the has never been an agreement to Stop making payments previously or now.The point is that we want to be treated Fairly .And we need the Mortgage Company to Comply according to Federal standards and to live up to their obligation to respect The Consumer.

Complaint: Ditech has continually misallocated my monthly payments. After each occurrence I contacted the company to resolve the issue. I was continually told they would fix the problem and make sure future payments were allocated correctly. Yet the very next monthly payment was misallocated. Due to these errors, my payoff amount was incorrect and I overpaid. Ditech said they would investigate the problem and if I was owed any money they would send it in 30 days. They made an error yet they hold my reimbursement money hostage.
The misallocated funds occurred in XXXX of XXXX, XXXX of XXXX, XX/XX/XXXX, XXXX of XXXX, XXXX of XXXX, and XXXX of XXXX. Regular payments were applied to additional principal and any extra principal payments were applied to regular monthly payments then I was charged late fees, interest, etc. because the full monthly payment was not paid.
There were also months that I did not receive my monthly statements. I had to contact Ditech to get a statement in order to have a voucher to send with my payment.
My escrow was calculated incorrectly and misapplied as well. Ditech said they could not send me a corrected escrow statement when I asked for it. I never received anything stating the error was corrected.
When my monthly payments were applied to additional principal, I was told by Ditech, that I had made the payments 1-3 days before the payment was due so they applied it to principal since my account was current. However, in the past I had made payments every two to three weeks and there was never a problem. If their policy is to apply all payments to principal should they be paid 1-3 in advance of the actual due date, they should have informed me ( the consumer ) of this change in policy. However, they did not. They continued to misallocate the payments despite my numerous attempts to rectify the problem. I even spoke to supervisors and was told someone in a management position would contact me to discuss the issue. This never happened. No one ever contacted me.
Ditech customer service is extremely poor and they are not interested in resolving problems. Yet they are quick to add late fees, etc. and to take your money and keep your money despite their errors.

Complaint: My mortgage was paid off XX/XX/XXXX. I had automatic payments set up through my credit union and forgot to cancel them after the loan was paid off. XX/XX/XXXX my credit union submitted my regular payment ( XXXX ) to DiTech. When I realized what had happen I contacted DiTech by phone explaining my mistake and please refund the payment. They told me it would be straighten out quickly. I had not received the refund by end of XX/XX/XXXX I contacted them in writing and received a letter saying the matter was being investigated. I replied there was nothing to investigate it was a simple overpayment and return my money. I received another letter saying I would receive their answer in XX/XX/XXXX ... As of now I have not received my refund, I don't see any good faith on their part of returning this money.

Complaint: Ditech Complaint - Several Issues : 1. OVER CHARGED INTEREST : [ Refer to Letters dated XX/XX/XXXX, XX/XX/XXXX, and receipts dated XX/XX/XXXX, and statements dated XX/XX/XXXX to XX/XX/XXXX ] I made a {$40000.00} payment on XX/XX/XXXX, the day before my normal payment was due. My husband and I spoke with a Ditech rep that same day and they were supposed to apply it towards the payment that was past due and the current payment, and the remainder would go towards the principal. I was told it would take a few days to process but that the payment date would be reflected correctly, as XX/XX/XXXX. That didn't happen, they waited until XX/XX/XXXX to apply this payment even though they had the funds on the morning of the XXXX ( this was verified by our bank manager ). Then, for the subsequent two months, I was still paying the large amount of interest until the XXXX billing statement came out, almost {$500.00} in interest each month. In XXXX it finally dropped to {$150.00}.
I have called several times. I always got a low-level representative that totally agreed it's all wrong, and they would refer it to a supervisor. Eventually I received a letter ( letter dated XX/XX/XXXX ). They stated they applied the funds correctly, and they sent an updated amortization table. I believe this table is incorrect. I wanted to speak with the department that was in charge of this mistake so they could explain their resoning. But as I said, whenever I call I only get someone who knows nothing. About 30 % of the time when I do call, I get placed on hold and then disconnected. It happened again tonight.
2. UNEXPLAINED AND UNAUTHORIZED REALLOCATION OF FUNDS : [ Refer to XX/XX/XXXX and XX/XX/XXXX statements ] On XX/XX/XXXX I made the XX/XX/XXXX payment. It was late, I had been waiting for the interest issue to get taken care of. I finally just had to pay it so it wouldn't reflect negatively on my credit. This payment was applied as expected.
But then I made the XX/XX/XXXX payment on XX/XX/XXXX, a day later, and this is where the problem is. They only applied XXXX towards the regular payment, which is normally XXXX, and the remaining amount, XXXX was applied towards the principal. The next statement showed me owing a past due amount of XXXX ( and I am not sure where the difference of {$30.00} went ). I could not figure out the logic here. I called, again, and the rep could not figure it out either. They were totally baffled. They referred it up the chain. Again. On the XXXX statement, it appears to have been reversed. However, on XX/XX/XXXX I was assessed a late fee of {$5.00}. But my payments at that time were current.
3. THEY SENT ME A LETTER OF DEFAULT, SAID I OWED SEVERAL MONTHS : [ Refer to letters dated XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, & XX/XX/XXXX ] Even though I had been making ALL of my payments, I received the letter of default on XX/XX/XXXX and was unable to reach their office by phone due to the holiday weekend. I sent a fax letting them know how upset I was. I also called them the next business day. I was told that they had a software upgrade, and everyone got those letters, not to worry. Of course I was worried, I pointed out that they did not send a followup letter of explanation so I had no reason to disregard that letter. And I was concerned about my credit ratings. I considered filing bankruptcy proceedings to stop the foreclosure they threatened me with. Also, I had previously received some letters stating I was eligible for counseling, so I don't really buy into the " software glitch '' story.
4. UNEXPLAINED AND UNAUTHORIZED RE-ALLOCATION OF FUNDS FROM PRINCIPAL BALANCE INTO DEFERRED BALANCE : On XX/XX/XXXX there is a " Deferral/Rate Mod Partial Pays '' $ XXXX charge, and a " principal + Interest Payment of {$2300.00}. It looks like they took funds from the principal and moved it to Deferred Balance. Are they charging me interest on that too? I have no idea what this is or why. I called tonight talked to a rep named XXXX who of course was clueless, he thought it was very strange, and he finally placed me on hold to refer it to his supervisor. Then, of course, they disconnected me.
It just never ends.
I would like to know which government entity oversees/regulates this company.
I would also like to know if there is an advocate resource available to me.
I've included the statements going back to XX/XX/XXXX, and the letters I've received.

Complaint: On XX/XX/XXXX we qualified for and were issued by XXXX a Sandy-impacted Mortgage Forbearance Certificate for our Ditech Mortgage loan. We had problems initially with Ditech honoring the Certificate and had to contact XXXX XXXX XXXX XXXX XXXX XXXX XXXX in XX/XX/XXXX because they reported us to the Credit Borough as delinquent on payments, and were trying to transfer our loan to get out of honoring our Forbearance terms, that since got resolved after the TV station aired our complaint. But now we have even more problems with them. Our Legal Forbearance Cert is issued with Ditech 's name on it, for Forbearance period until XX/XX/XXXX. However, we had to fight with them since XX/XX/XXXX to make sure they kept our account in forbearance, since they started reporting us as delinquent to the Credit Borough again and showing we owe back interest. They finally fixed our account showing no late payments, but have not yet fixed our balance, since it shows accrued interest of about {$45000.00}. NJ DCA says interest is not to be accrued during this forbearance time since this is a special forbearance for SuperStorm Sandy victims, but Ditech refuses to address or correct this, even after we showed them a letter proving the NJDCA confirmed no interested should be accrued during the Forbearance period. We have been paying the Escrow, per the terms yet another problem we had with them is that they have not been properly applying our money to Escrow, but keeping it in a " suspended account '' so we had to once again dispute this is incorrect, because it has affected our Principal tremendously and what they are doing is wrong. Our credit report shows our Principal balance increasing approx. {$2000.00} each month. Then to make matters worse, while we were in a dispute with them about this, they decided to transfer our loan to another loan servicing company ( XXXX XXXX. ) And gave us 15 days notice. Once again we disputed that they do not transfer us while we were in a forbearance and still trying to rectify another dispute about the interest. We complained they cant do this since we are in a forbearance until XX/XX/XXXX, which is in writing from them. They tried to do that to us in XXXX, but then decided they wouldn't do that then, because we were in a forbearance and it was unethical and illegal, DCA told us they were not allowed to do that anyway. After spending numerous hours on the phone with Ditech Loss Mitigation Reps, they told us to write dispute letters about all complaints, which we did. We have since wrote 2 letters disputing them to correct credit report, then not to transfer our loan to another lender while we are in a dispute and yet they transferred us anyway on XX/XX/XXXX even though we have not gotten a resolution yet, only that they received letter that we faxed on XX/XX/XXXX and were working on a resolution. They also told us if our loan transfers that all loan conditions would remain the same with new lender, yet we just got our new bill from XXXX and its no longer showing the correct amount, nor that we are in a forbearance. XXXX XXXX got no information from Ditech regarding our Forbearance, even though Ditech told us our loan agreement showing Forbearance would not change once it was transferred, this was clearly a lie to us. In fact XXXX has us as not making a single payment since XX/XX/XXXX and a past due amount of {$45000.00}, which is clearly incorrect. We have tried to explain this to XXXX Reps and they claim they have no record from Ditech proving we were in a forbearance, even though we faxed, mailed and emailed ( Several times ) 15 pages worth of written proof to them over a week ago. When we try to call Ditech, we are left on hold for over an hour and no one picks up. We don't know what to do at this point. We wrote to NJ Dept of Banking and Insurance, as well as SD Div. of Banking and Ins filing complaints with both and now we are contacting CFPB in hopes someone can help us rectify this nightmare of a situation. The sad part about all this, is that we were significantly damaged by flooding by SuperStorm Sandy, then we were forced to elevate our home, which meant moving my family with XXXX XXXX ( XXXX is a Type XXXX XXXX ) into a tiny bungalow 30 minutes South of our home. We were displaced for almost 9 months, while dealing with a shady contractor, and finally home trying to get back to some kind of normalcy for our children. Ditech has made our stressful situation so much worse by not correcting our account, and abiding by the DCA legal-bound forbearance certificate terms, they have messed up our excellent credit scores because of their negligence and then transferred us to another company without providing them with the correct amounts and proper information for our loan. We are beyond frustrated and in desperate need of help. We are considering hiring a lawyer and once again contacting XXXX XXXX XXXX XXXX XXXX for assistance. We would prefer not to have to go that route, but we are at a loss as to how to get this resolved asap so our credit doesn't get further ruined by Ditech 's mistakes. Please Help!!
