Complaint: A refinance was done multiple times in XX/XX/XXXX the owner being a XXXX man with a set income since XX/XX/XXXX was preyed upon and given a refinance over and above his income capabilities. We have modified this loan 3xs with XXXX and once again recently with Caliber Home Loans. Only to find out in the fine print its modified to a interest only loan. Nothing is ever disclosed to us. We were struggling and a post card was sent to us that we had a law suit with XXXX and needed to hire XXXX out in XXXX XXXX. We stopped our payments to XXXX it cost {$5000.00}. up front and XXXX a month for on going legal fees only to be told in order to get our modification we had to release XXXX from its obligations We now are paying a trial payment to Caliber and received nothing from the law suit nor the Real Estate law Center.

Complaint: I have been trying to work out a loan modification with Caliber Home Loans since XX/XX/XXXX. Each time I have submitted the paperwork they 've asked for, they say they need only certain additional documents for a complete package. Each time as I have submitted what they request, they say to check back the following week, and then they have either come up with a different list or say they have n't received something that has been sent multiple times. At one point, my first Housing Counselor said she sent a certain item 3 times to them. They have given a list of items one day and two days later when they have what they asked for they give a different list, all the while pushing back and stalling the timeline of review so that I am now in danger of foreclosure.
They are now in the process of DUAL TRACKING ... Caliber refuses to take the foreclosure sale date off my house, even though they finally conceded on XXXX XXXX that they have a complete loan modification document package to review. One representative told my housing counselor they would take it off in a few days after processing. Another, 2 days later, told her they will not remove the sale date as they believe they 'll finish reviewing and make a decision before the sale date. This makes it sound like they are really intending to go through with the sale, even though they say they 're reviewing now. I am no lawyer, but I doubt that the actions of Caliber Home Loans constitutes Truth in Lending, as I have caught them lying to my Housing Counselor.

( 2 ) There is a legally binding contract ( SHORT SELLAGE-bank approval ), and the buyer is in breach of contract.
( 3 ) A foreclosure is in process, and their paperwork service of process is defective. I was not served the complaint or summons and the default judgment awarded them is VOIDED. Their was no due diligence on their part when they intentionally knew the mailing address XXXX XXXX XXXX XXXX Georgia XXXX.

Complaint: I contacted my lender before my husband had XXXX that was predicted to leave him out of work for about 6 months. They said they could do a loan modification. They told me to stop paying my payment while I was working on modification or they would n't think I needed a modification if I could still pay the payment. Four months later, nothing is done so I contacted what I thought was a legitimate site that could help me work with my lender. I ended up getting scammed by the other company that and loosing {$5000.00} and barely stopped the foreclosure of my house one day before it was scheduled to be sold. Now my lender has raised my payment to include all delinquent payments and fees, as well as trashed my credit when I only did what they told me to do in the first place!!

Complaint: Caliber Home Loans has serviced my home mortgage since 2007 when XXXX XXXX extended a {$160000.00} loan at 7.62500 % interest while a {$81000.00} lien was on the property. Monthly mortgage payments are {$1500.00} with {$920.00} toward interest, {$200.00} toward principal. This agreement was made when my credit score was XXXX ; it has now increased to XXXX and I seek a better interest rate.
The XXXX XXXX agreement ( XXXX ) was executed in 2007 with a {$81000.00} lien on record from XXXX XXXX XXXX ( XXXX ). Today XXXX is no longer in business and no one can remove the lien. I 'm not being billed for the {$81000.00} but the recorded lien wo n't go away.
Caliber Home Loans has offered a {$150000.00} loan at 3.99 % over 30 years with the {$81000.00} lien still on the property, I requested a 20 year quote ( for 10 years of payments made ) and the process has stalled - XXXX XXXX ( XXXX # XXXX ) said the {$20000.00} loss on tax return XXXX unit property was problematic, he requested my wife 's financial information although she is not listed on the property or the loan, it was sent XXXX XXXX. My retirement income, 4 year history as XXXX, wife 's employment income and investment portfolio clearly supports liquidity, profitability, and solvency i.e. on ongoing good credit risk esp. at a reduced interest rate. The balance of the current mortgage is {$140000.00}, the {$8000.00} difference is Caliber 's refinance costs yet the transaction is entirely internal.
XXXX XXXX ( XXXX # XXXX ) stated the computer system was down XXXX XXXX and he 'd call back once online, he never did. My calls have been unanswered.
This process has taken too long with questionable actions. I want Caliber Home Loans to remove the {$81000.00} lien and I want a 20 year mortgage refinance rate ( less than 4 % ) reflective of my XXXX credit score and history of timely payments to Caliber Home Loans.

Complaint: Caliber Home Loans is refusing to provide me with an actual accounting of my impound account. The loan they were servicing was paid off when I sold the home. Escrow closed on XXXX XXXX, 2016. They sent a check dated XXXX XXXX, 2016 to me indicating it was an " escrow release - paid in full ''. On XXXX XXXX, 2016 I spoke to XXXX at Caliber Customer Service asking for an accounting of the impound account with actual numbers - not estimates and projection. She said it would be sent. Instead I have received a letter stating that my request for " mortgage release documents '' had been sent to the Servicing Department and I may or may not be the one who will receive the document. The impound account contained my money. I think I should be able to get an accounting of what Caliber Home Loans did with the money.

Complaint: Caliber Home Loans continues to be in defiance of the XXXX XXXX which was passed by XXXX to crack down on mortgage servicers like Caliber. This act gave CFPB the authority to implement the new requirements and adopt new rules to protect consumers by providing borrowers with better information about their mortgage loans and protecting borrowers from wrongful actions by mortgage servicers. On XXXX XXXX, XXXX, the Consumer Financial Protection Bureau ( CFPB ) issued mortgage servicing rules designed to protect borrowers when it comes to mortgage loans. The mortgage rules were finalized on XXXX XXXX, XXXX. The rules require mortgage servicers to : Send Periodic Billing Statements The mortgage servicer must provide a written monthly mortgage statement to the borrower. The statement must show : the amount currently due ( including how much will be applied to principal, interest, and escrow ) the total of all payments received since the last statement how prior payments were applied transaction activity partial payment information fees or other charges to the account account information ( such as the outstanding balance and interest rate ) contact information for the servicer and housing counselors, and information regarding delinquencies The specifics from the rule are : Periodic billing statements XXXX XXXX TILA XXXX XXXX XXXX XXXX.
Creditors, assignees, and servicers must provide a periodic statement for each billing cycle containing, among other things, information on payments currently due and previously made, fees imposed, transaction activity, application of past payments, contact information for the servicer and housing counselors, and, where applicable, information regarding delinquencies. These statements must meet the timing, form, and content requirements provided in the rule. ( see attached ) Caliber Home Loans assumed servicing of our home mortgage from XXXX on XXXX XXXX, XXXX. For XXXX XXXX, XXXX XXXX, XXXX XXXX and XXXX XXXX we did not receive monthly statements with Caliber. Prior to XXXX XXXX, XXXX XXXX did provide monthly statements. The first monthly statement we received from Caliber was dated XXXX XXXX, XXXX. We have repeatedly requested that Caliber send us the statements for XXXX XXXX, XXXX XXXX, XXXX XXXX and XXXX XXXX. In response to a previous complaint, they responded on XXXX XXXX, XXXX : " We are still investigating why you did not receive the statements in XXXX and XXXX XXXX and XXXX XXXX. '' To date we have not received the statements for XXXX XXXX, XXXX XXXX, XXXX XXXX AND XXXX XXXX. Please see page XXXX of the attached letter for confirmation of Caliber 's statement.
We need these statements because XXXX has recently confirmed that they did not post our XXXX payments to our account. Subsequently this caused a cascade of problems with Caliber. Caliber has been unwilling to address these missing statements or provide relief for the mistakes made in XXXX XXXX. We need the statements so that we can confirm whether or not Caliber applied the XXXX payments to our account. They have corrected problems in our account that occurred in XXXX and XXXX XXXX but have not addressed the XXXX XXXX, XXXX issue.
