Complaint: We are wanting to remove our escrow from our current mortgage, so we can pay a lump sum for our property tax and home insurance like we 've previously done with past mortgages. We have excellent credit, excellent payment history and we can afford paying a lump sum for our property tax/insurance. We called in and we were advised that we could remove the escrow, by submitting a written letter to remove escrow and to show evidence that you have successfully paid property tax and insurance on our own with no issues. I asked what would cause my escrow waive to be declined and the mortgage personal said if I do n't have a good history of paying my taxes/insurance ontime. We were told this was the process by a few people at Caliber Home Loans. When I called in to see the status they mentioned Escrow Waiver is up to XXXX. I called XXXX and they mentioned it was not up to XXXX and it was up to the Mortgage company. We have been conflicting information and no one seems to know the policy or how to administer the policy. I called Caliber Home Loans again and mentioned what XXXX said about them being the sole owner of making a decision on escrow waive. They said the would escalate this. After several days, I got info that my escrow waive would be declined because I do n't have the Loan To Value ratio. This contradicted what was told to me first, that all I had to do was submit a letter with evidence of good tax/insurance payment. Also, according to fannie mae 's website it states the following : The servicer must ...
Evaluate whether it is appropriate to waive the escrow account requirement based on the following : the mortgage loan documents and applicable law, the borrower 's prior mortgage loan payment history, the borrower 's overall credit history, the LTV ratio of the mortgage loan, and the borrower 's financial ability to handle the lump-sum T & I payments.
Deny a request to discontinue escrow requirements for a mortgage loan if the borrower has previously defaulted on the mortgage loan, a blemished credit history on other credit obligations, or limited cash reserves.
Maintain the following information in the mortgage loan servicing file and make it available to XXXX upon request : the borrower 's written request ; the servicer 's basis for the waiver decision ; and the waiver of escrow deposits disclosure provided to the borrower, if applicable.
So, according to XXXX a servicer can deny a request to discontinue escrow requirements for a mortgage loan if the borrower has previously defaulted on the mortgage loan, a blemished credit history on other credit obligations, or limited cash reserves.
I 've been struggling with both Caliber Home Loans and XXXX on getting answers. I do n't see any where in the policy of what the Loan to Value ratio must be. I do n't see Loan to Value being a criteria to deny escrow waiver.
I 've paid my own property taxes and insurance on my own with previous mortgages with no issues. I do n't have a PMI with my current mortgage, so I do n't understand what the issue is to honor the escrow waiver. Also, I was told by XXXX after 2 years, escrow can be removed, but I do n't see this in the XXXX policy? Another contradiction.
I do n't understand why there are policies for escrow waive, when the mortgage company and XXXX does not seem to know the policy XXXX themselves. Also, it provides me a better financial power to pay my own taxes and insurance on my own. We have our own savings we dedicate for these type bills and our monthly mortgage bill would be significantly lower. Are there any rights for the home owner about escrow ( especially if it is going to make it more affordable for the home owner )?

Complaint: My house flooded out causing damages that are in excess of XXXX. I am insured with XXXX XXXX. The insurance company issued a check in the amount of a little over XXXX to both the mortgage company and me. At that time it was my understanding that my mortgage company was XXXX and it was when I called to notify them of the loss at which time I was told that XXXX would simply endorse the check back to me so I could get the rapairs made. Two hours later XXXX contacted me back and told me that my mortgage had been sold to Caliber Home Loans. I then called them and told them what had happened. I was told to send them the check and that they would then send another appraiser over to make sure that XXXX XXXX had figured enough for the damages. I told them that I had agreed to do the job for what XXXX XXXX was paying to which I was informed that Caliber does not let " homeowner '' do their own repair and that it would take up to 5 weeks for them to have it appraised and get someone over to give a bid. I told them that I was a licensed contracter and I would make the repairs myself, at this time I was told that I would NOT be paid for any repairs made. I have made all the repairs with the exception of installing the carpet and the countertops. I have put out over XXXX total into my house at this time. Caliber has told me that I would have the total check sent to me and that if I sent a self addressed pre paid envelope for over night delivery that that I would have the check in 3-5 days. That was almost a month ago. I have been told this by numerous people yet at the same time everytime I talk to someone I get a different story. Last Thursday it was requested that I send them my receipts which I did. I was told I would get a check in 3-5 business days. TODAY I was told that a check for XXXX was sent out yesterday and that it would be up to 5 weeks before another one was sent. My house has no dining room, kitchen, master bedroom, dining room or master bathroom since XX/XX/XXXX and tomorrow is XXXX XXXX. This is totally unacceptable. My original paperwork from Caliber says that the only thing they will be doing is accepting the mortgage payments and all other parts of the mortgage agreement will remain in force. XXXX policy was to endorse the check back to the homeowner and let them get the job done either by themselves or a contractor of their choosing, THAT IS WHAT CALIBER IS SUPPOSE TO DO AS WELL, however they have point blank told me personally that they own my house and that I only pay rent on it. I asked them if they had contractors come give bids on my house and they bid morel than what XXXX XXXX 's quote was what would happen and they told me they would go to XXXX XXXX for more money, I then asked them if the bids came in less than what XXXX XXXX quoted, if I got the money back and I was told " NO, that 's our money ''. They seem to forget that I have personal losses involved as well, I have property that was damaged. I have paid out for the water mitigation and drying out, yet I get no money for that whatsoever. I 'm going on 90 days of having to live like this and put my money out of my pocket on this job, that is not right. The majority of contractors get money " up front '' before even starting the project and if I were a " preferred '' contractor of XXXX they would have made a single copy check to me as a contractor instead of a dual check to the contractor AND the mortgage company. I am due my money, they have received a proper invoice yet they fail to pay anything more than XXXX % when the project is at approximately XXXX %.

Complaint: I have been getting a lot of refinancing offers from my servicer with titles such as " Caliber Has Important Payment Savings News for YOU. '' The " savings, '' however, come from the re-amortization of the mortgage at a new 30-year term -- the actual interest rate is higher than that on our current mortgage. I understand mortgages well enough to know that this offer makes me worse off. However, I think other consumers could be tricked into a contract that makes them worse off. ( Admittedly, there 's fine print at the bottom of the ad that alerts consumers to this issue, but I think it 's cryptically worded. )

Complaint: I need assistance with two issues. In XXXX 2016, while in Chapter XXXX Bankruptcy. I signed an agreement with Caliber Home Loans to do a 3 month trial loan modification. As of XXXX XXXX, 2016, I 've been in a 90 trial loan modification and keep receiving calls and literature from real estate agents because my home appears to still be listed in Foreclosure status.
Also, my mortgage was FHA Fixed. Somewhere over the past few years itt was switched to a Conventional. But I 'm not sure if it 's fixed or adjustable?

Complaint: Caliber Home Loans assumed servicing of our home mortgage from XXXX on XXXX XXXX, XXXX. For XXXX XXXX, XXXX XXXX, XXXX XXXX and XXXX XXXX we did not receive monthly statements with Caliber. The first monthly statement we received was dated XXXX XXXX, XXXX. We have repeatedly requested that Caliber send us the statements for XXXX XXXX, XXXX XXXX, XXXX XXXX and XXXX XXXX. In response to a previous complaint, they responded on XXXX XXXX, XXXX : " We are still investigating why you did not receive the statements in XXXX and XXXX XXXX and XXXX XXXX. '' To date we have not received the statements for XXXX XXXX, XXXX XXXX, XXXX XXXX AND XXXX XXXX. Please see page XXXX of the attached letter for confirmation of Caliber 's statement.
We need these statements because XXXX has recently confirmed that they did not post our XXXX XXXX, XXXX payment to our account. Subsequently this caused a cascade of problems with Caliber. Caliber has been unwilling to address these missing statements or provide relief for the mistake made on XXXX XXXX, XXXX. They have corrected problems in our account that occurred in XXXX and XXXX XXXX but have not addressed the XXXX XXXX, XXXX issue.

Complaint: I 've sent three notices this year regarding my mortgage account being reported inaccurately to all XXXX of the major credit bureaus.
Specifically, XX/XX/XXXX mortgage payment was made processed on XXXX/XXXX/XXXX yet it is being reported incorrectly as 90 days late.
Also, my XX/XX/XXXX payment was made late only because the Caliber website had the monthly payment listed as {$1600.00} which was n't the case. I 've called and spoken to Customer Service Department representatives on multiple occasions who confirmed that the online account information was incorrect and therefore the less than full payment was n't an error on my part.
On XXXX XXXX I spoke to XXXX ( ID # XXXX ) from the Customer Service Department who agreed and confirmed with his supervisor that both XX/XX/XXXX and XX/XX/XXXX payments were being reported incorrectly. The confirmation number I was provided for this particular conversation is XXXX.

Complaint: I received XXXX offers via e-mail ( and XXXX via regular mail ) from Caliber Home Loans with offers to refinance with claims on how I can save money by refinancing into what are obviously sub-optimal new mortgages. I currently have a 30 year 3.375 % mortgage with about 27 years left. They sent me XXXX offer that tries to sell me on the idea of refinancing to a new 30 year mortgage at 4.0 % because " Getting a lower monthly rate and paying less over the life of your loan just makes sense. '' The other offer was to get me to refinance to a 20 year 3.75 % mortgage, again an awful fiscal move. Again they use strong language " refinancing is an easy way to solve many of your mortgage worries. '' They do put a disclaimer on the e-mail that lists out all of their assumptions, but the exuberant language they are using to try to sell people on making what is clearly an awful fiscal decision is wrong and borderline predatory in my opinion.

Complaint: I have a mortgage with Caliber Home Loans which went into foreclosure. I made a large down payment and have been making payments every month since XXXX XXXX. Caliber recast the payment arrangement to lower the payments from {$9000.00} to {$7700.00} per month which was approved, and XXXX XXXX, a letter was sent to me stating that as agreed {$9000.00} was to be paid XXXX XXXX, XXXX and every month after that {$7700.00}. The letter clearly states that ALL FORECLOSURE ACTIVITY WILL BE SUSPENDED. However, Caliber did not notify XXXX XXXX XXXX ( the company that does the foreclosures for Caliber ) that there is a payment plan in effect. XXXX ordered a sale date on XXXX XXXX, XXXX and it was tacked on my door on XXXX XXXX. The letter clearly states that all foreclosure activity would be suspended. Going against the agreement, foreclosure activity began before the payment was due. Payment was due Saturday XXXX XXXX, XXXX and sale date was order XXXX XXXX, XXXX
