Complaint: I signed and executed a modification agreement. During the modification agreement term, my mortgage servicer changed ( XXXX XXXX. to Caliber Mort. The new mortgage servicer ( Caliber Mort. ) took an amount that was to be put on the back end of my mortgage as a current obligation. When I advised of the prior servicers agreement ( XXXX XXXX. ), the new servicer ( Caliber Mort. ) refused to remove the amount as a current obligation and return it to the back end of the mortgage. The new mortgage servicer ( Caliber Mort. ) kept the amount as a current obligation incuring late charges and then sought to foreclose on my property.

Complaint: My true and lawful Attorney-in-Fact XXXX ( hereinafter " XXXX '' ) contacted CALIBER HOME LOANS, INC., and spoke to XXXX, SUPERVISOR, TELLER ID. NO. XXXX, XXXX XXXX XXXX XXXX, XXXX XXXX. XXXX on Tuesday, XXXX XXXX, 2016. XXXX promised XXXX that SHE will contact XXXX on Wednesday, XXXX XXXX, 2016. SHE never called. Shane on HER. When XXXX did contact CALIBER HOME LOANS, INC., to follow-up with XXXX, XXXX, CUSTOMER SERVICE AGENT, TELLER ID. NO. XXXX, and XXXX, CUSTOMER SERVICE AGENT, TELLER ID. NO. XXXX gave XXXX the run around and the worst part of it all is XXXX not only refused to have a SUPERVISOR come on the line when XXXX requested for it, but she put XXXX on hold for over 40 minutes, never coming back on the line once to check in with XXXX within that 40 minutes, and then XXXX had the audacity to hang up the phone after keeping FTLC holding for a SUPERVISOR for over 40 minutes.

Complaint: I am shopping for a new home and submitted an offer for purchase for a local property. One of the stipulations before the offer would even be accepted for consideration was that I obtain a prequalification letter from a specific lender. As a bank employee with stellar credit and virtually no debt, it was MUCH easier for me to become prequalified with my employer ( they have my existing mortgage, all my bank and investment accounts, and access to my income records ). Long story short, I feel like this is coercion and thought this was illegal. In speaking with a representative at the NC board of realtors, they say it is not illegal at all. Wanted to bring this to your attention. Needless to say, I did not proceed with the purchase.

Complaint: 1. XXXX county court docket. On XXXX XXXX, XXXX a XXXX XXXX is filed to foreclose the mortgage. On XXXX XXXX, XXXX Plaintiff files motion for summary judgement & to re establish a lost instrument. But then on XXXX XXXX, XXXX almost a year after filing the foreclosure plaintiff claims to have found loss instrument ( original note and mortgage ). Per Florida Fair Foreclosure Act Plaintiff must show is legal owner of promissory note that borrower signed at closing promising to pay debt. On XXXX XXXX, XXXX at final judgement granted by non jury trial plaintiff attorney shows me forged instruments note, mortgage. There is only XXXX original note & mortgage which are the ones signed at closing and these are not the ones I say with 100 % certainty and further prove it with a forensic examination report I have in my possession and Plaintiff has been provided a copy of. Per Florida statute XXXX a person is not liable on an instrument unless the person signed the instrument which I did not and a felony of 3rd degree. Some additional info provided above thru research.
2. This original XXXX mortgage loan acquired by XXXX was insured and has been paid and collected upon one time. Plaintiff has been trying to collect a 2nd time on a mortgage that has already been paid to them by insurance long time ago.

Complaint: The Foreclosure sale date is scheduled for tomorrow XXXX XXXX, 2016. Caliber Home Loans told me that I had up until 15 days before the sale date to submit all the documents to be considered for a modification review. I hired a law firm to help me, XXXX XXXX XXXX. The law firm submitted all the documents prior to the 15 days ( and also Caliber had the extra 5 days for them to be uploaded ).
Based upon the law firm communication, the law firm submitted all the documents in time ( prior to the 15 days ) and it was acknowledged that Caliber received them. Now the day before the sale date, Caliber is saying that they did not receive all the documents. Now they are saying that all the documents should have been in 37 days prior to the foreclosure sale date. Caliber contradicted themselves by first saying 15 days and now saying 37 days prior to the sale date. Is this an illegal foreclosure. Also as shown on a previously filed complaint, Caliber did not tell me the XXXX XXXX guidelines.
The attorney advised me that I could file bankruptcy. Caliber switched telling me their rules about the number of days that the modification package had to be in. They told me 15 days and now they are saying there is a 37 day rule. This is another example of Caliber Home Loans giving conflicting information as well as incomplete and incorrect information. Caliber does not provide all the information that is needed to help the homeowner in a timely basis. Inconsistent and incorrect information is wrong.
