Complaint: After several failed attempts trying to save our home it was sold on XXXX/XXXX/16 beginning in XXXX 2016. We contacted Caliber Home Loans and explained our situation at which point we begin the process of " loss mitigation with Caliber Home Loans. We were also advised by Caliber Home Loans to contact " Keep your home California '' which we did as well. We were notified at the end of XXXX that " keep your home California '' approved us for financial help and that a packet was being sent to Caliber Home Loans. XXXX XXXX we were notified by " Keep your home California '' that Caliber Home loans ( who referred us ) rejected the assistance that was being offed from " Keep your home California '' on the basis " Your loan servicer ( Caliber Home Loans ) has not approved your loan for participation in the Keep your home California program.
Caliber Home Loans has not once offered any alternative to foreclosure. We have reached out to Caliber several times and requested assistance however none was ever offered. As a former customer of Calibers I 'm embarrassed and horrified by Caliber 's treatment of a customer who has done everything to try and keep our home. I was laid off XXXX XXXX 2016 and have been looking for work and trying to save our ( My wife and XXXX children ) home.
I will be sending this along with the offer to assist letter from " Keep your home California '' that was denied by Caliber home loans, to anyone that is willing to listen. Councilman, Congressmen, Representatives, Federal Trade Commission & media outlets. I want my situation to help others unlike Caliber Home Loans. I have also included the approval letter from Keep your home California dated XXXX XXXX 2016, were assistance was denied by Caliber Home Loans.

Complaint: I am an XXXX male. I purchased a Condominium unit in XXXX, FL in a project called XXXX XXXX, on XXXX XXXX, 2008. I purchased the condo based upon the following statements made to me by the XXXX XXXX XXXX Loan Officer : 1.That XXXX XXXX was a luxury condominium whose values would only go up.2. The condo market was strong in XXXX, and I would have no problem finding tenants to rent the unit.3. He wanted to make it easy for me to buy the unit, so the loans were processed using " stated '' income. I tried to give my income documents to the loan officer but they were refused. He said that I could more than afford to repay the proposed mortgage.4. I could refinance the loan to recoup my down-payment {$100000.00} investment, lower my rate and payments - he would handle it all for me. After closing on the Condo, the value began to drop significantly. I was required to repay the mortgages on my own. I soon discovered that my earnings were not sufficient to repay the mortgage debt I had assumed. I spoke with some of the unit purchasers and several told me that the developers had attempted to keep the prices of the units up, artificially by having straw purchasers buy units at above- market prices. Once this activity stopped the value of the unit dropped, became consistent with the values of the local condo market. My transaction was examined by a Mortgage Expert who found the following issues : 1. My income was over-stated on the loan application by {$1000.00} per month.2. My Back Debt Ratio totaled XXXX %. My monthly debts exceeded my monthly income by $ XXXX. Even using the lender 's overstated income figure, my back debt ratio totaled XXXX %. The lender knowingly placed me in a loans that I could not afford to repay, based upon my earnings.3. The value of one unit dropped to {$150000.00}, almost immediately, and I found myself to be seriously under-water on condo. As the condo-project was undersold, the Association was under-funded. My monthly association dues sky-rocketed. In an effort to keep from losing the down-payment I made, I used my savings and retirement funds to pay the mortgage. I exhausted all of my savings and the loan is now in default. The Bank will not modify or refinance the loans due to the huge decline in value. I have applied several times for modification with XXXX XXXX XXXX and Caliber Home Loan and have received the run around. I have submitted documents again and again and have been denied for one reason or the other. I was in the middle of modification when XXXX XXXX XXXX sold the loan to Caliber Home Loan. So I tried to get modification through them. Both banks have no one point of contact and after submitting documents we get no response just foreclosure notice. Caliber Home Loan took all modification documents and said our loan is in modification documents and we will hear from them soon. But after a month we received denial letter for no specific reason along with foreclosure notice. There is no one person contact with Caliber Home Loans and representatives are rude to me and my family. They call odd hours for collection on the loan and hares me and my family with hate words. Also the unpaid balance on the loan is incorrect and in dispute with Caliber Home Loan. Bank increased my payment from {$2300.00} per month to over {$4600.00} per month even the loan is a fixed rate that was the reason for me falling behind because they miscalculated the escrow. XXXX XXXX XXXX also heaped fees & penalties upon me. I am under threat of losing my property and my Hard Earned {$100000.00} down Payment. I believe that both XXXX XXXX XXXX the original lender and my mortgage Caliber Home Loan Servicing regarded me as a " target of opportunity '' due to my National Origin & have both treated me in a manner that has been discriminatory and financially harmful to me.

Complaint: My current loan company, Caliber home loans, paid taxes on a parcel number that was not mine, and was actually discontinued before I bought my property ; from my escrow account and now will not refund my money. To add insult to injury, they are wanting me to pay more money into my escrow account for my taxes when they used my money wrongly. They made XXXX payments of XXXX $ to parcel XXXX and XXXX payments of XXXX $ to parcel number XXXX, neither of which have ever been mine. Total of {$2700.00} which was removed from my escrow account and never returned. I also paid an installment for XXXX for XXXX $ I have filed many complaints and have been trying to get it solved for over a year now. They told me to give them more time. I called in 3 months, and the representative had told me they closed my compliant without resolving it or refunding my money. I want some one to be held responsible for this error and want my money refunded into my account instead of them trying to take more money from me. I have always paid everything on time and all my paperwork and payments have been on time. Please help me solve this.

Complaint: In XXXX 2016, I reached out to a Caliber Home loan processor to see if I would qualify for a home purchase because I had home previously and had to file bankruptcy. After an in-depth phone interview. I was told to provide all information that was discussed, I did. The loan representative sent me a total of 3 different preapproval letters, non of which turned out to be accurate, as I was n't preapproved. After a great deal of searching, in XX/XX/XXXX, I found a home and wrote a contract, which the loan officer acknowledged. My closing date was scheduled for XXXX/XXXX/16. During this period I continued to provide information as requested. As I got closer to the closing date without any communication from the loan officer, I sent an email to request information about if the closing was set. She finally responded back to me letting me know that my loan had been suspended. I had to contact her because apparently this was n't important enough to call, send an email or text for. The day before I was supposed to close I get an email that states the underwriter has my information and she is expecting approval the following week. The day I was supposed to close the loan officer says the underwriter wanted another letter from student loans, which would have taken 30 days at a minimum. Additionally, the seller was only willing to give two weeks extension at a significant financial penalty. I was out of money and had nowhere to go. I thought that all of this had been looked at prior to issuing me a preapproval letter.
I reached out to a different banking loan processor and provided same information that was given to Caliber Home Loans and in one week ( and no money out of pocket ) I was told that according to new regulations I did n't qualify to make a home purchase. I needed to wait at least another year. I feel like this is information the caliber loan officer should have provided me instead of having me payout and lose {$1600.00}. Recently, I have had tried to communicate with Caliber Home Loan corporate office but all I get are excuses and them trying to justify they are right. Caliber Home Loan is trying to make it my fault that the loan officer procrastinated or that the loan did n't go through. I do n't feel as if they did their due diligence. If the rules were changed the loan officer, who is a " professional '', should have made me aware prior to the day before and the day of my closing. At least, if she had, I could have taken advantage of the contingencies built into the contract and received most of my money back.
This entire experience has caused me and my family XXXX and XXXX.

Complaint: I have been fighting, at my own expense, mortgage servicing fraud since XX/XX/XXXX after obtaining a high interest only loan from XXXX XXXX in XX/XX/XXXX.
Because the home was severely underwater I was not able to refinance and was told I could not apply for a modification because I was in XXXX XXXX bankruptcy. Eventually I was approved for a XXXX XXXX Streamline Modification and made the three trial payments. I was sent a Modification Contract that included approximately {$28000.00} for escrow not owed and for interest payments that had not been credited. The servicers, XXXX then XXXX XXXX would not voluntarily correct the errors and I spent about two years fighting them in the Bankruptcy Court. They could not explain how my escrow could be XXXX due in XXXX XXXX but I owed {$14000.00} in XXXX XXXX after they paid {$1600.00} tax in XXXX XXXX. They more than doubled my monthly payment and would not voluntarily correct it and would not let me proceed with the XXXX XXXX Streamline Modification because I would not sign it with the errors in it that would have illegally obligated me for an extra {$28000.00} not owed.
After my bankruptcy was completed I applied for a HAMP Modification with the newest servicer, Caliber Home loans. I was assisted by XXXX XXXX XXXX, a HUD authorized Housing Counselor. XXXX XXXX XXXX assisted in filing all the necessary forms and afterwards we would receive a letter from Caliber each month asking for a completed application, tax request form, and most recent income verification. XXXX XXXX XXXX repeatedly submitted the requested documents and asked me for new profit and loss statements each month to accommodate Caliber 's monthly requests. Although all of the requested documents had been sent and resent I received certified mail on Saturday, XX/XX/XXXX from Caliber 's attorneys, XXXX and XXXX ; giving me 10 days notice of a Trustee Sale. I contacted XXXX XXXX at XXXX XXXX XXXX on Monday, XX/XX/XXXX and she contacted XXXX and was told that since all of the required documents were not submitted 25 days prior to the scheduled sale date, even though they had been, Caliber could not and would not stop the sale. XXXX XXXX told me that it was an underhanded and unreasonable action and that the 10 day notice does not meet the 30 day notice required by the Virginia Code. She suggested that I file a complaint with the CFPB and contact an attorney to file for Chapter XXXX Bankruptcy Protection. At that time I was being treated at The XXXX XXXX XXXX XXXX XXXX Hospital in XXXX, VA and I had to interrupt and postpone my treatment to return home, find and retain counsel to file an emergency petition to save my family home. On Monday XXXX XXXX, XXXX, I received four identical letters from Caliber, dated XXXX XXXX ; thanking me for sending the additional documents and advising me they still needed additional documents to proceed with the modification review.

Complaint: Applied for a modification with XXXX XXXX XXXX, completed the trial steps, then in the middle of the final step, was transferred to a new servicer ( caliber home loan ) who processed my modification for 2 to 3 months with no answers, then sent a package for permanent status Modification in XXXX with a due date for payment XXXX XXXX, 2016, then I sent the package back with payment, but they 're saying I had to make a payment also for XXXX XXXX, WHEN I got the papers in XXXX. ( A month later ) And the first payment after XXXX would be due 8 days later!!! But also that XXXX payment ( a month ago ) is also due. Putting us back in the same hardship!!
