Complaint: This Complaint is a follow up Complaint I had originally filed on XX/XX/XXXX, ( Case # ) XXXX ), ( OMB # XXXX. ) The issue is currently and was at that time a Loan Modification denial I received from Caliber Home Loans, Inc.. dated XX/XX/XXXX.. Reasons stated on denial letter are as follows : { XXXX XXXX XXXX } Ineligible Mortgage, " You did not obtain your loan on or before XXXX XXXX XXXX '' { XXXX XXXX Modification XXXX } : Ineligible Mortgage- " Your loan was originated less than twelve ( 12 ) months from today '' Please see Attachment letter described as ATTACHMENT LETTER ( 1. ) RE : NON APPROVED Dated XX/XX/XXXX and ATTACHED LETTER ( 3. ) Dated XX/XX/XXXX showing difference in language stating originate date of today or completion date of review After receiving my first denial letter from Caliber Home Loans I contacted the SPOC via telephone to ask if I could obtain any more information regarding my denial. The reason explained to me by the SPOC was the same as outlined in the original denial letter except I was told by the SPOC that due to my loan not having the originated required time of ( 12 ) months or more that 's why my Loan Modification was denied. I was further advised to reapply in XXXX XXXX allowing enough time to pass by from the time when I filed the first application. The second application was filed in late XXXX XXXX fulfilling the needed originate date requirement time period of ( 12 ) month or greater Sounding a little drained on the phone realizing I would have to reapply all over again the SPOC commented to me assuring me that my extra effort would be worth it and that other than the Origination requirement there was no other reason that my application would not be approved if there was no changes that occurred from the first loan modification original and the second application which I stated there were not any changes as I recalled .My second loan modification application request that was filed XX/XX/XXXX. was sent while another letter that arrived XXXX stating for me to fill out another Form XXXX and fax ASAP so I contacted the SPOC regarding an error I was having filling out the form XXXX as It was explained in detail to me by the SPOC via phone and I was advised to fax the form ASAP to the SPOC which I did and later that same day I observed my Loss Mitigation status showing all documents have been turned in and my modification application is under review. On XXXX XXXX XXXX I received a second Modification denial letter stating denial reasons as follows : :XXXX XXXX HAMP `` Excessive Forbearance '' We are unable to create an affordable payment without changing the terms of your loan beyond the requirements of the program. XXXX Modification XXXX : " Default not Imminent ''. Default status not Eligible, " We are unable to offer you a Home Affordable Modification because you have not missed two or more Mortgage payments '' Please see ATTACHMENT LETTER ( 2. ) NON APPROVED Dated XXXX XXXX, XXXX. Conclusion : I believe the denial letter dated XXXX XXXX XXXX speaks for itself as to the ridiculous reasons given on my. Denial letters The original and the second denials are so stated differently regarding the denial reasons given but no change of circumstances ever. occurred between the two time periods and still have n't to date The statement of miss two or more Mortgage payments suggesting a option to being denied seems ludicrous as a option for getting approved or putting oneself at risk of foreclosure more so but without stating that risk I also would like to know why my loan is labeled as " Excessive Forbearance '' and what is its meaning in relation to my loan status which has always been paid on time and paid in full! CONCUSION I really do n't believe that any viable options were explored to the best they could be to work out a loan modification to help me with my hardsh

Complaint: I have been working with my lender for a loan modification since early XX/XX/2016. I have submitted all documents requested and in the middle I was transitioning between a new job. I have sent in explanation of my new job which started on XX/XX/2016. To date I have only been paid one pay stub which was faxed over to the lender on XX/XX/2016. I am not withholding any additional pay stubs as I have only received the one pay stub provided. I am now being informed 3 days before the foreclosure sale of my home that I my application has been closed out for review because I am missing pay stubs for the month of XXXX, I have sent in an explanation that I had no pay stubs for XXXX as that was the beginning transition of my new job. They are now unwilling to postpone the sale stating there is not enough time, there would be enough time if they would postpone the sale and allowing me to send another pay stub from my next paycheck and keep the review open.

Loan Number : XXXX From case number XXXX LETTER # 1 ON XX/XX/XXXX FROM XXXX ( ORIGINAL ) Loan Number : XXXX XXXX ( TRANSFERRED TO CALIBER HOME LOANS ON XX/XX/XXXX NO TRANSFER LETTER HAS BEEN RECEIVED AS OF XX/XX/XXXX ) Property Address : XXXX, NJ XXXX Sheriff # : XXXX, Court Case # : XXXX - Sale Date XX/XX/XXXX Plaintiff Attorney : XXXX XXXX Please note that I would like to request a STAY OF SALE FOR 4 WEEKS due to the fact that my loan is being sold to another Bank ( investor ) and I need their information in order to proceed with the proper Short Sale process with them. As of today the current servicer : XXXX was going to approve the Short Sale, but they are unable to do so since, as stated above, the loan is being sold and they are releasing it from servicing. They are also not allowed to provide the contact information of the new investor, they said that it should come in the mail on a " Welcome Letter '' which has n't arrived. This is " hindering '' my chance of saving my home from an unnecessary foreclosure ( see below and letter ). Based on the Consumer Financial Protection Bureau ( CFPB ) website " Mortgage Servicers are Warned About Legal Protections for Consumers When Transferring Loans ... Consumers should not be collateral damage in the mortgage servicing transfer process ... Mortgage servicers are subject to federal laws such as : the Real Estate Settlement Procedures Act, the Fair Credit Reporting Act, the Fair Debt Collection Practices Act, and prohibitions on unfair, deceptive, or abusive acts or practices. Even though the Foreclosure Sale Date is on XX/XX/XXXX, XXXX has been in the process of selling the loan to another Bank ( investor ) for a while ; they are not allowed to disclose their name. They say that I am supposed to receive a letter from them releasing the servicing and a " welcome '' letter from the new Bank. None of those have arrived ... ... I need some additional time to be able to identify who the new Lender is and proceed with their Short Sale process so I do n't end up in foreclosure for lack of knowing who is my Lender. Sincerely, XXXX XX/XX/XXXX ON XX/XX/XXXX XXXX RESPONDED to Case Number XXXX indicating that they received the inquiry and it was being escalated. THEN ON XX/XX/XXXX XXXX ISSUED A LETTER ON Case Number XXXX indicating that the loan was sold to CALIBER HOME LOANS on XX/XX/2016 and that the sale date was postponed. They also provided a copy of the transfer notice but there is no account number. AS of today XX/XX/XXXX I have not received a letter from CALIBER HOME LOANS. I decided to call them and thy gave me a hard time to locate the account number which is Loan Number : XXXX. The only problem is that the Foreclosure Sale Date is now on XX/XX/XXXX and we do n't have enough time to submit a short sale and get it approved and close. I am requesting an 8 week extension for us to be able to get an approval and close on the sale. Again, this whole ordeal is " hindering '' my chance of saving my home from an unnecessary foreclosure and the devastating consequences on my credit going forward. Complaint: I have a three months modification trial, I made all my three payments on time, but never got a final modification because my loan was sold to a different bank and the new bank not honoring my modification and going through with the forclosure on my home. That should be illegal, these guys are bunch of XXXX playing with people lives and deals and they should be stored, cuz they are doing it to a lot of innocents hard working people, that all they want is save their home and dignity. Complaint: We refinanced and signed all mortgage documents on XXXX/XXXX/2016 paying off our our XXXX mortgage with Caliber Home Loans and our second mortgage with XXXX Loans. We had received a verified 30 day payoff statement ( {$380000.00} XXXX from Caliber Home Loans, good through XXXX/XXXX/2016. After the settlement date, the Title Company wired the verified payoff to Caliber on XXXX/XXXX/2016 in the amount that was signed in our paperwork. This was confirmed as paid on XXXX/XXXX/2016. Caliber then rejected the wire in which the title company attempted to wire again and it was refused another time with no explanation, meanwhile accruing interest all these days. When I called Caliber Home Loans on XXXX/XXXX/2016, they stated that the amount was short since they refigured the numbers and in turn changed the verified and signed payoff. After digging into this in more detail, I found that Caliber had faxed an updated payoff statement with a larger amount to the title company on XXXX/XXXX/2016 without notifying anyone and after we had already signed documents. To rectify the situation, we immediately brought additional funds down to the title company, even though this did n't seem right, just so that we could get it paid off to avoid even more days of interest charges, all the while paying interest to our new mortgage company ( that we had refinanced with ). The title company then requested a new payoff good through XXXX/XXXX/2016 and wired out the amount of {$390000.00} on XXXX/XXXX/2016 including more days of interest and fees. The wire was confirmed paid on XXXX/XXXX/2016, but then returned again on XXXX/XXXX/2016 with yet again, no reason. We then called and requested for a final time a new payoff statement in which Caliber yet revised again good through XXXX/XXXX/2016 in the amount of {$390000.00}, including more interest and fees. We are still waiting to see if they will accept this payment. This is absurd! We then wired out the amount of {$390000.00} on XXXX/XXXX/2016. Caliber has not been easy to deal with and I have never heard of them increasing a payoff statement without trying to notify us or the lender or title company. This makes zero since and we should not be responsible for paying on their lack of communication, organization and frankly a complete mistake on their part from calculating the original payoff.

Complaint: I was charged and paid a fraudulent fee. My loan was transferred another mortgage company at the end of XXXX have had nothing but issues. I had to get my lawyers involved to rectify the errors in my account. When I first received information from the new mortgage company back in XXXX the statements showed I owed {$27000.00} and that I had not made payments in the last year. I do n't know whatinformation they received from the old transferring mortgage company, but I do know that I sent the new mortgage company, the court documents stating the terms to the loans from my bankruptcy that was discharged XXXX 2015. I made payments on time and monthly to the old mortgage companyaccording to terms of the agreementby the courts since XXXX 2015.There was no change to my accountafterI sent the information to the new mortgage company.So, thenI had to get my lawyer involved and they sent all thedocuments showing the court agreement and proof ofpayment since XXXX XXXX! XXXX, I received a monthly statement showing Iowed $ XXXX the statement there was no breakdown of why the payment was more than the monthly payment. I asked my lawyer and they thought it was due to increase in escrow. So, I paid it to avoid any late fees.When I got my statement this month is shows the extra money I paid was not for escrows but for fees. It does not state what type of fee. I should never of been charged any fees of any sort. I have made every payment according to court documents and have provided proof of payment. I called the new mortgage company. The told me they were foreclosure attorney fees. This fee is a fraudulent charge. I contacted my lawyers and they said I should not have received any fees and we can take both the old and new mortgage company to court to get the fee back and for getting my information incorrect from the beginning. I am already incurring lawyer fees to errors that were made from both bank.I should not have received any fees from the bank. XXXX companies are in violation of the confirmations order and discharge order in my bankruptcy. I have followed everything byagreement with the courts. I should not bepayinglawyers to fix errors by your bank! The terms for the loan are very clear in the court documentation. I am requesting the {$670.00} to be refunded back to me as it is a fraudulent charge. I do not have that kind of money to just throw away and expect better from our system. I have called and spoke to numerous people I have emailed them. I 'm so frustrated as I have worked hard to repair my hardships. The only way to rectify this is to pay more money to take them to court. This is criminal. I am a single mother who is law abiding and I am looking for some support as I feel I have become a victim of the system. They also are in violation of the agreement by not reporting to the credit bureau the payment that I have been made for the past 13 months. I am pleading with you to help me rectify this situation. I can not afford to hire lawyers as I already hired them. It is not right that these mortgages companies violated and continue to violate these court orders. This is affecting my lively hood and my children.

Complaint: We purchased a condo in XXXX XXXX, MO in XXXX XXXX. They ran the loan through Caliber Home Loans. First thing, was the property taxes were prorated, so we did not owe the entire year of XXXX taxes. So immediately after the XXXX XXXX house payment, they immediately took out {$1400.00} and sent it to XXXX County Assessment for the XXXX taxes ( which we did not owe ). Not realizing that had been done, then in XXXX XXXX, they sent in {$1100.00} to the XXXX County Assessment for taxes. Well, then in XXXX XXXX, we received a notice from XXXX County stating that the taxes had not been paid. We called Caliber and told them and asked what they did. They indicated that they had sent the payments. They gave me the dates and check number and amounts. Called XXXX County Assessment back, and sure enough they had received those checks, however, Caliber had put the wrong property description on it and since the amounts did not match up, the money is in limbo in XXXX County. Call Caliber back and told them that and that they needed to get ahold of XXXX County Assessment and get the legals corrected so the money could be applied. Questioned them at that time why we were paying the entire XXXX taxes and all I got was that they would look into it and it would take 20 days to fix it. Well, instead of fixing it, they took another {$2600.00} out of the escrow and paid XXXX County so the taxes would be paid. Now, XXXX, we receive notice that they are doubling the monthly payment because we are now in the hole over {$3000.00} because they have mis-handled our escrow account. I called them and demanded a full audit and told them I was not paying for their mistake and that they would have to eat it themselves. I gave them until XXXX XXXX to have it fixed and to return a call to me. As of today, XXXX XXXX, XXXX, I have heard nothing. When I tried to call them, you end up on hold for over 15 minutes or if you do get through, they put you on hold and that is where you sit until you hang up. If they have mis-handled our escrow, who else have they screwed up!

Re : XXXX XXXX / CALIBER HOME LOANS, Hereinafter " Debt Collector '' Re : Alleged Account Number : Loan XXXX : NOT A VAILD DEBT Alleged Foreclosure Date : XXXX XXXX, XXXX Unique Real Property Address : XXXX XXXX, Az. XXXX Notice : Consumer here by demands that Debt Collector, CALIBER HOME LOANS and its agents, immediately Cease and Desist any and all Foreclosure actions. CALIBER HOME LOANS and its agents are purposely obfuscating facts to the consumer of who is the real creditor and avoided important accounting issues. Sending hearsay unsubstantiated accounting of false and forged documentation is a serious violation of the FDCPA. Also Violations of XXXX Plain Writing Act. As a matter of record and fact, the consumer, acting in good faith repeatedly has brought to your attention that there are numerous fabrications, misrepresentations and violations to address in " Debt Collector '' CALIBER HOME LOANS, and its agents ', non-response communications. As a debt collector, your actions have been and are a violation of 15 USC 1692 and you are liable for each and every violation. Pursuant to the FDCPA and state and federal consumer protection laws, be advised that I, the consumer, have the " right of private action '' and can seek protection and enforcement within an Article XXXX court of competent jurisdiction.
