Complaint: I am a home owner who has fell on hard times and unable to make my payments on my home mortgage. I am trying to do the right thing and apply for a Short Sale. I have provided all requirements for the short sale including a qualified buyer. My home is in need of many repairs and located in an area that is predominately lower class rental properties. We have a buyer for my home and submitted to my lender for approval, but my lender will not negotiate. They have advised, " This particular investor has a strategy that is not value based. Caliber is the servicer of this asset. The owner of this asset determines the amount of loss they are willing to take and when they are willing to take that loss ''. My Realtor has showed me that my home is only worth around {$70000.00} and the investor behind my loan will only accept {$100000.00}. My Realtor has explained that due to the repairs, location and sold comparables, there is no way I can sell my home for {$100000.00}. I am at a loss of what to do and it does n't seem like the investor behind the loan is willing to give me a fair chance at selling my home for what it is truly worth. I have requested a copy of an appraisal and they again advised that the counter offer is not based off any particular value and just what the investor is willing to take. There has to be another option or some way to be able to sell my home for what the home is actually worth.

Complaint: Regarding breach of contract : On XX/XX/XXXX, I entered into a reaffirmation agreement signed by myself and the then lender XXXX, which was approved by a judge in bankruptcy court in Nebraska. The terms clearly state that as of the date of the new contract any fees were brought current and that the monthly payment included zero additional fees. XXXX allocated a separate fee for property taxes paid by them pre-agreement in XX/XX/XXXX ballooning my monthly payment from the agreed upon amount of {$480.00} to {$1000.00} per month. Subsequently XXXX sold the loan to Caliber Home Loans as of XX/XX/XXXX who inherited the terms of the reaffirmation contract, but have to date not correctly allocated the fees and additional administrative costs they have incorrectly applied. On XX/XX/XXXX a federal court judge and opposing counsel in a legal case I brought against XXXX confirmed that any amount demanded over the approved monthly payment of {$480.00} was indeed a breach of contract and that I could pursue a case in state court. I have spoken to Caliber about this breach of contract over the phone back in XX/XX/XXXX but to date they have not reconciled the account and have mis-allocated the lender advanced fees, administrative costs and deferred interest as it should conform to the reaffirmation agreement terms. Caliber is demanding over {$8000.00} in overdue fees to bring the account current by XX/XX/XXXX or face foreclosure. I was offered a loan modification by Caliber at 3.75 % interest which would have included taxes and insurance in the total monthly payment, but was unable to agree to it by their deadline of XX/XX/XXXX because the amounts listed are incorrect. I would like to have the benefit of a loan modification as I am currently unemployed. I have written Caliber requesting they have the contract reviewed by legal counsel and reconcile the amounts to reflect what they legally represent. If Caliber refuses to comply with the terms of the legal agreement then I will have to sue for breach of contract, but would prefer to set the record straight and move on with a loan modification that is based on accurate terms of the agreement.

Complaint: Now that we were finally discharge from Chapter XXXX it did n't take no time for Caliber Home Loans to call me and harass me and tell me we owe for XXXX payment and XXXX payment XXXX. Our mortgaged payment is XXXX and we have been sending XXXX. We sent XXXX payment out the XXXX and they are saying we did not pay it. Also there asking for XXXX payment already and we just mail it. We have 15 days and they say we are a month behind every month. This is not right we have made our payments faithfully and the extra money we sent was for the modification that we though we had in XXXX and they fail to tell us after we were approve for it that they took it away. But they are saying we owe {$2000.00} which is a lie and then they said they will charge us a penalty every month for non- payment. Because according to them we are late even if we have 15 days to pay. I am sick in tired of XXXX, XXXX XXXX and now Caliber they are all evil and do n't care about the person only on how they can XXXX us over. We pay a high interest rate of 9.35 and they figure if they can say we owe nobody else will finance our mortgaged and they can take advantaged. We need this to be resolve again and taken care of as our payments are paid in full.

Complaint: Caliber Home Loans, Inc., XXXX. XXXX XXXX, XXXX, TX XXXX ( Account Number XXXX ) maintains a suspected practice of receiving home loan payments before the deadline of the XXXX of the month, holding payment several days and posting the payment after the deadline for the purpose of charging inappropriate late fees. I mailed a payment on XX/XX/2016 and Caliber acknowledged that they received the payment prior to the XX/XX/2016 deadline. However, Caliber Home Loans , Inc. did not post the payment until XX/XX/2016. When I complained that they had adequate time to post this payment before the late fee deadline, they defended themselves by claiming an inability to handle their heavy workload. I feel this is an inappropriate business practice that borders on improper. Customers should not be held responsible for the poor processing of payments by this Mortgage Company.

Complaint: XX/XX/XXXX I purchased a Townhome in XXXX, SC as a Veteran loan, which was financed by XXXX XXXX ( XXXX ). I satisfied all pre-qualifying requisites to include obtaining flood insurance beyond the general home insurance. After a couple of months, XXXX sold my mortgage to Caliber Home Loans. On XX/XX/XXXX, Caliber Home Loans notified me that they had deducted {$2700.00} to purchase comprehensive wind insurance on my behalf. Although I understand I can purchase my own wind insurance, I find this practice quite arbitrary since during the loan qualifying process, XXXX XXXX did not require it. Further when I contacted them, they stated I was not required to get this insurance and even attempted to contact Caliber Loans on my behalf ( See attached e-mail ). Caliber Loans chose to purchase my mortgage, not the other way around and they did so knowingly I had no wind insurance, which as previously stated I 'm not required to have. If Caliber Loans feels they need to further protect their investment as they have stated on their notice to me, then that is a financial expense that they need to afford themselves, instead of placing this added financial burden on my and my family. A consumer should not be subjected to new requirements every time a loan is sold to another financial institution. This is not a fair practice. I asked that they return the money they deducted from my escrow.
