Complaint: My mortgage is with Caliber Loan, I received a modification though Caliber. I was making my monthly mortgage payment by cashier check. But they still foreclosed on my home, of which they recently foreclosed XX/XX/2016 and I was making the monthly mortgage payments. I 'm still living in the property. I received correspondence from XXXX stating they were going to foreclose on my property. I was not given the appropriate XXXX notice that is required by XXXX law prior to the foreclosure sale. It is a misdemeanor not to give the appropriate notice prior to foreclosure.

Complaint: Yes I received a pre approve loss mitigation application they Sai all I have to do was signed it and overnight it after reading over it carefully we discovered clause that was n't explain to us like lower your payment after 5 years your payment goes back up we are liking five years before our house is paid off and they are talking about another 30 years and at first they were asking for pay stubs and bank statements and my wife award letter so how can they do this without documents I am 3 months behind on my mortgage I told them I Will be making a payment and half by XX/XX/XXXX and on XX/XX/XXXX and I will not signed it please give some advice I never face anything like this my mortgage sold to another mortgage very unhappy.

Complaint: I obtained a XXXX loan in XXXX, am in modification review with Caliber Home loans since XXXX XXXX. They set a foreclosure sale date of XXXX XXXX XXXX, even tho I am providing all docs requested on daily, weekly basis they have never com pleted a mod pkge. I can not get a reasonable explanation of exactly what is required to qualify for a mod. or the process. Caliber bought my loan @ reduced price @ auction XXXX XXXX while I was awaiting Bankruptcy Ct approval of a mod I had been working on from XXXX XXXX since XXXX.This was not disclosed to me or the court. The ct approval was granted in XXXX XXXX for the mod to proceed however XXXX declared me delinquent from XXXX XXXX due to the sale to Caliber.They would not explain why they were dating my pmts to begin be fore the ct approval and because I could not cure the delinq uent pmts they convinced me to RESTART THE MOD PROC ESS which I finally agreed to do. I was in review with until wells advised me of the sale XXXX XXXX by letter advising me they no longer would service my loan, nor finish the modification as all my info was with Caliber. I now question why was I not advised of this 'short sale ' at auction OR offered any any such remedy to help me keep my home? Why did neither wells or caliber ever finish a modification package?? I worked with XXXX XXXX from XXXX. I furnished docs on a k daily, weekly basis, with over 100 agents. ( one of whom I was told to work with told me he had XXXX loans but mine was not one of them ) I thought I had a mod in XXXX XXXX, but the follow up paper work they told me to wait for never came, and I had to start the mod process over and a year of being in 'review ' later they set a foreclosure date ( I was in underwriting review ) forcing me into bankruptcy chptr XXXX to stop the sale. The " loan preservation specialist ' handling my loan denied it was ever assigned to her and she wanted me to start the process OVER AGAIN but not assure me it would stop foreclosure. I did continue the mod process after I filed for chpter XXXX in order to reduce my payments and repair my credit. No one should lose their home while being told they are in " review ". The homeowner has no knowledge of what is required to 'qualify ' for a modification, or the actual process. The modification package is never completed, docs expire and then the package is set to have something expire every day. It is extremely difficult to get info or answers to simple questions, you are just told to give them what they want and 'they will look at it and let you know '. They will not disclose how much income it will require to qualify or how you could improve your situation to qualify, they just wont answer you. They constantly lose doc uments and insist you did not provide them. They ask for docs that are within 2 days of becoming expired. They want invasive info on contributors ( even family ) as if they are qualifying for the entire loan. Finally there is no reasonable excuse for taking more than 90 days to complete a loan package on an existing homeowner. This process is a scam on an already distressed homeowner and is designed to fail, and their home is offered to a stranger at a foreclosure price, most often below the mortgage balance the homeowner is willing to repay with just some restructuring of the terms. It just is n't right. I have put all my savings into this home, I maintain it, I can not replace it. I have dealt in good faith and I have been lied to, misled, misrepresented to by XXXX mortgage cos. promising to help me, I have been subjected to tremendous stress, and financial ruin only to face the loss of my home to a totally NON ACCOUNTABLE corporation through THEIR under handed dealings for their gain.

Complaint: I was served with a foreclosure complaint on XXXX XXXX, 2014. The alleged plaintiff is XXXX as Trustee for XXXX Master Participation Trust. However, the actual entity is XXXX TRUSTEE. This entity was created in XXXX, XXXX with an address of XXXX XXXX XXXX XXXX, XXXX. This is the same address for CALIBER HOME LOANS, XXXX MASTER PARTICIPATION TRUST, VERICREST FINANCIAL. Caliber Home Loans, the alleged mortgage servicer, is the real party who is executing this foreclosure. It appears that CALIBER has been foreclosing on many properties over the last few years using their bogus entity XXXX TRUSTEE. They alter the name to XXXX as Trustee. I contacted XXXX and they readily admit they have nothing to do with the foreclosure. XXXX says CALIBER Home loans is doing the foreclosing. I am sharing my research with all agencies, DOJ/FBI, XXXX Atty general, US ATTY GENERAL, XXXX ATTY GENERAL, and more.

Complaint: We were contacted by Caliber Home Loans to refinance a mortgage we have with them to get a lower interest rate. We did all the paper work and they said everything was fine. We paid for the appraisal. We were expecting to close and then they said the IRS said we have Identity Theft so they said we could n't refinance even though we already hold a loan with them and paid for the appraisal. Caliber Home Loans should not have approved the loan and asked for appraisal if there was trouble. We spent a lot of time on this and they were n't organized. They do n't know what they are doing. Do n't use Caliber Home Loans.

Complaint: This all starts with a divorce and a vindictive x husband who gave me our home in the settlement, but did not add me as 3rd party to have the authority to talk to our bank ( XXXX ). So without being authorized on the account and not having the account number or address ( which my x kept from me ) I was not able to pay the mortgage immediately, until I contacted the Attorney General 's office who forced XXXX 's hand to add me as authorized 3rd party and I began to pay my mortgage, but by this time i was 6 months behind ( {$12000.00} ) THEN XXXX ( who owns the note ) changed services to Caliber, and my fight started all over again. And here is our story : It has been over 2 years since we first applied for a re-modification. and both times given 2 different reasons why we were declined in a span of 3-4 months of each application. Reasons of which were : 1. DTI too low 2. DTI too high. Also I was told by a Caliber Rep XX/XX/2015 that it is more profitable for them to sell our home then re-modify us. Caliber phone archives will prove this, if any one was willing to investigate our case. After our XXXX denial, completely frustrated and desperate to keep our home, knowing full well we can afford our mortgage, we hired the XXXX XXXX XXXX to represent us and help us fight Caliber from their unlawful dealings with our mortgage. With our attorneys now in charge, XXXX XXXX XXXX applied for our 3rd request for re-mod. They never accepted the packet, saying repeatedly docs were missing when we sent the docs repeated times. My attorney, faxed a complete re-mod packet, emailed the packet and also federal Expressed the entire packet overnight, but they still claimed they were missing docs. This now has become a game of cat and dog. Caliber told us the re-mod application had expired and we had to reapply and send the entire application package AGAIN!!! We are exhausting our savings to in attorney fees to fight Caliber to allow us to re-modify us. We submitted the XXXX re-modification and they said we would get a notification of approval in a month. Next day they notified XXXX we were denied, now because our LTV was too high. It was quite obviously to us all that Caliber did not even review our application. XXXX XXXX did some research on XXXX and Caliber and found unlawful handling/dealings with our mortgage. They presented an Escalation Letter with violations, in efforts to force them into a position of re-modifying our mortgage, but they denied all allegations and basically told us " prove it!! '' In XXXX we did a chapter XXXX bankruptcy to STOP the sale of our home and giving us the opportunity to cure the debt and reassume Mortgage payments which we were never permitted to do. ( Although we have the income and do n't even need a re-modification loan, they refused us XXXX re-mod AND disallowed us to even assume mortgage payments. ) On XXXX XXXX the trustee told Us That our chapter XXXX was denied XXXX XXXX, and our house was taken off the protection of the chapter XXXX and SOLD to the same company XXXX who is behind the denial of our applications which put us in foreclosure While the trustee was sending us " motion to deny chapter XXXX '' letter having the right to appeal by XXXX XXXX, yet our home was sold already back to XXXX and had NO CLUE. We have been fighting for almost 3 years with XXXX, XXXX and Caliber to allow us to keep our home, exhausting our savings to attorney fees, contacted the AG, even Senator XXXX office tried to help, all efforts have landed up losing our home which we HAVE THE INCOME. I sent pics to caliber of structural damage occurring from sliding off hill, due to flooding. XXXX '' crack in foundation, walls are separated, ceilings is cracked and there is NO way anyone will want this house neither will it pass inspection.BUT WE WANT IT AND WILL FIX IT, but completely ignored us.
