Complaint: CIT BANK IS REPORTING NUMEROUS LATES ON THE MORTGAGE THAT THEY DID NOT SERVICE IN XXXX. INDIMAC THE ORIGINAL SERVICER OF THIS MORTGAGE NOTE HAD APPROVED THE MODIFICATION AND HAD DELETED ALL LATES FROM OUR REPORT AS THEY PROMISED BUT CIT IS REPORTING US BEING LATE FROM XXXX XXXX XXXX. THEY SENT A LETTER STATING THEY DID NOT RECEIVE A PAYMENT FOR THOSE MONTHS .... WHY WOULD WE PAY CIT WHEN OUR MORTGAGE HOLDER AND SERVICER WAS INDIMAC WHO DID RECEIVE PAYMENTS ( ATTACHED PROOF ) CIT DID NOT BUY THIS LOAN UNTIL THE END OF XXXX SO THEY SHOULD NOT BE REPORTING ANY PAYMENT HISTORY FOR THE LOAN THEY DID NOT HAVE IN FIRST PLACE.

Complaint: Hello.
I have a second mortgage with Indymac, but now had transferred to CIT banks ( XXXX ). I have missed a payment for XXXX, due the I was out the country. So I was tried to get current. So I have made every payment since, so in XXXX I have was tried to get current on my loan, so I made my current payment of XXXX, than {$30.00} ( XXXX ) as late fees, than {$130.00} ( XXXX ) and {$210.00} ( XXXX ) and current due payment for the XXXX {$290.00} ( XXXX ) The funds {$30.00}, {$130.00} and {$210.00} had never applied on my account even it shows in my bank statement at CIT my loan information.
I have calculated since XXXX I have to make {$2000.00} as my due payments, but I have paid them {$2100.00} by end of XXXX. I have still own them payment for the XXXX and it 's good until XXXX XXXX.
They are keeping tell me that I have own the XXXX payments!!! It 's poor calculation from BANK ( financial institution ), as I showed my total paid above. How can I be confident that they can even manage my account? They are still reporting that I 'm late to Credit report organizations.
So I want them 1. Fix this problem 2. Fix my bad credit report.
I have attached the statement as I printed from their website. As you can see funds {$30.00}, {$130.00} and {$210.00} had never applied to my account if you will look at Principal and Interest columns.

Complaint: On XX/XX/2016 I submitted a complete Short Sale packet to Financial Freedom for review. They requested a new Property Appraisal by a 3rd party Appraiser of their choosing. On XX/XX/2016 the value came back at {$740000.00}. Based on the terms of the contract provided by financial freedom the appraised value will determine the acceptable purchase offer price which is XXXX % of that appraised value. An addendum with the new price of XXXX % of the new Value was submitted for approval in the amount of {$700000.00}. The note holder CIT group inc. was to give the approval within 2 to 3 weeks of submitted offer. Instead i received an email on XX/XX/2016 with no return or contact information that the appraisal had some Flaws? no explanation as to why the appraisal was not to their liking as i believe they are misinformed of the actual value of the property. The reason for this was a prior appraisal from a former offer from over 8 months ago by an out of area appraiser who gave a value of $ XXXX.with no consideration to the cost of repairs and its current dilapidated condition. That value was given as a hard number that was used and now that an actual and True value was given they cant accept the reality. I think this is acting in Bad Faith and should be reviewed by a second pair of eyes. This is the first time i have ever heard of the banks own appraisers value come into question. I feel this is not fair and they are acting in bad faith. I have informed the buyers to forward this complaint to their attorney as this is not a common occurrence and something definitely is amiss and should be investigated.

Complaint: we have a home equity line of credit loan with CIT bank was Indy mac the loan is a XXXX part loan first 10 years is a draw period then the next 10 years is repayment period so in are scenario we took a one time draw the bank set the minimum payment an we have made payments I looked at are loan an found out that there is no money going to the principle except what little extra more we paid so I called the bank an they said the first 10 years is interest only so I went back an reread are contract an no where does it say in the draw period or in the disclosure part that it is a 100 % interest only an know we also get a letter from cit bank that come XXXX 2017 that are payment will go up 3 times the amount so I called the bank back an the sent the complaint to a XXXX XXXX who looked in to it an after she did she sent us the same copy of the contract with a part highlighted that states during the draw period the minimum payment may not repay the principle that is outstanding on your line of credit well we new that ten years would have not payed the loan off but it does not say 100 % interest only so there should be a good pat of the loan paid to the principle an when I asked where in the contract or send me a letter stating this 100 % ten year payment i was told that quote I understand that the wording can be confusing its not they are playing with words are contract is very clear an easy to read an understand an are disclosure explains the payments an other ways to pay loan

Complaint: in XX/XX/2009 I applied for and receved a reverse mortgage to make a few repairs and renovations to a home that was given to me by my parents. the lender was Financial Freedom/Citi XXXX and backed by FHA. We did the repairs that the appraisers said must be madebefore they would release the funds. so we did the repairs and then some, then we looked into weatherization and the young man who came over told us there were broken beams in the roof and he could n't put insulation because of that and the roof leaking. we knew we had a leak somewhere, because of inside damage. all of this was observed by th appraisers, it had to be. so we had homeowners ins on the house and so we called our insurance over to fix the roof, they said the only thing they could fis was the fixwas the damage inside due to the condition of the roof and it had been that way for some time. so we fixed it and then we got another insurance company because they offerd us lower rates on car/house package. it was XXXX XXXX sent over an inspectorand he got up in th roof and did a complete inspection. got in the attic and in the crawl space as well and the whole thing. a few days later I got a letter from XXXX, saying we were being canceled due to the fact that the roof had a XXXX year life left on the roof. Once that hit the system we were not able to keep homeowners ins. As soon as they know the roof conition they cancel us. so financial freedom started getting ins on the property just to protect their interest, no liability, and were making us pay for it, we couldnt pay it, so when it got to {$5000.00} they sued us and Illegally got a default judgement. all this time I had been trying to get some help to get this roof fised, so we could get our own home owners, since FHA was a XXXX on this loan and actually had their own separate loan number on the paperwork I also called them, that 's when I found out that the appraisorsof the original loan were required by law to follow specific guidelines and that any severe problems had to be disclosed to us and more importantly FHA. My contention is that financial freedom was aware of this but they did n't want to let FHA know of those serious defects because then FHA would not have backed the mortgage. and after the insurance companies discovered it and we began to investigate and I contacted FHA and started ted the complaint process with them, financial freedom/citi bank, and their appraisers. My house was to be sold yesterday at sheriffs sale, I file motions with the court to stop it but I do n't kno if it happened or not. But this loan they made me ws predatory because they purposely did not disclose the serious defects to FHA or us. Had they disclosed this FHA would not have backed this loan. and there is a grant I can get to fix the roof, but they wont give it to me now because FF foreclosed. this all started with the court action filed on behalf of ff and XXXX bank. that court number XXXX in XXXX BY A law firm of the name of XXXX P.C, XXXX XXXX, IN XXXX ( XXXX, FINANCIAL FREEDOM LOAN/CITI BANK # XXXX Phone XXXX, FHA # XXXX, I do n't kno if the house was sold yesterday I filed an appeal with the court involved on Monday ththe XXXX.

Complaint: My father took out a reverse mortgage with Financial Freedom Mortgage, a division of OneWest Bank. The bank has foreclosed on the mortgage stating that he was not the primary resident of our home. They sent a process server to serve him with a summons & complaint but my father did n't have the capacity to understand due to him having XXXX and they said that they served me with the summons & complaint which is false. I was never served and their affidavit of service is fraudulent.

Complaint: I want to inform CFPB, that I have sent Debt validation and proof of claim letters pursuant to my private rights of action under FDCPA and FTC to CIT Bank and Onewest Bank Mortgage Servicing on several accessions. As of today, CITB has not validated, verified much less provide proof of claim according to law, FDCPA and FTC.
In ADDITION I want to report that there was three Assignments recorded on my property XXXX XXXX XXXX, XXXX, CA XXXX that I just recently found out.
The First Assignment of Deed of Trust recorded on XXXX/XXXX/XXXX at XXXX XXXX XXXX Recorders Office, executed by XXXX XXXX XXXX, as Vice President for Indymac Bank, XXXX The Second Corporate Assignment of Deed of Trust recorded on XXXX/XXXX/XXXX executed by XXXX XXXX, as Attorney-in-Fact for FDIC as receiver for Indymac XXXX, XXXX The Third assignment of Deed of Trust, recorded on XXXX/XXXX/XXXX and executed by XXXX XXXX XXXX, as Attorney-in-Fact for Indymac XXXX XXXX, XXXX.
As it is well known, XXXX XXXX XXXX is an infamous robosinger. All you need to do is XXXX and enter her name to find out that she signed thousand of instruments and documents that facilitated the initiation of illegally foreclosing on properties without legal and lawful authority to do so for over a dozen different entities and with titles as Vice-President to Attorney-in-Fact etc.
As you can see, I 'm very concerned as these assignments ' were recorded several years after the alleged loan was originated and is proof that there is broken chain of title.
In CIT response letter, CIT claims that CITB is the INVESTOR of the loan. I never contracted or singed any agreements with CITB.
In conclusion, I want for CITB bank as a DEBT COLLECTOR to respond to my debt validation and proof of claim demand according to the law, FDCPA, FTC and once and for all validate, verify, and provide proof of claim with someone with personal knowledge and authorize to do so under penalty of perjury. These are my private rights of actions and demand that these entities identify themselves under the law.

Complaint: I, XXXX XXXX XXXX am filing this complaint in order to report deed fraud against my property at XXXX XXXX XXXX, XXXX, XXXX XXXX. My mortgage was with IndyMac Loan Services and I started a Loan Modification process with them over 5years ago because my financial status changed and Indymac assured me that if I filled out their Loan Modification application along with my hardship letter and other requested documents that they would help me figure out a solution or give me other options. However, IndyMac never completed my Loan Modification and took a very long time in the process and never communicated with me on the status of my loan modification and then through a lot of late notices after the fact through the courts I found out that my house was foreclosed and yet I was n't served at any time much less given upfront notices or warnings. I never signed any papers or documents much less any waivers and now once again I am facing eviction due to all of the above. In addition, my name was fraudulently taken off my deed, my water bill, my XXXX XXXX bills in which I paid for over 9 years. I was n't served properly and my house was taken away from me and I had no way to turn to and no help because attorney wanted {$2500.00} up front to take on my case. My house was taken away from me without any prior notices and my Section 8 tenant subsidy was also taken away from me by XXXX XXXX XXXX XXXX. Other lenders including XXXX and XXXX XXXX were also involved and still involved because the bills they had taken out of my name including my deed still comes to my house. I want to file deed fraud against all of the above parties. The rent that I collected from my Section 8 tenant was {$1500.00} and yet none of this money was applied to my balance and was taken away from me over 5 years ago as well. This is my true and correct statement to the best of my abilities.

Complaint: CIT lost or misplaced a fax on XXXX/XXXX/2016 from XXXX Bank regarding trustee to trustee transfers for my wife and I. XXXX Bank has resent the forms as of XXXX/XXXX/2016. My wifes account matured today XXXX/XXXX/2016 and CIT will not release the funds saying they need 72 hours to process the paper work. I do n't understand how XXXX can ( lose ) a fax with their confirmation number. XXXX bank also sent copies of CITs fax confirmation from both dates by email. CIT has also confirmed that they have received an email with this info. I have been on the phone many times with CIT reps, XXXX, aanthony, XXXX XXXX XXXX, but I am still getting the run around.
