Complaint: Capital One utilizes deceptive practices when provided users with their credit card statement via email. On two occasions my payment has been late due to the fact that the email highlights the " Statement Close Date '' and buries the " Statement Due Date ''. All other credit card email statements I receives highlights the Statement Due Date and payment date. The manner in which Capital One disseminates the information on the email highlight statement it is easy for a user to miss the payment date and incur late fees. After presenting the emails I have received from Capital One to numerous individuals, they all thought the Payment Due Date was the highlighted Statement End Date and missed the Payment Due Date buried in the first paragraph. I feel this is done purposefully by Capital One in order to increase their late fee revenue rather than provide the consumer with an easy to understand email highlight statement of when and how much is due.

Complaint: After Capital One Data Breach that took place on XX/XX/2019, Capital One Bank sent me a letter requesting documents to establish my identity ( driver license, Social Security Card, Utility Bill and Bank Statement ). Since I have to accounts with Capital One I have submitted the same documents for both of my accounts. Capital One Bank validated my documents for my Neiman Marcus credit card and reinstated it, and accused me of discrepancy for the Capital One Venture credit card. I have called and asked for explanation as the same Bank can't make two different decisions, it is validated or not validated. I have also wrote to Capital One Executive Offices requesting their involvement in this matter but up until today I have not heard back from them. My documents are issued by the State and Federal authorities and their inability to validate them means I have forged the documents. And if so it means I have committed fraud by fraudulently establishing the account with fake documents. They contradict their actions by restricting my one account and reinstating the other. When I call to discuss the matter and request some kind of letter to state the reason for restriction they hang up the phone on me.

I have informed both Capital One and XXXX that I never open an account or contract electronically or via the internet. I do NOT sign any contract unless it is with a notary present and I can sign my wet-ink signature on the contract to signify my agreement. XXXX claims I opened an account online with Capital One. This is untrue ; and if they maintain this claim, I am demanding to see the initial contract I signed to do so. Complaint: I filed a complaint in regards to being a victim of identity theft. Capital One has disregarded my request on 5 occasions. On my last complaint, I advised that I was a victim of identity theft and that checking account and credit card were opened under my name. Capital One has replied stating the information showing in " public record '' matches what shows on the Capital One account. The address XXXX XXXX XXXX XXXX XXXX, CA which is a business that closed down. I attached proof. The two number that was given number shows under my name and reads under an XXXX XXXX. Capital One did no research to prove that no identity theft happened. I am not responsible for this account and it needs tto be removed off my record with Capital One immediately. Capital One has referred to Collection agency ( they already investigated and as Capital One it was identity theft. I have already submitted a copy of the police report and FTC report.

Complaint: Over the last few years I have contacted Capital One regarding 2 credit card I have with them that carry an annual fee. When I initially opened the cards I was working on improving my credit score and had no other options. It has been quite some time since then and I have continually asked my accounts be reviewed and the annual fee removed since they offer these cards with no fees. Each year I have to fight with them to remove the fee, yet they conveniently forget to remove the annual fee, so each year I am charged for it. This is honestly ridiculous. I have kept the accounts open since they have my longest credit history and closing them would ruin my average age. I would appreciate a serious inquiry into this as I should not have to keep calling every year to have the fees removed.

Complaint: XXXX XXXX has been calling me almost every day, at least twice per day for at least 3-4 months. They call from multiple phone numbers with area codes in several states and toll-free numbers. They call on both my home number and my cellphone. They do not leave messages if I don't answer. After the first few calls, I asked them to stop calling me. They now call me almost every day on an average of twice per day. I have blocked as many numbers on my home phone that my phone will allow. On my cellphone, I've blocked close to, if not over, 100 numbers from them. When they call, they give a first name and ask for me by name. The then say before they go any further, is this ____________ who resides at __________. I hung up on the first call after telling them I'm not giving out personal info when I don't know who it is calling. On the next call, I told them to stop calling. They called again a day or so later and this time I reminded them I said to stop calling and hung up again. They still continue to call. Most of the time I don't answer and just let the call go to voicemail. I then call the number back and get the recordings saying thanks for calling XXXX XXXX and I hang up and block the number. On others calls that I answer, as soon as they start into their " script '' I know it's them, so I hang up and block the number. Sometimes they call my cellphone and when I don't answer, they immediately call my home number ... and vice-versa.

Complaint: My XXXX credit report is reflecting random fake payments ( mostly late ) on an account that was paid off and closed in XX/XX/XXXX. The lender, Capital One Auto, suddenly started reporting payments again in XXXX and continue to do so. I have sent numerous challenges to the creditor, but they keep responding that the information reported is accurate. I have also initiated several disputes with XXXX, but they keep saying the dispute has been resolved. Yet, the inaccurate information remains on my credit report. Neither the creditor nor the credit bureau have taken this investigation seriously, and my credit score is being negatively impacted by the multiple recent delinquent payments that are being inaccurately reported. I am not sure how I am supposed to prove that I am NOT making payments to a creditor, but this information needs to be corrected. This has dragged on too long, and I dont even understand why a credit bureau would allow a creditor to randomly start reporting payments on an account that is reported as closed with a {$0.00} balance. The reporting even shows a status of Paid and Closed with a {$0.00} balance, and last activity in XX/XX/XXXX. So why are they reporting payments in XXXX and XXXX? These are completely made up payments, as I do not owe Capital One Auto any money, nor have I made any payments to them since XXXX. XXXX is the only credit bureau showing these fake late payments on my report. The other bureaus are reflecting the account accurately.

Complaint: I purchased 10 yards raised bed mix for {$470.00} on XX/XX/2019 from XXXX XXXX XXXX. The company delivered the mix on XX/XX/XXXX. This is not in dispute. XXXX XXXX XXXX sent a representative, Mr. XXXX XXXX, to my home on XX/XX/XXXX to discuss a problem with the product. During the visit he stated the company would issue a credit of {$470.00} and would come and pick up the inferior product the first of next week at no charge to me. They did come and pick up the product. However, no credit was issued. When the credit was not forthcoming as promised, I again contacted Mr . XXXX about the credit. He said, I can make that happen. Mr . XXXX 's cell phone number is ( XXXX ) XXXX. When I did not receive the credit promised by the company representative I filed a dispute with Capital One stating a credit should be given because they picked up the product ; but, no credit was given. As far as me not providing the the purchase agreement, Capital One has it because they sent me a copy furnished by XXXX XXXX XXXX. There is not dispute about the invoice. I did not have a refund voucher to send them so they closed the case without talking to the company representative who promised the credit.
