I have called repeatedly, emailed, uploaded, and mailed all requested documents. the cancellation letter, lease with back out clauses, Florida law. email from complex stating they would not provide certificate of occupancy. Complaint: I was sued and a judgement for a 17 year old credit card debt was entered against and they sent the summons to an address that I haven't ever lived at. It was my sister 's old address and a summons was never served there for either of those court dates. My sister said that someone came there in early XX/XX/XXXX and asked if I lived there and she told them that I do not live there and they left. This company was able to locate my current work address for a garnishment order so they should have been able to locate my current address because it's on my credit report and they purposely stated that they sent a summons to the wrong address and I haven't seen proof that someone even signed for that summons. I don't remember this debt and don't feel that I have been able to fairly answer to this. Also if it's 17 years old can I be sued over this? I called the court and they said a judgement was entered against me in XX/XX/XXXX for XXXX and renewed on XX/XX/XXXX and was for XXXX plus XXXX in interest totalling XXXX but I have no knowledge of either of these judgments and the reason I am finding out about this is because a garnishment order was sent to my employer and they informed me. Is there anything I can do to stop this or get this resolved without being garnished. Were my legal rights violated? Wouldn't XX/XX/XXXX even be past the statute of limitations if this debt is 17 years old? I only have 14 days to figure this out according to the court papers. Did this company break a law by not serving me correctly? I called the attorney on this and she said that nothing can be done and they do whatever they need to do to collect this debt. I don't even know if this debt is truly mine. I would like to know my legal rights regarding this. I just found out recently that an ex wife that I've been divorced from for several years still has a credit card with my name on it and I shouldn't be responsible if I didn't create the debt but with such limited information I can't defend myself on this. The only information I have is that the debt is 17 years old and that this company went to court without properly notifying me twice and a judgement against me was made and now I'm being garnished.

Complaint: XXXX deleted 4 fraudulent capital one inquiries from my credit report but they left 5 fraudulent inquiries on my credit report. No consumer in their right mind applies for credit from the same company this many times. It does not make sense a blind man can see that these inquiries were not done by me. Capital One told the CFPB that some are fraudulent. XXXX has been stating that these inquiries were verified for months. I asked capital one and XXXX for the paper, electronic and audible proof that I initiated these inquires and they both have failed to provide me the documents that they are using to authenticate these inquiries. How did the pick and choose which inquiries to keep and which ones to remove?

Complaint: Gentlemen : XXXX XXXX fraudulently charged our credit card and withdrew funds from our bank account for services not rendered. We never provided any information to them regarding both accounts not did we ever authorized any such charges or withdrawal from our bank account. We reported the incident to Capital One the credit card company. They immediately issued a new credit card, credited the account and promised an inquiry. To our utter amazement, shock and dismay we received a letter in early XXXX from XXXX, Fraud Investigator at Capital One that she did not find any indication of fraud. Except for an address in XXXX XXXX XXXX the letter does not have any email address or a telephone number where she could be reached. We called Capital One went around the Merry Go Around with them. No one was able or willing to help. We called again the following week on XX/XX/2019 and asked to speak someone from the fraud division. We spoke with XXXX and he put us on hold for a prolonged time. Finally XXXX, apparently his supervisor came on the line. After relating our concerns to him he finally conceded that they had received a response from XXXX XXXX but the response had another customers name on it. We requested that if we could get a copy of such response it was refused. We asked if we could get the response with the customers name redacted our request was declined again. We requested XXXX 's and his ( XXXX ) telephone number and email address. Again our request was declined. Finally XXXX conceded that XXXX 's report was incorrect and he would send the case back for further investigation. We received another bomb shell, another shocker in the mail yesterday. This was sent simply by the Customer Fraud Protection stating " We're happy to tell you that your fraud investigation with Capital One is now resolved '' Lots of questions come to mind. Based on what evidence did XXXX conclude that she did not find any investigation of fraud. Why are being denied in getting in touch with her. When XXXX concurred with us that XXXX 's investigation was incorrect and he would sent the case back for further investigation why have we received this letter yesterday. Is this mere negligence on Capital One 's part of collusion between them and XXXX XXXX. We have approached XXXX XXXX several time regarding these issues. They have refused to respond to our inquiry regard the charges to the credit card and lied about the illegal fraudulent charge to our bank account.

Problem -2 I made a transfer over the phone I asked customer service about transfer fees she said the transfer will be treated as a purchase so their wont be any fees so I get my statement capital one charged me {$20.00} interest late fee and madd my account past due I call customer service and tell them that I never got statements I wasnt suppose to get charged regarding transfer they need to reverse all the fees then he told me I have to pay off the account in full then they will take all the fees back Well with everything they did I dont trust capital one because if I pay off the account then call for fees credit requests They will tell me something around the fees charged were ledgenamet

In spite of the Automatic Stay, Capital One is continuing to collect this debt : On my XXXX credit file and XXXX, Capital One has reported this account as 90 days late, 120 days late, and a few days ago 150 days late! Additionally, Capital One is adding interest to the amount of the original petitioned debt. The reported Current Status is : " delinquent, at least 120 days or more than four payments past due, '' and ( 2 ) Description Remarks : " {$270.00}, 150 days past due. '' I have now disputed this account TWICE with XXXX, but Capital One keeps verifying their reporting as accurate, in violation of the automatic stay afforded debtors in Bankruptcy Code 11 U.S. Code 362. I am requesting that Capital One update the account language and descriptors on my XXXX file to read : " paid as agreed '' or " unrated '' AND " Chapter XXXX Bankruptcy. '' Thank you.
