Complaint: Hello Consumer Finance. Tried to purchase some cigars from XXXX XXXX XXXX for {$520.00}, and some shirts from XXXX XXXX for {$450.00} last Saturday XXXX and pay for them with our Capital One BUY POWER CARD Master Card. Both Transactions were declined for payment. Was rather embarrassing as both my wife and I have excellent FICO Scores, and, always try to pay off all balances monthly. Called the XXXX and spoke to the robot, admitted to making both purchases, and went back to purchase both carts as the fraud alert had been removed. Tried XXXX again, and was declined. XXXX XXXX transactions had went through but, most of the items that had been on sale had magically returned to their non sale pricing. Called XXXX again, and spoke with a XXXX, who was in the XXXX and asked, Why did you block my purchases due to suspected fraud activity? He indicated that he would try and get the block removed and if he could place me on hold for 2 minutes, to which told him no, and hung up. Tried again unsuccessfully to purchase my cart items at XXXX and called back and spoke with a Supervisor XXXX who ended up stating that they could not identify me and that I needed to prove my identity, would need to provide a mobile cell phone number that they could send a 6 digit pin to that I would respond with. Was so agitated and frustrated. Tried to use my wife 's credit card to purchase my cigars, which are only on sale for XXXX 's Day, and, whoever, blocked her card, or, the transaction as well. Thought it might have been dollar amount related, so tried to purchase a smaller amount of cigars at XXXX, with my card, and was denied also. Sent a complaint to MasterCard, and would like to enclose their response, as well as the XXXX 's response regarding this issue to you. Again, so frustrating that they feel that they have a right to prohibit a purchase for a lousey +_ {$500.00} dollars. Why? This is what we would like resolved if you are able. The experience has forced us to seek another credit card company, and hopefully, one that treats us with appreciation instead of oppression. Thank you for your time, Sincerely, XXXX XXXX

Complaint: I've tried several attempts to resolve this matter with the company listed below. After several attempts I have been forced to file a police report and also seek legal advice against the account listed. In addition please find attached a copy of the police report and DC number that was provided to me when report was filed. In addition I would like these accounts to be removed from my credit report. As I have asked before. These accounts are part of fraud and should be removed from my credit report immediately. Per Federal Guidelines in 603B letter when ever there is fraud on your credit report is shall be removed with in 4 business day.

Complaint: I opened my Capital One 360 Money Market account through a promotion code ( " XXXX '' ) that promised a {$500.00} incentive for depositing {$50000.00} before XX/XX/2018. I completed such deposits on XX/XX/2018, but did not receive the bonus as Capital One has responded that the deposit must be a single deposit even though the terms sheet for the promotion did not specify this. In fact, the terms state that " Deposits [ plural ] must be from another bank '' and there was nothing in there about the account having to reach a {$50000.00} balance. My account reached a maximum balance of {$26000.00} during the promotion period but it **did** have more than {$50000.00} in deposits from outside banks as required by the promotion. However, Capital One has failed to make good on the promotional offer.

Complaint: I made a payment on my credit cards from Capital One. Capital One accepted one credit card payment and applied the payment but has not applied the second payment. I called and asked why they had not applied the payment and Capital One told me that I had a reversed transaction and they would have to call my bank and verify the funds. I told them the same payment that was applied on the first credit card came from the same bank and funds are valid!!! Capital one has not applied my payment to my second credit card and I am still wondering why?!!!

Complaint: On or about XX/XX/2018, XXXX XXXX visited XXXX XXXX located at XXXX XXXX XXXX XXXX ; XXXX, Texas. Present with XXXX XXXX was : XXXX XXXX and XXXX XXXX. XXXX XXXX XXXX XXXX, XXXX XXXX submitted a Finance Application to Capital One Auto Finance. XXXX XXXX father, XXXX XXXX XXXX also joined the application as a co-buyer. XXXX XXXX, after agreeing to all terms and conditions of the Finance Agreement, took possession of the XXXX XXXX XXXX. As a marketing strategy of Capital One Auto Finance, XXXX XXXX began receiving robotic phone messages, as well as invoices, indicating that he was the principle person listed on the loan. Several attempts were made through Capital One Customer Service to correct XXXX XXXX XXXX, to correct him as being the principle borrower, and to place him, as per theFinance Agreement '' back to the co-buyer. This request was denied. XXXX XXXX, XXXX XXXX, and their brother-in-law, XXXX XXXX XXXX, spoke with a member of the Escalations Team in the Office of the President. The Representative in the Office of the Presidential Escalations Team only identified herself as XXXX. She would provide no other pertinent job-related information about herself. XXXX XXXX XXXX, XXXX XXXX XXXX, and XXXX XXXX XXXX were all on the conversation. Proper consent was provided to the Agent, known as XXXX, to speak with XXXX XXXX, who was more knowledgeable about the issue. .XXXX. XXXX advised the Representative, known as XXXX it is a violation of banking laws, the Truth in Lending Act, including other state and federal laws for a Lending Institution to modify or change an Auto Finance Agreement without the express consent of all parties involved. : XXXX advised XXXX XXXX, XXXX XXXX, and XXXX XXXX, that it was submitted to the Capital One Auto Finance Company to the contrary and that Capital One Auto Finance would not modify or change the Auto Finance Agreement. Although the Financial Agreement signed at the Dealership clearly shows to the contrary. The parties placed XXXX on Notice, that they would be filed in violation of the Truth In Lending Act ;, and The Texas Deceptive Practices Act would be instituted against Capital One Bank and its subsidiaries, for clear violation of state and federal banking laws. XXXX XXXX and XXXX XXXX both submit that, the bank has failed to comply with state and federal banking laws. Because of these actions and/or inactions, the proposed Plaintiffs have been subjected to their personal credit reports incorrectly reporting their true credit worthiness to other financial institutions. XXXX XXXX and XXXX XXXX make a formal request to correct this erroneous information, and that damages be awarded under state and federal law for these intentional acts.

Complaint: On XX/XX/XXXX I had an automatic withdraw to pay rent at XXXX XXXX in Washington DC through my Capital One 360 account. I was sent an alert from Capital One on XX/XX/XXXX that my check for {$2300.00} was declined, a full day after the check was officially declined. This was after I had over {$3700.00} across savings and checking in my Capital One 360 account. They also take a longer time to clear checks than any other bank I have used in the past. I was contacted by the management company of the apartment that my check was canceled and that I would owe a {$100.00} fee for the declined check. Capital One has free balance transfers between checking and savings and a one day grace period for inssuficient account funds that I was expecting based on signing up for my account. What is not clear is that you are not automatically enrolled in free services like most other banks. There is also no way to enroll in these services through the app where Capital One pushes you to conduct most of the account business. They make it difficult to sign up for these services in a way where they almost don't want customers to have the benefits that they offer for free. I never received an email about signing up. Even the email that stated that I did not have sufficient funds, which is not true, did not mention the free services offered. Capital One makes it difficult to know about the free services so fees can openly be charged.

Complaint: On XX/XX/XXXX a check in the amount of {$35.00} was presented as an EFT to my Capital One 360 Checking Account from XXXX. This charge was unauthorized. The history behind the transaction is that I previously held a XXXX Checking and Checking Plus ( credit line ) account for nearly ten years. Due to a dispute with XXXX, I closed out both accounts in XX/XX/XXXX and made regular monthly payments, scheduled to be deducted on the XXXX of every month to pay off the Checking Plus balance. On XX/XX/XXXX, I made the final payment on the account in person at a XXXX branch, bringing the balance to {$0.00}. I followed up on that transaction by calling XXXX to ensure that there would be no further deductions from my account. I was assured that there would not be and was advised that it was not possible for their system to initiate because there was a {$0.00} balance. I accepted this as factual. Despite being assured there would be no further deductions, on XX/XX/XXXX, XXXX sent another EFT for {$35.00} to my Capital One 360 account. After contacting XXXX, I called Capital One to file a dispute. I provided the relevant information regarding the history of the charge and let the representative know that XXXX stated that they would be sending me a check for the deducted amount. My true concern, however, was ceasing any further deductions by XXXX. I was told by the Capital One representative that there was no 'real ' way to block XXXX from the account ( not accurate ) because they were using an EFT and the 'numbers could change ' with each initiation. The representative mentioned that there could have been an adjustment period for XXXX 's system since I made the final payment mid XX/XX/XXXX. This seemed plausible and since XXXX was amenable, I did not move forward with the dispute and a week later, XXXX refunded the charge and also sent a paper check in the amount of {$35.00}. On XX/XX/XXXX, another EFT in the amount of {$35.00} was deducted from my account by XXXX. This time they refused to assist and suggest I file a dispute with my bank. I filed a dispute with Capital One and they refused to investigate the transaction or even reach out to XXXX, stating that it 'appeared ' legitimate. I brought to the attention of XXXX, the security representative at Capital One, that this is not standard practice for an institution to refuse to investigate or to refuse to contact any merchant regarding a disputed transaction and in doing so, they are jeopardizing the security of my account. He responded with defiance and indifference and insisted that they had no obligation to contact XXXX, that was for me to do, and ultimately they will not be following up. He noted that I was more than welcome to close out the account and open another one, however I declined and instead wish to terminate my relationship with Capital One once this matter has been resolved. XXXX eagerly closed two of my savings account and advised me to call back once the pending transactions in the Checking Account were completed and he will close that one out as well.

There was definitely an error on their part. I was never 30 days late.

Which happens on a weekly basis several times per week. Most recently my account has been restricted, and I can not make purchases on the card. Complaint: I rarely use my Capital One card, so when my annual fee was charged to my card I didn't receive an email alerting me to the charge. I did receive an email 30 days later telling me the {$19.00} was past due. I called immediately, paid the amount and explained the situation. Due to the fact that I am an excellent customer, the representative, as a first-time courtesy, said that she would reverse the late charges and report it as a " paid as agreed '' status to the credit report agency. The credit report was never corrected as promised and it has hurt my score substantially and caused two XXXX credit cards to reduce my credit limit substantially. I would like to have this corrected on my credit report.

Complaint: On several occasions i have called Capital One to discuss my credit account. i have never been able to complete a phone call with any representative of the company until today XX/XX/2019. I am usually placed on a hold and my call is then disconnected or when a representative does come on the line they say they are unable to hear me and disconnect the call. I have been unable to use my credit limit when below my credit line. I was able to learn from a representative of the company identified as XXXX that my credit limit had been restricted for missed payments ( missed payments which i do not dispute and have since fully paid the balance ), when i pressed on where information about the restriction could be located in the cardholder agreement i was placed on a fifteen minute hold before the call was disconnected. i then was able to speak with a representative that did transfer me to a supervisor ( XXXX ) to file an internal complaint with Capital One about what i believe to be misconduct and avoidance by the previous representatives.
