Complaint: Hi, I have a very urgent matter once again due to a foreclosure sale on XX/XX/2019. IAM STILL HAVING TROUBLE GETTING A HOLD OF SOMEONE AT THIS COMPANY. EVERY TIME I CALL AND INPUT MY ACCOUNT NUMBER IT GOES STRAIGHT TO VOICEMAIL AND NEVER CONNECTS ME TO ANYONE AT BAYVIEW. This is a very very big problem and issue as I can not speak with anyone and do not have a direct contact to a person. I applied for a loan modification to Bayview Loan Servicing , LLC numerous times before and they always prolong the process. Never gave an offer and never accepted my loan modification. Ever since then I have been trying to get a loan modification and I can not get one from this company. I mailed in my rma packet and all required documentation as per guidelines. Im in a loan modification review as they should have requested documents for a review. From the past Ive had trouble calling Bayview Loan Servicing , LLC to ask about any status or updates for the loan modification and a status on the loan modification I get nowhere. I call in, the phone system asks for my social security number or my loan number, I put in the loan number and or social security number, it rings couple of times and then it goes straight to a common voicemail. It says thank you for calling the underwriting department please leave a message or set up a time to call you back. Ive tried multiple times to set up the call back and never got a callback and the other times their phone system just hung up on me. I would try this couple more times at different times in the day and get the same results. These are the numbers I have called to get in contact with anyone at Bayview Loan Servicing , LLC : XXXX, XXXX, XXXX, XXXX, XXXX, XXXX all and each phone number has the same process. As soon as I input my loan number it seems like their system registers my loan number and does not transfer me to a live person at Bayview Loan Servicing , LLC but transfers me straight to a voicemail. I feel like this is international so that I would not be able to speak with any of the Bayview Loan Servicing , LLC representatives and to prevent me from getting a loan modification. This feels like a very big problem that they do this. I can not speak with anyone regarding my loan thus iam not able to know the status of the loan modification and I can not move forward. In the past I had this issue as well and it has not been addressed. In the past this has happened multiple times on multiple days and each one does this until I clicked the number 0 for a very long and tedious process I finally got someone. But now it does not work and it goes straight to a voicemail which even after leaving voicemails to be called back I never get any call backs. If Im not mistaken Bayview Loan Servicing , LLC is in violation of my Homeowner Bill of Rights. Seems like they do not want to help me but to just sell my home.

Complaint: Since XX/XX/XXXX asking mortgage company ( Bayview Loan Servicing ) to remove PMI. Finally in April, it was determined that we qualify. Bayview had home appraisal done on XX/XX/XXXX. On XX/XX/XXXX sent letter of denial to remove PMI as the valuation report indicates that our home value depreciated. In addition, Bayview conducted an analysis of escrow and taxes and increased our monthly payment by {$55.00}. To date we have not received a copy of the appraisal report. Complaint: Dear CFPB, This is my recollection of events as I tried to work with Bayview Mortgage upon the death of my mother and the management of her estate. Following the passing of my mother, we proceeded to follow through with managing her estate and filing any necessary paperwork. As I had been living in the XXXX, XXXX and XXXX home with her over the course of her demise, my husband took on much of the administrative work. One of the first things we did together was hire a probate attorney out of XXXX, TX. He advised us to continue paying on the mortgage and informed us that our home might also qualify as a Texas XXXX since I was the only heir living in the residence at the time of mom 's passing. He also told us to keep paying on the mortgage in her name, and we did. We payed on the home all of XXXX and into XXXX of XXXX. Without notification or correspondence, we were locked out of the mortgage portal that my husband had been using to pay the mortgage. XXXX XXXX was no longer allowing my husband access and he was prevented from paying ( he was not on the estate ). Our mortgage was current at the time. We built the home 14 years ago and have lived in the home, paying the mortgage on time for 14 years. My husband called the mortgage company ( XXXX XXXX XXXX ) and they said they had sold our mortgage to Bayview. We informed XXXX XXXX XXXX that we were in probate, and she apologized to us saying something to the effect of the right hand not knowing what the left hand was doing at her company, implying that it was a mistake. She told us payment was not due on the mortgage during probate and also not due because the loan was not in my name. ( We have since learned that both were false ). We stopped paying as instructed, and anticipated that Bayview would allow us to assume the mortgage and restart payments. She also told us to send the Probate Court Orders, Death Certificate and other documents to Bayview since XXXX XXXX no longer owned the note. Under the instructions of our attorney, we thought we could assume the mortgage while we were still in probate, so it was a surprise that they sold it. The first time we talked to Bayview was on or around XX/XX/XXXX, they said they couldnt talk to me. This is where we started encountering real problems as Bayview would not allow me to speak with them, claiming I was not authorized to speak with them regarding the account. We spoke with a woman named XXXX and sent all of our documents ( Probate Court Order, Death Certificate, Oath of Independent Executor, and Letters of Testamentary ( this according to the stated document needs in their flyer ) to her, including a letter of authorization for my husband to speak to them on my behalf. The Letters Testamentary should have been enough as it its the court order stating there was a will, that I am the Sole Heir and Inheritor, and that I am the Executor of the Estate and able to speak with them about this property. Meanwhile, my husband became very ill during the early months of XXXX. He was hospitalized for a week starting XX/XX/XXXX. He had been mistreated by previous doctors and had developed XXXX. His XXXX XXXX was shutting down and I was told he had the worst XXXX the physician had seen. They also told be if we had brought him in two days later, he would have not survived. It took my husband several months to recover. This is the reason for our slowness in follow-up. We expected Bayview to contact us ( as XXXX said she would ) about assuming the mortgage and for me to be authorized to talk to them. Later, my husband recontacted XXXX around XX/XX/XXXX. She said they had lost the documents and asked for them to be resent, which we did. We were waiting for them to contact us again regarding assuming the mortgage. During this time we were receiving documents calling our whole mortgage due, around $ XXXX. We also had several conversations with their debt collectors who called often. We attempted to explain our situation to them but we're met with frustration. My husband became sick again and was taken to the Emergency Room XX/XX/XXXX after two months of an unknown illness. Then a month ago, we recontacted Bayview and they said had lost the documents again. We sent them and included the sent email with the attachments from the first time we had sent the document to XXXX in XXXX, demonstrating our previous attempts to supply these needed documents. We did receive documents informing us of a court date from Bayview 's lawyers. The documents stated that the court may decide on a default judgment if we do not appear in court. We looked at the date when we got the documents and the Court Date had already passed three weeks before we had received the certified letters. I called Loss Mitigation department twice, once on XX/XX/XXXX and was on hold for two hours and fifteen minutes, then another time on hold for one hour. I finally got through. I talked with a man who, after pulling up and reviewing my file, was surprised to hear that my mom was deceased and that we were in Probate. He said that this is why the house had gone straight through to foreclosure, indicating that if they had received documents, it might not have, or at least at a slower pace ( but we had already sent them twice. ) I re-sent, again, the documents to Bayview this time to ( XXXX ). I was told to include ; Proof of Death ( thats what the Letters Testamentary does ), court orders ( thats what the Letters Testamentary also does ) and Mom 's Will and any proof of my rights to the property ( Again, thats what the Letters Testamentary proves ). We were also told to wait 3 to 5 days for the information to propagate their system. When I called back I was transferred to a different department and spoke with XXXX ( I have reason to believe she did not give her real name ). She also said she could not talk to me, that authorization had not happened. I asked if they had received our documents, and she said " no '' ( that would be the third time Bayview lost them ), then said she saw something with my name, then said again " I am not allowed to talk to you. '' She said that they had looked into authorizing me but that they were missing documents from me. I asked what those documents were, stating that I would send them immediately that day. She said that she could not tell me what documents were needed. So I restated, You need documents from me but you cant tell me what they are? She said, Yes. How am I suppose to know what the documents are that you need? Am I suppose to guess? I asked nicely. She became very angry with me and said No!! Youre not suppose to guess! But still she would not tell me what documents they claim they needed. She said that she was going to send an email to XXXX and open up a task bar. She said XXXX would be calling me in 3-5 days. I have not heard from XXXX. Meanwhile, we have heard from their lawyers pressing us into foreclosure even though we are in an inherited homestead and still in probate. Our court date for Forclosure is XX/XX/XXXX and our house is to be sold on the courthouse steps. I am responsible for the estate, but neither I, nor my husband are on the Note, as only my mom took out the loan to begin with. How are we to resolve our issues with Bayview, either through Mortgage Assumption, LossMitigation or Estate Home Sale, if we can not get them to speak with us. Complaint: My name is XXXX XXXX XXXX and on the second of XXXX I was driving home and was hit by a drunk driver. I was in the hospital until Saturday the XXXX of XXXX with a concussion, XXXX XXXX XXXX, and other issues. I was late with the mortgage payment but made it on the XXXX of XXXX trying to catch up. Today on XXXX XXXX I called to nicely ask to have the XXXX late fee waived and was told that they could not do this. Also Bayview has changed the amount of the payments they seem to ask what they want since XX/XX/2018 and they just seem to be doing whatever they can get away with. Since I have filed complaints with you before and caught them lying an other issues why has the Federal Government not taken control of this company. We have a contract for a set mortgage payment and bayview keeps breaking the contract and raising the payment.

Complaint: Please make this a rush as I have a sale scheduled for my property on XX/XX/XXXX and Im under a loan modification review. Hi, my name is XXXX XXXX. I keep sending over a full Request for Mortgage Assistance request and time after time I have sent a request and they still keep posting my property up for sale and to this day have not offered a loan modification. Im always in review. I again recently sent over all documents and Bayview Loan Servicing said that Im in review. I have some very bad issues going on right now with my servicer BAYVIEW LOAN SERVICING and about my previous banks. I'm having a very hard time dealing and working with my servicer BAYVIEW LOAN SERVICING. I have mailed and faxed over all documents for a loan modification but they are still proceeding with the foreclosure sale scheduled for XX/XX/XXXX If they proceed with the sale they will be in violation of the CALIFORNIA HOMEOWNERS BILL OF RIGHTS and other laws as well. As part of this bailout, on XX/XX/XXXX, the United States Government took over XXXX XXXX and pumped billions, which in XX/XX/XXXX, then Treasury Secretary XXXX XXXX said as much as {$200.00} XXXX would be pumped into XXXX XXXX and XXXX XXXX, each, which was separate from the {$700.00} in TARP funds given out to other lenders. 1. The guidelines issued by the United States Treasury set forth a detailed process whereby a participating servicer, either action or not acting through its subsidiary, must : a. identify loans that are subject to modification under the HAMP program, both through its own review and in response to requests for modification from individual homeowners ; b. collect financial and other personal information from the homeowners to evaluate whether the homeowner is eligible for a loan modification under HAMP ; c. institute a modified loan with a reduced payment amount as per a mandated formula, that is effective for a three-month trial period for borrowers that are eligible for a modification ; and d. provide a permanently modified loan to those homeowners who comply with the requirements during the trial period. Whether the homeowner qualifies for a modification or not, participating servicers are also required to provide written notices to every mortgage borrower that has been evaluated for a loan modification, whether or not the borrower has been found eligible. HAMP and its associated directives also set prohibitions against certain conduct including demanding upfront payments in order to be evaluated for a loan modification, instituting or continuing foreclosures while a borrower is being evaluated for a loan modification, assigning a single point of contact, maintaining an adequate level communication with borrowers, maintaining proper caseload to ensure HAMP objections are met, and restrictions on the way a servicer may report the borrower to credit reporting agencies. All servicers have systematically failed to comply with the terms of the HAMP directives and has regularly and repeatedly violated several of its prohibitions. Now that HAMP is over and expired due to servicers prolonging these modifications they are now proceeding with other alternatives. Under HAMP, the federal government incentivizes participating servicers to make adjustments to existing mortgage obligations in order to make the monthly payments more affordable. Servicers receive at least {$1000.00} for each HAMP modification. However, this incentive is countered by a number of financial factors that make it more profitable for a mortgage servicer avoid modification and to continue to keep a mortgage in a state of default or distress and to push loans toward foreclosure. This is especially true in cases where the mortgage is owned by a third-party investor and is merely serviced by the servicer. However, this incentive is countered by a number of financial factors that make it more profitable for a mortgage servicer such Bayview Loan Servicing , LLC to avoid modification and to continue to keep a mortgage in a state of default or distress and to push loans toward foreclosure. This is especially true in cases where the mortgage is owned by a third-party investor and is merely serviced by Service companies because Service companies do not carry a significant risk of loss in the event of foreclosure. California Business and Professions Code 17200 et seq., also known as the California Unfair Competition Law ( UCL ), prohibits acts of unfair competition, including any unlawful, unfair, or deceptive business act or practice as well as unfair, deceptive, untrue or misleading advertising. Bayview Loan Servicing , LLC and all other previous servicers and their Investors conduct was unlawful in that : They illegally began and prosecuted the non-judicial foreclosure based on the lien to the 1st Deed of Trust, despite i was not in breach of payments on said lien ; They engaged in the uniform practice of requesting unnecessary documentation, seeking repetitive submissions of the same documents, and never rendering a decision, and in doing so, such activity provides the basis for an unfair inquiry and could deceive the public because it places burdensome requirements on me that served no purpose but to provide a basis for either engaging in Dual Tracking by selling my home and by denying loss mitigation options, such as loan modifications ; They failed to properly consider loan modification applications before trying to sell my home. 1. On information and belief, Bayview Loan Servicing , LLC does not own a significant majority of the loans on which it functions as servicer. 2. Economic Factors that discourage Bayview Loan Servicing , LLC from meeting its obligations under HAMP by facilitating loan modifications include the following : a. Bayview Loan Servicing , LLC may be required to repurchase loans from the investor in order to permanently modify the loan. This presents a substantial cost and loss of revenue that can be avoided by keeping the loan in a state of temporary modification or lingering default. b. The monthly service fee that Bayview Loan Servicing , LLC, as the servicer, collects as to each loan it services in a pool of loans, is calculated as a fixed percentage of the unpaid principal balance of the loans in the pool. Consequently, the modifying of a loan to reduce the principal balance results in a lower monthly fee to the servicer. c. Fees that Bayview Loan Servicing , LLC charges borrowers that are in default constitute a significant source of revenue to it. Aside from income Bayview Loan Servicing , LLC directly receives, late fees and process management fees are often added to the principal loan amount thereby increasing the unpaid balance in a pool of loans and increasing the amount of the servicers monthly service fee. d. Entering into a permanent modification will often delay a servicers ability to recover advances it is required to make to investors of the unpaid principal and interest payment of a non-performing loan. The servicers right to recover expenses from an investor in a loan modification, rather than a foreclosure, is often less clear and less generous. e. Fixed overhead costs involved in successfully performing loan modifications involve up-front costs to the servicer for additional staffing, physical infrastructure, and expenses such as property valuation, credit reports and financing costs. 3. Rather than allocating adequate resources and working diligently to reduce the number of loans in danger of default by establishing permanent modifications, Bayview Loan Servicing , LLC has serially strung out, delayed, and otherwise hindered the modification processes that it contractually undertook to facilitate when it accepted billions of dollars from the United States. Bayview Loan Servicing , LLC delay and obstruction tactics have taken various forms with the common result that my loan serviced by Bayview Loan Servicing , LLC, in which im eligible for permanent loan modifications, and have met the requirements for participation in HAMP, have not received permanent loan modifications to which iam entitled. 4. By failing to comply with the California Homeowner Bill of Rights ; specifically, by engaging in the unlawful practice of Dual Tracking, Bayview Loan Servicing , LLC has left me in a state of despair and panic as I seek a loan modification from Bayview Loan Servicing , LLC only to have my home wrongfully, oppressively and illegally sold out from under my feet. I have sent them all documents but they still have not offered me anything. I have sent them documents again. They said they have all required documentation on file and am in review but still posted the home for sale. I do not know how much more times they will continue to do this. The stress this causes me and my family is very hard on my body. I want to keep my home and pay a reasonable amount. I have a sale coming up on XX/XX/XXXX.

Complaint: This complaint is to request CPFB to enforce RESPA on the following Servicers/owners : Bayview Loan Services, XXXX XXXX, XXXX XXXX and XXXX XXXX XXXX XXXX that have been appearing one after another in the case explained here below. On XX/XX/XXXX Bayview Loan Servicing filed an unsupported foreclosure on XXXX XXXX Courthouse case # XXXX XXXX against my home, claiming amounts out of the permanent modification agreement signed on XXXX at the XXXX XXXX Society of XXXX XXXX, the same entity that on XX/XX/XXXX did proof in Court that I was current in my payments according to the permanent modification agreement ; XXXX XXXX repeatedly scheduled on XXXX a non-jury trial motion to dismiss with the Judge that was delayed and opposed by Bayview LS. Many unnecessary delays have kept the unsupported foreclosure going on for 21 months now and with the appearance of 3 more new Servicers/owners in the case. A phone conciliation conference was finally scheduled but cancelled twice, I was told to give way to the settlement. On XX/XX/XXXX the new and fourth servicer/owner appeared : XXXX XXXX XXXX XXXX ; this company made the attempt several times for me to sign a new hardship modification package that I refused as it is obviously out of order ; then on XX/XX/XXXX I was informed of a settlement to deduct about {$10000.00} from the loan amount, cover lawyer fees and reinstate the payment according to the permanent modification agreement ; but it was astonishing to realize they were increasing the balance amount of the loan in {$20000.00} more, what of course I did not accept. The last communication through XXXX XXXX from XXXX XXXX dated XX/XX/XXXX, was to send again a new hardship modification package to be signed, what of course I refused. I guess XXXX XXXX is under a lot of pressure from this block of entities created to try to crush the system. I am out of debt and I always honor my payments on time but this situation did low my credit score to the incredible number of XXXX. I just sent again to XXXX XXXX XXXX the full payments accumulated that they sent back as well as the payment of XXXX. Because I dont see an end to this negotiation is that I humbly ask you to enforce Respa on these 4 servicers/owners. They are abusing me because I am a defenseless XXXX XXXX XXXX XXXX that will turn XXXX next XXXX, and which health has XXXX with this underserved and heavy attack. I thank you in advance for your consideration and all help you can provide that it can be an example in the future of the consequences of forged scams.

Complaint: I have requested the details for the mortgage amount we owe. Bayview Financial sent me a computer generated mortgage payoff letter. Bayview did not provide the detail I requested but sent me a canned letter which is inaccurate. Bayview did not provide the detail for the ( Escrow / Impound Account. ) There is no way of knowing what makes up this amount. In addition Bayview does not provide the detail for the ( Escrow Shortage Account ) in the payoff letter. The only amounts in escrow for our mortgage should be my property insurance and property taxes. Bayview will not provide any detail so I can not determine if their amounts and calculation for these accounts are accurate. Bayview has not verified these amounts and the amount of payoff in their letter is incorrect. After reviewing my property tax records the records show that Bayview has made a serious error and double paid the property taxes which has contributed to the incorrect amounts in the ( Escrow / Impound and Escrow Shortage Accounts ). Bayview has raised my monthly payment substantially with no explanation based on this false and incorrect information resulting from their mistake. It is likely this was also the case with XXXX XXXX which preceded Bayview as the loan servicer of our mortgage.. I feel strongly that Bayview is ignoring us and treating us unfairly because we are seniors and a minority.

Complaint: As of XX/XX/2018, we have made 3 requests via phone to Bayview to cancel PMI. Each time we were told that we qualify and to send request in writing. Each request in writing returned denials. EarlyXX/XX/XXXX, we submitted another request with copy of deed. Two weeks later Bayview responded that we qualify and to complete an affidavit of no lien in addition to an authorization for an appraisal. Appraisal completed on XX/XX/XXXX. XX/XX/XXXX letter from Bayview stating that the value of our home has decreased and a copy of the valuation report is enclosed. There was no valuation report enclosed. Called two times yesterday around XXXX XXXX and spoke first to XXXX and then XXXX XXXX. No one could locate copy of valuation report. XXXX reached out to XXXX, her supervisor for assistance and still to no avail. Bayview is not transparent. As of today XX/XX/XXXX still no copy of appraisal. Instead on XX/XX/XXXX Bayview performed an Escrow Analysis and determined that there will be a shortage in the escrow account and has increased our monthly mortgage payment by {$55.00}. This analysis is normally done in XX/XX/XXXX or XX/XX/XXXX.

Complaint: In XX/XX/2019 I applied for a mortgage modification due to storm damage and negative equity ( the mortgage is {$170000.00} and the accessed value is {$74000.00} ). I have been unable to rent the property to cover the mortgage amount due to the falling values of property in my area. I requested an exception for a forth modification but it was denied. A principle reduction and modification would enable me to keep the home I have had for 25 years.
