Complaint: In XX/XX/XXXX my wife and I applied to Bayview Loan Servicing for a mortgage modification based on hardship. The modification was denied. In XX/XX/XXXX we ask that the modification be reconsidered.. In addition to the reconsideration I asked for a breakdown of the amount past due because my records did not agree with the past due amount indicated by Bayview.. To date we have received no response from Bayview regarding our request Also Bayview has increased my monthly mortgage payment without explaining the increase. Our monthly mortgage payment has gone up approximately {$200.00} a month from the original mortgage agreement. XXXX XXXX was the original servicer of our mortgage and I was working with them on the correct past due amount and an increase in the monthly mortgage payment until Bayview took over the servicing of our mortgage in XX/XX/XXXX. After Bayview took over the servicing XXXX would not provide any further information concerning our mortgage. In summary I am asking for the following. 1. A detail breakdown of the amount past due 2. An explanation and detail breakdown on the monthly mortgage increases 3. A reconsideration of our loan modification request

Complaint: Late fees and other charges are being assessed incorrectly. XXXX, XXXX, and now Bayview Loan Servicing have fraudulently imposed late fees, and other charges since this loan first transferred from XXXX XXXX XXXX to XXXX, to XXXX, now Bayview. An original complaint had been filed against XXXX and they immediately transferred said loan to XXXX. After several months of trying to resolve this issue with XXXX, it was reported to cfpb. It was only then that XXXX responded and waived said charges, but within the same timeframe, the loan had already been transferred to Bayview. Please Note Notice of servicing transfer from XXXX, dated XX/XX/XXXX ( hence, the same time-frame XXXX was investigating said allegations of imposing late fees and other fees ), had not been received. It wasnt until we begin to receive letters from Bayview that concerned us greatly. I contacted XXXX to confirm servicing transfer, they concurred. I asked for a notice in writing. This is when I received notice of servicing transfer, which was ; late XXXX, early XXXX. Yet, Bayview imposed additional late fees. Most recently, I requested a detailed account history from Bayview Loan ; it was received XX/XX/XXXX. There are transactions that late fees in the amount of {$1400.00} were waived/assess on XX/XX/XXXX. However, Bayview continues to impose these same charges ( I tried to upload document ; it was only 3 pages long, but your system would not allow me to ... .stating it was too large ). SYNOPSIS : XX/XX/XXXX XXXX statement indicating late fee balance in the amount of {$1900.00}, corporate advance balance in the amount of {$330.00}. XX/XX/XXXX XXXX letter of explanation related to a fee in the amount of {$330.00} ( It was still unclear, and it didnt make sense, so I pursued it further ). XX/XX/XXXX XXXX statement indicating late fee balance in the amount of {$2000.00}, deferred balance in the amount of {$74.00}, corporate advance balance in the amount of {$87.00}, and unpaid fund balance in the amount of {$2000.00}. XX/XX/XXXX XXXX notice of explanation of unexplained charges ( late fees and corporate advance fees ). This notice from XXXX was only after two complaints were submitted to the Consumer Financial Protection Bureau ( CFPB ) related to unclaimed charges, late fees, and other fees. Corrections were made, and only {$370.00} corporate advance was to remain. XX/XX/XXXX XXXX notice of servicing transfer effective XX/XX/XXXX with Bayview Loan Servicing. However, as mentioned earlier, it was not received until late XXXX, early XXXX. XX/XX/XXXX Bayview statement indicates a late charge assessed in the amount of {$1400.00} and Rec Corp advance in the amount of {$330.00}, and escrow balance in the amount of {$2800.00}. XX/XX/XXXX XXXX letter response to cfpb complaint ; provided history related to servicing mortgage loan, beginning XX/XX/XXXX through XX/XX/XXXX. XX/XX/XXXX XXXX letter response to cfpb complaint to remove late fee reporting of our account from XXXX to XXXX. XX/XX/XXXX Bayview statement indicates a late charge assessed in the amount of {$1400.00}, Rec Corp advance in the amount of {$340.00}, and escrow balance in the amount of {$830.00}. XX/XX/XXXX Bayview account history, beginning XX/XX/XXXX to XX/XX/XXXX ( please note ; XXXX transferred mortgage servicing to Bayview effective XX/XX/XXXX ) XX/XX/XXXX Bayview statement indicates late charge balance in the amount of {$1000.00} and NSF balance of {$100.00}. In addition, Bayview has charged {$1500.00} homeowners insurance to our escrow account when I have already faxed/emailed documents requested. XXXX XXXX insurance agent has also provided what has been requested several times, dating back to back to XXXX ( when homeowners insurance was transferred ). We requested that no escrow fees be assessed for homeowners insurance as it is being debited from our checking account and paid directly to XXXX XXXX.

Complaint: I am a victim of XXXX deceptive lending practices and a fraudulent foreclosure committed by XXXX XXXX XXXX XXXX XXXX who operates a massive money laundering mill with fraudulent foreclosures based on false statements and forged documents claiming to be a " Trustee '' for a non-existing REMIC Trust XXXX XXXX. On XX/XX/XXXX we purchased a mortgage from XXXX XXXX XXXX XXXX ( XXXX ), a Company who was purportedly " organized and EXISTED '' under the laws of New York. We later learned that these statements were lies and deception since XXXX XXXX XXXX XXXX in XXXX was a non-existing corporation which never was organized under laws of New York ( or any other State ). See the record from NY Secretary of State which shows only ONE XXXX registered under laws of New York, a fraudulent XXXX filed in XXXX by con artists. According to SEC filings, XXXX was never a subsidiary of XXXX either. Thus, this loan was originally fraudulent and non-enforceable. In XXXX XXXX was accrued by XXXX XXXX XXXX who was purportedly a " Servicer '' for this Trust and our loan from XXXX to XXXX. According to SEC respond to my FOIA, Trust XXXX XXXX XXXX is a non-existing legal entity, which was never formed, never had any mortgages transferred into this Trust, never had any SEC filings and never had even a bank account. In fact, XXXX XXXX is a part of XXXX XXXX XXXX XXXXXXXX 's massive Ponzi scam based on borrower 's identity thefts and sales of unregulated US securities. It is not a secret that XXXX XXXX XXXX XXXX operates a massive Ponzi Scam in US Courts and illegal trading of void US securities ( aka XXXX non-existing REMIC Trusts mortgages ) where XXXX XXXX XXXX XXXX, acting as a fake Plaintiff for a fictitious Trust, obstructs justice to illegally foreclose on people like myself while banks received enormous profits, at least $ XXXX XXXX from each $ XXXX home by secretly reselling the same loan multiply times without any disclosures to the homeowners or sharing any benefits from trades - plus get the free house and proceeds from the sale. The entire scheme depends completely on concealing the fact that the loan is the cornerstone of a much larger fraudulent scheme wherein the players are going to make money in multiples of the amount loaned. In fact, borrowers, like myself, who signed papers were in fact unknowingly issuing unregulated securities for the sole benefit of investment banks. A foreclosure initiated by a servicer or Trustee fails to comply with applicable law since none of them have the right to enforce the debt. ALL of them have received a benefit and some of them have received a windfall derived from trading on the borrowers signature on the note and mortgage in an amount far exceeding the principal amount loaned. And those benefits or trading profits were derived strictly because they were trading on the signature of the borrower, together with the borrowers name and reputation, without disclosure to the borrower of compensation to be received arising from the origination of the loan and without consent from the borrower to trade on his/her name. Both, XXXX XXXX XXXX ( fake Trustee ) and XXXX XXXX XXXX ( defunct Servicer of non-existing Trust '' ) are perfectly aware that XXXX, who only serves its members, can not accept any assignments from XXXX XXXX XXXX XXXX since this corporation never existed ; and can not transfer any rights to any third parties. Yes, in XXXX XXXX purportedly " assigned '' its " rights '' to XXXX XXXX XXXX via robo-signed Assignment. On XX/XX/XXXX XXXX XXXX XXXX XXXX hired a law Firm XXXX XXXX who submitted a foreclosure case XXXX where the purported " Servicer '' Bayview Loan Servicing LLC tried to enforce my mortgage with XXXX. When my attorneys requested a validation of their rights to enforce, particularly copies of all SEC documents and assignments from XXXX and XXXX, Bayview and their lawyers refused to provide claiming that these documents are " irrelevant '' - while in fact they never existed. Most recently Bayview Loan Servicing Litigation Manager XXXX XXXX filed a Sworn Affidavit where he claimed that Bayview, acting in capacity as a Mortgagee for my loan, and that XXXX is personally familiar with all documents pertaining to my loan. In other words, XXXX intentionally submitted false statements to the Court about Bayview status since he knew or had a reason to know that neither XXXX or XXXX never existed.

Complaint: Mother passed away in XXXX. She had a house with a mortgage from XXXX. There was a will, I, her only child was to inherit the house ( and mortgage ). I began making payments. No lapse. Then, about 5 years ago the loan was sold to Bayview Loan Servicing LLC. To clarify, I do not live in the house my Uncle does. Since my moms death, all mortgage correspondence came to my home address where I now reside. After the loan was sold, I noticed my name dropped off the bill and when I called to see why I was informed that I appear nowhere and they cant give me any info on the loan. Over three years, I submitted copies of the Will, the Short Certificate of Death and the estate information. It doesn't take. In XXXX they sent an oddly addressed letter to my moms house ( never did that before ) demanding officially for information. I yet again submitted the documents in XXXX. Now, another letter has come to my moms house stating that the documents were insufficient and the foreclosure process will begin. I called today ( XX/XX/XXXX ) and after 45 minutes no one could tell me WHAT OTHER documents they required and could not answer my question. Instead I was told to write a letter in dispute that would then be reviewed by their legal dept and THEN they could let me know what more is needed. Ha. Will I have my house by then? Important to note : I pay extra on my mortgage every month which went to principal ... since XXXX took over, the are holding my extra money in a " suspense '' account! Of course, they can't do anything to change that because I'm not on the loan. This mortgage has a balance of about {$6000.00}. Also, discovered my mom 's deed is not in my name despite the estate set up and Will. I am on that and getting a lawyer to complete the transfer as I write this. I just feel like this company is really trying everything they can to get my childhood home! It's been absolutely unbelievable to deal with. Very shady practices indeed!

Complaint: My home was hit by hurricane Irma XX/XX/2017. I live in XXXX XXXX, Florida. The hurricane damage required me to repair my air conditioning which I could not afford. My mortgage company at the time was XXXX and I called and was offered three months of a forebearance to get back on my feet after the storm. I accepted as this allowed me to repair my air conditioner and fencing that had been knocked down. When three months were I called XXXX to make my XX/XX/XXXX payment and was told they would only accept {$3800.00} and I could not pay one month. I did not have that money as it was spent to repair damages from the hurricane. My loan was then transferred to Bayview and I applied for a modification to put the past due on the end of the mortgage and start making payments again. Bayview denied the modification, refused to accept less than all payments due and filed foreclosure. I have appealed Bayview 's decision to not offer me a modification and their response is that the investor is XXXX XXXX XXXX and I have exceeded the allowable number of modifications. I feel as though I would not be in this position had I not been offered the forebearance to " help me '' after the storm. I am afraid of losing my home because of hurricane Irma. I was current and my first missed payment was XX/XX/2017 after the storm. Thank you.

Complaint: I purchased my home in XX/XX/XXXX. When I purchased my home, I had a thriving career earning approximately $ XXXX per year. In XX/XX/XXXX, I lost my job and was unable to obtain a new one for quite some time ( about a year and a half ). As a result, I made the difficult decision to file a Chapter XXXX Bankruptcy in XX/XX/XXXX. I received notice that my mortgage was being sold to Bayview Loan Servicing in XX/XX/XXXX. Prior to my hearing, I opted not to pay my mortgage because I was unsure if the trustee would allow me to stay in my home. Once I found out that I could stay, I was unable to correspond with Bayview until my case was discharged. Once my bankruptcy was discharged in XX/XX/XXXX, I reached out to see what my options were for mortgage assistance. After submitting the necessary documentation to prove that my bankruptcy was discharged, I was able to submit my hardship application in XX/XX/XXXX. Bayview assigned me a representative to assist and work directly with me during this process. I explained further my situation, and what that I wanted to stay in my home. She explained to me that the only option they could offer me was a loan modification which only decreased my payment by $ XXXX {$150.00}. I asked if there was anything else that could be done to help, but because I had only been in my home for 4 years, that was the best that they could do. With this modification plan, I was to make 3 consecutive monthly payments ( XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX ) of the new payment as a trial, and then my loan/account would be in good standing. Luckily, I had just taken money from my reserves and was able to make these payments. Since then, I haven't been able to keep up with the payments as I am still experiencing financial hardship. I submitted another request for assistance on XX/XX/XXXX. I was again assigned a representative to assist me. This time, they told me that my application was denied because I had defaulted on my modification. Their only solution was to offer me a repayment plan where I would pay a large down payment and then pay increased mortgage payments over time. These figures were provided towards the middle to end of XX/XX/XXXX, would be due on XX/XX/XXXX, and that payment would cover XX/XX/XXXX. During the time that I had been actively corresponding with my representative from Bayview regarding my options, I also receive my Notice of Foreclosure with a sale date of XX/XX/XXXX. After they denied my modification, I decided it best for me to go ahead and put the property on the market. When I spoke to my representative during the last week of XX/XX/XXXX, I explained to him that I planned to sell but wanted to do the repayment plan through the end of XX/XX/XXXX instead of the end of AXX/XX/XXXX. I told him that this would give me enough time to actually get the property sold. Plus, since a family member had agreed to take out a loan to pay the repayment down payment, I wanted to give them as much time as possible. I told him I would call back during the next week, which would have been the first week of XX/XX/XXXX, to get the figures for the down payment for the repayment plan through the end of XX/XX/XXXX. He followed up with me one last time, and I told him the same thing. But he also asked me something about whether I accepted the plan through XX/XX/XXXX that he proposed ( I guess that's where they documented that I refused the payment plan option ). Well, he ( or someone else ) closed my case, and I didn't know it. When I called back on XX/XX/XXXX, I was not routed to the person I had been speaking with. I told this person that I was calling to obtain figures for a repayment plan for XX/XX/XXXX. He told me that he could not provide this because my previous hardship application was about to expire ( it expires 60 days from submission which was XX/XX/XXXX ). He urged me to submit the application as soon as possible because we are very close to my sale date, but he also assured me that we still had time. He advised me to call back on Friday, XX/XX/XXXX because my application would take about 48 hours to process. I submitted another hardship application that same day, XX/XX/XXXX, and called back on Friday, XX/XX/XXXX, to follow up as instructed. When I called back that Friday, they told me that my application was denied and that they could not assist me any further because I was too close to my sale date. They needed at least 37 days to process any requests like this. I explained the conversation that I had with the representative just a few days before where he assured me that there was time and that they could assist me. They just responded that they sent me a letter stating what she explained to me over the phone. All I could do was cry and ask for the reinstatement amount and the payoff balance to see if I could possibly work out another alternative. I know these companies ( mortgage companies ) are out to make money, but I truly wish Bayview would have communicated differently. I wish they would have told me when we were discussing my doing the repayment plan that they would not be able to provide me with a repayment plan option through the end of XX/XX/XXXX, and that they could not assist me when I called back on XX/XX/XXXX. They were evasive, and though they said my hardship application was about to expire, it had not yet expired. Therefore, they could have provided me with the requested figures. I honestly believe their request for the new hardship application was to buy them some time to ensure that I was out of the window for assistance. Technically, when I called on XX/XX/XXXX, I was outside of the 37 days they claimed they needed to process hardship applications before the foreclosure date ( this would have been 28 days ). However, this was never discussed. He told me to submit my application. Overall, I don't think they've ever truly tried to work with me during my hardship. Lowering a mortgage by only $ XXXX {$150.00} does not really help. They continuously send out these letters saying they are here and want to help, but all of their options say otherwise.

Complaint: XXXX XXXX XXXX is the current Servicer of my mortgage. I purchased my home in XXXX for {$350000.00}. I put {$270000.00} down with a mortgage of {$80000.00}. I have refinanced it to meet my divorce obligations. The last refinance was with XXXX. It was given to Bank XXXX XXXX I learned last week in XXXX. I was on a Trial Period of XXXX with Bank XXXX XXXX They refused to modify the mortgage and added {$200000.00} to my principle while XXXX had added approximately {$50000.00} to the principal balance. I received a package from XXXX stating that they were Servicing my loan. They ignored my 18 months of mortgage payments and added another {$360000.00} to my principal balance as a balloon mortgage that would become payable in 30years. XXXX told me in XXXX that if I didn't sign their mortgage modification that they would foreclose on my home. I believed them because there were many Foreclosures going on. I was unable to pay my mortgage in XX/XX/XXXX and just recently started a new job. Approximately 3 weeks ago I learned that I was being foreclosed upon. I was terribly perplexed because on XX/XX/XXXX, the date on the letter, stated that I should contact them. I contacted them to find out my options. Surely I was afraid to modify my loan again because they might have added a couple more hundred thousands to my principal balance. I asked for a reinstatement balance I just received it yesterday. Meanwhile, they are trying to foreclose on my home and trying to lie about owing interest in land that I purchased besides my home. They have no interest in it at all. My Title states that they don't. The Mortgage doesn't even State the metes and bounds. Quite frankly, this mortgage has kept me uneasy for years. A quiet killer. I could not obtain credit to maintain my home or even get a parent plus loan for my daughters college tuition. It has caused us great harm and embarrassment. How can Banks and Mortgage Companies continue to be allowed to take tremendous advantage of their customers like this. This is extreme predatory lending practices. Also, for them to try to foreclose on property that they have no legal interest adds to the injury. I have to retain an Attorney to try to stop the madness. To have a Bank enter a Judgement of default when they didn't even properly service me is a travesty. I need your help. The people of this Country deserve better. I could be homeless and actually should be nearly finished paying for my home. The legal proceedings in XXXX XXXX, New Jersey should be halted. I shouldn't have to incur legal fees for their abusive behavior.
