Complaint: I am writing to you regarding my loan for hardship for the second time. In XX/XX/XXXX I filled a complaint against my bank who in return told you they would work with me. It was not true once you close the complaint they ask me to fill out a hardship letter for the third time so I did. I faxed it on XX/XX/XXXX & XX/XX/XXXX to the bank. On XX/XX/XXXX I received a foreclosure notice on my house, and yet still today I have not received a denial letter from the bank. I am XXXX years old and have had my house for over 15 years. I would love to keep my house so I hope the bank will help me.

Complaint: We had a second mortgage loan through XXXX where we had automated monthly payments of {$270.00} deducted from our bank account. Our loan was sold to Bayview Loan Servicing without our knowledge. We noticed that our payments had stopped being deducted from our account, and we contacted XXXX. XXXX then told us that our loan had been sold, but we were not given any details. We found out that Bayview now had our loan because we saw it listed on our credit reports. We have been in contact with Bayview regularly via phone over the last 2 years, and our account has been passed around to several different people within the company with no resolution. We were told that Bayview did not usually handle loans like ours, and they were going to try to sell it. Meanwhile, they would not accept payments on the loan, yet they have been reporting to the credit agencies that we have missed 23 monthly payments in the last 2 years. We have no contract, no letters, no statements, and no email correspondence. We have tried to dispute this through the credit report a couple of times, but nothing has been resolved or corrected. Bayview reports that all information is accurate.

Complaint: Bayview Loan servicing L.L.C. XXXX XXXX XXXX XXXX XXXX, XXXX XXXX, FL XXXX Has been discriminating against me for over 5 years now! I recently completed my US Bankruptcy Court Chapter XXXX Bankruptcy, Final month of completion was XX/XX/XXXX, The Bankruptcy was Discharged on XX/XX/XXXX. BLS has completly abused me after they assumed my mortgage XX/XX/XXXX from XXXX XX/XX/XXXX. I have composed an eight page letter, describing in detail, how BLS has been misapplying my monthly payments, holding them " in suspense '' for no valid reason, and thus due to their unorthodox accounting and billing practices, made it appear that I was late in paying, when in fact the exact oppisite is true, I started making payments at least one month early. Many of the statements BLS sends me, are unintellegible, and impossible to figure out what it says.

BLS keeps promising to send me a full accounting of my account, however 3 weeks later I still have nothing from BLS, they are not honoring my requests, falsely reported me to the three credit bureaus that I was late in 2 payments! BLS has sent multiple statements for the same month. I need CFPB 's Help in getting BLS to set the record strait and correct the negative reporting to the three credit bureaus. BLS recently cost me getting a refinance because of their false credit reporting! Please, Please Help! Thank You!

Complaint: I have been in the process of trying to short sale my property to avoid foreclosure. Bayview Loan Servicing out of XXXX has been the company named by mortgage provided to process all necessary documentation to resolve the matter. As of XX/XX/XXXX I sent them the first short sale offer on the property. As of XX/XX/XXXX, I received a letter saying we had completed a full Loss mitigation package and they needed additional information from other parties. From there it has taken many follow up calls during which the Bayview representatives were very difficult to get a hold off, even when we schedule calls with them at their request and identified all email communication as they had required us. They would not show up for calls we scheduled in at least three occasions and when we ( my realtor and or myself ) got a hold of them, they would request the same information, not be informed about prior conversations or current status on the approval of the short sale. I received letters which indicated that while I had completed the package, they could request more information and from there it would take another 30 days to complete. We did not get request for additional information we had not sent before. It took until XX/XX/XXXX, two months after having received noice of complete package to finally hear that the initial offer was not accepted and that the bank was requesting a higher selling price. That info was provided by phone to my realtor, no letter on this. Knowing that the price the requested was higher than what the market was offering, my realtor, at Bayview 's suggestion put together a price challenge package with current market information and also submitted a second offer as the first one by then had expired. That second offer was submitted during the first week of XXXX and after weekly or twice per week calls with Bayview agent, which continued to be difficult to get a hold off and did not actively monitored the progress of the offer approval, as it became evident he was reading and looking for info only when my realtor would contact him, we still do not have an answer on approval. We have now received a third offer, only $ XXXX away from the bank asking price, this is the best one we have got. Upon submitting to Bayview again, we got an message from loan agent that he will be out until XX/XX/XXXX of this year. This is the second agent at loan servicer we are dealing with. When we called today to escalate and demand answers since last agent wil be out for 20 days, we got a new person that requested us to fill form XXXX, which is the initial request for loan modification. That document had been submitted back in XXXX, was acknowledge in writing by Bayview and their letter requested further paperwork to consider the first offer we had submitted. Unreal that new person ( as we escalated case today ) is attempting to take us back to day one, when they have consumed so much time, till the foreclosure deadline on making zero progress for the investor who asked them to " service '' this loan. The foreclosure sale will happen on XX/XX/XXXX, if short sales does not happen before. We have made every possible attempt to follow up and present offers that meet the investor expectations, but we are certainly bound by market conditions. The lowest offer was less than 5 % off from bank asking price, but out biggest problem is Bayview is not moving the approval process appropriately so offers are falling through. In fact Bayview Loan Servicing has been grossly mismanaging the approval process on the short sale, by not providing availability of personel as promised, status of approval, pending items, communication and requesting same information multiple times, where they are creating significant risk of true loss of potential revenue for the third party they represent, loss of revenue for my realtor and my property to go through foreclosure instead of a short sale. Expect you can help us resolve, what I can, without any doubts call the worst services experience I have had in my life, not even considering how much money is at stake here.

First Issue : XX/XX/XXXX I received an alert from XXXX Credit Bureau that Bayview Loan reported a Balance Increase First Mortgage, to {$280000.00}, the previous balance was {$280000.00}.
Second Issue : XXXX, XXXX, XXXX Bayview Loan Servicing - XXXX Mortgage Interest Statement stated the Outstanding Mortgage Principal was {$280000.00} - Principal applied {$2700.00} bringing the balance to {$280000.00} ending Balance.
Third Issue : XX/XX/XXXX Mortgage Statement reports the Principal Balance to be {$280000.00} with Principal & Interest & Escrow total Amount Due {$1000.00}.
XXXX I received a letter from XXXX XXXX XXXX and learned that Bayview Loan Servicing transferred my mortgage to XXXX XXXX XXXX. XXXX XXXX XXXX is reporting a negative escrow shortage of {$200.00} I want a full accounting detail to explain the mortgage increase that Bayview Loan Servicing reported to XXXX Credit Bureau. Complaint: In XX/XX/XXXX I missed 4 mortgage payments due to loss of monetary contribution from my ex-spouse and slow in business revenue from my floral business. I called my lender XXXX XXXX ( now Bayview Service ) to ask for reinstatement but they refused. So in XXXX, I called XXXX XXXX XXXX in XXXX XXXX to help me with loan mod assistance. From XX/XX/XXXX-XX/XX/XXXX I got denied for the loan mods. I then hired XXXX under XXXX XXXX to help me stop foreclosure as well as appeal the loan mods. While we were in loan mods appeal and review, they sent me foreclosure letters with auction sale dates. They violated the law by doing Dual tracking foreclosure. My sale date was in XX/XX/XXXX then postpone to XXXX, then back later to XXXX. It was postpone only because I called them to ask where's all my documents I have sent them. Their excuse was that they can't find them. But that didn't stop them from stopping the sale. They harassed & left me with no choice but to file Chapter XXXX on XX/XX/XXXX. It is still under the court 's review. I don't think I can afford the payments under Chapter XXXX. I am not upside down in my house. There's still equity in my house but Bayview wanted to take my house away without giving me a chance for reinstatement or loan mod. Since my dad is the grantor and he's XXXX yr ( I'm secondary ), I really believe they discriminated against him because they believe he doesn't have much time to " pay back '', so they denied giving us any kind of assistance. They violated the Fair Lending act for discrimination based on age.

Complaint: On 1XX/XX/XXXX, I called and spoke with a Bayview Loan representative regarding a mistake on their escrow analysis letter, dated XX/XX/XXXX. It showed they over paid my property tax bill by {$1700.00}, which caused an incorrect projection of escrow required for XX/XX/XXXX. On XX/XX/XXXX, I forwarded to Bayview the corrected county tax bill of {$2600.00} for their handling and payment, instead they paid {$4300.00}. The Bayview over-payment has also resulted in an incorrect projection of escrow for XX/XX/XXXX causing an increase of future escrow payments of {$110.00} per month for twelve months.
The Bayview representative reviewed my escrow account and found a note that indicated the XXXX XXXX XXXX 's office had returned the over-payment portion in XX/XX/XXXX. Although the escrow account was noted, Bayview had not reapplied the {$1700.00} credit, nor had they informed me of any corrections. The representative suggested I forward Bayview a detailed letter with copies of any supporting documentation in order to make corrections.
On XX/XX/XXXX, I forwarded a letter to Bayview Loan informing them corrections needed to be made on my escrow account. Specifically, I asked they reapply the credit of {$1700.00}, recalculate my escrow payments for XX/XX/XXXX based on the XX/XX/XXXX actual property tax & homeowner 's insurance amounts, apply only the proper escrow cushion amount and to refund the escrow overage that has developed over the last two years. I also informed Bayview they have a fiduciary duty to correct all problems on my non-interest bearing escrow account.
Bayview responded to my escrow complaint letter with a loss mitigation letter dated XX/XX/XXXX concerning delinquency and collection/foreclosure. I again contacted Bayview on XX/XX/XXXX to inform them my loan is paid-to-date and their representative informed me to disregard the loss mitigation letter. I also received a 2nd escrow analysis letter dated XX/XX/XXXX showing no corrections from the prior escrow analysis letter, other than the monthly escrow amount being lowered by {$75.00} with no explanation. I called Bayview on XX/XX/XXXX and the representative informed me that they would get the {$1700.00} applied to my escrow account and issue a new escrow analysis letter. Bayview also sent me an escrow overage check, dated XX/XX/XXXX, in the amount of {$240.00} without an explanation of how they arrived at this figure. I sent the check back to them to be reapplied to my escrow account, until we could resolve the correct amount of escrow overage to be refunded to me. At this point, I felt that I was being harassed by Bayview Loan.
Bayview finally sent me a 3rd escrow analysis dated XX/XX/XXXX pushing the escrow yearly calculation back by one month. This escrow analysis has the proper calculation of my taxes/insurance for XX/XX/XXXX. Please note that Bayview finally showed the tax over-payment as a credit of {$1700.00} on XX/XX/XXXX that was referenced in my XX/XX/XXXX monthly statement. Left to be resolved is the correct amount of escrow cushion that Bayview is allowed by federal law to hold. The new calculated monthly escrow amount is {$640.00} x 12 months through XX/XX/XXXXand equals {$7700.00} for taxes and insurance in XX/XX/XXXX.
Previously, I had informed Bayview that it is my understanding their escrow calculations should include an escrow cushion at 1/6th the yearly escrow amount, which indicates a new escrow cushion of {$1200.00}. However, my escrow balance going into this XX/XX/XXXX yearly calculation is {$5400.00}. Therefore, I believe Bayview Loan is in violation of federal law by withholding my escrow overage amount of {$4100.00}, which should have been forwarded to me within 30 days of their corrected analysis of XX/XX/XXXX. Can you please provide my with some assistance without the need of me having to hire an attorney in this matter. Thank you.

Complaint: XX/XX/XXXX I stopped my ACH w/drawal for my mortgage payment to Bayview Loan Servicing ( my second mortgage company ) because I was offered by them a Forbearance Plan ( in writing on XX/XX/XXXX ) because my property was designated as being in a major disaster area due to Hurricane Irma. I did not apply for this, they gave it to me and stated that during this time I did not need to make any mortgage payments for three months.
XX/XX/XXXX Letter certifying I sent them financial information they requested.
XX/XX/XXXX Announcing that I am pre-approved to " complete a loan modification '' that will lower my monthly payments. I did not ask for this ; this was offered to me.
XX/XX/XXXX Reference delinquent loan. I, at this time, had not been asked to make a payment. In fact, I was advised that my loan was in good standing.
XX/XX/XXXX Acknowledging receipt of my complete Loss Mitigation Application.
XX/XX/XXXX Announcing I am pre-approved to complete a unique loan modification.
XX/XX/XXXX Signed Loan Modification Agreement Prior to Bayview contacting me about the National Disaster Program, my mortgage payment was being submitted timely each month. I did not ask for a modification or any change to my mortgage with Bayview. They offered it to me, and I accepted. I checked my credit report XX/XX/XXXX, and discovered that they had reported to the Credit Bureau that I was past due XX/XX/XXXX and subsequent payments.
XX/XX/XXXX I contacted Bayview about this erroneous reporting to the Credit Report and received a letter stating in part that they were required to report factual data. The information they reported is not factual and is devastating to my credit score. This is very unfair for a business to be able to get away with such shoddy work.
During the time I was dealing with Bayview for this modification, it was next to impossible to make contact with them. Maybe ten percent of the time the phone was actually answered by a human being. I mainly dealt with XXXX XXXX ( XXXX ) ; but would leave a time for him to return the call.
I was a very good customer of Bayview. I paid my mortgage timely, eventhough I know I got a very bad deal from them in the beginning, but I honored my commitment, and they should do the same.

Complaint: The original mortgage was held by XXXX XXXX XXXX. My monthly payment was {$650.00}. This loan was then transferred to Bayview Loan Servicing as of XX/XX/17., with an interest rate of 10,19 %. At this point. I requested a loan modification due to my inability to pay the note based upon my income. I am a retired person with a fixed income. I did reach out to HUD for assistance in developing a schedule of my income and debts showing my inability to pay this mortgage amount. After speaking with HUD representative for several weeks and sending the schedule requested, I was unable to reach the individual who was assigned to me. After many tries, I called the main # and that persons indicated that the assigned person was out ( sick leave ) I asked if they would forward the information on to Bayview, XXXX XXXX, Asset Manager, who was the contact person @ Bayview, working up the modification request.
I am not sure if they used the package of information sent to them by HUD, even though it was sent.
During the modification loan process, I was told that I did not have to pay the monthly note, those missed payments would be added to the loan when approved. I did not know that they would report the late payments to the credit Bureau which affected my credit score. It was my intention to get my credit score up to a point that I could qualify for an FHA loan with a lower interest rate.
I have asked BayView to remove this from my credit report since the total deliquent amount was added to the loan which made my loan increase from {$36000.00} to {$40000.00} ( interest being added ) My other concern is that this loan is being secured by a home ( my house ) and 23 acres of real estate.. Secured by more than 3 times that of the loan. I have indicated to both XXXX and Bay View that I did have a description of my deed with house and 3 acreage, which would cover the loan. THEY WOULD NOT ACCEPT THIS!!!!
This property is my inherited property from my Grandfather. That is the reason I had the surveyor to cut out three acres around the house in case I wanted to borrow against.
Secondly, the 10.190 % interest is predatory

Complaint: Bayview Loan Servicing is incorrectly reporting late payments on a loan that never existed. The line item on my credit report appears to be a duplicate of a XXXX XXXX XXXX XXXX. They have reported late payments of greater than 120 days as recently as XX/XX/XXXX. These incorrect late payment reports are preventing me from qualifying for a mortgage. I have no other negative items on my credit report.
I have asked Bayview to review the account in writing and via multiple phone calls. They leave the erroneous information on my report, and typically add an additional late payment to my report for whatever the current month is when I file the request for them to investigate or a request/dispute with the bureaus.
