Complaint: Hi, I have a very urgent matter once again due to a foreclosure sale on XX/XX/2019. I applied for a loan modification to Bayview Loan Servicing , LLC numerous times before and they always prolong the process. Never gave an offer and never accepted my loan modification. Ever since then I have been trying to get a loan modification and I can not get one from this company. I mailed in my rma packet and all required documentation as per guidelines. Im in a loan modification review as they should have requested documents for a review. From the past Ive had trouble calling Bayview Loan Servicing , LLC to ask about any status or updates for the loan modification and a status on the loan modification I get nowhere. I call in, the phone system asks for my social security number or my loan number, I put in the loan number and or social security number, it rings couple of times and then it goes straight to a common voicemail. It says thank you for calling the underwriting department please leave a message or set up a time to call you back. Ive tried multiple times to set up the call back and never got a callback and the other times their phone system just hung up on me. I would try this couple more times at different times in the day and get the same results. These are the numbers I have called to get in contact with anyone at Bayview Loan Servicing , LLC : XXXX, XXXX, XXXX, XXXX, XXXX, XXXX all and each phone number has the same process. As soon as I input my loan number it seems like their system registers my loan number and does not transfer me to a live person at Bayview Loan Servicing , LLC but transfers me straight to a voicemail. I feel like this is international so that I would not be able to speak with any of the Bayview Loan Servicing , LLC representatives and to prevent me from getting a loan modification. This feels like a very big problem that they do this. I can not speak with anyone regarding my loan thus iam not able to know the status of the loan modification and I can not move forward. In the past I had this issue as well and it has not been addressed. In the past this has happened multiple times on multiple days and each one does this until I clicked the number 0 for a very long and tedious process I finally got someone. But now it does not work and it goes straight to a voicemail which even after leaving voicemails to be called back I never get any call backs. If Im not mistaken Bayview Loan Servicing , LLC is in violation of my Homeowner Bill of Rights. Seems like they do not want to help me but to just sell my home.

Complaint: I will like to stress my frustration with working with Bayview Loan Servicing and XXXX XXXX as an investor on a Loan Modification Process that started more than 4 years ago. Not only have they not cooperated with the circumstances and guidelines, but they have been so unorganized when it has come to this process. It all started with a simple request of a Loan Modification that started 4 years ago with XXXX XXXX XXXX XXXX. XXXX XXXX XXXX XXXX had approved me for a Loan Modification but they miscalculated the escrow 's which made my payment doubled ever since. I have requested multiple loan modifications since then, but they had advise that the file was needed to be placed on hold until Bayview Loan Servicing could obtain a Servicing right, and they would be the one 's moving forward with my negotiations. The Loan Modification Process was going well and they had approved me for a Trial back in XXXX of XXXX. I was so pleased because I was going to save my home that I have worked so hard to maintain.The Asset Manager at the moment, advised to prorate the payments this way the payments will be done on time. I Scheduled the 3 Trial Payments with him, and the payments will be posted for XX/XX/XXXX, XX/XX/XXXX and to be completed with XX/XX/XXXX. The XXXX payments were posted correctly and the Trial for the Loan Modification Process started. Once it reached the XXXX Payment, the payment was not executed. I called the Asset Manager and left a Message. The Asset Manager did get back to me and left another Message for a Callback. After a 3rd tried, I got in contact with another person in Customer Service and scheduled a callback with Asset manager. The Asset manager called me and advise that it was an accounting error, and the payments will posted. A month had past by and no payment was yet posted. When I called Bayview again, they mentioned that the payments will be posted for XXXX and XXXX, and not to worry about it because the payments were already authorized. XXXX past by and no payments were posted. I left numerous messages with no call backs until I received a Letter from Bayview that the Loan Modification was Denied because of No payments received in my account ''. How can this be possible when I authorized the payments, received confirmations regarding my payments, did my duty to call back to make sure they would go through and they mentioned it would be ok until my file was denied. I believe they did this on purpose to make sure my file gets denied for no purpose and to continue the Foreclosure action against myself. i requested a Loan Modification again and they granted to be reviewed. When I call for status, they always advice I needed to speak to Asset Manager and he never called back. I managed to get in contact with him, and he kept requesting information over and over again the information to drag along the file for months, then my file was again denied and this time due to the fact that " file was incomplete ''. How can this be done again when I complied with the documentation needed, I felt they did this on purpose again and its to a point that they have no organization once so ever. i requested another Loan modification back in XX/XX/XXXX. They opened a template. Till this day, I have not heard from any Asset manager Requesting no information until I called Bayview directly, and they advise me of the sales date. I have reached out to Asset Manager by email, phone calls, and even scheduled a callback with no results. This company has the worst organization when it comes to Processing a Loan Modification. I have complied with everything that is needed, even with the payments of the previous trial modification, and till this day, we have not being able to resolve the issue. I want to save my house, I make enough money to save my house, but now im on the verge of loosing my house due to mis interpretation of my file and mis organization. I have a sales date of XX/XX/XXXX, Im willing to cooperate with anything that is needed, I just need help. I would like to escalate my file to upper management because I'm walking a thin line before the Foreclosure Sale. I just want my file to be reviewed for the Loan Modification that I know I can qualify for, and the package has been sent more that 40 days to have my file be reviewed.

Complaint: When I was deemed a XXXX XXXX XXXX and unemployable Veteran, I put in for a hardship under the Obama Mortgage relief to reduce my payments from almost {$800.00} a month to a lesser a month payment. They reduced my payment to {$240.00} a month and extended my payments to 480 months. I had never heard of a 40 year mortgage, also even though I had gotten my remaining balance down to {$18000.00} now my remaining balance is over {$23000.00}. It was never explained that out of the {$240.00} I pay each verbally or in writing that only {$17.00} goes to the principal. That explains why my payoff has went from {$18000.00} to {$23000.00}. On top of all of that I am forced to have an escrow even though I am tax exempt due to being aXXXX XXXX XXXX Vet, also I pay my own home owners insurance via bank draft. As of XX/XX/XXXX there was a {$1200.00} in escrow. Last year the escrow had gotten almost to {$2000.00} and then XXXX out. It is something wrong because I haven't missed nothing but 1 payment in the pass two years, but on my credit report it shows 2 or more missed payments.

Complaint: Considering Bayview Loan Servicing has a reputation of not working with clients, I have decided to submit this complaint although I have emailed their customer service about the erroneous information on my credit report but no answer is yet received. I found that the BayView mortgage-loan info from my credit report shows the missed payment for XX/XX/2018. This information is incorrect and it has been affecting my credit report unfairly. The payment in XXXX was made on the XXXX. Although not being held against me, there is also erroneous information related to the payments made in XXXX, XXXX, and XXXX. I am attaching a snap of my credit report with BAyview errors reflected as well as print-screens of all my payments to Bayview from last year so you can check when the debt was taken from my XXXX account. My records prove that I DID NOT make any late payment last year, all payments were granted before the XXXX of each month as Bayview regulates. Thanking you in advance for your kind help in this matter

Complaint: Good morning, On XX/XX/XXXX, I my attorney and I sent all of the documents concerning our Loan Modification to Bayview Loan Servicing , LLC. Our contact person at BLS was Mrs. XXXX XXXX. My attorney, Dr. XXXX, faxed the signed documents to BLS. She then called BLS immediately to ensure that they had all of the documents they needed to execute the mortgage contract. I was with my attorney on the line when she was on the phone with BLS. I heard when the BLS person she was speaking to told her that the paperwork was in order. My attorney followed up by mail the original documents to BLS. As few months later, my wife, XXXX XXXX, received a call from Mrs. XXXX at BLS telling her that we had to resubmit a new Request for Mortgage Assistance because the mortgage contract that we signed was invalid due to an error that BLS made. My wife asked Mrs. XXXX ( BLS ), to correct the documents that had the errors and send them to us. Mrs. XXXX told me that she did mail the documents and that they were not returned in time. XXXX XXXX asked Mrs. XXXX, " Who signed for the delivery of the documents? '' Mrs. XXXX responded, " No one. '' She told my wife that she was sure that we received them. We never received the corrected mortgage documents from BLS. BLS has our contact information : cell phones, email, fax, and mail. If the documents were in fact mailed to us, they were delivered to the incorrect address. Furthermore, we never knew that BLS was missing any documents until Mrs. XXXX called my wife to inform her that we had to submit a new Request for Mortgage assistance. By that time our bank had already sent {$16000.00} in mortgage payments. XXXX XXXX negotiated a new home insurance premium with XXXX. Therefore, XXXX returned to BLS {$6400.00} in overcharged home insurance premium so that they could add back into our escrow. As of today XXXX XXXX, XXXX, no one at BLS has acknowledged that they have received the {$16000.00} in mortgage payments or the premium reimbursement check for {$6400.00}. We have already contacted BLS and still have not heard back from them. On Saturday, XX/XX/XXXX, I was awoken by law enforcement to sign for a subpoena. I have to go to court on Thursday, XX/XX/XXXX to fight a home foreclosure. I have been working with both XXXX and BLS since XX/XX/XXXX to solve this situation. Every time I believe that the problem is solved BLS comes up with something else to prevent us from keeping our home. It seems like they are making money by keeping us in this situation. Bayview Loan Servicing , LLC. ( BLS ) has engaged in this type of inappropriate and malevolent behavior since day one. We never receive the important documents that they claim to send to us. They also do not acknowledge the receipt of the documents, payments, and checks that we send to them. I have contacted the CEO of BLS on this issue on more that one occasion. Nevertheless, this unconscionable behavior is a very well established Unfair Business Practice at BLS since XXXX. Mr. XXXX, the former CEO of XXXX is now the CEO of BLS. XXXX was known as the " XXXX XXXX '' of the mortgage servicing industry. We sent {$23000.00} in electronic payments and checks to BLS during XXXX. As of today no person at BLS has acknowledged that they have received this money I made Dr. XXXX XXXX aware of this situation as soon as he was assigned this case by XXXX XXXX. I appreciate any assistance that you can provide in keeping my home. I do not want to end up as a homeless Veteran on the street. Thank you. Very respectfully, XXXX XXXX

Complaint: The property went into foreclosure and I was contacted by this company directly with a guarantee to get a loan modification and adjusted terms on the mortgage. The office kept contacting to make an appointment to go to their office, finally a representative came to the property even though I had tried to cancel the appointment. I initially paid {$500.00} at the first meeting and signed a contract with the company trying to save my home. Throughout the process I was not happy with the service provided so I decided to then contact the lender and found out there was a sheriff sale scheduled. Information was only being accepting by the lender from the third party. I paid {$2000.00} to XXXX XXXX for XXXX aka XXXX XXXX XXXX XXXX. Throughout the process they were very confrontational and even more so when I asked for a refund. They only offered to provide 50 % of what I had paid back which I have declined because upon further research and working with a housing counselor I determined I should have never had to pay for this due to being mislead. When I asked for a full refund the owner of the company " XXXX XXXX '' contacted me and screamed that they did lots of work and I would not be getting my full money back.

Complaint: I am a XXXX XXXX who was injured while working on the job. Upon my injury on XX/XX/XXXX, I have suffered financial hardships. I am a single father of XXXX children and I have been unemployed, had a reduction in income, due to my injury and illness. I had to file a Chapter XXXX Bankruptcy on last XX/XX/XXXX. Recently, however, I voluntarily dismissed the Bankruptcy because my circumstances became better. When the bank/lender ( Bayview Mortgage ) discovered that I was no longer protected by the Chapter XXXX Bankruptcy, they immediately filed to have a foreclosure/auction date for XX/XX/XXXX. Although, I am very hopeful that Bayview Mortgage will work with me on a loan modification so my children and I can stay in our home. A few years ago, they gave me a loan modification, but I lost my job, after I was approved. Thank you for assisting me in this matter.
