Complaint: On XX/XX/XXXX, Bayview Loan Servicing bought my mortgage loan from XXXX XXXX and within the first week I started receiving Default notices. Bayview claimed I was behind on the loan when XXXX XXXX sold the loan to them. I spent hours on the phone with Customer Service, went back to XXXX XXXX to be told I was whole with XXXX XXXX, and I spoke to Bayview Customer Service and they still insisted I owed money to XXXX XXXX. I finally consulted an attorney and under the threat of legal action, I received a letter from Bayview that I did not owe any payments or any fees. They also stated my credit report was not affected. I believe this was in XXXX or XX/XX/XXXX. Then in XXXX it started again. I continuously paid my exact payment and did not pay any fees they were charging me. When I called they insisted I owed money and held payments I made in suspense, during this process. Now they are processing my payments but are still charging me fees, and fees on the fees. Enough is enough. I sent them a letter this week and I want to make an official complaint. Hopefully you can help us and clear up my credit report.

Complaint: On XX/XX/2019, I received my XXXX mortgage statement. It alleged that I owed for 3 months ( {$2800.00} ), and that due to an incomplete payment, my last payment at the time of this mailing, was in a suspense account. This dollar amount was {$960.00}, but as my normal mortgage payment has NOT changed, and my normal payment as of XX/XX/2019 is {$960.00}, this is incorrect. On XX/XX/2019, I was able to get through to customer service and a representative for the company said that he saw where the error was. He said that " Corporate Advance Fees '' had been added to my mortgage payment, and that the computer read this as my payment being incomplete. He said it was a computer glitch, and that Bayview would send a corrected statement on Tuesday XX/XX/XXXX, to show that I only owed for XXXX and XXXX. I asked if he could take my XXXX payment over the phone, and he said that he could and then the XXXX statement would be resent to reflect that I only owed for XX/XX/2019 and going forward. I waited a week to file this complaint, as I fully expected to have the corrected statement in my hands no later than XX/XX/2019. On Friday, XX/XX/XXXX, I called Bayview again to ask about the status of my concerns and I was told by this representative ( not the same as before ) that she could see in the notes that there appeared to be an error in my payments, that she could see that I'd paid more than my required payment for XXXX, that she could see that I'd made my XXXX payment, but that she didn't know why a new statement had not been sent out. This is very concerning to me as VA is a non judicial foreclosure state, and when a payment is held in a suspense account it appears as though the home owner is behind on payments. I have been in my home 29 years and 7 months, and I have NEVER failed to make a full mortgage payment within the month that it is due. I make my payments over the phone toward the end of each month because when I was mailing in my payments, Bayview would delay processing my payments for as long as two weeks. Since I am in an active Chapter XXXX Bankruptcy, no late charges are allowed to be added to my mortgage payment if it is late, but I understand that once my bankruptcy is discharged, my payment will need to be processed no later than the XXXX of each month to avoid late fees. I am paid twice monthly, and by paying the mortgage toward the end of each month I'm able to fulfil my other financial obligations that must be paid prior to the XXXX of each month.

Complaint: This complaint is connected to one already filed but closed by CFPB # XXXX. There was no option to respond to response of the opposite party. The Complaint was filed against XXXX XXXX XXXX XXXX XXXX with Bayview Loan Servicing , LLC as an agent but to my surprise XXXX XXXX XXXX answered. XXXX claims that I have current account/loan number and they are entitled to answer to my complaint yet this is news to me because they were my servicer back in 2012 and I had 2 other servicers since then. Nowhere in my complaint, mortgage statements nor Complaint for Foreclosure exist the XXXX XXXX XXXX name. The situation is very confusing since alleged current servicer and previous servicer can not answer to my requests.

Complaint: On XX/XX/2019, the judge authorize a stay on my home being sold to work out a modification with the lender : XXXX/Bayview Loan. They refused to accept my application due to exceeding number of modifications. Their are homeowners with five or more modifications. There are No rules stating how many modification are allowed. They have also waited for my previous modification applications documents to expire as to keep me in limbo and allow my home to be sold.

Complaint: I have been dealing with Bayview loan services for approximately 3yrs now since they bought my Mortgage from XXXX. I fell behind on my Mortgage when I was laid off by my employer. I have been in a modification program with Bayview and during this time I've had difficulty contacting them to make my monthly payments. I've spent days trying to contact Bayview to make my trial modification payments. Just recently they refused to take my monthly payment stating that they were missing a signed document. Mind you I've been making payments on the modification up to this point. Because they refused the payment it voided my modification program and now Bayview is filing for foreclosure on my home. How is this legal? I was approved for the modification program by Bayview and had been making my monthly payments on time and they randomly refuse my payment. How can I save my home? I don't want to sell my home nor do I want it to be foreclosed on.

Complaint: In XX/XX/XXXX I applied for a home loan modification due to falling behind on mortgage because my wife had XXXX XXXX and lost her job. In XX/XX/XXXX I received a call from Bayview loan servicing to let me know I had been approved and the trial mod pmts would start on XX/XX/XXXX. I called a few days later to ask if i could go ahead and schedule ( 2 ) 1/2 pmts in XXXX to pay for XX/XX/XXXX pmt, i was told yes. I was then sent out the modification paperwork to sign and return, papers stated we would have 3 trial pmts and then it would be approved for first MOD pmt on XX/XX/XXXX. I made each of those trial pmts in the month before the due date. In XXXX i called to make a pmt and the system was telling me i was due for XXXX, there was not way that was correct as i had made the pmt for XXXX in XXXX ( this shows on Bayview 's pmt detail ) They stated at that time they would correct this they had misapplied a payment i had sent in. In XX/XX/XXXX there were 56 transactions made on my acct for them trying to fix their mistake and another 69 transactions in XX/XX/XXXX. As looking down through the pmt history i could see where the due date kept switching from XXXX to XXXX back to XXXX and never being updated to the current month that i was due for. I called several times to Bayview for them to fix the problem each time them stating they would escalate it and correct my credit report. Then after disputing them each time they would send a letter stating they could not retract the credit ratings due to being contractually late ( i was never late on a pmt once we entered the modification ) i have filed disputes with all 3 credit bureaus as well. i again called on XX/XX/XXXX to open another case each time i get a different reason why they can not fix the mistakes they made and update my credit report. we are trying to purchase another home and to get away from this horrible company that continues to do this to hundreds of customers. i have all the payment history from their website showing all the transactions and if you follow it you can plainly see where i made all pmts and a pmt in XXXX was reversed and never posted back. I need my credit report updated from this company and after 2 years of them not complying i will now be taking further actions on the company.

( All attached here. ) They were sent via 4 separate ways : two fax numbers XXXX XXXX & XXXX ) and to two separate email addresses which included the assigned negotiator ( XXXX XXXX XXXX ). XXXX and its employees never attached the documents to the file. We have called multiple times and had it escalated XXXX multiple times ) to be attached immediately, but AFTER THREE WEEKS XXXX STILL HAS DONE NOTHING ON THIS FILE. This is not acceptable. XXXX is violating their servicing guidelines and this is causing harm to their investor and the borrower. I want the documents attached to the file immediately and for XXXX to continue their review with no further delays.

Complaint: Bayview Loan is reporting a lot of inaccurate information on my report which is a clear violation of the FCRA. I have tried to have this account fixed to no avail. It is reporting to XXXX and XXXX and XXXX but a lot of contradicting information there is no way that they that they can validate this debt as it is reporting completely inaccurate they are in violation of my rights. XXXXn and XXXX are reporting a monthly payment of {$1900.00} and XXXX is reporting {$0.00}. XXXX is reporting the date opened as XX/XX/XXXX and XXXX and XXXX are reporting XX/XX/XXXX. XXXX and XXXX are reporting the last reported date as XX/XX/XXXX and XXXX is reporting XX/XX/XXXX. XXXX is reporting date last active as XX/XX/XXXX XXXX is reporting XXXXand XXXX is reporting it as XX/XX/XXXX. ALso XXXX and XXXX are reporting it as 120 days late but XXXX is reporting payment status unknown. There are so many obvious FCRA violations

Complaint: I have been working with Bayview since XXXX in regards to mortgage assistance. I have submitted all the documents, whenever we call in to get an update we are transferred to the point of contact, we have left several messages and he never returns any of our calls. We have set up appointments with him, to which he still never calls. I tried to call in to see if any one else can help me or to be transferred to his manager, but again I am transferred to his voicemail. How is one supposed to get any information or find out the status if my point of contact is not doing his job properly? Bayview is making this situation far worse and forcing me with no options. They now closed my application stating they are missing documents but will not tell me what documents are missing. They are making it more difficult to communicate and do what I am supposed to be doing when they are refusing to help me or return my calls.

Complaint: My complaint - - Bayview Loan Servicing supplied a loan modification to my ex husband with my name on it, yet never required my signature. - Bayview provided a cancellation of debt in XXXX in the amount of {$2200.00}. and never required my signature of acceptance. - Bayview never told me how to get my name off of the loan modification until it was too late - Bayview sent a XXXX in my name to my ex husbands address despite me providing my address/contact information and divorce decree to them in XXXX. - The property is not mine. the XXXX should have only been in my ex husbands name I was divorced in XXXX. My ex husband was awarded this house and since my name is also on the loan the divorce decree indicates i must be held harmless when it comes to this property. XX/XX/XXXX I found a loan with XXXX XXXX on my credit report. I immediately called them to find out why, and was told My ex husband received a loan modification from them. I explained the house was not mine and sent them a copy of my divorce decree. I asked how i could get my name off of this loan, and was told there was nothing i could do unless my ex husband refinanced in his name only, which he could not/would not do. I provided all of my contact information and asked that i be notified of any and all issues related to the loan. I never signed anything or agreed to a loan modification and Bayview told me my signature was not necessary. XX/XX/XXXX I received a letter from the IRS indicating i failed to report a cancellation of debt from Bayview received in XXXX. When i contacted Bayview i found that they removed all of my contact information at the request of my ex husband. They provided me with a XXXX that was mailed in my name to my ex husbands address in XXXX. Bayview refuses to send a correct XXXX despite having the divorce decree on file. They informed me they could not do this because i failed to file a release of liability with them, and will provide no explanation for why their staff never informed me of this on any of the numerous phone calls i made to them. The loan is paid off now so no one will help.
