Complaint: Hello I recently received a copy of my credit report and did not understand what was being reported- My home loan information reporting seems to be different than what I have on file. I am requesting verification of detailed account information and the dates reported to XXXX, XXXX and XXXX.
1. Please confirm the last date reporting or updating account details to each credit company.
2. Please confirm all negative payment dates reported ( ie 30-90-120 late payments ) 3. Please confirm last payment date I would appreciate this information be mailed to me to verify my records

Complaint: I was lay-off of my job but I found another job shortly after .... However, the new job paid less money. Before I get be hide on my mortgage I contacted my mortgage company and explained my situation and asked for a modification. I was told by the mortgage company that I had to be at least 3 months be hide before the could do anything for me. After my savings were gone which was months later I filed for a modification. I sent in all required documents and made all three trail payments. After that I was told by my account manager that I had completed everything that I had to do and now the underwriters had to process the modification. I called every month to get an update. Finally, I was told to make two payments to bring the mortgage current and my modification would be finalized. I made the two payments and called the mortgage company back in two weeks. At that time my account manager informed my that he had giving me the wrong information. I was told that I had to pay over 20K ( the arrears ) to bring my mortgage current or loss my home. I wrote upper management and explain the issue. Management was extremely rude to me. And now I an in the process of losing my home. This entire experience has been long, hard, misleading, stressful, inhumane, unethical and unprofessional. I hope that no-one never has to go through this awful experience from Bayview Loan Services LLC. This mortgage company needs to be accountable of their mistakes. Because the way they do business is negatively effect hard working people 's lives in a major way.

Complaint: The current investor trustee XXXX XXXX XXXX XXXX XXXX holds a note that was fradulently fabricated and is not the orginal which I have in my possession and which contains no endorsments cause it was never endorsed. Also attached is the promissory note with no endorsment faxed by prior servicer months before the one with an endorsment and lacking any date or nortirization lacks the proof as the orginal and that it wasn't actually endorsed in XX/XX/2016 well after XXXX no longer exsisted. The current servicer after being informed still has done nothing to reslove this matter. They don't have in there possession the orginal promissory note either or even the right to service the loan. XXXX never assigned or I never recieve notice that they transfered servicing and if they did who it actually was. Attached also is a service transfer estimates that actually states rXXXX XXXX XXXX XXXX as the trustee for this loan and not XXXX They are harassing me with a debt they have no right to collect on as they where never properly sold or transferred servicing rights and are not the note holder and not entilted to recieve payments. They have no license to do business in Hawaii and don't hold a local point of contact required by state law. They continue to send me statements and raising The attached disclosure about XXXX states they are not the lender and only a mortgagee in a noominee capacity and then being so doesn't effect my obligation to lender under promissory note. XXXX even though they made an assignment of mortgage never possessed or was given the promissory note threw endorsment and therefore can't assign a mortgage they don't have possession of the note it states they are assigning. Further they where to act on soley as nominee for lender which didn't exsist at the time of the assignment and XXXX XXXX wasn't the note holder at that time either and never provided proper notification that they where ever sold or transferred rights to service the loan. Also the assignment of mortgage is on a two page document with no page numbers and one page contains the assignment and the other the notirization. The two pages have no signs that they even where fabricated at the same time and could have easily been done seperatly and with no knowledge to the parties on the document. The second page also contains hand written in attached assignment of mortgage borrower XXXX XXXX XXXX and has no intials by notary that are required per state law when something is changed on a notirized document.

Complaint: I had been paying the same mortgage payment to Bayview loan servicing company which include tax and insurance for many years. Its an impound account for $ XXXX/month and later increase to $ XXXX/month and now it becomes $ XXXX/ month. On XX/XX/2018 I received anticipated escrow account disbursements letter that my property tax become {$14000.00} starting XX/XX/2018. I received an annual secured property tax bill from Treasurer and tax collector is only {$1500.00} from XXXX XXXX to XXXX XXXX. I had sent several letters to Bayview Loan servicing with a copy of the tax bill that I received from the treasurer and tax collector office but never get any reply back. Also I had paid the mortgage on time and sometime a little late, but once I talk to customer service they told me that I am current then later I received a mortgage statement that I was late about 2 months. So I paid those 2 month on the statement now it come again that I still own them another 2 months. I am confused about what is going on since I just talk to their customer service about the update payment. Later Bayview loan servicing sent one letter to me saying that they had sold the loan to XXXX fXXXX so I have to contact them. I am very stress and don't know when they going to put my property into foreclosure. Now with XXXX XXXX. They also sent me the same statement that my mortgage become $ XXXX/month due to my property tax increase.

Complaint: My Mortgage was initially held by XXXX XXXX then sold to XXXX XXXX and then to XXXX XXXX and then to XXXX XXXX. I was never informed my loan had been sold from XXXX to XXXX and kept paying XXXX XXXX who collected the money. In XX/XX/XXXX I received a certified letter from XXXX saying I was in default and immediately paid three payments but they had already sold my mortgage to Bayview. I have paid the mortgage each month but Bayview states that I have not paid for XX/XX/XXXX. When I first called Bayview they said I owed XXXX dollars and then I was current. I paid the amount at that time. Now they are saying I am late for a payment even though I provided documentation that I had paid every month. XXXX reimbursed some payments but did not return all the payments I had paid them. Bayview says XXXX did not pay them the correct amount. I requested a transcript of calls with Bayview which they have not produced, I have also requested an answer to the documentation sent to them showing the payments I have made to all these companies and have received no written response. I am speaking to their escalation department again requesting and they are now saying that I requested a transfer from my escrow account which I have not made.

Complaint: I was given a home loan from XXXX in XX/XX/XXXX. I signed my loan documents on XX/XX/XXXX and it closed on XX/XX/XXXX. I never recieved a final HUD settlement and only have had them be able to produce on dated XX/XX/XXXX. When my mortgage documents where filed the notatary stamp and signature on page 14 or 15 doesn't match or look like the ones contained in my deed. Futher the document was edited by adding in county of Hawaii in upper left but was never intialled by the notary or me which is required when a change is made to a document. The three page promissory note that the servicer and XXXX XXXX XXXX XXXX XXXX as trustee claim to prove internet and ability to foreclose contain no notary stamp, no date on signature page, a signature that isn't mine, and didn't contain any indorsment from XXXX XXXX till after XX/XX/XXXX. Prior sevicer had sent documents that had a promissory note not containing the endorsement and one containing the endorsment. There is futher an assignment that was done in XX/XX/XXXX from XXXX to XXXX which is an assignment of mortgage. It was requested by XXXX XXXX and done by an officer XXXX XXXX of XXXX out of a flordia address. There is no evidence showing that XXXX XXXX had ownership of my mortgage or note to do this transfer and no documents showing chain of title from XXXX to XXXX to XXXX to XXXX which would be required when transferring the note. XXXX was to be listed as the nominee for the lender and if directed by the lender had the power to sell or transfer the mortgage no where does it state that XXXX had any power or ownership of the note. Even if they did they have no license in XX/XX/XXXX to sell a mortgage or assign a mortgage or to do business in general. This avoids any normally taxes or fees that would be associated with a normally assignment or sale of a mortgage. Futher since in XX/XX/XXXX XXXX no longer exsisted there was no directions given by a lender and no proper endorsments to show a legal chain of title. XXXX was given certain abilities which where outlined in the discloser that the lender provided and in no way states XXXX at ots own discreation could assign my nortgage. Futher the assignment is two pages of the XXXX the first is all the info about the mortgage and signature by XXXX officer and on the second is the notary stamp and signature contains no page numbers and has hand written in assignment of mortgage XXXX XXXX XXXX.
There is nothing showing or verifiying that these documents where produced at the same time and if either the XXXX officer or notary had knowledge of them being signed at the same time. XXXX XXXX was illegally made the servicer when there was never any notice given to me that is required when the servicing of the loan is transferred. This loan was also supposed to be part of a mortgage securities certificates and was required to close under a PSA agreement and follow certain guidelines which would at that time require the mortgage and note to be transferred. This never accured and therefore never became part of a certification series overseen by a trust company. This makes the mortgage null and void as it was never properly sold or transferred from XXXX XXXX to anyone. Futher XXXX XXXX changed and set the interset rate at XXXX for almost 5 years and never once changed it even though it was an adjustable rate mortgage. The current servicer has started raising the interest rate and has failed to provide the required documents showing what the adjustment is based off and why it is changing the amount it has. The mortgage has also been in and out of court since XX/XX/XXXX and the XXXX as trustee has never been able or produced any documents stating the have interset in the property and the right to foreclose. XXXX as trustee futher has no license or office in Hawaii to be able to deal with mortgages and neither does the current servicer XXXX homeloans. XXXX XXXX or Bayview XXXX has produced verification that they can do business in regards to mortgages in the state of hawaii. The mortgage contains a notary stamp on page 14 that doesn't look like the notary on other documents, has no areas crossed out showing gender and party, contains alterations never signed or endorsed, lacks the rubber stamp with notaries name and number. The promissory note contains a signature that isn't mine, no dates on third page by signatured, was not filed along with mortgage, no notirizing to verify I signed it, has been produced with and without an endorsement in blank by XXXX in XX/XX/XXXX, no witness signstured, wasn't signed by the lender or bank, and has not been provided with wet signatured or in original size. The burden should be on the servicer and XXXX to provide proof that these documents are not fraudulent. That the assignment was not fraudlent.

Complaint: At the end of XX/XX/XXXX, XXXX XXXX transferred my mortgage to Bayview as my new mortgage servicer. On XX/XX/XXXX I received a Transfer of Service Notice from Bayview.
I missed the XX/XX/XXXX mortgage payment and made a payment arrangement with XXXX to pay {$2400.00} per month from XX/XX/XXXX through XX/XX/XXXX. Please see attached XX/XX/XXXX letter from XXXX. It is my understanding that the payment arrangement that I made with XXXX would follow over to Bayview. I sent a copy of this letter to Bayview on XX/XX/XXXX.
I have been paying a month behind because I only get paid once monthly at my job. By the month of XXXX I should be able to start paying within the month. For instance on XX/XX/XXXX I paid for the month of XXXX in the amount of {$2500.00}. I get paid next on XX/XX/XXXX and will pay the amount of {$2500.00}, which should be my last payment of {$2400.00}. I have notified Bayview of this.
Every statement I have received from Bayview has a different amount. I have called Bayview several times trying to straighten out my loan. Every person at Bayview that I spoke to has told me a different amount that we owe and a different story. Yesterday I received a notice on my house door to call Bayview.
I spoke to Bayview today and the woman I spoke to said that the payment arrangement was broken. I was never told that. Where is all the extra money I have been paying going to?

Complaint: I have a daily interest mortgage loan. This loan has changed financial institutions several times since I took out the mortgage loan in XXXX. I have had problems paying my mortgage in the past due to an identity theft and the haulting of my Social Security Benifits. I sought help with getting the then mortgage holder at the time to defer my payments. I have since had to file Chapter XXXX bankruptcy. I filed my bankruptcy case in XX/XX/XXXX. During my bankruptcy filing the mortgage changed hands again. A company called Bayview Servicing is now handling my payments for whom ever has my mortgage. My payments of XXXX I often rounded off and was sending XXXX dollars or XXXX.The original mortgage company was applying the overpayment to my principal. This new company is holding my over payment for over a year as unapplied funds. I have ask them several times to apply the funds to my principal. This company is holding my money and it is not benefiting me by lowering my principal. I was told they are holding my money because it is not a payment, I repeat this is a daily interest mortgage. If my payment was a day past the due date the company would not hesitate to take the additional interest from my payment. Bayview has been holding XXXX of my money for over a year. I want these funds and the annual interest it would have saved me had it been applied to my mortgage applied to my mortgage.

Complaint: I have been receiving incorrect statements from Bayview since XX/XX/XXXX. I have emailed XXXX XXXX requesting corrected statements and she emailed XXXX XXXX apologizing that she had not replied and that she would look into it but I have not received a reply to my emails nor a corrected statement.
Bayview has sent incorrect statements before but they have researched them and corrected them in a timely matter. This time it's been months. I have had to file a government complaint before.
I am demanding in writing that Bayview corrects the statement. I have always paid extra each month and I pay at the end of each month. The statement should reflect that my account is current with XX/XX/XXXX payment owed. I send all payments overnight with tracking like I do all payments. XXXX payment will be mailed XX/XX/XXXX. I requested via email to XXXX XXXX to please notate the account.
