Complaint: I applied for a loan modification through Bayview Loan Servicing. My house was almost totally destroyed during Hurricane Florence in XXXX. Bayview Loan Servicing has received multiple payment from my insurance company. The amount of the insurance payments is approximately XXXX. The total loan payoff is estimated at XXXX. The home is currently in the process of being repaired and I have been keeping an open line of communication with the servicing provider so that I will not lose my home. I received a mortgage statement dated XX/XX/XXXX with {$2600.00} in unexplained fees. They claim these fees are for property preservation, property repair, hazard insurance claims, lock charges etc.. The property is covered by an insurance claim and these additional charges have not been substantiated. No one at Bayview Loan Servicing is able to tell me why we incurred these charges.

Complaint: Bayview is guilty of financial impropriety and borderline fraud by grossly understating my monthly income and greatly inflating the " value '' of my property for the purposes of foreclosing on my home. At issue is a modification request that Bayview denied ( letter attached ). In the letter Bayview understates my monthly income by {$5000.00} a month and over estimates the value of my home ( comps attached ) by almost {$200000.00} for the purposes of denying my modification request. This is fraud and unacceptable.

Finally, my Notarized Affidavit of Non Response was also served to BAYVIEW sent Certified Mail # XXXX-XXXX-XXXX-XXXX-XXXX. At closing never paid all funds. Went out of business before addressing fully. Sent 3 people to my home on XX/XX/XXXX to harass me banging on windows and doors frightening my children and arousing neighbors. Filed foreclosure proceedings that were dismissed for failure to prosecute XXXX XXXX XXXX.XX/XX/XXXX-XX/XX/XXXX Claimed ownership of Note and mortgage through FDIC. Rejected 10 loan modifications from XX/XX/XXXX-XX/XX/XXXX. Filed two foreclosure complaints, second was picked up by XXXX XXXX XXXX XXXX who bought mortgage during litigation from XXXX.both dismissed. Bayview Loan Servicing LLC.XX/XX/XXXX-XX/XX/XXXX Have no original Note, was not in possession of it at time it filed foreclosure summons. Still awarded Summary Judgement even though they admitted that their affidavit was wrong, and found a missing {$7600.00} 1 year into foreclosure proceedings, proving at was not even in default when lis-pendens filed. Judge is a close family friend of my ex wife and should have recused himselfas he did in two other cases involving us. Appeal being filed

Complaint: I have a commercial loan with Bayview Loan Servicing but no escrow account with them. I have been paying my own real estate taxes, commercial insurance and flood insurance for many years. On XX/XX/2019, Bayview went into the XXXX, CT public records and upon seeing my real estate taxes were not paid yet, and they are due by XX/XX/XXXX, decided to make my payment for 6 months of {$5200.00}. What they did not know was I paid by company check to the town of XXXX, CT the amount due. I called Bayview many, many times and explained to them their mistake but they did not care, in spite of showing them, the public records are current. The tax collector in XXXX, CT verified they received Bayview 's check and since I was current, sent back the check to Bayview. Bayview then proceeded to post my regular monthly mortgage payment as {$2500.00} PLUS an additional {$5200.00} as a total due monthly of {$7700.00}. Since I did not pay the erroneous escrow of {$5200.00} back to them and while they were waiting to get the check back from XXXX, Ct, they posted to all 3 credit bureaus I owed them a monthly payment of {$7700.00} in XX/XX/2019 and continued to post I owed them a monthly payment of {$7700.00} in XXXX, XXXX, XX/XX/2019. I called Bayview many times each month but they did not want to hear anything from me. I complained to you and still have not received an answer back from the US government except that instead of 30 days to resolve, it is now 60 days to resolve which ends up by the end of XXXX, rather than the end of XX/XX/2019. I also complained to the 3 credit bureaus. XXXX never responded to me, XXXX said my Bayview account was deleted, from their profile of me and XXXX sent back a resolution to me that is totally NOT acceptable to me. In XX/XX/2019, they now show my monthly payment is not {$7700.00} but {$2500.00}. BUT, why do the months of XXXX, XXXX, XXXX and XXXX still show my monthly payment was {$7700.00} but is erroneous reporting of my profile? This is not true and I want it removed immediately, NOT 3 or 4 months later. Their erroneous reporting of my profile has caused me to be turned down by XXXX XXXX for a refinance of a residential property I was doing while this was going on. XXXX XXXX told me they turned down my application because my monthly payment of {$7700.00} monthly to Bayview was way too high for me to afford a refinance. Bayview 's erroneous payment of my real estate taxes and subsequent denial of responsibility has hurt me financially and I am still waiting for the CFPB to help me out in this matter.

Complaint: This company has not answered yet my previous complaint # XXXX I am resuming here the status of the complaint : I signed with Bayview Loan Servicing LLC the attached PERMANENT MODIFICATION LOAN AGREEMENT in XXXX that shows I was complying with the modification terms and never being in default as proved in Court in XX/XX/XXXX. Bayview filed a frivolous foreclosure on XX/XX/XXXX against my home claiming amounts out of this modification ; Bayview sent innumerous harassment letters almost two years prior to the filing of the frivolous foreclosure, always claiming unlawful amounts out of the above modification. After 21 months have passed Bayview hasnt rectified their position yet ; they transferred the Service on XX/XX/XXXX to XXXX XXXX who also transferred the service to XXXX XXXX XXXX on XX/XX/XXXX. I needed her to tell me now to get access into a site sent by Bayview Loan Servicing , LLC to view the status as well as any outstanding items and to be able to upload Doc.which maybe still needed. Please refer to memo included dated XX/XX/2019 from office of XXXX XXXX. Ms. XXXX stated the only update she sees at present is XX/XX/XXXX denial.I had not and have not yet received anything from Ms. XXXX office as of yet. # 2 upon asking Ms. XXXX to help me get into the suggested site, in order to review the status by tracking my account at www.Bayview Loan Servicing, LLC. Comthen go to tab ( which was no such site ) called '' My Worked Out Details '' to view status and outstanding items.There was only a My Workout Details was a Gymnastic center work out.obviously she was unable to find such a site either. Upon asking her why I was denied again and what papers were missing she stated none, it is the investor denying the modification which she stated is XXXX XXXX'.someone else suggested I send a dispute denial to Ms.XXXX asking her to forward my request to the investor on my behalf MY COMPLAINT IS WHY WASN'T I SENT A FORM TO DISPUTE OR APPEAL THIS DECISION, I received nothing on all decisions being made, XXXX Resentative Mr. XXXX XXXX has heard nothing also from these representatives verbally or posted to the uploads of my status.If not posted or contacted how would I know of progress or denial taking pla e and what would be the next steps to close Ms. XXXX did say she does not see a solution or a sale date upon my aski g where is this going I feel like this is extremely unfair and somewhat bias that I'm being discriminated against started with 2 payments behind which would have been addressed at that point except for the loan company refusing the payments no one at the loan is trying to work with me and my Representative Mr. XXXX to resolve the matter and stop trying to justify takeing my home and leave me homeless i maybe XXXX in years but im XXXX inmind I'm not senile or stupid and plan to be around a longtime still. Due to unemployment until XX/XX/XXXX, per the attached agreement I informed Bayview of my Employment and on several occasions contacted the office to put my loan back in good standing as Promised.Instead I now have a higher interest rate and also added interest separated from my principal in the amount of over {$37000.00} since XX/XX/XXXX I have paid more interest, and I have interest which is waiting for me to pay the loan in full. My loan was paid up by XXXX XXXX XXXX until i got a Job. When I started back to work the loan was caught up. I have tried to correct this for over 4 years. I am reaching retirement with my mortgage, in a situation that I was promised that the loan would be Refinanced or modified by Bayview, however when I called they told me they had no authority to do what they promised. I feel the promise was just to get me to sign the paperwork.Speaking to Representative after Representative then Mortgage transferred to still getting no help. Phone call after phone call has caused me so much frustration, I do not think at XXXX years of age I should have this battle, therefore I am really hoping to get this settled with help from CFPB. This is my second request for help, my property value is not increasing, and the home needs some repairs.I will be retiring in XX/XX/XXXX, and would like to do so in peace.
