Per Bayviews Customer Account Activity Statement that they provided in response to the above claim, they are showing TWO late charges for XX/XX/XXXX, one for XX/XX/XXXX, one for XX/XX/XXXX, and one for XX/XX/XXXX. I HAVE NEVER BEEN LATE! Alleged fraudulent, deceptive and racketeering activity a. However, the attached canceled checks are showing that I have sent the following payments ( MANY VIA CERTIFIED MAIL SINCE BAYVIEW FAILED TO SEND ME MONTHLY STATEMENTS ) ( See attachment # 1 ) as shown below each and every month : PAYMENT FOR MONTH CHECK MAILED XX/XX/XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX ( FOR XXXX ) XXXX XXXX XXXX XXXX XXXX 2. Bayview stopped sending me monthly statements in XX/XX/XXXX. This is a clear violation of 12 CFR 1026.41 - Periodic statements for residential mortgage loans. I notified Bayview and the Court ( Case 3:18-cv-00435 ) of this violation twice and the documents were received and filed in The United States District Court for the XXXX District of Virginia on XXXX XX/XX/XXXX ( See Attachment # 2, Paragraph # 2 ) and XXXX XX/XX/XXXX ( See Attachment # 3, Paragraph # 2 ). a. Bayview Loan Servicing FAILED to send me monthly statements and instead chose to send them to an address in XXXX XXXX, Virginia. This was done from XX/XX/XXXX through XX/XX/XXXX. In addition, Bayview is showing various amounts as the Total Amount Due for each month, ( See Attachment # 4 ) Alleged fraudulent, deceptive and racketeering activity MONTH BAYVIEW TOTAL AMOUNT DUE SENT XX/XX/XXXX FOR XX/XX/XXXX {$28000.00} SENT XX/XX/XXXX FOR XX/XX/XXXX {$28000.00} SENT XX/XX/XXXX FOR XX/XX/XXXX {$8400.00} SENT XXXX XXXX FOR XX/XX/XXXX {$14000.00} SENT XX/XX/XXXX FOR XX/XX/XXXX {$11000.00} SENT XX/XX/XXXX FOR XX/XX/XXXX {$12000.00} SENT XX/XX/XXXX FOR XX/XX/XXXX {$12000.00} SENT XX/XX/XXXX FOR XX/XX/XXXX {$6000.00} SENT XX/XX/XXXX FOR XX/XX/XXXX {$11000.00} a. This is clearly in violation of the Fair Debt Collection Practice Act. Bayview sent TWO statements out for XX/XX/XXXX with different Total Amount Due amounts and two statements out for XX/XX/XXXX with different Total Amount Due amounts. Alleged fraudulent, deceptive and racketeering activity 3. Bayview Loan Servicing stated in their response ( dated XXXX XX/XX/XXXX ) that as the date of this correspondence, Ms. XXXX mortgage loan is due for the XX/XX/XXXX installment. HOWEVER, my cancelled checks in attachment # 1 shows that my XXXX payment was mailed on XXXX XX/XX/XXXX and Bayview ( XXXX XXXXXXXX XXXX ) processed it on XXXX XX/XX/XXXX, THREE days prior to their correspondence! How did they not verify the information prior to adding it to their response? Bayview also showed the Total Amount Due as {$11000.00}! b. Bayview Loan Servicing stated in their response ( dated XXXX XX/XX/XXXX ) stated that Bayview added a litigation fee in the amount of {$9100.00} to Ms. XXXX monthly mortgage statement. However, pursuant to the Courts Order of XX/XX/XXXX, Bayview removed the litigation fee from her mortgage statement. However, inflated unknown fee is still showing on my statements! Alleged fraudulent, deceptive and racketeering activity c. Bayview Loan Servicing , XXXX XXXX XXXX, Mortgage Electronic Registration Systems and XXXX XXXX XXXX ALL have failed to send me my Mortgage Transfer Disclosure as mandated by 12 CFR 1026.39 - Mortgage transfer disclosures ( ( b ) Disclosure required. Except as provided in paragraph ( c ) of this section, each covered person is subject to the requirements of this section and shall mail or deliver the disclosures required by this section to the consumer on or before the 30th calendar day following the date of transfer. ). I have NEVER received a Mortgage Transfer Disclosure. Alleged fraudulent, deceptive and racketeering activity d. In XXXX, XXXX XXXX XXXX ( the alleged original lender ) provided sworn testimony to the Court ( XXXX County, Virginia ( XXXX ) ) stating that the loan mortgage loan was sold and transferred to XXXX XXXX XXXX XXXX. on or about XX/XX/XXXX ( Attachment # 5 ). XXXX XXXX XXXX filed court documents ( United States District Court XXXX District of Virginia ( Case XXXX Document 10 Filed XX/XX/XXXX Page 3 of 16 PageID # 87 ) also states XXXX sold and transferred the first loan to XXXX XXXX XXXX on or about XX/XX/XXXX. ( Attachment # 6 ) However, once Conference Calls were held with the Court, XXXX XXXX XXXX suddenly changed their material facts and sworn testimony and stated that the First loan was sold to XXXX. ( Attachment # 7 ) Alleged fraudulent, deceptive and racketeering activity e. Bayview Loan Servicing and XXXX XXXX XXXX provided documents WITHOUT any type of endorsement. Then, poofjust like that, they provided documents with an alleged XXXX endorsement and known alleged robosigners. ALTHOUGH XXXX never had anything to do with my mortgage/note. ( Grouped as Attachment # 8 ) Alleged fraudulent, deceptive and racketeering activity f. At a minimum, the alleged changing of sworn testimony and documentation is in violation of Federal ( 18 U.S. Code 1621. Perjury generally ) and State ( Code of Virginia : 18.2-434, 18 U.S.C. 1001 AND Virginia Code 18.2-435. Alleged fraudulent, deceptive and racketeering activity 4. The Deed of Trust states " and the Beneficiary, Mortgage Electronic Registration Systems , Inc. ( MERS ) ( solely as nominee for Lender, as hereinafter defined, and Lenders successors and assigns ). a. I was never informed of the MERS and XXXX Patent/Security Agreement ( In XXXX, XXXX acquired XXXX, and modified that better-known name to become XXXX XXXX XXXXXXXX ). g. This major omission was allegedly in violation of 15 U.S. Code 1125 - False designations of origin, false descriptions, and dilution forbidden. This omission is also allegedly prima evidence of the fraudulent conspiracy orchestrated within the banking system. Alleged fraudulent, deceptive and racketeering activity 5. I am also a victim of the Libor manipulation. Alleged fraudulent, deceptive and racketeering activity 6. This entire mortgage was based on alleged fraud since inception and throughout the entire process and Fraud vitiates all contracts! 7. This alleged massive fraud is so blatant and evil and must be stopped immediately! It is evident and documentation has shown that the mortgage/note contain many alleged legal violations, alleged contract breaches, alleged mortgage fraud, alleged broken chain of title as well as many other problematic issues. I have been fighting this battle for almost TEN Years and have reported this alleged continued misrepresentation and active concealment. 8. Due to the massive discrepancies and alleged fraud upon the Court, I am alleging that XXXX ( and/or Bayview Loan Servicing ) is not the holder in due course nor ever took possession of the note and thus has no claim or rights concerning the note. Therefore, Bayview Loan Servicing does not have any interest to the note! 9. Constructive fraud ( Blacks law dictionary ) - " all acts, omissions, and concealments involving breach of equitable or legal duty, trust or confidence, and resulting in damage to another, 38 Cal Rptr. 148, 157 ; i.e. no scienter ( intent to defraud ) is required. Thus the party who makes the misrepresentation need not know that it is false. Complaint: I have been paying off my mortgage to XXXX XXXX ( XXXX ) the original provider in a regular, automatic fashion. From about the beginning of this year Bayview Loan Servicing have been sending me letters demanding that I pay the same mortgage to THEM. I sent them several letters explaining that their demands are senseless, but they would not listen. ( There was no authorization from mortgage provider to switch. ) They are threatening with foreclosure. They ruined my credit rating and prevented me getting a loan. In about XX/XX/XXXX the provider stopped collecting from me. I then switched payments to them. For some reason they are pretending not to receive those, even though XX/XX/XXXX and XX/XX/XXXX have been marked in my XXXX account as PAID. I am enclosing one of the typical letters. The person just designated to look after my account is XXXX XXXX, tel XXXX XXXX XXXX, email : XXXX They keep acting as if had no money to pay. This is not the case, I simply don't want to pay fwice.

Complaint: History : My mother passed away in XXXX, leaving a home and mortgage to my brother & myself. After her money was depleted, I personally began making the payments until I could no longer financially afford the payments. Due to the recession, the real estate market has never rebounded where the house is, plus it is overbuilt [ 7500 sq house on 18 +/- acres with private lake in rural area ]. Upon ceasing payments to XXXX XXXX [ XXXX or XX/XX/XXXX ], the loan was assigned to Bayview Loan Servicing , LLC. Bayview is a collection company. However, I have been completely up front with them, requesting a deed in lieu. Upon my brothers death, his 50 % was left to his XXXX adult children. It was discovered than XXXX nephew has a large judgement against him. I immediately notified Bayview that a foreclosure would be necessary. In XXXX, I was told everything was fine for the deed in lieu. After a more thorough title search, Bayview discovered my nephews judgement. I provided the necessary info to allow nephew & Bayview to communicate, so Bayview 's legal team could negotiate with XXXX XXXX regarding the judgement. Nothing has happened. Bayview has not maintained the property, yard, etc. I have still been paying the utility bills. My & my nephews emails are not responded to, nor are calls. The property looks quite abandoned. Bayview has not followed the promised procedures, etc. I have never had any credit problems, so have no knowledge of the processes. I do believe that 1 and 1/2 years is TOO LONG for this process to take. Applying for a mortgage or refinancing an existing mortgage

Complaint: Dear Sir/Madam, XXXX/Bayview/XXXX tried to foreclosure on my house with a sale date of XX/XX/XXXX and there was nothing I could do to stop them. I tried to start paying on my mortgage and contacted them over and over but they never contacted me once and there was nothing I could do to avoid them foreclosing on my house except to file a chapter XXXX. Im a single mother with XXXX great teenagers and Ive been working my entire adult life and only lost my ability to pay my mortgage for 6 months, and had to ask XXXX/Bayview for a forbearance - WHICH THEY APPROVED ME FOR - when I turned XXXX and had a hard time finding work as a woman in XXXX, a younger person industry - and Ive been fully employed since then. There was nothing I could do to avoid their foreclosure process, I did everything they told me to and everything I could to avoid it. XXXX/Bayviews actions caused me to have to file chapter XXXX as my only option to keep my home, see list below. XXXX/Bayview has unlawful practices against people who are under forbearance that cant do anything to avoid foreclosure. XXXX approved me putting my mortgage on a forbearance plan after I lost my job for 6 months and I HAVE PROOF OF THE FORBEARANCE APPROVAL. I got a job and called them immediately to start paying on my mortgage again but they would not let me start paying my mortgage until they reviewed my loan to determine how to adjust it. It took them over 7 months to make their determination that they couldnt adjust my mortgage so I could start paying on it again and I had to file a chapter XXXX as my only option to save my home. I earned a salary of {$150000.00} per year with my new job, and had earned that for years before and years after and I earn that currently so THERE WAS NO BASIS FOR THEM NOT TO ADJUST MY MORTGAGE and let me start paying again which is why I am contacting you. There was no way for me to avoid XXXX/Bayview from foreclosing on my home. In addition, I have incurred exorbitant XXXX/Bayview foreclosure lawyer fees at the end of their foreclosure process, even though I had done everything they told me to do and called them weekly for 7 months and did everything I could think of to move them forward but with zero success. They only gave me one choice - to pay them {$70000.00} or lose my home because it took them 7 months to make a decision, and I owed them {$70000.00} by that time and I was left with no alternatives at the end of that time to save my home except to file a chapter XXXX. They have caused the following list of disastrous impact to my family 's life while ruining my financial life over the past 3 years. Complaint details : The amount of money that I owed Cenlar/Bayview on XX/XX/XXXX was {$25000.00} - this was the day I started my new job and I informed them I was working and wanted to reinstate my mortgage payments immediately. By the time they finalized their decision that they couldn't help me at the end of XX/XX/XXXX, the amount I owed them was {$50000.00} from late payments and other charges and now it is {$70000.00} due to the addition of all the foreclosure lawyer fees. Remember that I contacted them the day I started working to begin paying on my mortgage again I want to know why they charged so much money and I want it removed from what I owe because I should not be held liable for their horribly managed company. I did everything I could to avoid foreclosure and they did absolutely nothing. I should not have to pay for that. They switched my account managers 3 times, and each time the new account manager made me fill out the same 15 page modification application paperwork because their system lost the previous applications I'd submitted along with losing everything else in my file. They never called me once during the 7 months it took them to make their determination that they couldn't help me even though I was fully employed. I called them every single week during this period and their records confirm this. This was the most stressful call of my week because they never had an answer, always made me fill out the forms again because they had been lost in their system and once one of their " Customer service agents '' told me that my house was in foreclosure in the summer of XXXX even though I had been doing everything possible to re-start my mortgage which was the most stressful and hard thing for me to hear that you can imagine. My kids and I love our home and this was devastating. They gave me the phone number for XXXX XXXX XXXX handling my account and I called them so they will have a record of that call. The XXXX lawyer I spoke with told me it wasn't in foreclosure, they were still waiting for Bayview to work with me since I was working and wanted to stay in my home and that I needed to call them back which I did and that conversation took another stressful 2 hours out of my day, all to no avail. I wasted hundreds of hours to fill out their 15 page modification application paperwork 3 times and calling them every week for 7 months, all to no avail. I contacted them every week for 7 months to see if they'd made a decision yet which they never did until the end of that period, all while I was working full time! Each call took at least 30 minutes from being on hold and then trying to find my account in their system, determine why they weren't getting my file completed and trying to find the account manager I was working with since they kept leaving the company and they assigned me a new one every few months! I called again at the end of this period and the " customer service manager '' I spoke with who finally gave me the result of their months of time was to tell me that I wouldn't qualify for a modification and that my only choice was to get the house on the market ASAP. They gave me no reason for their decision. They made no mention of other alternatives or chapter XXXX to save my house even though I stressed the fact that this was my main priority every time I talked with them over the 7 months. I had to work with a separate refinance company after XXXX/Bayview made their determination after 7 months that my only option was to get my house on the market immediately. This XXXX XXXX XXXX charged me {$4000.00} to work with XXXX/Bayview to modify my loan and avoid foreclosure but they weren't able to help me ultimately since I hadn't paid on the mortgage for a year before getting the forbearance which XXXX XXXX XXXX didn't bother to tell me up front so they too could charge me for something they knew they couldn't do for me. I want all of that money plus damages returned to me by XXXX/Bayview. I haven't been able to get any credit for the past 36 months even though I have been working all of the time since I contacted them on XX/XX/XXXX to start paying on my mortgage again after I started working again simply because I couldn't get XXXX/Bayview to make a determination on my file for 7 months. This has halted my business plan that my contractor and I have had for over 12 months to move forward with purchasing a fixer upper to sell with deep experience he and I have in this area. The opportunity cost of the money I could be earning is another way their unlawful practices harmed my kids and I. I am paying an exorbitant interest on my car - .01 % under the illegal interest rate limit because of my horrible credit rating after not paying on my mortgage, which is ALL XXXX/Bayview fault since it took 7 months to make a decision even though I called them the day I started working again. The fees XXXX/Bayview foreclosure lawyers charged my account was for $ XXXX/hr. I want all of that money removed from what I owe. To have to file a chapter XXXX after I had to file a bankruptcy and do a short sale on my house in XXXX is devastating to my credit even though I took every action I could to avoid it, see above. I had to file bankruptcy at that time and sell my house through a short sale because our country was in a depression from what the wall street " bankers '' ( I have other names I call them that are inappropriate for a letter ) that sank our country 's economy by chopping up mortgages into little bits, selling them off in packages and then betting against them in the market and the devastating effects of those losses in the market threw our country into a depression. I was XXXXne of 14 million Americans who lost their homes during that horrible period and I did everything I could to remain financially stable and only asked for a few months of putting my mortgage on hold while I secured a new job after I turned XXXX and didnt realize the hiring problems that caused me ; but that doesn't mean I should lose my rights as a person which is what XXXX/Bayview has tried to do to me in this process. XXXX/Bayview never gave me an answer as to why they wouldnt approve me for a modification even though I made enough money to make the payment comfortably. I have documentation for all of the above, who I spoke to at XXXX/Bayview and when and all of the time I spent filling out their 15 page forms 3 times and calling them every week for 7 months until they finally told me there was nothing they could do. This company put my life on hold for years and prevented me from moving forward with my life. I am a single mother with no family and had to seek therapy due to the stress of this situation which is still having an impact on us since they took advantage of me and had NO regard for the impact they were having on me and my children. Ive been working very hard in the XXXX XXXX industry for 20 years and I cant even get a $ XXXX/mo car loan for my son because of what this company did to my credit. Complaint: Hi I need to change my insurace co. Please, email me the necessary documents so I can have insurance with XXXX. That insurance does not pay. My house is destroeyed, and nobody care. Bayview bought the mortgage from XXXX XXXX XXXX XXXX but they want from me XXXX dollars, how can I pay such amount, the apprise of the house is XXXX SirAbout 7 months ago my house in XXXX XXXX XXXX XXXX, XXXX, Florida XXXX was invaded by people, they put 10 dogs in the house and misused my house and trespassed my house. I called Sheriff a deputy came and said, they invaded your house, but they were not at house at that time and only the dogs were there, and he said I have to call animal rescue and they can move the dogs. I called them, but they did not come. They said sheriff should first send the people and then they can come and take the dogs, I waited there until the people came, I called sheriff and some deputies came, but the people said they rented the house and the deputies did not ask them for documents and only the words were documents and the deputies have gone, now they were encourage to destroy the house as they thought sheriff can not send them out. I went to the court and the court people told me, as they invaded the house and tress passed the house the sheriff should send them out, again I called sheriff and the deputies came and this time they said, the court should give us permission to send them out. And they told me I have to go to the court again. The game between sheriff and court took months until, my previous tenant hired an attorney and he guide or forced the sheriff to send them out. But they destroyed the house with their 10 dogs, now it is over 3 months that they have gone and the sheriff do not send the paperwork to the state attorney. The contractor estimates they damaged the house over 150,000 dollars and I have to pay this money. It is over three months that insurance company play a game and do not pay. The contractor said that they have enough documents to start the work, and the Bayview people do not contact the contractor to listen to their explanation. Because their house is not destroyed and they do not suffer, and do not take any serious action, sheriff house is not invaded and destroyed so they do not take any fast and serious action too, it is fine for them, I have to pay and am responsible to pay on time and if I do not I have to pay fine and late fee, but the system does not care that my house is destroyed by people and invaders and the 10 dogs damaged doors, floor and electric system in the house. It is fine and I have to pay? How can I pay, I worked 45 years as a XXXX and XXXX XXXX XXXX and with my small retirement money how can I pay all these costs? I can not print money and pay? How can I pay in the time that my house is invaded and destroyed by people and their dogs? Imagine if your house were invaded by people and their 10 dogs and you could not go there for 7 months and you could not live there for more than 7 months, which condition you were in, is it fine? I have a lot of paperwork from insurance, but they do not pay any money, how can I repair all these water damage, and other damages? Here is the letter I wrote to the Bay view, they kept the check from the insurance company and want some documents from contractor, and contractor says that he has enough paperwork and documents to work. And Bay view do not contact the contractor even I gave them the telephone number, the problem is that all of them are fine, I am the only one who his house is invaded and destroyed and for them it is fine? Dear Bay view company It is over 3 months that we are plying the game of insurance. My house is destroyed and totally damaged and I am busy with paperwork. The contractor said yesterday that he has license for repairing and remodeling and not for building a house from foundation and my house need to be repaired from the invading people and damaging operated by 10 dogs and water damages, I do not want to build a new house. I asked them to explain for you the situation and I hope that the game will be finished. I am the only one who his house is destroyed and damaged and must suffer, I am responsible to pay one time and if I dont, I have to pay late fee and extra interest, but the other side play with my time and energy, because the contractor said, what he had insurance and license is enough for repairing and you did not call him and speak with him, I gave his telephone number and asked you to call him, because if he call, he can not speak with you as a lot of robot are between you and him. Please, do something, imagine if your house was destroyed by invasion of people and 10 dogs and damaged totally by them and water and you were after paperwork for over 3 months, what would you feel? I pay taxes and insurance but as my house was invaded by dogs and people, I have to pay attorney to force the sheriff to do their job. Because, sheriff house was not invaded and destroyed. It was fine for them as my house was invaded and destroyed? I hope the game will be finished soon. Please, call the contractor his number is XXXX and his name is XXXX. The other matter I want to change my insurance company to state farm, please send me the paperwork so that I can change the insurance company. Please have in mind that I am the only one who his house is destroyed and suffering, the rest people are fine. There is an assumption by the court that you want a free house and not paying your mortgage. 2. Yet the court procedure takes a few minutes with the judge and plaintiff doing all the talking. 3. The court did not allow me to cross-examine or question the plaintiff. 4. My motion and plea were ignored by the court. 5. The rules of the court were compromised in favor of the plaintiff. 6. Dates were set by the court for making the decision in plaintiff favor. 7. Complaint: Hi, I have a very urgent matter once again due to a foreclosure sale on XX/XX/2019. FOR A LONG TIME NOW IM STILL HAVING TROUBLE GETTING A HOLD OF SOMEONE AT THIS COMPANY. EVERY TIME I CALL AND INPUT MY ACCOUNT NUMBER IT GOES STRAIGHT TO VOICEMAIL AND NEVER CONNECTS ME TO ANYONE AT BAYVIEW. This is a very very big problem and issue as I can not speak with anyone and do not have a direct contact to a person. I applied for a loan modification to Bayview Loan Servicing , LLC numerous times before and they always prolong the process. Never gave an offer and never accepted my loan modification. Ever since then I have been trying to get a loan modification and I can not get one from this company. I mailed in my rma packet and all required documentation as per guidelines. Im in a loan modification review as they should have requested documents for a review. From the past Ive had trouble calling Bayview Loan Servicing , LLC to ask about any status or updates for the loan modification and a status on the loan modification I get nowhere. I call in, the phone system asks for my social security number or my loan number, I put in the loan number and or social security number, it rings couple of times and then it goes straight to a common voicemail. It says thank you for calling the underwriting department please leave a message or set up a time to call you back. Ive tried multiple times to set up the call back and never got a callback and the other times their phone system just hung up on me. I would try this couple more times at different times in the day and get the same results. These are the numbers I have called to get in contact with anyone at Bayview Loan Servicing , LLC : XXXX, XXXX, XXXX, XXXX, XXXX, XXXX all and each phone number has the same process. As soon as I input my loan number it seems like their system registers my loan number and does not transfer me to a live person at Bayview Loan Servicing , LLC but transfers me straight to a voicemail. I feel like this is international so that I would not be able to speak with any of the Bayview Loan Servicing , LLC representatives and to prevent me from getting a loan modification. This feels like a very big problem that they do this. I can not speak with anyone regarding my loan thus iam not able to know the status of the loan modification and I can not move forward. In the past I had this issue as well and it has not been addressed. In the past this has happened multiple times on multiple days and each one does this until I clicked the number 0 for a very long and tedious process I finally got someone. But now it does not work and it goes straight to a voicemail which even after leaving voicemails to be called back I never get any call backs. If Im not mistaken Bayview Loan Servicing , LLC is in violation of my Homeowner Bill of Rights. Seems like they do not want to help me but to just sell my home.

Complaint: I have a loan with Bayview XXXX. By their numbers ( which are incorrect ) I owe about {$13000.00} in real estate taxes and {$2000.00} for insurance ( annually ). This is roughly {$16000.00} per year. They have been deducting {$1700.00} monthly for escrow which totals about {$21000.00} annually. After paying all taxes and insurance this year there was a remaining {$2000.00} ( roughly ) in my account. This actually means there will be {$23000.00} ( roughly ) in the account to pay {$16000.00} in taxes and insurance next year. This is an overage of roughly {$7200.00}. Since XX/XX/2019 I have been requesting a total escrow report. As of date, I have not received one. Further, since this date, I have requested the escrow be reduced given they are rolling over thousands of dollars. I was notified today that they will reduce payment rough {$200.00} per month or {$2400.00} annually. This reduction falls about {$5000.00} short of what is actually needed. I have been with Bayview XXXX for 2-years and escrow payments have gone up about {$800.00} per month since they took over the loan. My complaint is Bayview XXXX has negated payment reduction for 6 months ( since they want to put reductions in for XX/XX/XXXX payment ) and are charging exorbitant unwarranted escrow fees. Also noted is there has been a tax reduction on this property, not a real estate tax increase. Further, I am XXXX this year and real estate taxes are frozen in XXXX County for seniors. There is no justifiable reason for these fees given there are no increases anticipated.

Complaint: I believe Bayview Loan Servicing, LLC., is trying to take my home form me. I currently owe less than XXXX XXXX dollars. So, in less than 4 years my home will be paid for. Approximately 2 weeks before being switched to this company, XXXX XXXX notified me that my mortgage was sold to Bayview Loan Servicing LLC in XXXX XXXX, Florida. The sale occurred in the middle of XXXX, XXXX. Because of my impending divorce and my husbands refusal to abide by the judges ruling, ( mandated XX/XX/2019 XXXX, that he continue to pay the mortgage, I fell 3 months behind in paying my mortgage. The house is only deeded in my name. After being charged with contempt, out of fear, my husband began making partial payments in XXXX, but to date he still owes for mortgage payments in arrears. Albeit, the last two payments he has made have been full payments. The representative from Bayview who I was assigned to me is, XXXX XXXX. She is an unprofessional mean-spirited liar. She has failed to communicate with me even when I have made appointments to speak with her via telephone. I have made five appointments that she has not adhered to. Then she lied and said she called, but there was something wrong with my phone. She refuses to answer her business phone when I call. She rejects my email messages. she has lied, stating that I made repayment agreements I never consented to. She has sent me documents with erroneous information in it and tried to get me to sign those fabricated documents. She has refused to offer me more than one repayment option on the back-mortgage amount I still owe. I have asked Customer Service for a different loan officer, but my request has been ignored. I am beginning to believe that she is the only women working at that company. Yesterday, XX/XX/1019, my husband made two full back payments. But although Bayview listed both payments on my statement for XXXX, they only credited my account for one of those payments. At this point, I owe less than XXXX dollars in back mortgage payments. If the payment that I wasnt credited for was added to my account, I would owe less than {$3000.00} dollars. So, today, XX/XX/2019, I tried to make a partial payment of {$1500.00} dollars via Bayviews website. That way I would be completely caught up before the end of XXXX. I was informed that I could not make a payment. Furthermore, I was informed that before I make any future payments, I must consult with XXXX XXXX XXXX. There is something very sinister about that company, and there are plenty of negative reviews online and requests by disenchanted consumers to start a class action suit against the company.

Complaint: I have tried tor to resolve my issue of a loan modification with Bayview Loan Servicing several times. I have resently filed a complaint against them for not allowing me to have modification do to an issue with my employement during the last one that made it impossible to make the third , and last payment on time for my last modification. I gave them evidence of the change in income, and job that caused this, and it was not excepted, even though I did try to make the last payment only two days after their cut-off date . In their last denial, they gave me the option to file for another loan mondification along with sort sale , and deed in-lew of foreclosure. I submitted a new loan modification application on XX/XX/2019, requesting new consideration. I Am doing this new application even though it has been over a year since the old approval , to which they have denied my because I an still the year due to when the trial months fell, not the approval itself. I want to ensure that I will be given fair consideration , and not rail-roaded into losing my home.
