Complaint: URGENT!!!!! SALE DATE TOMORROW FRIDAY XX/XX/2019 I am a crime victim. My home was stolen through a title crime by two time felon XXXX XXXX XXXX through a forged Deed transfer which took title out of my name. XXXX was arrested on XX/XX/2019 in XXXX County for Mortgage Fraud and is currently in jail awaiting sentencing because he could not meet his bail of $ XXXX. I was in the middle of a loan modification and error process when my servicer Bayview Loan Servicing , LLC abruptly stopped it and dual tracked me to a foreclosure sale, for lack of holding legal title, knowing it was a criminal that stole my title. They are well aware of this title crime yet continue to conceal it in order to pass it off as a marketable title foreclosure sale. It DOES NOT have marketable title as it is tainted by forgery. This is a federal crime. Under legal statutes they are required by XXXX to report this in a Suspicious Activity Report ; Not use it to their advantage. My title shows XXXX XXXX, alter ego XXXX, as owner. They are not only aiding and abetting but they are selling a property that has been used in a crime to an unsuspecting buyer at a foreclosure sale.

Complaint: I completed 2, 3 month trial modifications with Bayview Loan Servicing LLC in XXXX for {$1100.00} and {$1000.00} in XXXX. I almost had to complete a 3rd modification because Bayview claimed I refused the offer. This is why I'm filing this complaint today, Bayview has been undermining this entire process since XXXX. I filed a complaint ( File No : XXXX ) with the State of Illinois XX/XX/XXXX. During the investigation Bayview failed to disclose they were pursuing foreclosure against my property. Bayview gave the impression they were going to continue the modification process by sending " New point of contact '' letters, having these people contact me and giving me false hope of the process. I've called numerous times, leaving messages and email, all unanswered. I received a notice from their attorney 's office XXXX XXXX XXXX for Judgment of Foreclosure and order of sale XX/XX/XXXX. The order has the Judges court stamp for XX/XX/XXXX. XX/XX/XXXX, Bayview drafted a letter claiming, " We have not received the required documents within the time allowed, this is the same thing Bayview claimed XX/XX/XXXX, XXXX, and XXXX. I emailed the information first to the investigator XX/XX/XXXX because Bayview 's website continued to load never allowing to upload the assumption packet. When then point of contact XXXX XXXX called me XX/XX/XXXX, he assured me the communication between me and Bayview would be better. He said Bayview claimed they didn't get the General Authorization, Cover Sheet, Complete Customer Information Worksheet, Applicant Acknowledgement and Agreement, and w-9 form signed and dated. I explained to him Bayview 's website wouldnt allow me to upload the documents and that investigator XXXX emailed it to Bayview. I re-sent the paperwork through email to him the same day ( XX/XX/XXXX ), and never heard from again. I tried calling him at the number at the bottom of his email, it went to a different person voicemail. I left messages with that person to pass to XXXX XXXX dont remember his name ) that person did call me back but not XXXX. I would call and sometimes the line would just ring, then a busy signal. The calls would drop, sometimes the automated system would go haywire. I emailed XXXX XX/XX/XXXX, requesting a call XX/XX/XXXX, and again XX/XX/XXXX, he never called backed. I called multiple time XX/XX/XXXX, and could not through. I received a new point of contact letter XX/XX/XXXX. I email XXXX XXXX the same day but got no response. I filed a motion to vacate XX/XX/XXXX, but because the Judge who signed the order is on vacation until XX/XX/XXXX. I called his clerk and left a message asking about a temporary Judge but never got a return call. I want my property, but Bayview is helping who ever it is trying to get my building, take it. Bayview is dishonest in their practices, and they use the same reason for why this process is halted. I have email confirmation proving I sent the necessary documents. Bayview and it's attorney deceived the Judge. This is Bayview 's process not mine, it shouldn't take this long to complete a modification, it's been going on for 4 years. I completed 2 mods and the paperwork, Bayview is dragging the and are stealing my property.

Complaint: My loan was sold from XXXX XXXX to Bayview when I got behind on my payment. XXXX XXXX told me they were selling it to another bank and did not explain why. When I asked they said banks do this all the time. Then I found out it was this predatory loan collection agency called Bayview Loan Services. Bayview has had my loan less than one month, already they have come up to my house repeatedly, at least 3 times by now, they have made phone calls, texts, and sent between 8-10 letters. They are acting in a predatory nature. I have a XXXX XXXX child in the home and I do not want strangers here. If I call in to tell them Im going to make a payment, they make me go through a long history of why I am behind on my loan. They use false kindness to get you to tell your story and then they pounce on that to use it against you They will not leave me alone even though I have made two payments since they had my loan. Theyve claimed I had payments still pending when the payment had been made over a week before. Theyve kept me on the phone for an hour trying to explain my situation, then wanting me to tell it again next time I called. They said they work for an investor not a bank, and when I asked who, they said XXXX XXXX and that I had signed paperwork saying they could come to my house after 45 days. Not true. A customer service rep told me to put my taxes through a website that wouldnt actually file them if a needed to. They are completely scammy and have people working for them who look and sound nice that try to gain false trust, and to get people to open their door. Bayview also seems use a certain type of person mainly woman to do this on purpose. I wouldnt be surprised if it was a specific business practice of theirs. They harass me almost on a daily basis ether by phone, at my door, or with letters. They say things like, we only want to help you, or, we need to make sure you hear your welcome information - these people need to be reigned in with some sort or regulation or fine because they are out of control.

Complaint: Since Bayview took over the mortgage from XXXX XXXX company in 2018, there have been issues with Bayview not applying payments, adding " fees '' that are not ( in my understanding ) appropriate, and then sends letters stating that I am behind, when I am actually paying based on the figure settled with XXXX ( {$400.00} / month ) plus additional to cover any late fees. In XXXX, just after I separated from employment with XXXX XXXX, Bayview began sending letters stating that I was approximately {$1600.00} in arrears, even though I had had been paying monthly ( again, based on XXXX 's amount ). I viewed my Bayview account online today to see where Bayview actively held some payments, and applied others. Attached are documents showing the payments via XXXX XXXX bill pay, and additional documents ( submitted to Bayview ) showing a hardship that should resolve in the next two weeks ( car accident in XXXX prohibited my gaining new employment whilst receiving chiropractic care ).
