Complaint: My home loan was originally with XXXX XXXX. We had just agreed on a forbearance plan that was to start XXXX due to hardship. On XXXX, my loan was transferred over to Bayview Loan Servicing LLC. They are refusing to honor my forbearance plan. I have included the documentation showing the transfer and the forbearance plan that was accepted with XXXX XXXX. Spoke to XXXX ( ID # XXXX ) at Bayview Loan Servicing ( BLS ) and he stated that he is trained to say that they can only honor it if it is a fully executed completed loan modification and nothing else. Transferred to XXXX ( ID # XXXX ) Escalation dept and she stated the same thing.

Complaint: XX/XX/2017 to the present we have been charged a corporate advance fee with a total amount exceeding {$27000.00}. We have been told that this fee covers fees charged by the servicer but have never been given an itemized statement showing why these fees are justified. We have had problems through the years with employment, change of employment, lack of employment, health issues and reduced income. We are currently in a payment plan and on two months from being done, our payments are {$1400.00} a month for 6 months. We are seeking an explanation an audit of our mortgage, money to be returned or credited back to our account and the information to contact our servicer ourselves.

The person signed after the cut of date of pooling and service agreement with SEC the alleged trust that is was placed in. The assignment was signed by a Lawyer that was actually the foreclosure Attorney in XX/XX/2010 he sign as President of XXXX. He was not the president of this company, therefore this assignment is tainted and fraud cant be the based of obtained a deed. I have also mailed s request for a loan modification and they havent responded. I also made calls and all had been to no avail.

Complaint: Name : Lender Name : Bayview Loan Servicing Loan # : Dear Sir/Madam I am writing this letter to explain my unfortunate set of circumstances that have caused us to become delinquent on our mortgage. I say Us because my parents and I live in our home. In XXXX I lost my job, due to a company merger. I lost my medical coverage and unfortunately that year I went thru several XXXX XXXX with no insurance. As soon as I got better I found a job that only gave me resources to put food on the table. Finally, in XX/XX/XXXX I got the opportunity to work for a big company, I was getting back on my feet when in the month of XX/XX/XXXX, I slipped in a split position at XXXX, that Couse injuries to my XXXX and XXXX XXXX on my XXXX XXXX I was unable to walk. Knowing that I have responsibilities I was persistent to walk even in XXXX I attended work but was not able to perform my job duties due to the scrutinizing pain that I felt while sitting, driving, walking impossible to go up flight of stairs or carry my briefcase. I lost my job at in XX/XX/XXXX. I looked for a new job immediately to get health insurance, but it was not enough to pay all my responsibilities. after 4 years of suffering my XXXX discovered that the trauma of my fall had XXXX XXXX XXXX that held my XXXX and had a XXXX XXXX that had form due to XXXX XXXX. I went thru XXXX during that time frame the association foreclose on my house, I had paid them but in the process of the HOA changing attorneys there was no record of my payment, that law firm had closed and kept the money I tried to stop the sale and again brought all monies due to the HOA {$15000.00} to the HOA, they said they could not reach the new attorney in charge due to a storm that damage power lines and my house was sold at a public sale on XX/XX/XXXX for {$30000.00} XXXX XXXX. The court tried to reverse the sale, but the buyer would not appear in court and registered the title even thought there was a motions and objection to sale pending. I called Bayview Loan services and informed them of the situation and all they said was to try to get the title back, so you may apply for a modification. I hired lawyers, we did a stipulation and settlement agreement with the third party person to return the title and I have been paying him all this time. In XX/XX/XXXX I finally payed him off, and I have registered the title back in my name. I have tried several times to get a loan modification and Bayview keeps changing the officers, and only say I have been decline but never sends nothing in writing, modification request done in XX/XX/XXXX decline due to investor guidelines I have asked who is declining or why and they only tell me I will receive there response in writing. I payed another attorney to defend my foreclosure, had to file for Bankruptcy chapter XXXX to give time for a modification called MMP thru the bankruptcy defense they decline said I did not make enough money but never sent a letter. " error by attorney ". After I went to NACA, and I was helped free of charge,, they guided me and i did another modification request and it was decline saying it did not have 38 days and was told MrXXXX XXXX XXXX that I had to apply again for a loan modification again I paid XXXX XXXX XXXX to request and extension of the foreclosure and it was reschedule for XX/XX/XXXX and again I was decline, reason " the investor did not approve '' but I have not received a letter notifying of such nor my options if any. Bayview loan services does not even tell me who the investor is. nor sends me a written letter of denial or options even after caling them The last person to work the modification was Mr.XXXX XXXX XXXX a very rude person with no XXXX that even got the NACA agent upset due to his rudeness and aggressive tone he used with her. she said she will complain to his superiors. Please note that i have made payments Under Chapter XXXX bankruptcy, The Trustee XXXX XXXX XXXX has notify me that Bayview loan servicing LLC refuses to accept payments from the Trustee ..

Complaint: XXXX has improperly frozen our HELOC based upon wrongful information in our credit report. Even though we contacted XXXX immediately, they said they would not fix their mistake until we got a letter from our first mortgage company stating that their info was wrong. And now that we have that letter, their customer service keeps failing to resolve the issue ( the last straw was today when they forwarded us to an online survey and " special offer '' when they said they were transferring us to the HELOC department who would fix the problem ). XXXX 's customer service has been atrocious, XXXX clearly ignored information in our credit report stating that the wrongful information had been flagged, and was under review and/or already in process of being corrected ; and now that I've followed their instructions ( and spent time and money hiring a lawyer to get this fixed ) they are non-responsive via their own customer service system to get this sorted.

Complaint: My mother passed away in XX/XX/2018. She owned a condominium in XXXX XXXX, at XXXX XXXX XXXX XXXX XXXX XXXX CT. The property has a mortgage with Bayview Mortgage. I called them in XXXX explained that we were selling the home, and sent them a copy of the will. The representative at Bayview told me to " keep paying one payment a month and we will be fine. We listed the property for sale with a Realtor and I have continued to make a payment each month as instructed. As of this date the lender has not taken any legal action against the property, which is now in probate. However, at the end of XXXX their inspector changed the locks on the property and posted a notice that no one can sell the property. This is interfering with our ability to sell the property, as well as depriving my family of the use of the property, which we are entitled to, as the heirs of the estate. Please help us regain possession of our family property. Bayview has no legal reason nor right to take possession of the home. The home is in good condition. In fact I have recently done substantial work to the property to facilitate its sale. The property was also completely secure until the lender broke into it illegally. Although, I have provided the requested probate documents to the bank they refuse to discuss the matter or respond to my repeated calls.

Complaint: Stop the Sale ) of my home on XX/XX/XXXX place a ( retainer ) on my account for my home and that your company correct your mistakes reinstate my regular modification.The sale of my home would have been illegal done By Bayview!! Because I have been contacting your company on numerous occasions to get my mortgage intact also for your company to fully reinstate my modification to correct amount of {$380.00} my regular payment on my documents before paying up my loan back In XX/XX/XXXX. Your company was given a total of {$7100.00} after being told by Bayview. Which was agreed upon after, all was layout that starting XX/XX/XXXX my regular payment and modification was reinstated back to {$380.00} because my mortgage was on track. But soon as the payment statement came Bayview came with a bogus layout saying I needed to pay XX/XX/XXXX {$91000.00} principal {$100.00}, Interest {$120.00}, Escrow taxes {$150.00}, Regular payment {$380.00}, Total Fees & Charges, Unpaid Past Payments {$530.00} total {$910.00} fraudulent fees coming from Bayview because all late fees & past due was included in the {$7100.00} bringing my account current as of XX/XX/XXXX and that I start paying my regular payment in XX/XX/XXXX which was actually agreed on start paying XXXX XXXX.This is all documented on record I feel like my home and account is being targeted in a form of retaliation/discrimination because after talking to Mr. XXXX on XX/XX/XXXX could not even explained why the {$91000.00} amount came from along with a young lady he transferred to right after telling him my problem with my account. Talking to Mrs. XXXX XXXX the same day she could not give me a reason for the payment and promised someone would call me back which I never received a call about the payment I feel fraudulent on your company behalf. She claimed at the time {$1700.00} which was bogus XXXX XXXX XXXX then she claimed a bad checks was why my mortgage was that amount and that lies because all that was included in the payment {$7100.00}. Then Mrs. XXXX XXXX XXXX claimed it came from XX/XX/XXXX bad checks and that is a lie I never sent bad checks and also all my fees was paid in the amount {$7100.00} XX/XX/XXXX. Feel like Bayview Loan been illegal applying false fees to people account then illegally taking homes that is very bad illegal practices. Not aware I recorded the conversation on XX/XX/XXXX XXXX ( call time 26:21 min ) with Mr. XXXX & Mrs. XXXX XXXX unaware I recorded my conversation with them for my own protection also so this can be handled legally because I was told long as I am involved in the recording it was legal. I been contacting them since that fraudulent amount was applied to my account. *****As of XXXX XXXX I obtained proof from Bayview Loan Servicing site they have been stealing form me possibly others as well. Complaint: I am in the middle of a repayment Flex plan with my mortgage servicer XXXX XXXX XXXX XXXX. The repayment plan is uploaded with this complaint. I have made the first two payments as required on the plan and would like to make the third ; however, I can not because my new loan servicer as of XX/XX/XXXX, Bayview Loan Servicing, has placed my loan with them in Active Foreclosure and they will not honor my current repayment plan. On XX/XX/XXXX, my home mortgage servicer, XXXX XXXX XXXX XXXX transferred my home loan to Bayview Loan Servicing. On XX/XX/XXXX Bayview Loan Servicing sent me a letter claiming I owe them {$350000.00} immediately, and if the full payment is not received in 30 days, they will obtain a judgment for the full amount of the mortgage against me ( this letter is uploaded w/ the complaint ). The amount due immediately is over {$10000.00} more than my most recent XXXX XXXX monthly bill indicates as principal balance due : {$340000.00}. There is no explanation from Bayview as to why another $ XXXX has been tagged onto my loan. I received the XX/XX/XXXX letter from Bayview on XX/XX/XXXX, at which time I promptly called Bayview to inquire why my loan is in collections when I was in a repayment plan with XXXX XXXX that was supposed to transfer over to Bayview. I first spoke with Bayview XXXX XXXX on XX/XX/XXXX. XXXX didn't even have a current phone number or email for me, so XXXX XXXX provided him with old data. XXXX stated that the paperwork from XXXX XXXX is a mess so it's taking some time to sort things out. If that was the case, then Bayview should not have jumped to placing my loan in Active Foreclosure, which I discovered nextt on XXXX XXXX, while speaking with Bayview loans asset XXXX, XXXX XXXX. XXXX informed me my loan had been placed in Active Foreclosure with Bayview on XX/XX/XXXX, unbeknownst to me. I asked XXXX if she could contact XXXX XXXX to obtain the missing repayment plan for my file so things could get corrected and I wouldn't be in danger of foreclosure. XXXX said she can not do that. That I would need to do that and then send Bayview a copy of the agreement I had with XXXX XXXX to Bayview 's email : XXXX. My conversation w/ XXXX was at XXXX XXXX. I called again to speak with someone who would be more helpful than XXXX, and ended up with XXXX on XX/XX/XXXX XXXX XXXX. XXXX advised me to file for a new workout plan or hardship with my new servicer since Bayview would not be able to honor my existing repayment plan with XXXX XXXX. XXXX added that is all I can do at this point if I wish to try to avoid foreclosure. On Saturday, XX/XX/XXXX, I received a letter from Bayview Loan Servicing 's attorney 's office stating my home is being foreclosed ( this letter is uploaded as well ). I immediately called on XX/XX/XXXX Bayview and spoke with XXXX at XXXX XXXX. XXXX consulted w/ her supervisor, and again, said I would need to re-file for a workout plan with BAyview because Bayview would not contact XXXX XXXX to procure the existing repayment agreement. I have emailed my written repayment agreement with XXXX XXXX directly to Bayview three times now. They still claim as of today that they have not received it. I spoke with XXXX on XX/XX/XXXX. I sent over the repayment agreement again, at XXXX XXXX. Because Bayview and XXXX XXXX refuse to communicate with each other regarding the transfer of my loan, my loan has gone from an active repayment plan that I was current on and had paid {$8100.00} toward, to a loan in active foreclosure that I can not make a single payment on. And, now the letter from Bayview 's attorney 's office has increased my mortgage amount yet again, probably to include their fees which should not even be happening in the first place, to {$350000.00}.

Complaint: My name is XXXX XXXX. I have a loan with Bayview Loan Servicing LLC. I would like my home to be released to me. I would like Bayview Loan servicing LLC to stop negatively reporting on my credit bureau report. I've never had a late payment. I feel like I'm being treated unfair. I paid my mortgage off in XX/XX/XXXX. I have been paying on fees add to the mortgage.. My mortgage came from XXXX. I really only owe {$380.00}, this is an add on created at my first mortgage company, XXXX. Since I have Bayview Loan Serving LLC has acquired my mortgage it has increased every time the payoff is near. I have over paid {$1200.00} on this mortgage and I need help to be done. Bayview wanted {$1200.00} for the add-on to mortgage. When I started paying it off the add-on amount kept changing now it is {$1700.00}. This add on I was informed by Bayview Loan Serving LLC. XX/XX/2019 the last payment was made. I only authorized one mortgage payment of {$360.00} for XX/XX/2019. There was a second payment withdrawn from my account for {$360.00} on XX/XX/XXXX unauthorized. The balance on the mortgage after the first mortgage payment was made in XX/XX/XXXX of {$360.00} would have been approximately {$100.00}. I received the check for {$250.00} in the XX/XX/XXXX mail. I checked my bank statement and call my bank. I had my bank reverse the second mortgage payment. Receive documents in the mail saying to pay my mortgage off and there are no liens on the property. Bayview gave me a representative by the name of XXXX called me on XX/XX/2019we did final payment on the mortgage of {$200.00}. I also received an overnight package requesting XXXX XXXXsome dollars to close the mortgage out overnighted do XXXX the day before. Yesterday I received the documents saying I owe {$1600.00}. This is what they want to make the mortgage current. Every payment I made in XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, are marked as unpaid. My bank statements will prove that I paid my mortgage. The letter also says I'm 149 days delinquent in my mortgage and they want to foreclose on my home as of XX/XX/2019. I pay all my own taxes and insurance on the property.

Complaint: Hi, I have a very urgent matter once again due to a foreclosure sale on XX/XX/2019. IAM STILL HAVING TROUBLE GETTING A HOLD OF SOMEONE AT THIS COMPANY. EVERY TIME I CALL AND INPUT MY ACCOUNT NUMBER IT GOES STRAIGHT TO VOICEMAIL AND NEVER CONNECTS ME TO ANYONE AT BAYVIEW. This is a very very big problem and issue as I can not speak with anyone and do not have a direct contact to a person. I applied for a loan modification to Bayview Loan Servicing , LLC numerous times before and they always prolong the process. Never gave an offer and never accepted my loan modification. Ever since then I have been trying to get a loan modification and I can not get one from this company. I mailed in my rma packet and all required documentation as per guidelines. Im in a loan modification review as they should have requested documents for a review. From the past Ive had trouble calling Bayview Loan Servicing , LLC to ask about any status or updates for the loan modification and a status on the loan modification I get nowhere. I call in, the phone system asks for my social security number or my loan number, I put in the loan number and or social security number, it rings couple of times and then it goes straight to a common voicemail. It says thank you for calling the underwriting department please leave a message or set up a time to call you back. Ive tried multiple times to set up the call back and never got a callback and the other times their phone system just hung up on me. I would try this couple more times at different times in the day and get the same results. These are the numbers I have called to get in contact with anyone at Bayview Loan Servicing , LLC : XXXX, XXXX, XXXX, XXXX, XXXX, XXXX all and each phone number has the same process. As soon as I input my loan number it seems like their system registers my loan number and does not transfer me to a live person at Bayview Loan Servicing , LLC but transfers me straight to a voicemail. I feel like this is international so that I would not be able to speak with any of the Bayview Loan Servicing , LLC representatives and to prevent me from getting a loan modification. This feels like a very big problem that they do this. I can not speak with anyone regarding my loan thus iam not able to know the status of the loan modification and I can not move forward. In the past I had this issue as well and it has not been addressed. In the past this has happened multiple times on multiple days and each one does this until I clicked the number 0 for a very long and tedious process I finally got someone. But now it does not work and it goes straight to a voicemail which even after leaving voicemails to be called back I never get any call backs. If Im not mistaken Bayview Loan Servicing , LLC is in violation of my Homeowner Bill of Rights. Seems like they do not want to help me but to just sell my home.

Complaint: My husband had his 3rd XXXX XXXX on XX/XX/2019. He was on XXXX XXXX. with reduced income till XX/XX/2019. When he returned to work he was Fired! We were already behind on the mortgage before his XXXX. My husband is working full time again & I work part-time. My mortgage company is Bayview. I have applied 3 times for a modification. Bayview responds back with higher monthly payments to get us caught up. My current payment is {$1300.00} with 5 % interest. We cant afford this much less a higher payment. If Bayview would put my late payments @ the end of my loan & lower my interest rate we could afford it! We owe about {$130000.00}. We have lived in our house for 14years.

Complaint: I have been working with Bayview loan servicing for months to modify a previous loan modification that I was late for one payment. I have filed a complaint with the CPFB over this issue. I was denied due to a rule that I can not have another modification within a 12 month period. The anniversary date for the modification in question is XX/XX/XXXX. I was a denied for the last application on XX/XX/XXXX, one day from the anniversary date of the last approval. I have supplied Bayview all proofs that they have requested pertaining to reason that I was late on the last payment, that I am current employed with a better paying job, and that I am receiving rent from them non-owner occupied side of the XXXX. I am requesting that Bayview give me proper consideration of my situation, and that timeframe that I am making my request for a new modification per their rules.
