Attempts to collect debt not owed

Debt collection: Payday loan debt

Debt is not yours
Complaint: On XXXX and XXXX two collection reports were reported by ADASTRA Recovery. One was from XXXX and the other is from XXXX XXXX XXXX according to my credit report and were both for in the amount of {$310.00}. I have never opened these accounts and have told AdAstra that my accounts were compromised during that time. I had previously had some ATM theft so i filed a police report on XXXX when I noticed my identity had been stolen. XXXX XXXX documented the identity theft and then i filed a statement with them on XX/XX/17. After all the tourment I assumed it was over, Untill 5 months later as ADASTRA had told me that XXXX and XXXX had reported this 6 months after. I have mailed in the requested documents and 11 months later this is still open. {$310.00} is not even a large number, im just not willing to pay for it if i didn't open these accounts. I really do not understand why I have to suffer with a lower credit score when these are completely fraud deposits to someone using my identity. The only thing they could verify with me was that the user had used my mothers maiden name. Completely not fair when i hope you know someones moms maiden name when they just stole all your information.

Took or threatened to take negative or legal action

Debt collection: Payday loan debt

Threatened or suggested your credit would be damaged
Complaint: This company is reporting to all 3 major credit bureaus that I still owe a debt in connection with a payday loan. I satisfied and paid this debt on XX/XX/2018 through a law firm they hired to help collect the debt. When I speak to AD ASTRA ( the company reporting the collection to equifax, transunion and experian ). They tell me they have not yet received " remittance '' from the law firm and refuse to report this accurately as paid in full. The law firm, XXXX XXXX, states they sent AD ASTRA the proof of payment on XX/XX/2018 and that AD ASTRA is the only one that can correct the reporting on my credit. I called AD ASTRA today and was hung up on repeatedly and told they would not correct this reporting. I have filed disputes with all 3 credit bureaus and supplied the proof with documentation, but AD ASTRA has maintained this reporting to all 3.

Defendants, when preforming its investigations into Plaintiff disputes, employed superficial faux-investigations, which consisted of essential matching the inaccurate data previously reported with inaccurate data currently in its system. 14. Defendants also should have responded to the CRAs that the account could not be verified because Astra did not have Plaintiffs signature on file. 15. Lastly, Astra failed to report to the credit reporting agencies that Plaintiff disputed the debt, which was inaccurate and misleading, and negatively affected Plaintiffs credit score because disputed tradelines are not taken into consideration in some credit scoring models. 16. The Defendants violations of the FCRA caused the Plaintiff actual damages, including harm to credit score, emotional distress, and inconvenience.

False statements or representation

Debt collection: Payday loan debt

Attempted to collect wrong amount
Complaint: I contacted Ad Astra, a collection agency based out of Kansas who was been reporting I owe them {$650.00} from a XXXX payday loan from XXXX. I contacted them in XX/XX/XXXX in which they offered me a settlement of {$500.00} on the debt for {$650.00}, I do not recall them saying anything about it expiring. I contacted them again in XXXX of XXXX in which they still had that settlement available for {$500.00}. The representative incorrectly disclosed the existing debt to what would be an unverified 3rd party on the inbound call, which violates FDCPA. I called them again last week and asked to pay the {$500.00} settlement, and now they refuse to take it, stating that it expired and now I can only pay the {$650.00}. I asked to speak to a supervisor and received the run around by the rep who was apparently passing messages from myself to her supervisor, and back through to me about why she's not going to take the call. ( This is unprofessional ). I ask to speak to the Director of Operations or the director of the floor and was told that there was only one manager in, and it was XXXX. After alot of begging XXXX did finally take the call and refused the {$500.00} payment of the settlement I was offering to pay today. I advised her that one of the reps there committed 3rd party disclosure on the call in XXXX and although she said she can review the call, she did not seem to care much. Ad Astra never advised me of the settlement expiring and I feel that as soon as I was ready to pay, they took it away and want the full balance now. I request that the CFPB does an independent audit at Ad Astra, reviewing every settlement call they have ever had to see if in fact they do or do not expire, and if they have ever accepted a settlement from a consumer after it allegedly " expired. '' I feel that that the {$500.00} COULD still be taken, but they are instead attempting to take advantage of an unemployed consumer to get more money.

Attempts to collect debt not owed

Debt collection: I do not know

Debt is not yours
Complaint: This company is trying to collect {$1900.00} from me for a debt they claim I owe. I have written them several letters since XX/XX/2016 demanding that they comply with the Fair Dept Collection Practices Act and the Fair Credit Reporting Act by ( 1 ) providing me a contract or bill with my signature on it as follows : " I am requesting validation, made pursuant to the Fair Debt Collection Practices Act. Please note that I am requesting validation ; that is competent evidence bearing my signature, showing that I have ( or ever had ) some contractual obligation to pay you. '' They sent me a computer printout of a bill, but nothing with my signature on it. They are in violation of the Fair Dept Collection Practices Act and the Fair Credit Reporting Act by claiming I owe money and they have no document bearing my signature wherein I allegedly authorized these charges. They are reporting this fraudulent claim to the credit bureaus as a valid debt, yet they are unable to validate the debt.

Incorrect information on your report

Credit reporting, credit repair services, or other personal consumer reports: Credit reporting

Information belongs to someone else
Complaint: Over the years I've had problems with family members credit accounts being wrongfully reported to my credit file including bankruptcies!. Recently my sister 's medical bills totalling more than {$4500.00} from XXXX XXXX XXXX have been put on my credit report and I've contacted XXXX XXXX XXXX who is the collection company handling the accounts. I've asked on XX/XX/XXXX,XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX to please correct this problem. XXXX out of XXXX accounts were removed in XXXX but there is still one account that remains on there and continuously damaging my score. In the past my mother and father filed Bankruptcy and that public record landed on my credit report for years! I was unable to get a car, house, or anything. I didn't know where to go for information. I finally walked into a bankruptcy office and showed proof of identity and they removed it. This also happened with my younger brother using his nick name and resulted in medical bills totaling {$7000.00} being inaccurately reported to my file. I worked hard to removed those accounts. It's unfair and not right that these company 's just pin these accounts on family members of the people that benefited from the credit accounts. They also need to find a better way to find the people. I was told that XXXX looked up the address and reported the delinquent account that way instead of reporting the account by the social security number. Reporting by address is XXXX and is wrong, not a good a practice because my sister and brother did live with me at one point. I have never had a fair chance to improve my credit score because of all of this. I am wondering if there is any way I can be compensated? Thank you.
