Attempts to collect debt not owed

Debt collection: Payday loan debt

Debt is not yours
Complaint: A few months ago I pulled my credit and notice AD Astra Recovery is reporting a balance of {$610.00}. Because I honestly believe this debt IS NOT mine, I've sent letters to this company asking to verify this debt. I'm sure this company has NOTHING with my signature saying I received this money because I don't ever recall getting a payday loan with them! I have not received anything but a print out of a balance they claim I owe. A print out stating a balance IS NOT sufficient verification to prove a debt! I need documents proving this is my debt. I do not know who this company is and they are affecting my credit score by contentiously reporting inaccurate information. Because this company have failed to validate the debt properly and yet still verify the debt with the credit bureaus, they have violated my rights. These rights were put in place by the FCRA and the FDCPA. I have given this company enough time to send the proper documentation and they just simply ignored my request. They have failed to validate the debt, but still verifying the debt with the credit bureaus, and are still attempting to collect the debt.

Communication tactics

Debt collection: Payday loan debt

Used obscene, profane, or other abusive language
Complaint: I spoke with a representative at Ad Astra about planning to make a payment of {$50.00} a month and was told that my payment wasn't enough. The representative was really rude and disrespectful. I failed to get the name of the representative. The company call me a lot and recently when I pick up the phone they hang up in my face. I am attempting to work out a payment plan with the company however my attempts have been unsuccessful. I am not negating my responsibility- I just experienced a financial hardship which caused me to get behind on my payment. The company calls me excessively from XXXX but fails to work with me with me yet harrasses me.

Took or threatened to take negative or legal action

Debt collection: Payday loan debt

Collected or attempted to collect exempt funds
Complaint: I started receiving calls from Ad Astra on XX/XX/2018. My cell phone logged 17 calls and 3 letters. I spoke to them and wrote to them explaining I am on XXXX which makes my income exempt from collections. The company that sold them the debt knew that and they should go after them for selling them an uncollectible debt. They then placed it on my credit report in XXXX and so far haven't removed it after I asked them to. I have no assets that they can seize so they are wasting their time.

Took or threatened to take negative or legal action

Debt collection: Payday loan debt

Threatened to arrest you or take you to jail if you do not pay
Complaint: Company is AD ASTRA RECOVERY the payday loan was PAID IN FULL. The initial loan, according to my credit report, was XX/XX/XXXX. It was a payday loan from XXXX XXXX XXXX # XXXX in XXXX XXXX. Because it was paid. I never received a letter or phone call, EVER. I recently got a home phone number. That's when the calls started. They called my house, told first my XXXX yo daughter that I needed to call them ASAP because they had a warrant for my arrest, and tried to get her to give them my home address. Which of course she didn't. My daughter was so upset. They called right back, my husband answered this time. He asked them, not so nicely.. Who they were and why they were calling. A woman stated that there was someone on their way to my house to arrest me, and she needed to verify my address. He laughed ever so rudely and replied, " My wife works for a XXXX XXXX '' which is true and not to call again. 6 more calls came in bk to bk in a matter of 10 minutes. I work nights so I was asleep, but woke up with the commotion. I called the number that called and was yelled at to give my address. That a process server was on their way with a warrant. I laughed, cause see, I with common sense, know a process server doesn't arrest people for one. For two, I work for a police department as my husband had stated earlier, and one of my XXXX XXXX is to XXXX XXXX into the XXXX XXXX. So I told her that, concluded with, I'll wait for the process server to come arrest me, and disconnected. They placed another hit on my credit report XX/XX/XXXX. This can not be OKAY RIGHT?!

Attempts to collect debt not owed

Debt collection: Payday loan debt

Debt is not yours
Complaint: On XX/XX/XXXX, I received communication from the company AD ASTRA claiming I have a debt with them. I need the following : Were you named on the original contract with the original creditor? Do you have a contract between your Ad Astra and me, signed by both parties? If not, produce the document authorizing the release of my information from the original creditor to you ( Power of Attorney ), signed by me. It is against the law for a creditor to share my information to any party other than the account holder without my authorization. Giving my information to a 3rd party without my knowledge or consent is perpetrating identity theft. Do you have first hand knowledge about everything that has transpired with the alleged account, including when the account allegedly belonged to the original creditor and any other parties prior to your acquisition? Do you have written consent to collect information about me and to share information about me with the credit reporting agencies - in writing, signed by me? Even if I checked the box that they could share my information and that they might forward it to a collection company, unless XXXX XXXX XXXX is specifically named in the original contract, I am not liable to them. Sending old billing statements from a is the same thing is not validation Where is the recorded assignment from the original creditor to them? How much did they pay for my information? Where is the contract showing that I agreed to do business with Ad Astra Recovery specifically? 73 AmJur 2nd, Sections 90 and 93 state that they can not substitute onto a contract unless they have an interest to protect. That means that they have to be clearly and specifically named on the original contract to have an interest to protect. While on the phone with this company a representative even stated that I have no contract with Ad Astra.

False statements or representation

Debt collection: Payday loan debt

Attempted to collect wrong amount
Complaint: I obtained what was supposed to be an installmant loan through XXXX XXXX on XX/XX/2017 for a total of XXXX dollars due to hardship. From my understanding they added about 200 dollars worth of interest onto the loan and i would have over a certain amount to pay the loan back as you i have with previosly obtained and paid loans. I began paying the loan back in payments of XXXX every other week from XX/XX/2017 untill XX/XX/2017 so a total of 11 payments of the XXXX, so over two thousand dollars worth of payments overtime. About half way through i had logged intoXXXX XXXX to see what my exact balance was and to my suprise it was exactly the same amount as the loan i had recieved despite all of the payments i had made towards the account. I called XXXX XXXX to ask them what was the deal with the account balance and how it hadnt decreased even with all of the money i had already paid. They then told me that the only way i was going to be able to pay the loan off entirely was to pay the interest, as well as the entire amount that i had borrowed initially. I made sure to tell her i didnt sign up for a payday loan and that i signed for an installmeent loan, something that i could pay back over time because of the tremendous hardship i had been facing. They then told me that i had no other option but to just pay it off. I kept making payments every other week untill XXXX and my account indeed still remained the same amount, if not more by the next time i made a payment. So finally i sent them an email statiting that i was not going to pay them anymore due to the fact that i had already paid the loan in full three times over, and that i did not ever sign for a payday loan. I knew it could not be interest compiling that fast within teo weeks due to Texas legal laws in place. As of last month XXXX XXXX has had a collection agency ( ad astra recovery services ) flag my credit, bringing my score down tremendously. They show that i obtained the loan in XXXX of this year ( which is false information ) and that i have only made one payment ever with the account ( which is also false ) i have sent in bank statements, i have sent payment confirmation reciepts via fax from my email, but the company persists on leaving the falsified information on my credit account as if it were truely an installment loan i just defaulted on, and did not pay them for when its not true. They refuse to remove it unless i pay them an additional 1000+ dollars.

Threatened or suggested your credit would be damaged
Complaint: I am re-opening this case due to the fact that issue was not resolved or addressed. The company in question is and used threating tactics in it's written correspondence of this disputed debt. Which is a direct violation of the FDCPA. Stating in the letter that we have not received any correspondence as it relates to this disputed debt when you have received correspondence from me and stating in both letters " if you don't pay us we will damage/negative your credit on your report ''. I would be happy to provide copies of these letters if you or the CFPB need them. I consider this wording to be very threatening and aggressive. I look forward to working with you to address this concern and issue.

Attempts to collect debt not owed

Debt collection: I do not know

Debt is not yours
Complaint: I have never done business with Ad Astra Recovery Services. I do not have a signed contract with Ad Astra Recovery Services. I am not liable for this debt from XXXX. On XX/XX/2018 I contacted Ad Astra Recovery Services asking for a proper debt validation. Ad Astra Recovery Services failed to complete this request. Ad Astra has had ample time to validate this debt. An alleged e-bill does not meet FRCA requirements for validation. If Ad Astra Recovery Services can not produce a signed contract from me acknowledging that I have in fact done business with them and am liable for this debt, which is proper validation, then they must remove their erroneous trade from my credit report at once. Inserting erroneous information onto a credit report is a FRCA violation that is liable for payouts starting at {$1000.00} if pursued. Ad Astra Recovery Seevices INC does not have permission to contact me by phone, e-mail, or US mail. All communication must remain in the CFPB portal.
