Complaint: I received a title loan on XXXX XXXX of {$2200.00}. The title agency charged me an extra {$3600.00} for acquiring the loan. The loan also- had an interest rate of 118.28 %. I made over XXXX payments of {$380.00}.
I had to file for bankruptcy due to my husband passing away and my financial status. The bankruptcy was filed on XXXX XXXX and discharged on XXXX XXXX, XXXX. The title loan agency was placed under the bankruptcy. Despite the closed out bankruptcy I continued to pay the agency. I became two months behind on XXXX XXXX and the agency came to my place of work and took my car. My son offered to bring the account current, but the agency added several thousands of dollars making it impossible for us to get my car back. Please help!

Complaint: The following is a complaint I would like to submit regarding an account with Westlake Financial services. I had an active account from XXXX/XXXX/XXXX through XXXX/XXXX/XXXX. On XXXX/XXXX/XXXX, I came across an article by the Consumer Financial protection Bureau in which they state that Westlake Services , LLC had used illegal practices that violated the Fair Debt Collection Practices Act, the Truth in Lending Act, and the Dodd-Frank Wall Street Reform and Consumer Financial Protection Act during the period of XXXX XXXX and XXXX XXXX. I myself had an account with this company. By the way, I was a co-signer and not the primary signer. I also contacted Westlake and spoke to a supervisor back in XXXX XXXX regarding these allegations and was told that I would be receiving a letter regarding this matter within 120 days. It is now XXXX XXXX, XXXX and unfortunately have not heard or received anything from Westlake.
There was a period in which my brother became delinquent on the auto loan payments. During this time, I began receiving threat calls from Westlake representatives in which they would intimidate me. At first I would tell them that I did not care if they repossessed the car. I would explain to them that I was visually impaired and had no need for the car. They would ignore me and would say that they would pick-up the car, my credit would be damaged, and I would be prosecuted. Such threats lead me to ditch other financial responsibilities such as credit card payments and other loans in order to avoid such events. This resulted in all my accounts going into collection. I do have proof through copies of credit reports.
This loan was plagued with problems since the beginning. For example, the dealer ( XXXX XXXX ) located in XXXX XXXX had agreed to a 16 percent interest rate and a 5 year term which we signed the contract for. However, about a week later we were called back in and were persuade to signed another contract. On this one the terms had been modified to a 42 month term. The dealer had explained that due to this, we would have a little higher payment but would end up paying less interest and much quicker. We ended up being financed through Westlake Services , LLC with an interest rate of 23.99 percent and a {$590.00} payment for financing {$16000.00}. All in all, I ended up paying over {$30000.00} for this vehicle. In addition, terms such as maturity date and fees were also changed during the time of the loan. For example, the hard copy contract shows the maturity date as XXXX/XXXX/XXXX but was later changed to XXXX/XXXX/XXXX. By the time the last payment was due, I still had a balance of {$3500.00} which I was successfully able to refinanced through XXXX University XXXX XXXX XXXX XXXX XXXX.
Intimidations by This company came in different forms. There were several occasions in which Westlake Services use spoofing tactics to get me to answer their calls. They would also call other persons who were listed as references to let them know we were behind on payments. I do believe calls were being monitored during the times we spoke as I was advised that calls were being monitored and recorded the times we were contacted. During this loan period, I also was confronted by individuals who said they were repossessing the car. I even had one individual knock at my door after XXXX. Such repossession events lead to repossession fees being added to my account. This went on even though the car was never repossessed. I had so many fees added to my account by the time the maturity date came, I thought I would not be able to pay. In fact, I asked for some of the fees to be waved and was not successful. I also explain that I was still paying a payment on a car that required mechanical repairs. There had been an extended mechanical warranty added to the purchase but never appeared when needed.

Complaint: My car company charged off my car loan because at the end of my loan I still owed money due to a few deferments during the loan. I contacted them to see if i could continue to pay my monthly payments until it was paid if full and I was told NO, I had to pay the balance in full. I could not afford it so they charged it off. I had a XXXX % payment history with my loan. I then talked to someone who said my car is out for repossession. My family gave me a loan and I made a XXXX XXXX payment of {$1800.00} which paid my loan in full. I still had late fees and interest fees of {$940.00} left. I called each week and had a new representative each time tell me someone would call me back. No one would ever help me after I paid the {$1800.00}. Finally I spoke to a guy that went over my option of a settlement for the remaining fees. I was told I would get a per-settlement offer via e-mail sent to me. It never came. I called and called and then finally I spoke to XXXX XXXX, she looked at my notes and apologized for getting no responses and the run around. she said that guy who made the settlement terms with me was no longer with them. She then said all settlements in their company are placed on suspension and she would contact me once the suspension was released. A week later I got a call from XXXX and she said they accepted my settlement of {$650.00} and the other term was that they would delete the account from my credit. Today I received the per-settlement e-mail letter. It did not indicate the term of the account deletion from my credit so I responded to the e-mail asking someone to please contact me. After 4 hours and no call I called XXXX myself and explained that this term was left out and can they please revise the letter and re-send it to me so I can pay this right away. XXXX told me No, they ca n't change the letter, she said I need to pay and they will take care of that. I said I need this in writing. She then became mad and very rude to me saying she has went above and beyond to help me when in fact I was the one calling their company everyday with no responses. She said she has no access to e-mail when I asked her to send me a confirming e-mail of our terms since they ca n't change the letter, she said there is nothing she can do and to not call her again today ( that was my first time calling her today ). I am so upset, all I want to do is pay my settlement and have this removed from my credit so I can forget about them forever. They have zero customer service skills and do not care about their customers. I do not know what to do at this point. If I do not pay I will never receive my pink slip and they will continue to report missing payments to my credit like they did last month even though my car is paid in full and the remaining balance is just fees. I need help please.

Complaint: I took out a title loan on my car. As of XXXX/XXXX/2016 it was paid off ( I had a {$0.00} balance ) but during the course of the loan the car had been repossessed for 'nonpayment ', but it was in error and they agreed to waive the reposession expense. I asked for my title once the loan had been paid off, but they claimed I still owed this repossession expense that they had agreed to waive. So I filed a complaint with that company and NOW they claim I owe over {$1000.00} past due and they have changed teh 'repossession expense ' from over {$500.00} to {$160.00}. I do n't know what they are trying to pull but I do not owe them this money. I have a letter dated XXXX where they claim I only only them {$0.00}.

Complaint: Hi there my name is XXXX I have a loan with Westlake Financial Services, they have been contacting my father to get information and payment from him for my vehicle loan which I am on alone, no one else is or ever has been on there with me. They called me 45 days past due saying my car was up for repo unless I payed the XXXX in full. Just needing clarification of this is right? Complaint: WestLake Financial is a predatory high interest lender and they approved our loan initially. After approval, they claimed that the first payment was late so we have to return the loan back in Full with their additional Processing Fee. We contested the processing fee but they wo n't budge and threatened to file a lawsuit and even started sending us legal notices in certified mail. We return the loan along with the processing fee. In the mean time, there were 2 monthly payments that were made. When we asked for those Monthly payments to be returned, they flatly refused claiming that they do n't return any Payments despite the fact that Loan was Paid in Full without any deductions for monthly payments made.

Complaint: An account was opened in my name that does not belong to me. Westlake Financial Services continues to try to collect a debt that does not belong to me, and they are continuing to report it on my credit file when they have been told that the debt was as a result of identity theft/identity fraud. I have contacted this company and told them verbally, by email, and by fax that this is not my account and that they were reporting it against the wrong person. Westlake Financial Services has refused to respond to me, and they continue to report this fraudulent information to the credit bureau. I have demanded that they send me the documents to prove that this account belongs to me and have determined fraud. Instead of responding to my requests they continue to report this fraudulent information to the credit bureaus. Westlake has done nothing at all to prove that this account belongs to me. I have sent Westlake Financial Services a copy of a police report, and identity theft affidavi as well as a letter from JAG so that they would know that this is not my account, but they refuse to comply with my request.

Complaint: While buying a used vehicle for about {$8500.00} with a {$500.00} trade in and no money down the dealer came up with a contract financing with Westlake financial services. After they took my old vehicle and fixing a few thing on my new XXXX the salesman has me sign the financial paperwork that I agreed to as far as 9.9 % interest rate. As I looked through the paperwork I see a {$1500.00} banking fee added on to the loan total which ended up around {$12000.00}. I asked the salesman what it was and he answered it was normal. I did not like it at the time but I was in a position where it was to late to back out of the deal. So I signed. As I thought about it that banking fee seemed like a crooked way for a bank to not only get more money out of me and charge me interest in top of it. This deal took place in the spring of XXXX. I have since traded that vehicle for a different better vehicle in XXXX at a different dealership and asked them if they ever heard of a banking fee like that and their answer was it did n't sound legal to them either.
