Complaint: Now, we have been the victim of financial mismanagement by an auto finance company ; Westlake Financial XXXX XXXX XXXX, who financed an automobile purchased for our XXXX XXXX XXXX daughter upon her recent graduation from XXXX high school which amounted to approximately XXXX with a down payment of XXXX plus costs. About a month after making the first payment she was rear-ended in a XXXX car accident which subsequently went to arbitration determining that another driver covered by XXXX XXXX was determined to be at fault. Our XXXX insurance had her and the car covered, which insurer paid Westlake XXXX plus. Included in the transaction was XXXX insurance covered by the finance company itself, a division of Westlake. Although Westlake was notified of the accident, they continued to harass us by phone and correspondence that other payments were due. This went on continuously for a month and a half at the rate of a dozen calls per day ( XXXX kept a record ). I then sent a registered cease and desist letter, a copy of which I have attached. That did not deter them in any way as the calls kept coming. Of course I found out that they were separate departments and one did not inform the other, typical of these companies who think that automation will take care of everything. Their personnel got very nasty with me when I tried to explain and I feel certain that their next act was out of vengeance, which was to report that the car was 'REPOSSESSED '' - that was the final blow. Her credit score has dropped to around XXXX when it was XXXX before this episode.
We have enlisted the aid of XXXX XXXX, who specialize in repairing credit, however that does n't solve the main problem - the damages incurred by Westlake Finance.
Of course, we are seeking an attorney for XXXX so that we may recover serious damages inflicted by West Lake Financial for their purposefully malicious negligence and due diligence failure. While much of this is a result of 'Business Automation ', it is no excuse for their obvious negligence - " The right not knowing what the left is doing ''. Additionally, West Lake Financial, insurer of the XXXX on the same auto, was paid up-to-date as agreed to with regard to the finance agreement, up to the point of the accident, when XXXX took possession of the automobile and claimed its status as 'totaled ', thence paying $ XXXX plus, up front, even though XXXX was the insurer for the party responsible for the accident as determined in arbitration. Westlake has continued to attempt to decrease their liability by claiming that we still owe them when they, the holder of the XXXX, should have satisfied all - a XXXX is a XXXX Is a XXXX. Unfortunately many companies are depending on automation to solve their productivity problems while unknowingly creating greater ones with the burden being placed on the consumer.
Her credibility together with increased financial burdens have been seriously affected thus denying our consumer rights. Moreover, the credit reporting company 's involvement has indeed compounded the situation considerably. They also can not continue accepting false information and then publishing it with impunity - particularly in XXXX 's case, to wit ; providing information that the auto in question was 'Repossessed ' when in fact 'Totaled ', as the term is used. The XXXX insurance business is a 'Risk ' ; however they clearly are attempting to evade that which they take, and continue to escape responsibility.
This kind of business operation, 'neglect of due diligence through automated reliance ' is unfortunately, a prolific practice used throughout today 's business culture and needs to be addressed with full vigilance. We look forward to achieving some semblance of success and maybe do something about this obvious practice of, for lack of a better word, XXXX the consumer.

Complaint: I applied for a secured title loan at a web site called " XXXX '', on XX/XX/2015. After submitting my information the web site stated that I qualified for a loan for {$5000.00} secured by the title to my XXXXPorsche Boxster. The loan site indicated I would receive a loan for {$5000.00} at 7 % interest rate. I was quite happy about this as my wife and I had just moved from XXXX, XXXX to XXXX, XXXX, and we were in need of funds. After I had completed all of the information online, I received a check for {$5000.00}. We signed over the title to my car and only then received our initial bill which showed a loan apr of 88 %. We were quite stunned and my wife called the lender ( Wilshire Commercial Credit ) and asked about the loan interest rate. Again, over the phone the representative stated that the loan was granted at a rate of 7 %. The representative stated that the payment of {$390.00}, almost all of it going to interest was so high because of " fees ''. All of the transaction was completed online, using " XXXX '' ' and nothing that I signed showed the exorbitant interest rate of 88 % apr. After this I researched the company, Wilshire Consumer Credit '' and found that many other consumers had been duped just as I had. In fact I learned that this company was the subject of legal action by the Bureau of Consumer Financial Protection, for similar and other deceptive loan practices. I am requesting assistance from the Bureau of Consumer Financial Protection in obtain a just resolution of this matter.This whole matter is particularly abhorrent given that while I was in the process of obtains this loan, and in subsequent discussions with company representatives, Wilshire Consumer Credit was being prosecuted in court for such abhorrent actions. Please help me obtain a satisfactory resolution in this matter because otherwiseI will certainly lose my car! To make matters worse still, when I received my XXXX bill it showed an additional charge of {$150.00} for " prepaid interest ''. Again, I had not seen anything about such charges until I received the bill! Following our inquires with Wilshire Consumer Credit, they sent us a loan document that showed the interest rate of 88 % apr, which was signed digitally using software by " XXXX ''. Complaint: I purchased a XXXX Mitsubishi Montero XX/XX/XXXX. It was financed through West Lake Financial XXXX XXXX XXXX # XXXX XXXX XXXX, CA XXXX. I found out XX/XX/XXXX that they were not reporting to the bureau. I called to correct this problem, I was told by West Lake staff that they did not have my social security number. I sent the necessary information, which was requested by West Lake in order for them to begin reporting. I called XX/XX/XXXX because I was informed by the credit repair company that I was working with at the time that West Lake was still not reporting, mind you I have been in good standings with them throughout the duration of my loan in attempt to rebuild my credit. So I was told to send the same information again so I did. I went to purchase a newer car last week and to my surprise West Lake is still not reporting. I called and spoke with numerous customer service reps and supervisors and this time they told me they have my information from when it was sent XX/XX/XXXX but I need to send it again via fax and call back so they could pull it and add it to my file. I was told after this they would begin posting immediately. I did as I was advised, however once I called back the story changed I began getting the run around and was advised to email it because they can not receive fax. I emailed the information needed and they still refuse to report my credit.

Complaint: To whom it may concernI 'm writing you today about my horrific treatment by Westlake financial services, I purchased a XXXX Mitsubishi endeavor at a dealer XXXX XXXX XXXX. in XXXX XXXX in XXXX 2015. I put done {$5000.00} on a {$7000.00} car, but for some reason Westlake just sent me a bill for over {$8000.00} not sure where they get that number from. On XXXX XXXX my car was repossessed because I was behind on payments due to me being furloughed from my job with the state of XXXX. I paid off the outstanding balance within 72 hours and wanted to get my car back.
I was told by Westlake customer services that by paying the outstanding balance the car would be held in XXXX and would not go to auction. After I paid the balance I contacted Westlake customer services and they could n't locate the car, the car had been moved 4 times and was no longer located in XXXX State. It took Westlake customer services over a week to find the car, when they located the SUV it was in XXXX at an auction house.
Westlake failed to send the release papers to the tow company which meant I could n't pick up the car and it took Westlake over a week or more of me calling everyday sometimes hourly for them to send the release papers. I contact Westlake customer services and got very little help and was transferred to other departments I asked to speak to a manager and was told " no '' rudely. I tried contacting their corporate headquarters and got no reply.
The vendor/sub-contractor Westlake used to tow my car lost the plats to the car and I needed a notarized letter from Westlake stating that in order for me to get new plats for the car, Westlake customer services had me contact the towing company for the letter which they responded with no and stated that it 's not their policy to give notarized letters I then contacted Westlake again and was told someone would call me back. In addition, I found out that the SUV windows were left open and the inside now has water damage that needs to be fixed. I keep trying to contact someone in management at Westlake and all I 'm ever told is that someone will call me back which they never do.
It 's now one month later and I still do not have the car back Westlake is demanding payment for the car but it 's in their possession. Due to this stress caused by Westlake I have miss days off from work and the stress has aggravated my medical issues. I would like to end my contract with this company as they are very unprofessional, rude, and they are predatory lenders.

Complaint: I initially was approved for financing with XXXX by Westlake Financial. XX/XX/XXXXBefore being paid in full I would receive late night phone calls, from block numbers it would be a westlake rep being rude, laughing and then they would hang up.
Westlake would act as if they didnt receive payments that I made. So in XX/XX/XXXX I paid my car off. Never received title. Then on XX/XX/XXXX I went to go view a home I wanted to buy. I arrived at the home and entered. No more than 10 min had passed. I saw a tow truck backing up to my car. I ran outside and asked the guy what was he doing as I was getting in my car. I told him Om viewing the home and was he looking for the previous owners. He replied no im going to repo the vehicle. As I sat in my car he lifted my vehicle while i was still in it. Then said he would call the police. I told him go aheah! The police arrived and the company westlake hired told an officer of the XXXX Police department that the finance company was tracking my vehicle.
I know that my vehicle has no pre installed gps for the model and year car. Nor after market. I showed the police documents for payment ect ... .They stated this is a civil matter and they were leaving. After 20 min XXXX of the XXXX men said they were dropping the car. So they left. A course of 48 hrs. I was followed by multiple vehicles. I stayed up with no sleep. I would go to random locations between midnight and XXXX and I would see either a tow truck or a guy driving a Hyundai Elantra with transponders on the hood.
I would go to the park and they guy in the car would sit and stalk me. On the 3rd day I went to the park and within 15min the guy pulled up. Almost T boning my car.
I asked him why does he keep finding me. And to leave me alone because I paid for my car. He was standing my the passenger window and said He just wanted to let me know westlake canceled the repo. I responded ok so why are you following me. He replied I need to get the tracking device off your car. I asked well how did it get there. He replied I put it there. I said No we will wait on the police.
He reached down before I could pull off and snatched something that was black off near my front passenger side tire. So I pulled off to block him in the park to call XXXX. He was able to drive off. I followed him but had already contacted the police. I was instructed to write down the license plate and go back to the park the police were waiting. I returned to the park and told officers. There response was in the state of NC it is illegal to put any type of tracking on a vehicle as such without a warrant. I was given a police report number and was told a detective would follow up. They also asked a description of the man. The license plate number was tracked to a detective company. But they had no legal right to put any device on my car. Placing a device on someones car in NC is considered and Illegal search.
Westlake conspired with this company to commit a illegal act. I dont know exactly when the device was placed. Upon a full professional evaluation of my car. I was told someone tried to disable my vehicle to where it would cause injury. And a estimated damage of {$5000.00}. Incl the tow truck damages.

Complaint: In XXXX 2014, they repoed my vehicle - upon them receiving the next day {$1800.00} XXXX ( more than what was owed ) they INCLUDED all the necessary fees affiliated with the REPO charges. Thereafter, a full and final payment of {$460.00} was mailed to Westlake to pay the remaining balance OFF IN FULL. ( check cashed ) A couple of months passed and I called to follow up on the title being mailed to me. I was informed that I had incurred additional charges of {$140.00} for the remaining of the repo bill. I was furious - because I knew they were being very dishonest. In no way would they have released that vehicle to me without all fees being paid in full.
Not only have they refuse to forward my title to me they have reported Derogatory remarks with all XXXX credit bureaus.

Complaint: Westlake has not been responsive to my requests since XXXX so that I may get current tags on my vehicle. I have made XXXX calls since XXXX asking for assistance and continue to be told it will take various amounts of time for them to get ( sometimes 24 hours, sometimes 2 weeks ). I moved XX/XX/XXXX. XX/XX/XXXX I went to XXXX get XXXX driver 's license and new tags for my car. I was advised that I need to have my finance company request the memo title XXXX, and have them send it XXXX. My temporary XXXX tags expired on XXXX and I am no longer permitted to drive it until Westlake Financial submits the XXXX title. Can you please help encourage Westlake to get the necessary title paperwork XXXX? If I can not work, I can not pay them.

Complaint: I took a title loan out with Wilshire Consumer Credit, an extremely high interest, short term loan, for about {$2600.00}. The terms were 10 % per month. I intended to only have to make one payment before paying them off but I ended up making two, XX/XX/XXXX & XX/XX/XXXX but then I had the funds to pay off the loan XX/XX/XXXX. Because I had to wait for a check to clear I called in to provide my account information on XXXX XXXX, I was given a payoff amount, was told that the funds would be removed in the next day or two and my pink slip would be returned in about 5 to 7 days. on XXXX XXXX I started receiving calls from Wilshire. When I responded I was told by the lady who answered that they had not been able to take the monies owed because I had given them incorrect account information and that I now owed an additional $ XXXX. I told her that I 'd given the correct information and asked why I would intentionally give them an incorrect account number. I also asked why they had n't called me back and at least leave a message immediately upon realizing there was a mistake. I was told that I should 've realized the monies had n't been removed and since I wanted my pink slip it was my responsibility to contact them. I told the lady that I was happy to pay the payoff amount given on XXXX XXXX but no more. Her reply was that was n't going to happen and she passed me on to her supervisor, XXXX XXXX. XXXX initially i.d . 'd himself as being XXXX XXXX for some reason. XXXX then proceeded to intentionally mangle the pronunciation of my last name, XXXX. Then when he reviewed the matter, he also stated that I had given them an incorrect account number. When I rejected that notion he became very condescending and told me that there was a tape of the conversation, that he would listen to and then decided if I had given an incorrect account number or not. I told him that we should listen to the tape together. He rejected that and said that was n't possible. Through out the conversation XXXX was extremely condescending and very unprofessional in that he repeatedly cut me off and talked over me, many times being merely repetitive. He ended the call by saying he would listen to the tape & make his judgement. I did n't hear from XXXX until XXXX/XXXX/15, when I received a collection call. I checked my account & they still have n't removed the funds. I just went through the same initial call that I went through before but with a more polite and professional individual. The results have been the same, he attempted to pass me off to his supervisor but the supervisor was in the meeting. To me it 's very clear what they 're doing. They intentionally wrote down the account number wrong and want to collect an additional few hundred dollars. It 's probably a way they pay their employees.

Complaint: An account was opened in my name that does not belong to me. Westlake Financial Services continues to try to collect a debt that does not belong to me, and they are continuing to report it on my credit file when they have been told that the debt was as a result of identity theft/identity fraud. I have contacted this company and told them verbally, by email, and by certified letter with return receipt that this is not may account and that they were reporting it against the wrong person. Westlake Financial Services has refused to respond to me, and they continue to report this fraudulent information to the credit bureau. I have demanded that they send me the documents to prove that this account belongs to me and they have refused to do so. I have asked for a copy of the signed contract, and any other information that they have to prove that this account belongs to me and they will not even respond. Instead of responding to my requests they continue to report this fraudulent information to the credit bureaus. Westlake has done nothing at all to prove that this account belongs to me. I have sent Westlake Financial Services a copy of a police report, and identity theft affidavit so that they would know that this is not my account, but they refuse to comply with my request.

Complaint: I was contacted by Westlake Financial Services in XXXX, XXXX for an Amendment To Retail Installment Contract agreement. The terms were accepted in XXXX XXXX, XXXX. I keep my part of the agreement and made all of the payments. But Westlake never issued an Cerificate of Title for my XXXX XXXX Focus XXXX XXXX Sedan XXXX. The last payment was made in XXXX of XXXX and the payment was accepted. I received a notice from Westlake Financial Services in XXXX stating that I owed them {$2300.00} for the balance of the loan. I spoke with a XXXX XXXX XXXX a manager of Westlake Financial Services asking him why did I owe this money when I honored the Amendment Installment Contract, and XXXX XXXX XXXX pretended like he did n't know what I was talking about regarding the installment contract. So I made several attempts to find out why Westlake Financial would not honor the hardship contract. I tried to explain to XXXX XXXX that I was a consumer and there must be a mistake with the balance of the loan. He pretended that he never knew anything about the hardship agreement and I must pay the balance of {$2300.00}. I mentioned to XXXX XXXX that Westlake Financial Services was not honoring the agreement and he would no loner speak with me about it and demanded that I pay the balance of the loan and I tried to explain to XXXX XXXX that Westlake Financial Services received the last payment of the Amendment Agreement and I should have received something in the mail before XXXX of XXXX stated why they will not send me a certificate of title. I never heard from Westlake Financial Services until XXXX of XXXX, but the last payment was make in XXXX of XXXX. I have suffered a great amount of financial hardship due to not having any transportation and I 'm still out of a car. My credit report has a repossession on it and I ca n't qualify for a car. Complaint: I bought a truck advertised at {$6400.00} on XX/XX/2015. I gave a {$1500.00} down payment which left a balance of {$4900.00}. I received the loan payments breakdown of {$350.00} per month for 37 months. That is a total of {$12000.00} plus the initial {$1500.00} deposit. So I am financing {$4900.00} to pay back {$12000.00}? Furthermore, I did not get to drive the truck until the A/C was repaired as advertised. The car is not street legal as there are broken taillights which they promised to repair and the tag lights are also inoperable. I did not receive the truck until XX/XX/2015 with the paperwork of my financing. When I told them that I did not want the truck because this was not the advertised price, they said that I would lose the deposit and I already signed all the documentation. So then, Westlake Financial called me to ask for pay stubs. I asked them if I did not cooperate, would I still get approved for the loan. They said no. Good. Now I can get my money back.Right? Wrong! I have been lied to by every single person employed at XXXX and would like to purchase the truck at the advertised price of {$6400.00}, or return my down payment. Furthermore, they asked me to lie to the finance company -- by telling me what to say to them when they ask me questions. I am suppose to meet with the Sales Manager today and am extremely nervous about the outcome.
