Complaint: On XXXX XXXX, 2015, a payoff in the amount of {$7500.00}. was overnighted to Westlake Financial Services Westlake Financial Services XXXX XXXX XXXX XXXX XXXX, CA XXXX.On XXXX XXXX, 2015 @ XXXX, the payoff was signed for by XXXX at their office. On XXXX XXXX, I reviewed my account to find that the payment has not been applied, at time my account is reflecting XXXX DPD. When speaking with representative, they do not know where the check was applied and why it has not been applied to my account. All of the information was provided, tracking number XXXX, account number, amount, date of receipt and time. When calling to speak with representatives, they advised that they there is nothing they can do, I have to wait for research and posting. My account is approaching XXXX DPD and this will affect my credit. Also, I am possibly in jeopardy of having vehicle repo 'd and another payment being due on the XXXX of the month.

Complaint: I have been l financing a vehicle from Westlake financial for 2 years now. Anytime I contact the company the representatives are always very rude and handle me very rough. For the most part I paid on my car on time until this second year where things have not been so good. They have also done things such as mislead me in regards to fees associated with my account. I asked to have a due date change to assist me with on time payments and they have refused. I have also explain times of hardship and they do not care. I have asked them if I could make partial payments to pay half of my payment each time I am paid in the same month and they refuse. They have threatened me that if I do n't recover the payments they will repossessed my car and the repossession would be 2 times more than what the payments will be. They have been very rude and has caused very stressful times for me. For instance previously I had a past due balance and originally set up ACH debit. I called to cancel the debit and a representative supposedly updated the information. I received a insufficient funds notification at my financial institution stating that Westlake tried to withdraw the funds anyway without my consent. They charged me a {$15.00} fee XXXX when they were never authorized to withdraw the funds any longer. I really hate that I 've done business with this company they treat their customers very poorly and do not deserve to be in business. They do not understand that people face hardships and are not customer friendly at all. They do not try to work out arrangements they scream at you and tell you you should have made the payment on time then. I have also tried to refinance with another company who could n't figure out why so much interest was being apply to this loan even though at the time of purchase I had a lower credit score. They have also change things such as not reporting to all agencies credit wise and have not notified the consumer. I experienced an instance where another car loan company has tried to pull my credit report and according to the agency Westlake has not been reporting payments to my credit. Overall I am very dissatisfied with their service and the way they treat people.

Complaint: I borrowed {$2700.00} on a title loan from Wilshire Consumer Credit XX/XX/XXXX, and added an additional {$500.00} XX/XX/XXXX for a total of {$3200.00}. I 've been making {$200.00} payments throughout. I 'm approaching {$6000.00} now and my balance is still over {$3000.00}. I 've recently learned that Wilshire was found guilty of unfair and illegal loan practices. I knew something was wrong with their practices but thought I was just stuck. I would very much appreciate your help in this regard.

Complaint: I am behind in my car payments due to unforseen personal circumstances. I had established a good standing with Wilshire up to the point of my default and and often paid early. I refinanced an existing loan only to have payment due in just 10 days. I have spoken to Wilshire several times about my inability to pay at this time and tried to work with them. Upon day 30 of my delinquency, they sent a repo man out to repossess my car and continue to call at all times of the day from various numbers. I tried to settle one month with the repo man but he was abusive and would not accept since I was a few days into the second month and he wanted 2 months or nothing. I told him that I was unable to do that and would have to pay my other bills instead. The phone number they are calling me on is my work number and the only number I have. I asked them to stop calling this number as it is affecting my work and ability to pay them back. They have ignored this request and on top of calling me incessantly and leaving nasty voicemails, they are now calling my references and have called one of my references at least four times that I know of. One of the calls they made to said reference was yesterday -- just after I had spoken to them and told them NOT to call my references since they know how to locate me. XXXX from XXXX XXXX ( the same number they call me on then leave a message to call XXXX which is Wilshire ) called at least one of my references at yesterday XXXX XXXX, AFTER my conversation with them at XXXX XXXX. This tactic is used to embarrass, harass and humiliate me ( I told them I know this is an unfair practice under the Fair Debt Collection Act ), not to mention ruin my reputation in a community I have worked hard to establish a name and a business. They know how to locate me! I had just talked to them! I told them I have every intention to get my account paid up and will do as soon as I can. It may be another 30 days, but could be sooner since I am in sales and have several deals in the works. Wilshire has proven they do not want to work with me, but harass and embarrass and intimidate me. If you read other consumer comments on the Web this is a typical tale, and many say do n't take a loan with Wilshire! Generally, I can not have no conversation with these people since they talk over me and are not interested in anything I say. It 's just " pay up or else ''. I am available and can be located as I said, but I do not answer every XXXX # call coming into my phone assuming it is a solicitor and I use this line for business and I am often with clients or need my phone available for incoming and outgoing business calls. Also, when I looked up the number they are calling me from XXXX it is listed under " Westlake Financial '' with whom I have no known business.

Complaint: I am a current customer of Westlake Financial Services. I have experienced excessive harassment from them concerning payments. The most recent harassment and threats occurred in XXXX XXXX. Here are XXXX examples of the issues with this company. First, I purchased a XXXX CHEVROLET SILVERADO from XXXX Auto Sales in XXXX, XXXX in XX/XX/XXXX. The loan transferred to Westlake Financial Services, after the sale. I called XXXX after a year of on time payments to inquire about dropping this excessive interest rate of 26 %. At that point, it was explained that they do not refinance vehicles over 10 years old. There was no mention of this at any point before I purchased the vehicle. This past XX/XX/XXXX I had some work done to the truck, after a small auto accident. However, when the insurance agent inspected truck and checked VIN number, they disclosed to me that this truck was totaled out in XXXX long before I purchased said vehicle. ( VIN report to validate this information attached ) I contacted Westlake Financial Services and they advised proof of having a clean title, and they do business with XXXX Auto Sales all the time. I emailed a copy of the VIN report to Westlake to " investigate ''. I use that term loosely as the " investigation '' was a call back stating what a representative had already told me about having a clean title. Moreover, since they have a clean title, I am bound to contract to pay or have my vehicle repossessed. Then they proceeded to follow up with threats of having repossession on my credit report. Second, my auto payment is due on the XXXX of every month, due to unforeseen circumstances I had to wait for my pay check which caused my payment to be 4 days late. However, I started to receive the collection calls on the XXXX. One day after payment was due. The collection agency on behalf of Westlake, I spoke with them advising of the situation as I normally have them paid before or on the due date. When I attempted to pay my auto account online using Westlake online payment system on XXXX/XXXX/XXXX, the online account was locked. I contacted customer service and got directed to the pay by phone feature. I paid my balance via checking account and received a confirmation number for the payment. I received another collection call the week of XXXX XXXX. This time the very impolite agent advised me that I had not paid my bill and If I did n't pay ASAP it would be placed on my credit report as delinquent. Again, another call the same day, I explained that I did pay, and I needed to check my bank account, the agent said if I did n't pay ASAP he would have the truck repossessed, at this time the account was between 7- 9 days past due! When I spoke with customer service, they advised that the bank payment " could not be located '' and the issue with being locked out of my account was because they locked it for being late. Asking if I could pay again, I was advised that my only payment options were locating a payment center at XXXX XXXX or XXXX XXXX. If I could not do that, they were coming to repossess the vehicle. When I asked for a supervisor, they could not accommodate and I would receive a call back, which never occurred. Then I sent an email to customer service, with no prompt response either. I had to call back and escalate XXXX other times to get a supervisor on the phone who would hear my situation. I was advised that they would waive all fee 's and process payment. Late payment fees and NSF charge from the company in total of {$70.00}. They took payment on XXXX XXXX and my account did not release funds until XXXX XXXX. This led to even more calls from inconsiderate, threatening, and harassing collection agents. I feel ask though I have been taken advantage of by this company. They have no care or concern for the consumer. Nor have they bothered to report ANY of my on time payments to the cr

Complaint: I started a contract with Westlake Financial Services on XXXX/XXXX/2013. Since then they have made my life so hard. I decided to buy a car to build credit but little did I know I was making the worst decision to finance with them. They have not reported or even tried to pull my credit report since then. I 'm constantly on the phone with them sending them whatever they need, copies of my ID my social security card everything but they do n't seem to care about it. Everytime I call them I speak to a supervisor to see what 's really wrong but all they tell me is We ca n't disclose information to you. That 's ridiculous, I pay XXXX dollars a month for what? For them to tell me I 'm not the account holder. I 'm so frustrated with this company all they do is lie and hang up on me because they do n't want to help me. I have contacted the credit bureaus to see if anything is wrong on my credit report but they tell me everything is fine. XXXX even contacted them and tried to get them to report but they also got hung up on. I 'm running out of options. I honestly just want to stop paying the car. I have no use for it if I 'm not getting credit. I just received XXXX letters from Westlake Financial Services and there is XXXX different names on them. How is that? They are the worst company I have ever been in contact with. They even told me themselves to give up, that there 's nothing I can do about it. Please help me I have payed more than half for the car already. I really think I deserve to get some type of credit.

Complaint: In the XX/XX/XXXX I totaled my vehicle. It was so upsetting I had to scramble to get another so I could get to work. I had a long bought of unemployment before that and a little XXXX girl to take care of my. Transportation and Job are very important to me. You would assume that a tragedy like this is something you would experience once in a lifetime if ever but that is not the way WestLake treated me through this process at all. First off my original loan was with XXXX XXXX. Despite my unemployment, I never missed any payments for either company. The communication was poor with XXXX and worse with Westlake. I received nothing in the mail telling me when Westlake took over my loan. Nothing!! My XXXX payment was kicked back that XXXX nearly two weeks after it was due with no vendor to pay not because the money was n't there. I received no calls from Westlake either looking for payment. I had to hunt down emails in my email box to find XXXX email from XXXX saying a new company was taking it over Westlake this was XX/XX/XXXX. So I searched my email for Westlake and had XXXX email from them- again nothing in writing nothing in the email. The email link to set up a new account did not work, I had to look up the company online to call them. Nearly when my next payment was due they set up my ACH withdrawal over the phone, apologized profusely for the transition confusion and said they totally understood that I should n't have to make XXXX payments in XXXX that they would defer XXXX infinitely and pay when I could. Now back to XX/XX/XXXX, I have a XXXX accident but have all the necessary insurance I need. I received NOT XXXX DOCUMENT from Westlake once again explaining this process as if I would be an expert in a once in a lifetime tragedy. I am sorry that they have a department that deals with these issues daily but show some empathy, compassion and customer service and figure out how to help your customer through this process instead of treat them like a delinquent only calling to demand money! With no knowledge each and every time on my case what I was going through and where I was at in the process. Just a bill collector call with no back up!! Complete disconnect to other departments and not nice at all. I am your best friend when I am making my {$400.00} dollars payment to you each month but I am literally harassed with no substance phone calls when I have totaled my car and you know I have the proper insurance what is the issue. THE PROCESS TAKES TIME!!! FIX YOUR BOOKS TO REFLECT THAT!!!!! XXXX said that they would pay not worry. Than payment was n't made for nearly a month later. When Westlake was still calling me and I would ask well why is there still money due they would always well ask the insurance company. Finally when I spoke with XXXX they said well did you talk to Westlake you have XXXX insurance. Then I went back to Westlake and they said oh ok well you need to just talk to our XXXX department and file a claim. I was horrified, and made it very clear to them this better not be effecting my credit when you guys again do n't have this transparency in your departments. I pay them my XXXX insurance money with my loan each month they pay the XXXX insurance on my behalf but it did n't occur to them to notify me that that was the next step something was n't automatically done to initiate this process on their side again like I said earlier this is a once in lifetime thing for me what the heck!! I get transferred to someone else that person takes down my XXXX claim information my claim had begun ... or so I thought. I go in more detail in the attachment there is n't enough space to explain the lack of communication in this process, I just want my credit fixed and reflecting no late payments ASAP! They slowed this process no one else!!
