Complaint: Loan servicer failed to comply with all requirements in 1024.31 Definitions. For purposes of this subpart : Consumer reporting agency has the meaning set forth in section 603 of the Fair Credit Reporting Act, 15 U.S.C. 1681a. Day means calendar day. Hazard insurance means insurance on the property securing a mortgage loan that protects the property against loss caused by fire, wind, flood, earthquake, theft, falling objects, freezing, and other similar hazards for which the owner or assignee of such loan requires insurance. Loss mitigation application means an oral or written request for a loss mitigation option that is accompanied by any information required by a servicer for evaluation for a loss mitigation option. Loss mitigation option means an alternative to foreclosure offered by the owner or assignee of a mortgage loan that is made available through the servicer to the borrower. Master servicer means the owner of the right to perform servicing. A master servicer may perform the servicing itself or do so through a subservicer. Mortgage loan means any federally related mortgage loan, as that term is defined in 1024.2 subject to the exemptions in 1024.5 ( b ), but does not include open-end lines of credit ( home equity plans ). Qualified written request means a written correspondence from the borrower to the servicer that includes, or otherwise enables the servicer to identify, the name and account of the borrower, and either : States the reasons the borrower believes the account is in error ; or Provides sufficient detail to the servicer regarding information relating to the servicing of the mortgage loan sought by the borrower. Reverse mortgage transaction has the meaning set forth in 12 CFR 1026.33 ( a ). Service provider means any party retained by a servicer that interacts with a borrower or provides a service to the servicer for which a borrower may incur a fee. Subservicer means a servicer that does not own the right to perform servicing, but that performs servicing on behalf of the master servicer. Transferee servicer means a servicer that obtains or will obtain the right to perform servicing pursuant to an agreement or understanding. Transferor servicer means a servicer, including a table-funding mortgage broker or dealer on a first- lien dealer loan, that transfers or will transfer the right to perform servicing pursuant to an agreement or understanding. Complaint: A previous complain was submitted and I asked Wells Fargo to waive double fees charged on my account, fix error on my transactions and they responded that my checking account has a high credit of waived fees. I was n't talking about my Checking Account, I am talking about my Saving Account which is currently overdrawn. They have n't waive any fees on my Saving Account. A check was misplaced by the Bank. They canceled it on my checking account and deposited on my Saving Account after have it deposited on both accounts because they did n't giv e me available balance for it. I used the check balance from my checking account and they took that used money from my checking account twice and transferred it to my saving account causing its overdrawn, meaning they took the money from my checking and also from my saving account, canceled the check deposited on my checking which was the place I used the money from and took money from my saving account also for that same check. They also charged me fees for transferring available balance on my saving account to my checking account. {$35.00} dollars fees were accessed because I transfer money and they overdrew my account after that charging me fees for the previous transfer. They removed my Saving account from my online account and now I ca n't give you proof because they are smart and sneaky and removed me from online access.

Complaint: We were refinancing our 1st mortgage with a REPUTABLE company, NOT WELLS FARGO ( getting away from XXXX ) - Wells Fargo just happens to have a minority stake in our property through HELOCS - In our CLOSING agreement on our new 1st mortgage, we discovered that Wells Fargo EMBEZZLED {$250.00} from us - when we complained to them that they conducted MORE fraud against us, all of a sudden this {$250.00} was some sort of a " fee '' - WELLS FARGO CA N'T CHARGE A FEE IF WE ARE N'T DOING BUSINESS WITH THEM - ESPECIALLY WITHOUT ANY ADVANCE NOTIFICATION ... that is stealing. They have a fiduciary duty to us, as ALL of our bank accounts are at WELLS FARGO ... Had they actually informed someone of their intent to charge this " fee '', we would have absorbed their loans into our NEW MORTGAGE ... I have already had fraud committed against me by WELLS FARGO in the " New Account '' SCAM that they were conducting and previously fined for - Their most recent fraudulent actions involve skimming off of transactions that they have nothing to do with - They were NOT entitled to our XXXX , LET ALONE to steal {$250.00} from us in the process. AGAIN, we were NOT doing business with them. They had NO RIGHT to request any information or issue any " fees '' - primarily because no one was doing business with them. YOU NEED TO CHECK THIS OUT, BECAUSE I GUARANTEE THAT WE ARE NOT THE ONLY ONES THAT THEY ARE DOING THIS TO ... Their response to the fines that you have previously issued to them is reprehensible - They merely treat the money as if it 's payola or some type of licensing fees to enable them to continue the fraudulent abuse and theft that they routinely conduct against their consumer account holders. Because they know there is NO CONSEQUENCE. Fines are not enough - CRIMINALS NEED TO BE CHARGED with their crimes!!! And by the way : Did you EVEN BOTHER to notice that there are MORE COMPLAINTS on your site AGA INST WELLS FARGO, THA N ANYONE ELSE ...??????? By far - all you need to do is look. Complaint: On XXXX / XXXX / XXXX - I was the victim of an internet scam. The fraudsters convinced me to issue a cashiers check for {$9000.00} and put it in the mail. The check would take 4 days to arrive in HI. My friend came to my home and I discussed the matter with him and realized that it was a scam. We immediately called Wells Fargo fra ud department to stop the cashiers check after submitting all requested information we were given a case number. We then went to the XXXX CA branch and spoke with XXXX XXXX . We presented him with the stub from the cashiers check, explained what happened. He called the fraud department, closed the checking and savings accounts, blocked online access, and assured my boyfriend and myself that a hard stop had been placed on the cashiers check and that the fraudulently stolen funds would be returned in about a week. XXXX asked me to come in the next morning to open new accounts. I came in the next morning, opened new accounts. XXXX assured me that everything was safe and that the {$9000.00} would be transferred to my new account. Note - A police report was called in to XXXX PD since that was the location where the check was sent. On XXXX / XXXX / XXXX I called the claims assistance center to follow up on the status of the {$9000.00} going back to my account. They said a form was missing and that they would mail it. I did not want to wait so I went back to the XXXX XXXX and spoke with XXXX XXXX . He called the claims center, and they did not know what form he needed, so they would call back. In the meantime, the claim was closed. On XXXX / XXXX / XXXX with the stress from this situation I went into the hospital with XXXX XXXX and was kept XXXX XXXX XXXX . I was released Sunday night. As it turns out XXXX at the XXXX XXXX failed to have us fill out the correct fraud paperwork for a cashiers check to create the bond to protect us from the loss. In addition, on XXXX , the XXXX branch refused to accept the affidavit of check fraud that was requested by the fraud department. The check was cashed when XXXX had assured us that a hard stop had been placed on the check on XXXX / XXXX / XXXX .

Complaint: This shady bank, Wells Fargo , will change your checking account type and thus account requirements for monthly fee avoidance and only notify you at the bottom of your online statement which I never really access. Then they charged a monthly fee by bumping up the requirements for the account whether it is minimum account balance, number of debit card transactions, or whatever else the requirements for waiving the monthly fee. Disclosures should be agreed upon before a switch can be made, or else they should have to close the account if they do n't get a positive agreement for the account changes.

Complaint: I have an account with Wells Fargo, and I have been trying to get access to copies of checks that have been deposit onto me account ; but the online system only allow Wells Fargo clients to access checks within 90 days of deposit ( most banks allow up to 3 years ). <P/> In order for me to get online access ( view ) the check details ( such check number ) behind the 90 days, and or go to the branch for the same reason, Wells Fargo charges his clients a fee per every check request. In addition, it will take the clients 10 days or more to view the check that it will be sent via mail. Wells Fargo do not allow his clients to print, download a check behind the 90 days either. In my personal opinion, it 's my believe that Wells Fargo practices are not only deceiving the consumers on what fees they charge ( i.e - my account has no fee if I keep a a minimum balance ; however they will get their money to use such services like get a copy and or view a check ), but as well unfair business practices.. Most banks, such XXXX XXXX, allow their clients to view account summary, checks, print, and download the same up to 3 years ; so why is Wells Fargo does not follow the same rules as other banks?

Complaint: On XXXX XXXX XXXX I mailed a certified bank check for the payoff amount of {$1700.00} to Wells Fargo from a purchase made at XXXX XXXX XXXX XXXX . I called Wells Fargo on XXXX XXXX XXXX to confirm that my payment was received and processed and according to automated system stated new balance was {$2600.00}. I contacted Wells Fargo on XXXX XXXX XXXX and then on XXXX XXXX called spoke with a supervisor and they stated there was nothing they could do. On XXXX XXXX XXXX I went to my bank at XXXX and XXXX XXXX at XXXX XXXX XXXX XXXX XXXX at XXXX XXXX XXXX XXXX ME XXXX called Wells Fargo and spoke in a three-way conference call with a XXXX from Wells Fargo . XXXX XXXX offered to fax over a copy of the certified bank check made out to Wells Fargo that included our names and account number but they refused. XXXX referred us to XXXX XXXX XXXX XXXX saying we did n't meet the contract obligations. We spoke to XXXX at XXXX XXXX and he said he could n't help us. I contacted my attorney generals was told to contact CFPB to file a complaint. We have contacted Wells Fargo several times to no avail.

Complaint: I opened a checking and savings account with Wells Fargo late XXXX XXXX . I specifically said I only wanted a checking and savings account and nothing else. A couple of weeks later in XXXX XXXX a credit card shows up at my door step. I specifically did not ask/want the credit card. I activated it a couple of weeks later. I called them XXXX XXXX and asked where the card came from, no good response. I called them XXXX XXXX , after the whole banking scandal, no good response. I then checked my credit report XXXX XXXX and saw that that they did a hard credit pull on my account for that credit card. I called them and told them I did not authorize it and they did not tell me they did a hard pull on the account. XXXX XXXX , XXXX I talked to one of their customer service reps and the guy said if you cancel the card we can send a letter to the credit bureaus and retract the credit pull. I said fair deal. I got a call today XXXX XXXX , XXXX and the guy was from " executive '' relations and he said that is not something they 're going to do because I " benefited. '' Well they 're not removing the credit pull, I closed the card, and I lost the points I accumulated. Basically, it 's the worst customer service I 've ever had and least amount of answers to my questions. I 've NEVER, EVER had a credit card or bank account for less than a year from opening. I 'm usually the type that rolls with the punches but Wells Fargo was really good at driving me away.
