Complaint: I have applied for a loan modification with my lender Wells Fargo in XX/XX/XXXX. This was escalated by the Fl Attorney General 's Office in XXXX and I STILL have no resolution. There is a bit of background to my case so I will explain by being as brief as possible but without leaving out any details. I purchased my home in XX/XX/XXXX. WF approved my loan with a falsely understated amount for my escrow payment. Within XXXX days of closing my payment increased by several hundred dollars due to the escrow payment alone. They increased it again the second year although my property taxes and insurance DID NOT increase. Still, it was affordable to me. Time passed and I started a business. Everything went very well for a time. Then, I had a rough quarter and fell slightly behind on my mortgage payments. I asked WF several times to review me for a repayment plan but they refused. I continued making monthly payments but was in a bit of a delinquent status due to my temp. inability to catch up all the payments at once. Then, last summer I went away for a bit. During this time I made several payments via XXXX XXXX as there were no WF branches in the state I was in and WF would'nt accept payments online. While I was out of town WF came to my house with foreclosure paperwork and shoved it into the hands of a friend of my family who was visiting here from XXXX on XXXX. She is not a XXXX and does not understand or read XXXX therefor, according to Fla. statues their " service '' is invalid. Furthermore, they served this paperwork without previously sending me a notice of default nor a notice of intent to accelerate the loan. I have asked them on numerous occasions to provide proof of these things and they have sent me XXXX photo copy of a collection letter. They have n't sent any of the additional information as they do not have it. Come to find out, they did not apply XXXX of the payments that I made through XXXX XXXX. So while I thought I had XXXX payments to make up WF was claiming that I owed XXXX. I had saved the receipts to I sent them to them and they did research for about XXXX days. When they finally located the payments they returned them to me!! These payments were made when my loan was still in good standing and they should have been applied to my account. I 've demanded that they explain themselves and why they returned the payments and they claim I requested them to be returned to me. This is a bold faced lie. All I have wanted to do is get my loan straightened out. I would never ask for money to be returned to me. Anyway, I owed XXXX months plus the XXXX missing payments ... This totals XXXX. However after WF located and returned the payments to me they were claiming I owed XXXX months. I am not sure who at a bank is so incompetent that they think XXXX but it clearly does not. I have asked them to explain and correct this as well and they can not and refuse to. Then, after I filed a complaint with my Attorney General 's office they began to review me for loss mitigation options. They should have BY LAW done this before attempting to file a foreclosure. Now, they have had the file for over XXXX months and they are playing games with underwriting. They are claiming now that I owe almost one year in payments but this is a direct result of their stall tactics, losing XXXX payments and refusal to review me for a repayment plan last year when I clearly qualified for one. They are attempting to extort XXXX out of me for " pre-paid '' Attorney fees even though they did not pay this to their Attorney and the fees are ridiculous. For example, they are trying to charge me over XXXX in filing fees whilst my county charges only XXXX to file a new case.

Complaint: Wells Fargo, formerly Wachovia MortgageBack in 2006, a XXXX year old XXXX and his wife received orders to XXXX for the XXXX leg of a XXXX. The housing market was HOT! They consulted various big lenders, and ended up buying a house for {$140000.00}, with an XXXX/XXXX loan through Wachovia ( Now Wells Fargo ). This was an alternate to a VA loan, but still 100 % financing. The second loan ( 20 % of the purchase price ) was going to be a highter interest rate, but it was a seemingly necessary program to do to buy a home in such a hot market. Three years later, the housing market went bust. Same year, the now new parents, received XXXX. They refi'ed the XXXX house, with the big mortgage loan being now 5.875 %, and the small, 20 % mortgage being a whopping 8.62 % interest rate. Now, XXXX in XXXX, the couple rent out the home in XXXX for a loss of about {$250.00} a month. This couple is my husband and myself. I have called Wells Fargo for years now, begging to refi the house. Interest rates are LOW now. Their response remains the same - They will not refi it because it is not my primary residence. But it is not my primary residence ANYMORE, because the XXXX had other plans for my family. I 've asked everyone there, every year, what I can do? Who can I call? The most definitive answer I have received from them is " just to short sale the home. '' Yes, they recommended to short sale the home. We do n't want to do that. It was our American Dream to buy our first home, and we did, proudly, and used nothing but American owned companies in the process. I do not want the home given to us, or defaulted on by us. I want a fair chance to refinance the home on FAIR terms. 8.62 % interest rate ( the small loan ) is far from fair. This company has made ENOUGH money due to the misfortunes of others. We have never been late on a payment, or never discussed foreclosing or a short sale. Unfortunately, nothing can be done until we receive orders back to XXXX and that can be our primary residence again.

Complaint: I had linked my newly established XXXX account debit card with my Wells Fargo bank account. I was under the impression that I had opted out of any overdraft protection " courtesy '' programs with Wells Fargo ; therefore, any transaction resulting in funds being overdrawn would be declined, which should apply to drafts initiated by XXXX as well when insufficient funds were available. I came to find out that Wells Fargo repeatedly allowed these transactions from XXXX to go through and charged the typical overdraft fee of {$35.00} each time. They simply changed the terminology for the type of transaction this constituted, although by definition and consequence enacted on my account ( same {$35.00} fee assessed on each accepted draft of an account bearing insufficient funds ) this is precisely an overdraft fee that Wells Fargo covertly branded as something else in order to justify the procedure ; however, I was never informed of this new practice nor would have agreed, as I opened my account, like I mentioned, under the notion that these fees would not and could not be charged. Upon reviewing the terms they have listed for all types of checking accounts, I do not see this expression used anywhere. As I recall, the bank employee I spoke with referred to it as something along the lines of a reverse payment. They can call it whatever they want, but unless they are admitting that they are engaging in bait and switch tactics and lack the legal and ethical standards that any banking institution, especially of their stature, would uphold-however optimistic a view this may be in today 's economic climate considering that the bordering on fraudulent and deceitful practices of these banks are commonplace, which in no way should excuse them. Part and parcel, this is an overdraft fee, wrongfully and connivingly instituted by the bank clearly illustrating a full-fledged violation of the contract between myself and Wells Fargo which eliminated the chance incurring overdraft fees in any of my accounts. As per their claim that this constitutes a mitigating courtesy they provide, I would like to know who defines courtesy or, moreover, for whom this trulyis a favor, as without my consent or permission, the beneficiary is only the bank.

Complaint: I am a XXXX representing my client in her efforts to obtain a loan modification from Wells Fargo. Throughout the entire process, which still has not been resolved, Wells Fargo has failed to take proper action, has imposed unrequested and secretive " cease and desist '' orders which prevented my client, her ex-husband, and her housing counselors from communicating with Wells Fargo without any knowledge or permission, Wells Fargo has irrationally and wrongfully and repeatedly refused to accept legitimate documents from my client to establish evidence that my client was conveyed titled to the subject property and that she obtained a valid divorce ; when I have escalated these problems to higher persons, I have been assured that the problems have been resolved and that I could call the supervisor directly if a problem occurred, only to discover that the problems were not resolved and that the supervisor deliberately failed to return my phone messages and refused to call me until I sent a written email. Today, when the supervisor called me and refused to address the problems I raised, he refused to permit me to speak with his supervisor and he refused to give me the name of his supervisor, telling me that I would not get any different result from a supervisor. This treatment of me and my client has persisted for more than six months. FINALLY, reviewing my files of this case, I just realized that Fannie Mae never responded to my XXXX XX/XX/2014 Complaint which I submitted in regard to this matter.

Complaint: Via XXXX XXXX, a general contractor advertising landscape improvement financing with zero interest rate, we secured from Wells Fargo XXXX XXXX a loan in the amount of {$35000.00}. The balance of the loan/credit card XXXX of {$17000.00} was due on XXXX XXXX, 2015. We did n't receive the statement for XXXX or any letter advising us that the balance on the loan/Visa was due in full of XXXX XXXX, 2015 otherwise we would have to pay Deferred Interest charge for {$11000.00}. The Deferred Interest or fine is more than 66 % of the balance! How can CFPB, FDIC or any agency allow financial institution to pay on consumers this way?
