Complaint: Two weeks ago I contacted Wells Fargo because I am late on my car payment. At that time the car payment was approximately 45 or so days late ( actually I do n't know the exact # because Wells Fargo would n't tell me ) but as of today I was notified of a 60 day late on my credit report. I tried to make a payment with Wells Fargo but they would not take it. I believe they wanted XXXX payments which at that time I was unable to do that but I was willing to set up a payment XXXX for the XXXX and XXXX for the XXXX which is coming up. They refused. I hung up and called back thinking I might get someone willing to work with me. They transferred me to a Manager and he said he was the only person I could talk to and he was not working with me. ( not in those exact words ) but he showed no interest in working with me or taking my payment. ( Fast forward ). I have a XXXX car garage ( tandem ; XXXX car in front XXXX in back ) but I ca n't close the garage because I have items in the front spot so XXXX car sticks out. The Manager never mentioned anything about repo and my intention was to pay the back payments this Thursday the XXXX so my intent was not to hide the car because if it were I would have parked my other car on the street and closed the garage. I park this way all the time because XXXX cars can not go all the way into the garage. Well Friday XXXX at XXXX someone came banging on my door yelling for me to give him the car. I was at home alone therefor I did not open the door. My Jetta was blocking the Toyota so the only way for him to have seen the car was to enter the garage. He continued to bang on the door making loud noises and when I finally opened the back door he was sitting in his truck blocking my garage and blocking my other car. I asked him to leave and he refused stating " he will sit there all night '' he was disturbing the neighbors with the yelling and the loud noise from his truck. I eventually had to call the Sheriff 's to get him to leave. I am not sure but I could swear that the voice was the same voice of the manager I spoke with on the phone a couple of weeks ago. In my opinion it seems as though Wells Fargo employees are getting kick backs for repossessing customers cars because the voice sounded the same as the manager that would not work with me. Please investigate this because if that is what they are doing Wells Fargo needs to be aware of this practice. Also, I am not sure if a repo man can come bang on your door at XXXX and demand that you give him the car. I do n't know the rules .I want to call Wells Fargo to try and work something out but I am afraid that that same person will answer the phone. I simply want to know my options so I can decide if I want to keep the car or turn it in. In addition Wells Fargo put insurance on the loan for a month but have spread the payments over the deration of the loan ; meaning I am paying 13 % interest on the insurance because I am paying 13 % interest on the loan. It 's bad enough that the car only cost XXXX and I have been paying it since 2011 and I still owe XXXX. And they would not work with me to rewrite the loan when I asked, when it was current.

i am writing this so something other than the system will help me. between medical bills, moving and my customership which is excellent i should not have to beg for XXXX dollar. i know it was refunded I also know if someone took the time they would see how i pay and keep my account.
i do not expect to be put thru this. i want my XXXX back of interest., i will never sign a cc agreement with minumum interest charge again. I did not pay maybe XXXX doillas and now this. i do not have time or XXXX intactedness to spend time on this. i am tired of scripts. i will not use my card til this is addressed. scripts are great but getting to know customers is even better esp a good XXXX like me

She forwarded my call to XXXX & I left a voicemail at XXXX about my concerns, requested she look into my account, contact XXXX & call me back.

Complaint: I decided to purchase my first house in XX/XX/XXXX. My realtor was an acquiantance that recommended I use XXXX XXXX XXXX, XXXX to secure a mortgage loan instead of a private bank. She stated using a private bank would delay the closing process and an advisor would not have to check my credit multiple times like private financial institutions would. I took her advice/recommendation and set an appointment with an advisor at XXXX XXXX. I disclosed all the information required for him to apply on my behalf. At the end of our meeting I was told to pay an application fee of approximately {$400.00} without prior knowledge I would even be charged for services. After being approved for a loan and several weeks of not finding what I needed, I started feeling pressured from my realtor and financial advisor. Though my realtor would only recommend XXXX XXXX properties, I was identifying potential properties found on the internet with greater success. My realtor, XXXX XXXX of XXXX XXXX XXXX, recommended I take out cash loans from lines of credit and/or family members in order to provide a larger down payment. My advisor also told me to consider taking a mortgage loan with a higher value. He told me to consider my financial situation in the future and envision I would not always be at my income level and perhaps make even more in the future. Their pressure deceptively and abusively persuaded me ( an under-educated and inexperienced consumer ) to consider the higher loan amount approved of {$130000.00} instead of my original loan cap of {$110000.00}. I reluctantly and ( now ) regretfully agreed to raise my loan cap at their recommendation. A few weeks later I found a home at the max loan approval amount of {$130000.00}. My yearly income was less than {$40000.00} and I would be the only applicant for the loan. My FHA loan application was sent to XXXX XXXX XXXX XXXX XXXX. I was told by my advisor that this bank was more lenient of credit/income standards. A week or so later I received the news I had been approved for the loan. After closing my loan was transferred immediately to Wells Fargo Mortgage. A little over a year after closing on my first home, my household income was reduced due to hardship. I reached-out to Wells Fargo Mortgage for assistance. I gave all current income information and my modfication specialist never returned my request for modification other than to send a letter stating I did not qualify. Every time I called Wells Fargo I was given the run-around after failing to qualify for modification. How is it possible I could not qualify for a mod due to my DTI if it was EXACTLY the same at origination a little over a year prior?? By XX/XX/XXXX I was no longer able to make payment on my own. I called numerous times and requested a short sale process or deed in lieu. I was told a short sale or deed in lieu could only be honored if I obtained a realtor and had the property on the market for 30 days. I contacted MANY realtors in the XXXX area to no avail as no one wanted to waste their time/money on 'selling ' a property they would make no money on. My home was ultimately forclosed on and my credit/finances are permanantly damaged for the rest of my life. I can not qualify to purchase a new home due to the foreclosure on my credit history at the expense of a realtor and financial advisor who unfairly persuaded me into a situation I could not afford and wanted a few extra hundred dollars in their pockets. Complaint: I applied for a construction loan from Wells Fargo. I was told that the transition from the construction loan to the conventional loan was relatively easy and straight forward as long as the home was completed within XXXX year. During the initial application process Wells Fargo kept asking for the same information and updated information since they had lost data and other data had expired due to their delays. The initial closing date kept moving out and I felt it was too late to start over with another lender. When I went to close on the construction loan the rate was 5.15 % interest only instead of the discussed 5 %. When the house was completed and I wanted to switch to a conventional fixed rate 30 year mortgage Wells Fargo delayed every step of the way. They had only XXXX people in the whole country for construction loans despite being the largest lender in this market segment. XXXX of the customer service representatives left and the remaining customer service rep was completely overwhelmed. Documents were lost and communication was absent. The delays on the Wells Fargo side triggered new demands for documents as previous documents had expired. The title and appraisal was incorrect which caused additional delays. The entire mortgage process was an unprofessional mess and costly in terms of time and money. The part that bothered me the most was that every time Wells Fargo delayed the conventional closing they made more money. The interest rate on my conventional loan was 4.625 % which included interest and principle vs 5.15 % interest only on the construction loan. Every mistake and delay caused by Wells Fargo cost me time and money while improving their profit.

I asked to get it waived and they said I need to get an appraisel to see if the value is high enough. Surprise! The appraiser must be theirs and it costs another {$360.00}. Complaint: I found that Wells Fargo reported to a credit reporting agency that I owed them a debt of {$420.00} on XXXX 2012 on a credit card account. I never opened a credit card account with Wells Fargo and have no knowledge of any credit card charges made on a Wells Fargo credit card in my name. I wrote to Wells Fargo and informed them of these facts. I also told Wells Fargo that I believed that these charges were fraudulent and suspected that I had been a victim of identity theft. I requested that Wells Fargo conduct an investigation into the matter and that Wells Fargo provide to me all account documents and billing statements related to this claimed debt so that I could determine whether I had been a victim of identity theft as I suspected. Wells Fargo responded but refused my request for documentation and its response does not indicate that it conducted any investigation into my claim that I had been the victim of credit card fraud and identity theft.

Complaint: My husband and I purchased a home in XXXX, we both signed VA loan with XXXX XXXX XXXX. Several years later my husband took out home equity line of credit for XXXX. I did not sign this loan it is in his name alone. I did however sign the lein to our property. In XXXX, my husband died due to XXXX XXXX Exposure in the XXXX XXXX. He left no assets and his estate was probated, leaving the home solely in my name. I contacted XXXX XXXX XXXX and the loan was behind due to medical expenses. XXXX XXXX XXXX did a loan modification for me on the orriginal loan. I am not sure I should have had to pay fees for that loan but I did. When I contacted Wells Fargo, they would not give me any information on the loan, would not eeven give me the terms because my name was not on the loan. They even locked me out of the online account services. I asked if I occuld assume the loan, and they said they could not dicuss the loan with me. They did say that I was not responsible to pay the loan as my name was not on it, but since I signed the lein if it wasnt paid they could forclose. So continued to pay through my bank 100 dollars every month ( the amount due monthly was XXXX ). I still had no idea what the terms of the loan were. A few months ago a statement made it through to my house. This is when I learned this was an intrest only loan with a balloon payment due in XXXX XXXX. I called Wells Fargo and at this point they now said I was elligiable to refinance. Why not three years ago? I dont know, I paid three more years of nothing. The original amount was XXXX I now owe XXXX. I cant get a strait answer out of Wells Fargo and now after fighting scrimping and saving to keep my family home for myself and XXXX children, I risk loosing it even though I have paid XXXX toward the loan over the life of the loan. The last three years without my knowledge that none of it was going toward the principle. Now they are trying to get me to go into a work out??? why I have never been late? They keep sending me hardship paperwork to fill out. My attorney says I am not liable for the loan and shouldnt have had to keep the terms for the last 3 1/2 years. So now a widow of a XXXX XXXX at risk of loosing the family home because of a financial institution taking advantage of consumers

Complaint: Our client is the son and heir of his parents, who were the co-owners of their home in which our client is currently residing. His parents, who purchased their home in XXXX, recently passed away. Our client was the administrator of his mother 's estate, which was recently closed. He has contacted the servicer to request that he be allowed to assume the loan and to discuss his loss mitigation options. The servicer refused to communicate with either him or his brother, the only other heir and successor-in-interest, at all and quickly began foreclosure proceedings. The client has provided the servicer with copies of his parents ' death certificates, estate documents showing that he was the administrator of the estate and a written request that the servicer communicate with him. The servicer refused and stated via correspondence, that the client should contact " our customer directly for information or to be authorized to receive information on the account. '' As XXXX customers are XXXX, that is impossible for the client to do. The servicer has not acknowledged, in writing the notice of error that it was sent. The servicer 's refusal to speak to either of the heirs has caused them to incur additional arrearages, costs and the necessity of retaining an attorney. The client and his brother are the only successors-in-interest and wish to assume the loan and to be evaluated for loss mitigation, but have been unable to do so.

Complaint: XXXX & I fell into financial hardship when XXXX lost her job in XXXX. We filed bankruptcy, chapter XXXX in XXXX of XXXX and were discharged in XXXX of XXXX. During this time with XXXX children we could not afford the payment to the trustee [ {$600.00} per month ] and our mortgage. I missed approx. XXXX mortgage payments, however, foreclosure proceeding did not begin or occur at anytime since we were protected by the " automatic stay '' of the bankruptcy law.
In XXXX of XXXX, Wells Fargo Mortgage approved us for a remodification under the new federal law for FHA loans however charged us exorbitantly high capitalized interest ( noted as " New Money '' on page XXXX ) in the amount of {$46000.00}. To be honest, we were both naively under the impression that our principal balance we remain at {$240000.00}, as it was before our filing of Chapter XXXX in XXXX.
Since we have XXXX children, keeping our house was most important to us so we accepted the remodification and signed the documents at our local Wells Fargo Branch. We did not know we would get hit this hard in delinquent interest, other unknown fees, and feel Wells gouged us placing us well underwater on our loan.
We also both feel we should have been offered a better finance rate than 4.25 %. If the " New Money ( Cap ) '' was lower and so was the annual rate this could be potential difference of {$100.00} - {$200.00} per month. Which is a big deal to a family of XXXX in XXXX.

Complaint: When my ex-husband died in XX/XX/XXXX I was successor trustee of his estate. The only asset in the trust was his vacant house. He had a balance of more than {$30000.00} with Wells Fargo on the home mortgage. There were no cash assets in the trust. I made the $ XXXX monthly payment on the house because our XXXX son wanted to be able to live there. The house could not be lived in at the time because of the repairs that needed to be done, and we could only afford minimum outlay so he was doing as much as he could himself. Then my son died in XX/XX/XXXX, and I had no use for the house, and consulted Wells Fargo to see if I could sell it. They told me I could not sell the house unless I paid it off and got a new mortgage, which I was in no position to do. I continued to make payments through XXXX of XXXX when a real estate friend of my said I should find out if I even had to make the payments, since I was not the owner and my name was neither on the house or the mortgage. I consulted an attorney who told me I had never had to make payments from my own personal money, I only was legally obligated to pay from money in the trust. Since there were never any cash assets in the trust, I had no legal responsibility to make the payments. In XXXX I stopped the automatic withdrawals from my account and informed Wells Fargo by phone that I was not making any more payments. They still withdrew the XXXX payment. I was incensed! I called and demanded they return the money to my account. I once again explained that I was the successor trustee and was not obligated to pay. The representative said " Oh, it does n't say you 're the successor trustee. I 'll have the payment returned. '' Which she did. My problem is Wells Fargo had a complete copy of the trust within XXXX months of my ex-husband 's death. The trust clearly shows no cash assets. They knew I was not legally responsible for the payments. My last correspondence with Wells Fargo was to inform them that they had no legal right to the payments I had made, and I wanted them to return the {$26000.00} they had illegally accepted. They wrote back, and the response was astonishing. It read : '' While speaking to you regarding the inquiry, you further advised me that the successor trustee was not personally liable to pay the mortgage balance. You also make this statement in our inquiry as well.
" At no time were you personally liable for this mortgage. Therefore we deny your request to refund the monies requested. " I have had no further contact with Wells Fargo, though they continue to send statements to the estate of my dead ex-husband c/o me at my address. I finally wrote " deceased '' on a letter and sent it back. Have heard nothing from them since. When they were still sending the estate letters c/o me, I learned they were putting the house in auction. This house, if in good condition, would be worth about {$40000.00}. As it sits, neglected for the last ten years, it needs a complete re-hab according to the building inspection. The cost would be at least {$20000.00}. I paid ( when I thought I had to ready it for sale ) to clear all the accumulated junk ( XXXX dumpsters ), clear the back drain, take down a diseased tree and keep the lawn mowed. I would dearly love to find a way to make Wells Fargo repay the money they knew they were not legally entitled to. I certainly want to keep them from doing this to someone else. I am XXXX, and in good health, but the next successor trustee might not be so fortunate. Wells Fargo should not be able to get away with this again. I would like to know if what they did was illegal, and if I can get my money back. I have copies of all correspondence and records of everything that happened from the date of the original mortgage to the date of the refinance.

In XX/XX/XXXX I had dual residency : XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX and XXXX XXXX XXXX XXXX XXXX XXXX. During that time I never received an annual interest payment despite XXXX XXXX through XXXX mandate : " landlords must pay annual interest amount to tenants. If the tenant is going to apply the security deposit to rent because the landlord failed to pay the annual interest in CASH to the tenant or failed to provide the tenant with the annual update of the account information, the landlord has XXXX days to rectify these failures. " My security deposit ( totaling {$750.00} ) was never returned to ME, XXXX XXXX XXXX, and I never received any annual interest payment or knowledge of the XX/XX/XXXX check amount until XX/XX/XXXX. This same apartment complex, XXXX managed by XXXX illegally evicted ME, XXXX XXXX XXXX. The eviction is masqueraded as a legal judgment of possession but the judgment of possession is ILL GOT AND ILLEGAL, the warrant of removal is ILL GOT AND ILLEGAL BECAUSE THEIR LAWYERS XXXX XXXX and XXXX XXXX NEVER EFFECTUATED SERVICE OF PROCESS MEANING : I never received a complaint and summons and if I do not receive a complaint and summons how then can I properly defend Myself or inform a designated Representative to defend Me, XXXX XXXX XXXX, if I do not know the date, time, or venue. Lawyers XXXX XXXX and XXXX XXXX are ( located at XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX, Phone : XXXX, fax : XXXX ) have caused ME, XXXX XXXX XXXX, great unnecessary grief and sorrow.
Since that time Wachovia is now Wells Fargo. I have attempted on several occasions to deposit and or cash the check totaling {$1.00} AND ALL INTEREST SINCE XX/XX/XXXX to no avail. I have contacted and followed through with the state XXXX escheatment protocol to claim any monies unclaimed by Myself, and XXXX is still not cooperating under the leadership of XXXX XXXX XXXX. When are you going to learn.

Complaint: `We received a mortgage from Wachovia mortgage in XXXX XXXX. We were told and have proof in our paperwork that the payment we exect to pay was XXXX amonth. When we received our XXXX statement in XXXX XXXX the payment was XXXX. When we inquired we were told this was our payment. We struggled for2 years trying to make this payment, cashing in our retirement, savings, and anything of value we had to keep out of foreclosure, trying to get a modification.
We were granted a modification in XXXX XXXX with a payment of XXXX. We made our payments well before th due date of ech month during the TPP. I have documents to prove this. In XXXX of XXXX we received a letter from Wachovia stating that wells fargo was taking over Wachovia and that our modification WOULD BE HONORED by wells fargo. We Made our Final TPP payment in XXXX XXXX. I called a local Wells Fargo Mortgage to fnd out where we should pay our mortgage and was told any local wells fargo bank. We Did thisIn XXXX we started getting calls from Wells Fargo stating that we owed almost XXXX because " We did n't pay our mortgage ''. I sent all of our payment receipts via certified mail, they were signed for but what happened to them I do not know.
We received a packet from Wells Fargo with a modification wih a payment XXXX a month. We did not accept this because it was not the amount we had originally agreed to with Wachovia, nor were we ever told that our payment would increase, It was quite the opposite.When we called again we were told that the original payment was too low.?
We litigated from XXXX XXXX until XXXX of XXXX. We never got an opportunity to get in the court room, there was a decision made against us 1 week before our scheduled court date, we were NEVER notified that there was any change in the court date. We had a family friend who is an attorney contact wells fargo and we recieveda modification for XXXX husband was seriously ill Beginning in XXXX XXXX until XXXX XXXX XXXX We were surviving on my income alone which is not enough to sustain the household alone. In XXXX XXXX We were contacted by Wells Fargo and started the modification process being told we were a perfect fit for their programs.
We complied with every request, supplied all the documents necessary. Only to be passed off from XXXX rep to another. We received a decision t deny a modification. K appealed and they denied again. Now we are being told that they can not help because we had a modification in XXXX and XXXX.
!. they never honored the XXXX in XXXX, yet hold that against us.
XXXXWe can apply for a modification XXXX a year according to XXXX XXXX
But because the decision came in XXXX XXXX, stating we do n't fit the criteria what is the criteria? XXXX were never told what criteria we do n't fit. we cant get a modification????
XXXX we are under water with this mortgageXXXX. we had a temporary financial setback XXXX. if we cant afford the mortgage now, how could we afford it in XXXX when our finances were XXXX less per year? but were granted a mortgage.
I refer you to XXXX VS Wells Fargo XXXX The Emergency Economic stabilization Act and ask that you please help us keep our home with a reasonable payment.
Our XXXX, our marriage has suffered due to this situation, it has been 8 years I have been fighting this.
