Complaint: I have previously sent this collector a request on XX/XX/XXXX to validate this debt as well as sending a letter to XXXX and XXXX. Under the Fair Debt Collections Practices Act ( FDCPA ), I have the right to request validation of the debt you they I allegedly owe you. I have given them 30 days to remedy the situation, which is a very reasonable period. I have received no reply from them. Since they are still reporting this account on my credit report, they are now in violation of the FCPDA. This account is also past the statue of limitations as it is reporting as opened XX/XX/XXXX, which has surpassed 5 years and this collector has reported this as a charge off but once I disputed it they changed the balance from {$0.00} to {$6600.00} stating this is the balance owed as if theyre still coming after me, which is a violation of the FCRA!

Complaint: This is an addendum to Complaint # XXXX.in regards to new information discovered on XX/XX/2019. I received a voicemail from XXXX XXXX of VW Credit in regards to my receipt of an email dated XX/XX/2019 that VW Credit has reported, yet again, that my XXXX payment has not been made. Volkswagen of America was to have made my XX/XX/XXXX car payment on XX/XX/2019 and was told that the process had been started to remove the lack of payment from my credit report. Today, XX/XX/2019 through voicemail left by Ms. XXXX, I was told that the check Volkswagen of America sent to VW Credit had a stop payment on it. I was also told that an electronic payment was made on XX/XX/2019. Why was a stop payment placed on the check? Volkswagen treats a long standing customer with indignity. I am the one whose credit is affected. I am the one who is being played with. Well, this is not a game and Volkswagen ought to be ashamed treating me this way after 22 years as a customer. I wish to rid myself of my relationship with Volkswagen and will take steps to do just that. Both VW Credit and Volkswagen of America have cheated me enough. It needs to stop.

Complaint: I have been paying off a car with VW credit for 3 years. I have paid on-time or early each time. Additionally, I have paid more than the amount needed. I recently received a bill and it had a late payment plus new payment on it. I contacted XXXX extension XXXX on XX/XX/19 to discuss this problem. She agreed that the billing was wrong and would handle it. I made a XXXX dollar payment that day as I usually do every month. Subsequently, I received a late payment notice again with a threat that they will contact the credit bureau. I called again today and after 30 minutes, much of which was on hold for XXXX extension XXXX, she indicated that I should actually be ahead not behind based on my payment history. She said she will again look into it. However, I am concerned that their accounting department has not audited my account correctly. I paid the remaining balance that is due to prevent further threats however, I believe their accounting department needs to be held accountable as I am probably not the only person this is happening to. Neither customer service representatives could provide me with a reference number for my call. I also sent an email inquiry today as I wanted some proof that I am trying to get this situation corrected.

Complaint: I purchased a XXXX XXXX from XXXX XXXX XXXX in XXXX of 2016. Upon receiving the car I continuously had mechanical problems. The car was continuously in the shop with the problem persisting. I missed time from work because I was unable to drive the car due to the mechanical issues. I then moved to Ga and continued to bring the car to the shop. I contacted VW customer relations and was working with a manager I told them constantly I no longer wanted the car because it was inconvenient for me I preferred another car or my funds back. I contacted a lemon law lawyer who begin working on my case. During the time he was working on my case I turned the car in not knowing that it would cause him to stop working on my case. The car was sold and I was never notified about the car being sold I dont know where or for how much. I would like this off my credit due to the fact that the car was in fact a lemon.

Complaint: XXXX granted me an extension/deferment on 2 payments due to my being involved and affected by the XXXX XXXX. Because of this there was some confusion about when I was to start paying again. I thought in good faith I was paying on the correct date but missed the window by a few days causing TWO separate 30 day late payments. They are reporting I was late when in fact they received two payments, one each month. I have written to them asking them to correct this misinformation on my credit reports yet they keep responding with a form letter asking me for " more information '' It is clear they are not actually looking into this at all and just fluffing off this problem. How can they extend terms then report lates? This is in violation of FCRA.

Complaint: On XX/XX/XXXX, I was involved in a vehicle accident that resulted in my XXXX XXXX XXXX being declared a total loss by XXXX XXXX. After the collision center at XXXX XXXX XXXX in XXXX, NC, submitted paperwork to XXXX XXXX on XX/XX/XXXX, the insurance company sent the necessary power of attorney documents to my mother, XXXX XXXX, on XX/XX/XXXX. The car loan from VW Credit is in my mother 's name due to the fact her credit score is higher than mine and she was able to secure a lower APR when we refinanced the vehicle XXXX years ago. However, the vehicle has been in my possession since XX/XX/XXXX, and I reimburse my mother for all car payments. XXXX XXXX informed VW Credit on XX/XX/XXXX, that my mother and I had completed all necessary paperwork and had accepted the payout amount of {$5500.00} to go towards paying off the vehicle. XXXX XXXX requested VW Credit sign a letter of guarantee and send to the XXXX XXXX total loss department as soon as possible so that a check could be cut and overnighted to VW Credit. For the past 10 days, VW Credit has sat on the letter of guarantee, refusing to sign it. In the meantime, VW Credit continues to draft my mother 's bank account for car payments on a vehicle that is currently sitting in a salvage yard. On XX/XX/XXXX, VW Credit drafted her account for {$220.00}. I have reached out to VW Credit on several occasions, but I've been given the runaround. XXXX XXXX has contacted VW Credit on a daily basis to expedite my total loss claim but VW Credit refuses to acknowledge its fiduciary responsibility and sign the letter of guarantee. In the meantime, I am having to pay out of pocket for a rental vehicle. The current cost is approaching {$500.00}. I believe that VW Credit should do its job and close out our account, so that I may purchase a new vehicle. This is creating an undue hardship due to the fact I commute XXXX miles roundtrip to work every single day.

Complaint: I asked for an online payoff quote which was a certain amount. Then when I sold the vehicle to a dealer, the payoff went up by {$700.00}. When I inquired as to the disparity, Audi Financial told me there is a different payoff for a dealer ( based on fair market value ) than the payoff would be if I personally paid off the vehicle. I contracted for a certain amount of miles in my lease, and I paid that amount. It should be irrelevant how they are paid off. To resolve this, I had to payoff the lease, wait a for a title, and then sell the vehicle to a dealer. Audi is participating in an unfair business practice and should be fined for this behavior. It's clearly corporate overreach.

Complaint: In XX/XX/2016 I leased a XXXX XXXX ( VIN XXXX ). I was clear that I needed XXXX miles per year because of my commute. This was discussed in person and via email with the sales manager. My previous lease, the lease referenced and current lease are all XXXX miles. When I turned in the vehicle I was charged for mile overage. It was then revealed that the lease documents were tampered with. The lease miles were changed on the document. The document that was given to us as a copy was not the copy that I signed. The paperwork that I signed absolutely matched the XXXX miles agreed upon. XXXX is not taking this seriously or even helping to investigate matters, they are reliant upon us for getting email records from our previous email provider.

Complaint: To Whom It May Concern, I am writing you in complaint about Audi/VW Financial. I was directed by OCCC to CFPB because of the nature of the loan. I have a lease for 36 months thru Audi Financial. The price of the car was about {$70000.00}. In which I preceded to put {$12000.00} down upfront to get the payment to where I felt comfortable. In all leases there is a total amount due. Usually closed ended leases calculate that as the total of remaining payments ( including interest/deprecation ). Open-ended leases are different story. In my case, ( closed-ended ) I have had this car for 12 months and was hit by a old lady with only liability insurance. Obviously her insurance company did not cover the entire cost of the car in which my insurance, XXXX, covered under underinsured driver. I problem here now lies that Audi gave me a payoff on the lease of {$50000.00}. My insurance, in which I was not at fault and currently suing the other party for injury, is paying out {$54000.00}. Audi financial is stating they are to keep the overage in payoff. I have spoken to 3 supervisor in Audi total loss department and none of them could answer the question Why? I am in the car finance business. I work with both XXXX and XXXX XXXX, which is XXXX XXXX. Nobody in either total loss department could understand why Audi is refusing to give the money back. I reach out to you in hope that I can get some type of help in resolving this problem. I feel that regardless of the car being leased or financed if there is an overage in payoff, paid by insurance carrier would go back to the insured. Reaping the benefit of my good insurance. I do not believe it is lawful for Audi to keep that money. Because where I stand I am getting total screwed by both Audi and the old lady that hit me. I return the vehicle in great condition and 10 thousand miles under the yearly usage limit and Upon the return was not made aware from any Audi service member I would be receiving a additional bill or any other notices, and I did not any receive any letters or calls. Six months later i receive a call from a collections agency stating that a bill of over {$500.00} dollars from Audi claiming damages to the vehicle. Before returning the vehicle I recently moved to another residence, so any notices via mail that Audi sent were not received but Audi made no further effort to contact me although they have my direct phone number and have had no trouble contacting me previously. I believe best practices and efforts to settle whatever account issues were not exercised and now my credit has been severely damaged because of this negligence.
