Complaint: I would like to express my feelings of despair coupled with immense anxiety that have been triggered the day I was lied to and misrepresented with false information. It is time to get to the bottom of it, thanks to the CFPB.
On XXXX XXXX my husband leased a car from Toyota Financial Services. The representative of the leasing company affirmed that my husband was approved for the lease, and the XXXX dealer will deliver the vehicle to our residence.
I will clarify yet again, my husband signed for the lease, and I did not fill out any applications with my information. In fact, I do not have a drivers license ; I never had a drivers license. I have no need to lease a car and never intended to do so. Nevertheless, with the arrival of the new car, there were documents that required my signature.
Since I am completely unfamiliar with the car leasing protocol, I followed the directives given by the driver that delivered the car. After my husband signed the lease agreement, the driver required a spousal signature since we live in the same household. He said that the paperwork request is mandatory for insurance purposes and handed over paperwork that he had prepared. My husband specifically asked about the nature of the documents to which the driver replied that by law when one gets an insurance quote, everyone residing in the household has to be listed on the policy even though they do not have a drivers license. He explained that it is urgent he gets my signature before he leaves otherwise there will be issue with the car insurance policy.
My husband and the driver drove to my workplace in the new car, and the driver mandated my signature then and there and re-explained how important it is. I naively followed the instructions without giving out any of my personal information to Toyota Financial Services and I signed on the basis that it 's required for insurance.
The problem began when my husband unfortunately was involved in a accident. When he spoke to a XXXX representative, he was told the car is totalled and ca n't be repaired, he also affirmed that since he has full coverage " As it 's mandated for a leased vehicle, it 's not possible to lease a car without full coverage insurance '' they will pay for the full value of the car. However, that was not the case. XXXX did not pay the full amount. ( I will attach the letter from XXXX to prove it, I 'm not here to say that XXXX did n't play a role in this mess, but I 'm submitting a seperate complaint for that ) Toyota Financial Services claimed that I have gap insurance with Toyota Financial Services as well as a damage waiver that will cover the remaining balance and therefore I should n't worry about the fact that XXXX did n't pay in full.
I remember clearly my husband being on the phone with Toyota Financial Services day after day since he always was ahead of his payments by 3-4 months and wanted to know if hell be refunded ( As you 'll see from the collection letter I 'll attach where it says Customers Payments, who was promised to be refunded to my husband since it was an overpayment ).
After hundred calls and many aggravating hours spent merely to reach a representative, my husband got through, and Toyota Financial Services agreed that there is a overpayment ofapprox. $ 1,600and they will send the check in the mail for that amount.
I will never forget the day when mail from Toyota Financial Services arrived. Surprisingly, instead of receiving a check as promised, we received a detailed bill, which amounted to almost {$14000.00} ( Will attach a copy ) of what they claimed my husband is liable for. The frustration of receiving the bill was extreme. My husband contacted Toyota Financial services, and was told that it was an error on their part and it will be taken care of promptly. In the meantime, while waiting for them to correct their error, my husband 's credit score dropped by 250 points. When he verified the reason for the credit drop, the only liability that showed up was Toyota Financial Services account in delinquency!!!!! My husband called again and again and again and there was no one to talk to Nevertheless after over 1 hour and 15 minutes hold time, a representative answered, and transferred the call to the recovery department because he did not have access to our file since it was delinquent.
Unfortunately, I 'm limited in the amount of words I can put into this complaint, and I will not have the ability to mention every single phone call of abuse and dishonesty and lies that was told. I WISH I WOULDVE RECORDED THEM, JUST TO SHOW THE CFPB HOW EVERY REPRESENTATIVE SAID SOMETHING ELSE!!
What I do want to say is that a year after the Toyota delinquency appeared on my husband 's credit report and made an aggravating mess, it all of the sudden appeared on my credit report! " " Yes as I says it just began reporting to my credit reports!! I 'm not in any way joking, I purchased several times copies of my reports and since there 's no one to talk to at Toyota Financial Services I contacted the credit bureas for help and all they told me was how I 'm able to dispute it and they will forward my dispute to Toyota '' '',,, This is entirely illegal, and should Toyota Financial Services claim that I signed, I believe I made it clear how the driver fooled me into signing this on the basis that it 's for insurance.
After disputing it several times with the 3 major CRAs the answer always came back with one statement " WE VERIFIED THAT ALL INFO IS ACCURATE, but nothing more than this statement. And they would n't release any info on how they verified it.
I ask the CFPB to explain Toyota Financial Services my rights and educate them on the FCRA since I am a novice and give them this last chance to remove it and make things right.
Should Toyota Financial Services feel that they are a prominent enough institution and theres no need for them to waste their time making things right, I will have to pursue legal action.

Billing problem
Complaint: I have been on the phone this morning, XXXX/XXXX/XXXX, to XXXX XXXX and XXXX XXXX for 1 hour 13 minutes. Have spoken to a " XXXX '', then transferred to " XXXX '' XXXX XXXX where she put me on hold a few times, this most recent time for 15 minutes when I asked to speak to her manager or supervisor, and then she disconnected me.
XXXX told me that an outstanding balance is still showing due for the return of my second key on the XXXX XXXX XXXX XXXX that I traded in for an XXXX XXXX XXXX back in XXXX XXXX from XXXX XXXX XXXX XXXX XXXX. I have gone over this with the circuitous XXXX XXXX departments ad nauseam last year and thought that it was FINALLY resolved. All of a sudden, these past few weeks I 've been getting phone calls and letters from XXXX XXXX stating the key was never returned and I still owe {$400.00}.
Here is my record of actions taken : XXXX/XXXX/XXXX traded in XXXX XXXX XXXX XXXX for an XXXX XXXX XXXX with salesperson XXXX XXXX of XXXX XXXX XXXX XXXX XXXX. Gave him one key for which he gave me a receipt ( without a signature from his manager because he told me his manager was unavailable and it did n't matter anyway ). I said I 'd return the next day with the second key.
XXXX/XXXX/XXXX returned to XXXX XXXX XXXX XXXX XXXX and handed second key to XXXX XXXX for which he issued me a revised receipt, signed by the manager. He merely took his copy of the original receipt and changed the " 1 '' to a " 2 ''. I insisted on waiting for his manager to sign this one which he made me wait about half an hour to get done.
Within a week I started seeing outstanding charges in my online account and began making phone calls to XXXX XXXX to inquire.
XXXX/XXXX/XXXX " XXXX '' XXXX XXXX told me my online account had n't been updated yet and not to worry ... .my account would be updated to reflect proper credit once XXXX XXXX XXXX paperwork was logged in. She told me to allow 24 hours to check my online account again.
XXXX/XXXX/XXXX My online account still showing outstanding charges. I attempted to call XXXX XXXX again and was kept on hold for 11 minuted 9 seconds and had to hang up to attend to my business.
XXXX/XXXX/XXXX I called XXXX XXXX again and spoke to " XXXX '' who told me there was n't any paperwork from XXXX XXXX XXXX with the agreement to cover my first two payments, however, my account did show that " 2 keys were returned ''. I then asked for my issue to be escalated to find out why I was getting different information about my account. I was then transferred to " XXXX XXXX '' in the " Loyalty Department '' who told me there was " no dealership activity '' on my account and suggested I wait 72 hours to see if my online account had been updated with the correct credits. I asked to speak to someone else that could give me more definitive information. She suggested I call XXXX XXXX XXXX and speak to their sales manager.
XXXX/XXXX/XXXX I spoke to " XXXX '', Sales Manager at XXXX XXXX XXXX who told me he was aware of who I was and my " situation '' and he would speak with " XXXX '' to ask her to " resend '' my paperwork agreement to XXXX XXXX through their " dealership portal ''. He told me he 'd call me back within an hour to confirm it had been done. He never called me back.
XXXX/XXXX/XXXX Spoke to " XXXX '' then " XXXX '' then " XXXX '' trying to get to the bottom of the situation but could n't get any resolution. Everyone told me different information.
XXXX/XXXX/XXXX My online account was still showing outstanding monies due. I called XXXX and spoke to " XXXX '' who told me the online account would n't be updated that quickly and I needed to wait another 7-10 days.
XXXX/XXXX/XXXX The last person I spoke to on XXXX XXXX, XXXX was " XXXX '' ID # XXXX, phone number XXXX who assured me the issue of my first two months being paid for was resolved and those charges removed from my account ( which I confirmed online ) and the receipt for the second key was received and the key charge would be removed although it might take a few days to show up online. I checked my online account a week later and all outstanding charges were removed and it seemed as though the account was FINALLY in order. I had n't received any communication, any notification that any monies were due until about a month ago ( XXXX ) when I received my first letter from XXXX XXXX and then the phone calls started stated they needed to speak to me.
You can then jump to the beginning of my complaint to when I initiated my call to XXXX XXXX inquiring as to the " collection ''.
There were a series of serious issues I had with this dealership and needed to resolve. One issue was that the finance person, XXXX XXXX, added a " roadside service '' to my new lease which I never approved when he asked me a handful of times ( each time discounting the price ). I had n't realized he added the service anyway until I got home and reviewed the lease agreement more carefully. At the time of signing at the dealership he was verbally stating the charges and just turning his computer screen for me to digitally sign on the line without seeing what I was signing. I realize what a big mistake that was when I got home and is the reason I decided to sit down and read the contract more carefully and noticed the erroneous charge.
I was also promised, in my trade-in deal with XXXX XXXX, and verbally approved to me by his manager, that the payment for the first two months of my new lease would be waived. That promise was ignored and took numerous calls and ultimately required that my partner physically go to XXXX XXXX XXXX XXXX and speak very loudly in the showroom so that other customers could hear how unfairly we had been treated so that the manager would come to speak to him and follow through on issuing the proper paperwork to XXXX XXXX stating the agreed upon terms.
That issue, with great time and effort on my part, appears to be resolved although now, it seems, the return of the second key is still being questioned. The series of phone calls I listed above were regarding both the 2 month payment credits AND the return of the key credit.
Attached are the two key returned receipts from XXXX XXXX XXXX XXXX XXXX, which I provided over a year ago as well.

Problem with fees charged
Complaint: I reside in Texas.i signed a LESSEES AFFIDAVIT OF PRIMARY NON INCOME PRODUCING VEHICLE FORM # XXXX I believe is an exemption from my having to pay property tax on this vehicle..I was charged a miscellaneous fee of {$110.00} on my XXXX XXXX lease payment.i called and was told it is a PROPERTY TAX CHARGE ... and they pay the tax but I have to reimburse them. If I am basically renting the vehicle and they own the vehicle why do I have to reimburse the property tax ... also why is it presented as a misc. fee instead of a property tax ... what if I file an itemized tax return? Do I get to claim this charge or does XXXX not only charge me, but also claim the deduction ... ..how does this work. If Im paying a property tax I need documentation to show I paid a tax and not a fee.

Problem with additional add-on products or services purchased with the loan
Complaint: Leased a new vehicle from XXXX XXXX XXXX in XXXX XXXX and noticed that the finance guy did not want to share the contract with me until after I had finished signing. Upon seeing the details of the contract after getting home, noticed there was an after market add-on for {$4000.00} which I never agreed to purchasing, let alone signing an addendum stating that I wanted the add-on or proof that " XXXX '' was ever installed on the vehicle or came with the vehicle. I came back to the dealer on Sunday to speak with someone and the Finance person told me to come back on Monday to speak with the Sales Manager who told me to come back on Tuesday to deal with the original Finance person who ripped me off in the first place. I called the Finance Director who claimed that there was nothing that she could do until the original finance person came back although she was the DIRECTOR, that all his deals were " locked up '' inside his desk and that she had no access to them. After coming back to the dealer on Tuesday and speaking with the original Finance person, he exclaimed that they did not charge me for the {$4000.00} add-on although the contract clearly shows that it was included in the price of the vehicle which determines the amount financed and the monthly payments. He also mentioned that this is a lease, so there 's no financing, which makes NO SENSE whatsoever. He proceeded to remove the {$4000.00} add on and added the total oto the " Rental Charge '' portion of the lease, jacking it up from {$2000.00} to $ 6,000+ to keep the same monthly payments. Eventually, I walked out and asked to speak with their GM, who never showed up. After waiting for another 15 minutes, the Finance Director tells me that she will " resolve '' the issue and removed all the erroneous add-ons and charges out of thin air and removed about {$7000.00} of fraudulent charges on my lease contract and bringing my monthly payment significantly. In the end, there was really no explanation for what occurred because the dealer knew that they were caught red handed and had no proof that the add-on was ever installed or requested by the buyer and tried to save the sale. I could not believe how much trouble I had to go through to get something removed from the contract that did not belong in the first place. Be very careful if you are purchasing from this dealer and make sure that they actually print the contract out and walk over the price with you line by line and provide full explanations for all of the charges and documentation for any " add ons '' that they might have thrown in there that you did not want.

Excess mileage, damage, or wear fees, or other problem after the lease is finish
Complaint: I had a lease through Toyota Financial Services ( TFS ) which ended. I received a letter from TFS dated XX/XX/XXXX, stating I owed {$430.00}.
On XX/XX/XXXX I spoke with XXXX ( Agent XXXX ) who reviewed the charges. Most of the charges were incorrectly billed to my account. There was a questionable amount remaining of {$62.00}. That amount was for a pro rated property tax amount due from the previous lease holder ( the lease is a transfer ). XXXX was not sure I owed this charge and told me to call back on XX/XX/XXXX to confirm the status of this charge.
When I called back on XX/XX/XXXX, I was told the amount went to collection with XXXX XXXX. To avoid reporting to credit agencies I promptly paid the balance.
Going back to TFS on XX/XX/XXXX I have been transferred around several times and once again was told to call back.
In the interim I have been transferred to 5 different people, all from different departments of TFS ( or some other corporate entity of Toyota? )

Excess mileage, damage, or wear fees, or other problem after the lease is finish
Complaint: In XXXX of XXXX I returned Toyota Camry for end of lease. Prior to lease i had an inspection which determined tail light crack and damage to tire. i had both of these replaced prior to return. In early XXXX toyota billed me for damages to car. i called, submitted my proofs and was told this matter was resolved and had assumed it was. now almost two years later Toyota submitted my account to a collection agency XXXX XXXX, XXXX. This matter was resolved almost two years ago and i consider this harassing.. it is very apparent that they prey on consumers after they expect their records to be long gone. the collection agency has no fax and does not provide a prepaid postage to respond. another harrassing feature.
