Complaint: I was experiencing hardship and requested my mortgage company, Seterus to assist me in reducing my payment. I was always on time and current with my payments prior to my request for assistance. Originally, I was told that I did n't qualify unless I was late with my payments. I was told that I must be late or delinquent with my payments before they would consider my case for approval. I submitted a letter which detailed my hardship. I expressed that I am responsible for my debt and I want to pay my payments on time ; however, I foresee it becoming very difficult to maintain all accounts as I was operating with a negative balance. My payments were lowered for a temporary period until the loan modification was complete. My original payment was apprx. {$1600.00} and my payments were lowered to apprx {$1200.00}. I paid these payments directed by Seterus, on time during this period ( 10-12 months ) before the modification became final. I recently ran my credit score and my XXXX shows that I have been late 6 months, which is incorrect. Seterus report my account late XXXX. I was never late. I made the temp mod payments on time and continue to pay my mortgage on time. I have paid my mortgage on time since I bought the property in XXXX. I filed a complaint through the credit bureau challenging the information they have posted on my account. My account lists as a FHA and conventional loan. Unsure if it is reported correct.

Complaint: I just received a 'notice ' from Seterus stating, " Thank you for your recent request for assistance ..., while your request was carefully considered, your loan could not be approved ... ''. I would simply like any sort of proof that I ever asked for any sort of such assistance from Seterus. I have asked to provide information and validation and authorization that Seterus is the servicer of my loan, and those many requests are well documented but after approximately 6 months, Seterus still has not provided anything legitimate or legal but yet continues to harass me.

Complaint: I demand that Seterus return any money they have received toward the supposed servicing of my loan! It has never been my intention to pay anything to Seterus until they provide legal documentation on the proper, and legal, transfer and ownership of my loan ( as per legal record XXXX does not own the loan ) and then legal documentation/authorization from the owner that Seterus is servicing the loan. I 've asked for such documentation since Seterus first began their extreme harassment and I 'm still asking for it. I also spent years asking XXXX XXXX XXXX for this information and I have received XXXX of pages of documentation, even forged documentation, but still nothing regarding the ownership of the loan. I simply did not realize that Seterus was forwarded funds from XXXX and Seterus is simply holding and benefiting from holding funds by not at very least applying to funds toward the principle of the loan.

Complaint: I purchased my home in XXXX and was not required to have flood insurance because I was in Zone X. My servicer was XXXX. At some point in the last few years my servicer changed to Seterus. In XXXX FEMA changed the flood maps in my area and placed my property in Flood Zone AE ( high risk ). I did not get any notification of this change from FEMA nor from Seterus. I was unaware of the change until recently when my home flooded with XXXX ' of water from the XXXX flooding. I checked with my neighbors and most of them got notifications from their mortgage company when the maps changed telling them they had 45 days to provide flood insurance or it would be placed for them. I have read that it is a Federal Law for mortgage companies to place flood insurance on their assets to protect them when they are in high risk flood areas. As I understand it is their responsibility to know this information and inform me. The situation now is that I have a home worth pre-flood XXXX but now needs XXXX to rebuild. I currently owe XXXX on the original mortgage. I feel that the servicer or XXXX or FEMA bear some responsibility in not having the coverage I needed. I have gotten some money from FEMA as disaster relief but not to cover rebuilding. The home currently is vacant and not livable. I have called Seterus and they give me the run around sending me to their Insurance department XXXX who then tells me I do n't have Flood Insurance. ( I know ) They tell me I can not talk directly to their property mitigation department nor directly to XXXX about getting help with rebuilding costs by way of cash or mortgage reduction. I do n't want to walk from the house but the numbers just do n't add up. I need to find the right person which has not happened to date.

Complaint: Myself and my husband had our hardship resolved and was able to remain in our home after we were swindled by two real estate agents, long story short we applied for a loan modification which was approved this XXXX 2016 after paying the trial period amount of {$2200.00} for three month i called in to pay XXXX on the XXXX and was told the loan was now XXXX via the automative service, i immediately hung up and called back so i can speak to a live person who also assured me that this was my new amount and i will get adjusted information in the mail.
On the XXXX i received a call stating i still owe XXXX i was just as confused as the person on the other end who took over an hour to pretty much tell me it was an error and i have to pay late fee and they cant help me resolve this issue.I called and spoke to over XXXX people and no one could give me a straight answer not to mention my XXXX statement came with the lower amount on it as well.

Complaint: In XXXX of 2016 we were solicited for a Mortgage Loan Modification by Seterus, the servicer of our XXXX Mortgage. The deadline to make the first Trial Plan period Payment was XXXX XXXX, 2016 and we made the payment in XXXX. As explained in a prior complaint to your office by us against Seterus , Inc. ( Case # XXXX ) we made all of the required Trial Plan Payments and have been trying, unsuccessfully, since XXXX, 2016 to finalize the Modification.
Recently, after receiving solicitations from Foreclosure Lawyers, we became aware that XXXX filed a Mortgage Foreclosure Action against us on XXXX XXXX, 2016 ( XXXX XXXX Court Case # XXXX ), after they offered us the Modification and before the first payment was due. This Dual Tracking by XXXX and Seterus was in bad faith and a VIOLATION OF THE CFPD REGULATIONS PROHIBITING DUAL TRACKING IN LOSS MITIGATION AND LOAN MODIFICATION PROCEDURES. In addition, Seterus continued to accept our payments in XXXX, XXXX, XXXX, XXXX, and XXXX and NEVER notified us that a forclosure action had been filed.
We have been victimized by Seterus over and Over again!
All this time we have been negotiating with them we had no idea that they had already filed a suit against us.

Complaint: I have been reported late on my mortgage when the lender has been unable to be reached by phone for payment. I have been charged fees without notice and been unable to have removed. I have had insurance placed on my loan even with adequate coverage in place. The company does not offer refinancing at better rates and forces mey to stay with them unless I fall behind and ruin my credit, then they will offer a better rate.

Complaint: I have had an ongoing problem with Seterus Mortgage Servicer since XX/XX/XXXX regarding my escrow account, however XX/XX/XXXX, there was an error made in which to company attempted to charge me XXXX monthy for my mortgage, ( I have the letter ). Now after several months of going back and forth with misapplied payments and ultimately another escrow done XX/XX/XXXX, the error was corrected and my payment lowered from the real amount of XXXX to XXXX. I went to review my XX/XX/XXXX escrow again, it is not available for download, nor are any of my monthly statements for XXXX, XXXX, XXXX, XXXX, and XX/XX/XXXX so I can verify the escrow amount during these times.
This is an essential function and my understanding the law that these documents made available to me in a functional manner. I have consistently had problems with this company and any documentation. I do not want to have to consistently have to contact CFPB, XXXX or any other entity just to get my statements or escrow.
I believe there to be a further issue but I am not sure of that at this time, it will require further review and may be something I have to cure, but I can not do that without the timely delivery of my documents.

Complaint: Seterus sends a welcome package it arrives XXXX XXXX XXXX and paperwork says " NEW LOAN '' and provides a new loan number and an insert of all their fees and charges. This is not my XXXX home nor is this the XXXX time that I have experienced a transfer of servicer. As stated in section XXXX of most and definitely the security deed that Seterus claims to be servicing.
" If there is a change of the Loan Servicer, Borrower will be given written notice of the change which will state the name and address of the new Loan Servicer, the address to which payments should be made and any other information RESPA requires in connection with a notice of transfer of servicing ''. Says nothing of you will or may receive a new loan. This was the first problem as I knew that I had not applied for any loan. I had no knowledge of the company SETERUS. First thing to do was XXXX SETERUS. The results were thousands of complaints, most that I read that day were about this welcome package and being unable to either make payments or payments being applied late and escrow issues.
On XXXX XXXX, XXXX XXXX XXXX of Congressman XXXX XXXX 's office initiated a conference call with me and Seterus representative XXXX and he point blank stated that " Seterus will not accept payments with original loan numbers '' from the actual recorded documents that are on file and thousands of dollars have been applied. And apparently XXXX was not lying. If you review some of the complaints you already have on file you will find that my experience with this company is not unique. Others have had payments returned as they had the loan number on their payments that they have used from origination. Seterus has been demanding ransom money from me under the threat that they will take my home if I refuse to agree to a loan I have neither wanted nor applied for.
All consumers need to know why new loans are being created to replace existing loans when Seterus states it is merely servicing existing loans. Why are consumers being forced into new loans to keep their homes? Seterus will not correct erroneous information. I received a letter from a XXXX XXXX stating I have a loan that Originated on XXXX XXXX, XXXX. I promptly sent a certified letter disputing their information and requested documentation to support that erroneous information and received no reply.
Seterus has sent me letters stating that my request for a loan modification is denied and denied twice XXXX separate letters. I have not requested a loan modification on a loan that I have no association with. I had not even purchased a home in XXXX. MISLEADING AND ILLEGAL IF YOU ARE REQUESTING COMPENSATION FOR SERVICES NOT PROVIDED. Seterus has now listed my home for foreclosure with the Law Firm of XXXX XXXX XXXX for XXXX the XXXX, XXXX. I finally received the documents I have been requesting and the remaining principle balance on Loan Number # XXXX the only allege loan tied to my home shows the following information : Unpaid Principal Balance XXXX Accrued Interest XXXX Escrow Advances XXXX For months Seterus has been threatening and harassing me. I have sent many certified letters to Seterus after they turned down the ransom if I did not send money with this created loan and account number of theirs. Their actions landed me in the emergency room from XXXX that had me XXXX for weeks and had to go through physical therapy. Seterus hired the law Firm of XXXX XXXX XXXX to initiate foreclosure procedures on my home. XXXX XXXX XXXX sent a letter to me dated XXXX XXXX, XXXX advising that the Seterus loan '' XXXX '' had been referred to them for Foreclosure and that I had 30 days to dispute the debt.
