Complaint: Seterus inc. my mortgage servicer has taken payments from me over the phone then sends letters saying my account is suspended and the money was put into a suspense account. They have tried to charge me with incorrect fees such as property inspection, that are only allowed if im in default. I would n't be in default if they properly applied payments they have taken from me and put in suspense.When I call I tell them and tell them I want to make my regular monthly payment and dispute the charges they agree and take my payment, then later they send me the letter saying I am in default because the money they took from me is in a suspense account.Meanwhile they keep adding fees including a lock change fee which never happened, they refuse to send me a complete intemized list of the fees. I have ample resources to pay they just wont apply any money taken to my account, they also report me to the credit bureau companys .All I want to do is pay my mortgage they insist I must pay these fees with no chance to even see what they are. Please help me I continue to fall farther behind every day Thank You

Complaint: Filing Complaint about Seterus, Inc. tricking me, harassing me and not living up to what their Hardship Customer Service representatives told me.
I contacted my mortgage company in early XXXX, XXXX to let them know I was having difficulty keeping up with my mortgage payments. I had been looking for work for over 7 months and was still unemployed. My husband had recently passed away and at that time we had to deal with exorbitant medical bills from his 11 year long term illness with XXXX The last XXXX were XXXX as he was almost completely XXXX except for very limited XXXX. Our care for him was 24 hours a day 7 days a week and all his care fell to our XXXX daughters and myself, so I could not work during this time.
I explained my situation and that my brother-in-law had offered to teach me XXXX and he felt I could be working by XXXX, XXXX. I believe the first person of contact with Seterus, Inc. who directed me to the Forbearance due to extreme hardship was a Supervisor by the name of XXXX XXXX. I do not have all the names of those I 've spoken with but each time I 'm told I can not get back to XXXX and that I have to speak with whoever answers my call. I have spoken with more than a few which has caused me to have to repeat my situation over and over. That tells me their notes on my mortgage and issues are not documented. Each time I waste time getting the new person up to speed. I followed XXXX express directions ... filled out their form, had documentation of my husband 's illness and death, and a letter explaining my situation and what I was doing to work my way out of it. I was told that there should be no issue with my getting the forbearance but that I would have to make a payment of {$4800.00} before they could approve my forbearance. I borrowed the money and made the payment.
I found out within weeks that the forbearance had not been approved. I was told by the newest representative of Seterus that I needed to change XXXX things on the forms they required. I did so and within an hour had the new forms to them. That was XXXX XXXX, XXXX and I have been harassed continuously since.
Twice I have filled out the paperwork as they directed. Twice I gave them exactly what they required. I was told this would not be an issue and that Seterus, Inc. would work with me since I had been paying my mortgage payments on time and was a good customer, and with consideration to the hardship our family has been through.
I am trying to save my home after some very hard times for our family. Please help. I just require Seterus, Inc. to live up to what I was told would happen .... I would make the lump sum payment and they would leave me alone to learn programming and get employed until sometime in XXXX XXXX.

Complaint: I received my XXXX 2016 statement from Seterus showing A total amount due of {$3300.00}, showing a past due amount of {$1600.00}. I immediately called Seterus on XXXX/XXXX/16 and talked with XXXX XXXX. She told me everything was OK. I asked why was it showing I owed for last month when the check was received by them and paid to Seterus on XXXX/XXXX/16. She stated that the payment is due on the XXXX of each month. However, it will not be reported to the Credit Bureau unless after the XXXX of the month. I indicated to her that this does not made any good sense and asked her if this is going to happen every month showing no payment received and why were their system changing to show no payment had been made. I noted that nothing had been applied to the Principal, Interest nor Escrow and the Outstanding Principal Balance remained the same as the XX/XX/XXXX statement of {$180000.00}. I assumed it would be corrected on the XX/XX/XXXX Statement. However, when I received my XX/XX/XXXX Statement, it showed, again, that I was past due for the previous month. The Principal, Interest and Escrow is incorrect because nothing was credited for XX/XX/XXXX as well as the outstanding Principal Balance. There are serious errors with these statements and I want the proper credit for the month of XX/XX/XXXX because nothing was credited as well as stop showing that I am a month behind on every statement because this is inaccurate.

Complaint: In brief, Seterus, the current mortgage company will not release insurance funds earmarked for a repair to the house.
In XXXX XXXX the property at XXXX XXXX XXXX, XXXX XXXX was found to need soil stabilization work done. In comman parlance a '' sinkhole ''. The claim was filed with XXXX insurance in XXXX XXXX. In XXXX XXXX, after review by a XXXX XXXX XXXX XXXX XXXX XXXX, the claim was approved.
In XXXX XXXX XXXX XXXX XXXX, a soil stabilization and foundation remediation company was engaged, and a pre-stabilization cosmetic estimate was performed by.
XXXX XXXX XXXX was paid XXXX of their portion of the remediation funds and commenced work. The work was completed on XXXX XXXX, XXXX XXXX XXXX XXXX was paid the remainder of the remediation upon completion.. Then a second cosmetic inspection was performed by XXXX additional companies XXXX XXXX and XXXX XXXX XXXX. An average of their XXXX estimates was agreed upon by XXXX Insurance as appropriate payments for cosmetic repairs. The check for {$26000.00}, ( copy attached ). was made payable to myself, XXXX XXXX XXXX and XXXX XXXX XXXX as the Holder of the Mortgage. Since then the Loan has transferred to Seterus Inc . The check was cashed by XXXX XXXX XXXX on XXXX XXXX, XXXX.
XXXX XXXX XXXX sent the money to XXXX prior to Transferring the loan to Seterus. This caused several months of back and forth between Seterus and XXXX and finally a CFPB complaint before the funds were located. Now Seterus agrees that they have the money but now have invented more impediments to releasing the cosmetic repair funds.
Until the cosmetic work is completed we can not close this claim out. I have received numerous letters from XXXX XXXX asking when the claim will be completed. Now they are planning on cancelling my insurance ( notice attached ) and not reinsuring the house if the claim is not completed and closed.
I have also received somewhat threatening letters from Seterus about " fraudulently cashed claim checks ''. ( XXXX dated XXXX XXXX, XXXX, copy attached ) I wish to emphasize that the stabilization is complete and and has been signed off by all municipal XXXX XXXX and state agencies that need to do so, as well as XXXX XXXX XXXX. The remainder to close out the claim are numerous but minor cosmetic repairs both inside and outside the house.
At the time of the claim the house was in foreclosure, it has since been permanently modified and is in good standing.
Seterus will not release the funds to us to perform the cosmetic repairs. They have said that 1 ) I need to open a new claim or sometimes when they can find the claim 2 ) that all work performed needs to be performed by a XXXX XXXX. The cosmetic work that need to be completed is in no way structural in nature. Several boards on the decks need to be replaced. Baseboards and trim need to be replaced and /or repainted. Floor tiles need to be fixed. Per the state of loricda and XXXX XXXX repairs of this nature, presuming they cost less than {$25000.00} do not require a Licensed XXXX to perform. We have been in contact with then several times via phone and mail : letters attached.
They, Seterus, Is now saying that their policy is that if repairs cost more than {$10000.00}, they need to be performed by a licenced contractor. I contend that this requirement was not is my original mortgage documents with XXXX Bank on XXXX, was not a requirement at the time the claim was filed, it not a requirement in the XXXX of Florida nor in XXXX XXXX, and that, therefore, they ( Seterus ) can not add unnecessary and onerous restrictions to the disbursements of funds. I further contend that they are intentionally delaying this process in order to " force place '' expensive insurance

Complaint: My mortgage rate was variable and went up. I sent my original payment off before I received the new mortgage amount. As soon as I received the new mortgage payment I called Seturus and paid the difference. Seturus had applied the amount to other fees because they considered it a partial payment. By the time they moved the funds back to payment, they were reporting a 30 day late. However the funds were sent to them way before. I called and disputed the 30 day late and Seturus verified is was incorrect and I should not have a 30 day late, but they are still reporting it wrong. I disputed the 30 day late with the credit companiesXXXX, and XXXX Seterus verified them as correct to the credit agencies.
This is costing me hundreds every month, because I am trying to refinance and I am being told that my loan is being denied because of the late being reported.

Complaint: I have been consistently given false and misleading information/instructions from Seterus regarding my attempt at a loan modification over the past several months which has resulted in a potential foreclosure of my home, escalating late fees and severe emotional distress. I have literally spent the equivalent of DAYS on the phone with countless Seterus representatives. I need to waste time explaining the facts to them over and over while also being asked to submit the same documentation over and over again. Most recently, I followed the exact advice received from a Seterus representative on submitting my divorce decree as part of my modification packet. Following 8 months of review and further mistakes in handling of the documents by Seterus, I was informed by one of their supervisors that I should not have listened to their representatives 8 months previousand that the same documentation was required that I was told would not be required. Their pattern of blatant misrepresentation has caused me to lose sleep on most nights as I worry about whether I can stay in my home. I made all necessary trial payments for the modification and only waited to sign/execute the final papers last week when I learned of the newest swerve from Seterus. There is a foreclosure sale date of XXXX XXXX, 2016 and I am seeking immediate resolution in the form of the modification agreement that was originally agreed to. I have never formally complained about a company before in my entire life but I feel compelled to say that Seterus has by far the worst customer service I have ever experienced. They are either just inept or fraudulently malicious and I am shocked that regulators continue to allow them to be in business given the sheer number of others who obviously have had similar experiences.
