Complaint: Seterus/XXXX in CFPB compliant XXXX, I complained that Seterus is not providing me with the assumption documents due to be heir to my dad 's homestead that under florida law upon his death by default I become owner of the property. Seterus responded that I still need to provide other documents to proceed with the assumption documents.
I have filed bankruptcy protection on my property as heir at the time of my dad 's death.
Seterus did not dispute my ownership to the property and is requesting to continue the mortgage payments, thus its concession of my standing as ownership.

Complaint: We were transferred to Seterus from XXXX, Bank, we were told that {$3300.00} was past due, We paid that before the due date of XX/XX/XXXX. Seterus formed a escrow account that we did not have with XXXX nor with Seterus as we pay all out taxes and insurance ourselves. Seterus no5tified us that we still owed the XXXX after we paid it in XXXX installments XX/XX/XXXX. Due to bad / negative correspondence about Seterus we went ahead and sent another {$3300.00} by certified check to go against money not owed, but Seterus said we did, then starting in XX/XX/XXXX XXXX started collecting escrow as we had no choice but to pay as this was our new total monthly bill. we could not short pay nor were given any other option. escrow was calculated for 12 months to collect money owing. Seterus collected for over 18 months not the 12 and when questioned reimburse us {$2500.00}. but kept the {$3300.00}. this adds up to paying the {$3300.00}, 3 times.
A complaint was filed and they justified it with us making the decision to pay the escrow amount that we did not have an option to. they did not point out in their letter in response to the complaint the we were never supposed to be escrowed for any amount. ever! we always paid our property taxes ourselves, the first payment cleared the debt, the second payment the put towards our principal? And the Escrow they kept I have no idea where that went? now I call and they are not available, they are closed at XXXX PST on a Wednesday? I can not call, letters create a cluster of confusion without resolution.

Complaint: I have a HAMP loan and received a letter in XXXX informing me about a {$5000.00} incentive that had been applied to my XXXX. An offer to modify was also included. I signed and mailed it. In XXXX I received the enrollment paperwork via XXXX. I thought I was ineligible because my XXXX payment would be late ( I am a XXXX on a XXXX ). I called Seterus to inform them of the late payment, and was told I qualified. I signed the enrollment and sent it in the XXXX envelope Seterus provided. I was given a new payment amount, told that when modifying one month 's payment is skipped, and that as long as I made the new payment by XXXX/XXXX/16 I would be current. I made that payment. On XXXX/XXXX/16 I called to confirm receipt of the payment, and was told it was the incorrect amount, was being held in suspense, and I was behind. I made payment arrangements and continued to follow up with phone calls. Since XXXX, I have spoken to 5 reps and 2 managers. Two reps told me I was current and the lower payment amount was correct, 2 told me that was wrong, the 5th rep told me both in the same conversation. The managers told me I was behind and refused to let me speak with a superior. I 've incurred late fees, an inspection fee, and received delinquency/foreclosure notifications. On XXXX XXXX I went onto Seterus 's website to check that an automatic payment had been made. I also downloaded all of my 2016 statements except for XXXX, which was missing from their site. I called Seterus to request a hard copy. I have not received it. I have more specific details and documentation, including all written correspondence I received from Seterus. The character limitations prevent me from providing those details here, but I will enthusiastically share them.

Complaint: Mortgage company Seterus is managing my account. I have incurred late fees which they have been unable to explain. I have requested this information on the phone and in writing. I have confirmed that they have my correct mailing address. Each time, I am told that a written response is forthcoming. I need to know about these charges as I have been making my payments timely, electronically. If the problem is with the electronic payment system, I need to seek recourse through them. Complaint: On or about XX/XX/2016. I received a letter from Seterus, Inc informing me that my property taxes are delinquent and need to be paid by me. In previous years Seterus has been paying property taxes on my behalf through XXXX. So far I have called Seterus and XXXX to assist me and no one was able to explain to me why the property taxes had not been paid even though there is an escrow on my account. The individuals I spoke with could not find any documentation that any type of communication had been sent to me. I have not received any communication that I would be responsible for my own property taxes, nor any communication on the status or changes in the escrow account. I have filed a complaint in recent months about Seterus and their claim that I was behind in my mortgage payments which has since been resolved. At this point I would like to file a formal complaint that Seterus is not properly maintaining my records as it pertains to my account.

Complaint: I am writing this in reference to a response you received from Seterus, Inc. in regards to XXXX. Seterus has misrepresented the information. They state they received nothing in regards to a loan modification request for loan number XXXX. I was under the impression until yesterday Seterus was cooperating with me on the loan modification. I have sent them The XXXX 's Assistance form as well as all other documents requested by Seterus over XXXX times since they said we should have an answer in XXXX to XXXX days. They told you they had not had any response from us from XX/XX/XXXX through XX/XX/XXXX. I ca n't go back to the response to cfpb but you can see their response to you which we did not receive a copy of. I appears the are misleading you as well as myself. I have stayed in constant contact with Seterus and have thwe phone records and all correspondences with Seterus as well as the copies I have sent to them. In XX/XX/XXXX Seterus advised me after sending them everything requested, they were reviewing the information. Then I called every XXXX weeks. Each time I contacted them, the employee would say they sent me a letter stating the need for additional documentation not requested at the time of the request for XXXX " missing '' document. This has been going on since my loan was transferred to them from XXXX. To understate the horrible service for this request would not be possible. I have sent this to them completed 3 times since XX/XX/XXXX. I was advised to resend it again last week because they said the Borrowers Assistance form was incorrect this time. I uploaded a new package of a new Borrowers Assistance form Thursday XX/XX/XXXX. They ask me to call them Tuesday to make sure they got it, my house has now been moved to foreclosure status with no sale date according to the XXXX When I told her I was informed last week to upload the documents she kept going back to someone over her and placing me om hold. She informed me they did n't have all the documents in so they closed the modification request. She told me they showed they spoke with me last week. This was when, they advised me to upload the new documents. This was done per their request, AGAIN ... this time only for the to have time to close the request for loan modification file. She acted as I was supposed to be aware of this. I was never notified and spoke with them XX/XX/XXXX and was told to send all the documents over other than the ones they have accepted as having no expiration date. I will send you a new update on the people and dates of contacts as well as Seterus request. But for their lack of acknowledgement that I have proof of contact when they deny this, is outrageous. I am going to summerize this information as well as the letters from XXXX, their compliance XXXX. She and In have spoke as well. She sent all of XXXX pages of her records stating they sent all of those letters, but I only received XXXX of those letters. Now, XXXX told me yesterday, she saw the documents were received I had uploaded. She also said she submitted a request to reopen the loan modification process as well. Certainly they will not handle this with any regards to me. I need to have someone to help me with this as I have proof of what as well as when was sent via fax or upload. Also why did they not tell me the file was closed on XX/XX/XXXX instead of telling me to resend the documents. These have been sent over per their request 3 times now since XX/XX/XXXX. I have proof. Complaint: Beginning with XXXX XXXX XXXX selling my loan to Seterus, debt collection their customer assistants and " supervisors kept informing me that I had filed for bankruptcy ( I have never been in bankruptcy ) 3 months and numerous phone calls yielded only idol promises that it would be taken care of without any success, so I could not make my first paymentand then a second payment and into the third payment which were in my bank waiting to be processed to Seterus. I finally spoke to someone that returned my call 20 minutes after we had spoken to inform me that I was right there was no bankruptcy but now they would need all 3 months of the mortgage including late fees. Due to a hardship I have fallen behind 2 months on my payments and had filed for modification. Once again the constant problems continue either I was getting letters stating they had not received all paperwork that had been included in the first request. Resent paperwork 3 times now. They were going to allow a forbearance due to a box that was checked, on the paperwork, that should n't have been. Resent All required paperwork once again with a detailed hardship letter and now less then two weeks later have now received a letter stating they can not approve me for a modification due to fannie mae stating that my financial information has been determined that I am not at risk of default because I did not document a financial hardshiop that has reduced my income. Could n't have been much clearer than then the hardship letter explaining my part time job had been discontinued in XXXX thereby deducing XXXX a year less. And because I am a senior citizen, plus, I really have very little options on positions in my marketplace. This would seem to be a conclusion for any cooperative company that it will be difficult to continue my current mortgage payment at the amount it is at now. In addition have received two letter stating that they are going to start the procedure for foreclosue. ( What ) I have equity in my home I can sell it but because this spot and land has been in the family for 70 years and my husband and I built this home 24 years ago ( he passed away XXXX ) I really choose to be able to continue living here.
I have worked in the real estate and mortgage company for 40 years but I have never found a more difficult and almost impossible, to understand, company as XXXX has been.

Complaint: Complaint again Seterus Mortgage. I am trying to purchase another house & sell the one I 'm in where the Seterus Mortgage is the loan holder. I went to pre-qualify XX/XX/XXXX & was turned down. I got a copy of the credit report & they state that I was 120 days late for XX/XX/XXXX & XX/XX/XXXX & XXXX. I have consistently paid each & every month. I believe they made a huge mistake in reporting to the credit bureau. I 've talked with them 4 times now. The 1st time I called they did n't have payments entered that were paid & deducted from my bank. Oh ... so they fixed that, the next day of their awful website all of a sudden it showed payments for XX/XX/XXXX & XX/XX/XXXX. At that time I asked for them to send a payment history to me. They said no problem. About 1 week later I get an application for a modification with them. Mind you I talked with them 2 other times in between this first original phone call. They are VERY RUDE customer service people that will not listen to anything you say. Last night I got the worst representative. She yelled at me several times, interrupted me several times. Told me they did nothing wrong. I asked to speak to a manager 4 times & she refused to get one on the phone. She said they would n't say anything different that she did n't say. My girlfriend & I have gotten all my bank statements for XX/XX/XXXX-XX/XX/XXXX & XX/XX/XXXX. Looks like I 've been paying, I believe they have been applying it to the wrong year and/or month. I was deliquent at one time, but only for 3 months & that was in XX/XX/XXXX. ( I was scammed by another company ) I entered their Modification Program. I paid for the trial period of 3 months & they applied those payments, I believe to the wrong months, making it look like I did n't make any payments. They refuse to discuss anything, that they may be in the wrong or rectify the situation. Along with refusing to allow me to talk to a manager. They do not have email to write to, they did give me a number for complaints. And researching this company, I 'm distraut of the way I have been treated & the lack of knowledge that the representatives have in this important situation. They continually contact me with " offers '', calling on the day of the due date. Last night the first thing the representative said, oh your current to you want to set up your next payment. They say they put notes in their computer when I contacted them, but each representative does not read them. I asked for them to send me a payment history for the entire time I 've been with them & all documentation with my signature on it. I would like to get this resolved ASAP to get approved to buy another house. Guess they do n't want me to pay off that loan? The first person I talked with, I was on the phone for almost 2 hours & she had to talk to her manager about missing payments not being recorded right. Again, they refuse to rectify this situation that has hurt my credit more than I imagined & being treated so disrespectfully XXXX by the representatives. Complaint: Complete XXXX Loan Modification Package submitted to Seterus on XXXX/XXXX/XXXX. They did n't review the documents for over 30 days, making the documents out of date. Updated documents sent and sent again. Called and told the package was complete. Called a few days later and was told there were missing documents and the other agent was mistaken. Sent in the missing documents. Then apparently another missing documents letter was sent to the homeowner on XXXX/XXXX/XXXX. Was not received until XXXX/XXXX/XXXX. XXXX asked for missing docs to be submitted by XXXX/XXXX/XXXX - over the XXXX holidays!! DOcuments not received by XXXX/XXXX/XXXX and file closed on XXXX/XXXX/XXXX. XXXX XXXX at Seterus now saying that file can only be reopened with ENTIRE NEW PACKAGE SENT, and the cycle starts all over. WHY DOES SETERUS DO THIS TIME AND TIME AGAIN?? It 's back to XX/XX/XXXX. XXXX XXXX 's supervisor, XXXX XXXX says we do n't have to resubmit a NEW PACKAGE. We just have to send in the information requested in the missing document letter. What is correct or true?
Seterus on behalf of XXXX is deliberately not reviewing documents and providing false and misleading information about these files to homeowners and their advocates.
I just spent 30 minutes on the phone with XXXX XXXX, who said that the file was closed because they were seeking information that was duly provided ( I have emails that show the information was sent ) about a contributor. This also happens time and time again. You send Seterus information and they claim they never got it.
I still do n't know what to do or what to send and why I have to send everything in again, just to be in the same place in a few months. Why is this going on in XX/XX/XXXX!
