Complaint: On XXXX/XXXX/2012, I completed a deed-in-lieu of foreclosure and was discharged of the mortgage debt of the property located at XXXX, IL. I am now being contacted by the company Seterus , Inc, a debt collection agency. Seterus claims that I am in default on my loan for this property and that I owe them money. I have sent them the warranty deed in lieu of foreclosure several times to prove that I do not own this property and that the debt was discharged, but they continue to send collection notices.

Complaint: I negotiated a Deed in Lieu of Foreclosure with XXXX on XXXX for my property with XXXX XXXX XXXX handling the Deed in Lieu of Foreclosure ( DIL ) paperwork and completing the agreement as the law firm representing the mortgage company. Several months ago, a company called Seterus Inc. started sending me overdue mortgage collections notices for the property I had discharged in the DIL proceedings 4 years earlier. They also knocked my credit rating down over XXXX points by incorrectly reporting that I was over 180 days delinquent in paying my mortgage. They requested paperwork on the DIL agreement which has been sent 3 times now and they still continue to harass me by sending several collections requests per week via mail and continue to call me regarding this mortgage that we discharged in a DIL agreement over 4 years ago.

Complaint: One more time Seterus needs to back off until it is established that they are indeed the legal and rightful servicer of this loan. Statements as such from Seterus and an informal letter from XXXX XXXX XXXX does not provide such especially since XXXX XXXX XXXX was n't even the rightful servicer as proven by the fact that they only registered with the XXXX system earlier this year and based on what, their word that they were the servicer? It has been stated that XXXX is the owner of the loan so there should be notification from XXXX but yet XXXX will not address the loan or issues with the loan and the servicing and there is presently nothing legal that shows the XXXX owns the loan ( the fact the loan can be transferred does not represent the fact that is was legally transferred so providing original loan docs does nothing to prove this ). The only legal recording for the house related to this loan is between myself and XXXX Mortgage and they are n't in business any longer so all of this stinks of impropriety. I get XXXX document that appeared to be forged by XXXX XXXX XXXX and when I enquire about it via the CFPB, I 'm contacted by an attorney. At this point and until I pay another penny, I need to know by an attorney precisely the owner of my loan and have referencing legal documentation on current ownership and the transfer of the loan. I also demand a review of how and why XXXX XXXX XXXX was acting as the servicer of the loan without it being legal or rightful which includes why only earlier this year they attempted to make it appear legal. I 'm also even fuzzy on what the XXXX system even does, does that constitute legality? In my mind the only thing legal is an executed contract or a legal and recorded filing and I have neither with XXXX XXXX XXXX XXXX, or Seterus. I have already notified Seterus in writing that I view all communication as harassment and they continued for months to violate collection laws. I even view receiving any sort of statement or literally anything from Seterus as harassment and yesterday I received a cell phone call and this is after XXXX XXXX XXXX legally stated they had purged most likely the illegally obtained number from their records ... My ultimate issue is that I 'm curious the money trail. I would suspect that this loan was written off long ago but yet companies like XXXX XXXX XXXX are simply out trying to profit from a 'dead ' debt. I feel a part of this could be that someone 'declared ' it a XXXX loan while I never was aware of it being, never signed anything indicating XXXX was involved so none of this makes sense. Most importantly where has my money been going? Has it just been going to XXXX XXXX XXXX or is XXXX, thus taxpayers getting the money??? I feel the banking industry just hopes no one researches as deeply as I have as I would suspect tens of thousands if not millions of loans have been improperly handled, this is why the companies have had to 'robo sign ' documents, this is why investment properties I have bought have had to use quit claim deeds which is nothing more than XXXX person saying you own the home, it 's recorded, it seems real as long as no one disputes it ... I will note that on the financial side I somewhat understand 'the game ' that was played with mortgages at the time, they were bundled, they were sold, a lot of shady things went on but as the lender, I have every right to have proof that everything is rightfully and legal correct with my loan.

Complaint: I am currently unemployed and live in the state of California. Seterus is the mortgage company that services my loan. The investor on my loan is XXXX and Keep Your Home California ( KYHC ) is making my mortgage payments until I am employed. The escrow portion ( taxes and insurance ) on my mortgage payment went up ( in XXXX 2016 ) which caused the payment to change in XXXX 2016. Seterus was to notify KYHC and advise them of the escrow change and payment change. On XXXX/XXXX/16 I contacted Seterus and spoke with representative about status of loan. My loan is due for XXXX/XXXX/16 and funds in the amount of {$1000.00} for the XXXX 2016 are in suspense. Payment amount is now {$1000.00}. Seterus representative informed me that they do not contact KYHC when there is payment change that I need to do this. I stated mortgage company must contact KYHC when there is payment change. Representative stated they would look into this and call me back XXXX/XXXX/16. I did not receive a call from Seterus. I called Seterus XXXX/XXXX/16 and spoke with Service Lead representative that I received Seterus acceleration letter and did someone from Seterus contact KYHC about payment change. I stated supervisor was suppose to call me back on XXXX/XXXX/16 but I have never received call. He stated supervisors do not call borrowers and stated he was not sure if someone has contacted KYHC. He asked if I had something in writing from XXXX that states payment change process that mortgage company must notify KYHC directly of payment change and for me to email him this info. I stated I would not do this and Seterus must contact XXXX. This person was rude and hung up on me. I am stunned as it seems to me Seterus does not have process in place for payment change when receiving funds on loan from federal funded program. I called KYHC XXXX/XXXX/16 and asked representative if they had received notification from Seterus regarding payment change they stated no. I verified process on payment change with representative and was advised KYHC must receive payment change notification from mortgage company not borrower. I called Seterus again on XXXX/XXXX/16 and requested supervisor but was told I spoke with supervisor on earlier call. I stated I did not speak with supervisor but service team leader. I stated I just spoke with KYHC and they advised me there is nothing from Seterus reqarding payment change notification. Representative stated they will need to check on this and call me back. I stated when will they call me back as they did n't last time. Representative stated they would call back. I also am worried my credit bureau report is being negatively affected which will cause me more problems trying to get a job. Thank you.

Complaint: I submitted a payment through XXXX XXXX whom then gives me a confirmation number, which then the funds are then drawn from my personal bank account. Seterus does not offer any other options for payments. I am elderly and on a fixed income, I have XXXX late payments and my account is current. Seterus is now saying I owe them a late fee for a payment that I clearly made to them. I called in to their care dept, they were not willing to help me and told me my payment confirmation number meant nothing to them and that I should than take issue with my personal banker for the lapse in payment. So I say again I 'm XXXX yrs old on social security with no other income and really ca n't afford to pay them for their clerical error. The funds have been in the bank since payment was rendered. Now They want me to travel to them and show proof of payment. I Am ready to give up. This company Seterus is awful and the web is litered with complaints of the same type of abuses. Please help me!

Complaint: Our loan was sold. After 3 months of no communication about not receiving payment, we get a foreclosure notice on our door. We immediately call and are offered a loan modification. We did the steps, and continued making cashier check payments. After finally getting our money back we forward it on to the company. Months later we get a notice on the door, our home is going to be auctioned. We contacted them and they said, " we never agreed to a modification ''. All the while we are making payments. We go to the bank and find out they are holding our checks, and not applying them to our loan. Now we stand to lose it all, and the communication to save our home is impossible to get.

Complaint: We did a Deed in Lieu with Seterus, Inc in XXXX of this year. Since that time they have repeatedly altered the information reported to the credit agencies. First showing XXXX missed payments instead of the XXXX we actually missed. Following a complaint to the CFPB they removed that and a month later reported that we missed XXXX payments 6 months prior to Deed in Lieu when we had been paying on time. Seterus has also refused to provide a refund of ~ {$500.00} owed to us since 2012 when they mailed an escrow refund to us that was never delivered. I spent two years calling in and attempting to collect it only to be told I had to prove I did not cash the check in question.

Complaint: An inaccurate and understated appraisal was completed XX/XX/XXXX. I paid {$350.00} for this appraisal through Seterus Inc.. The appraisal came in at XXXX sq. ft. The actual sq. ft of my home is XXXX approx. I paid for this appraisal so that the bank would remove the Private Mortgage Insurance if the Loan to Value was XXXX % or below. Since the appraisal was understated I had a loan to value of XXXX %. I have sent proof with several letters to Seterus Inc. since XX/XX/XXXX that reflects my actual sq. footage but they do n't seem to care or want to help me. PMI runs me almost {$200.00} per month of which I have been paying since 2005. I am elderly and need your help.
