Complaint: A line is now drawn in the sand in reference to alleged Loan # XXXX The above-referenced loan from inception involved what is proving to be a long list of fraudulent misrepresentations, mortgage fraud, both actual and constructive fraud, forgery, identity theft, federal false claims, extortion, deception, slander of title and the list could go on. Despite the concerted efforts to conceal the fraud involved in the transaction identified by the alleged loan identified above ( # XXXX ) the true facts, nature and intent of XXXX and its successors are emerging.
XXXX XXXX XXXX, XXXX and its related subsidiaries, XXXX XXXX XXXX XXXX, the FDIC, XXXX XXXX XXXX, XXXX, XXXX XXXX XXXX , XXXX, XXXX, XXXX XXXX XXXX as successor in interest to XXXX XXXX and as XXXX XXXX XXXX, and its related subsidiaries. Most noted subsidiaries of XXXX XXXX XXXX, specifically is XXXX of XXXX, XXXX XXXX and XXXX XXXX XXXX and now Seterus have all participated and profited in various ways and at various times in my more than ten year long struggle to survive the deception an outright extortion as the following statements of fact and the attached supporting documents will show.
FACTS : 1. The contract ( ID # XXXX ) that XXXX XXXX XXXX, XXXX has proffered to XXXX, and all other Successors and Assigns, was rescinded in writing XX/XX/XXXX.
Written notice of rescission sent, received and acknowledged by XXXX XXXX XXXX XXXX/XXXX/XXXX. Rescission was based upon fraud. XXXX manufactured a means to create a default by increasing a fixed rate mortgage payment from {$800.00} and change to over {$1300.00} and change and stated it was because of a sudden increase in property taxes. Six years of property tax records did not reflect any increase. That followed by misapplied payments and the refusal to return my nearly {$60000.00} down payment along with the threat of foreclosure. This was all within the first year.
2. I purchased a Homeowners title insurance policy from XXXX XXXX XXXX. I have tried. Although I have provided by certified mail many times copies of the policies and the written request for the closing file to determine who received my money and who else needed to be contacted to request the funds be returned. I have received several letters acknowledging receipt of the request and asking that I allow 30 - 60 days and it never comes. I have on occasion had representatives of XXXX XXXX to tell me verbally that information requires a subpoena and that I must sue them to get that kind of information. I have a letter from XXXX XXXX in response to one of my written requests stating that XXXX XXXX does not keep closing files. XXXX XXXX takes a great deal of pride in their '' XXXX XXXX 's ever-expanding, multibillion land-record database that allows them to retrieve and complete the most complex mortgage files '' for the BANKS. What of the consumers who purchase their products?
3. The FDIC would not entertain a claim being filed by a homeowner when I made contact with their office after XXXX went into receivership for their misconduct.
4. XXXX did help to bring a small piece of XXXX XXXX XXXX 's misconduct to light. XXXX provided written confirmation again as they did in XX/XX/XXXX the acquisition date from XXXX XXXX XXXX, XXXX was XX/XX/XXXX. This proves that XXXX XXXX XXXX did not acquire ownership of the mortgage or note in XX/XX/XXXX to assign ownership to anyone. There had been no filings XXXX, Deeds or otherwise since XX/XX/XXXX other than my acceptance of the Warranty Deed that I paid for with my own money.
5. XXXX willfully and knowingly filed those fraudulent assignments in an attempt to facilitate another fraudulent foreclosure using the newly created loan out thin air from SETERUS. Continued on attachment

Complaint: I once again find myself filing a complaint against Seterus. I am in the process of refinancing and requested a verfication of mortgage on XX/XX/2017. I was told by the agent that it would be sent to XXXX in 3-5 days. I called on XX/XX/2017 and was advised by a differant agent that they were short staffed and it would be sent out no later than XX/XX/2017. It was not sent and I spoke to yet another agent at Seterus who told me it was 5-7 days and with Monday XX/XX/2017 being a holiday the information would be sent on XX/XX/2017 at the EARLIEST. This has delayed my closing as this was the final document that I needed to close. Seterus is deliberately delaying this process that has caused my rate to climb from 3.75 % to and unknown figure well above 4 %. I do n't know how many complaints you must receive before anyone in the government takes action against Seterus. I will seek my remedy through my Congressman and the Virginia Attorney General 's Office and consult with an attorney on my legal rights.

To whom it may concern, I discussed XXXX, SME of Seterus customer service today XX/XX/XXXX to dispute {$90.00} inspection charge that is not my responsibility but the issue from the transit period to Seterus from XXXX in XX/XX/XXXX. I always paid the mortgage on time 100 %. I never got the transfer letter attached in timely manner and they just charged the inspection fees without any inspection notification letter to me. I am so frustrated that Seterus {$90.00} charge on the statement over 3 years that I have disputed.
Per the conversation with Seterus Customer Service team in XX/XX/XXXX, I am requesting to waive the inspection fee {$90.00} charging to my account again. This is not my fault but the fault from the previous the previous mortgage servicer, XXXX that never forwarded the fund to Seterus. I also updated my mailing address timely manner but they did not update the correct mailing address so I could not get the transfer information accordingly. This is not my fault so can not pay the inspection fees {$90.00} that Seretus charged and it is not my responsibility.
Seterus charged 2 times of inspection after XXXX even I updated my address and payment information accordingly in Seterus. Your research department already verified that I paid all payments on time every month.
Please reconsider and waive the charge {$90.00} fee as XXXX and I discussed and agreed on the phone that I am going to make a payment of {$990.00}.

Complaint: In reference to case # XXXX, Seterus made inaccurate statement when it stated that escrow account was open by XXXX Mortgage. It was never open by XXXX. An escrow account requires payment of principal, interest and taxes. I never paid taxes to XXXX Mortgage. Payment records shows that. In fact, even after it is transferred to Seterus, first few months I paid only the principal and interest. Therefore, there was never an escrow account when XXXX transferred mortgage service to Seterus.
As per loan modification, all the documents signed are null and void, because loan modification never went into force.
In any case, the original act by Seterus to set up an escrow account caused financial stress resulting in the damage of credit and unable to take advantage of low interest rates, resulting in serious financial losses.

Complaint: We had been working with our servicer to explore our options to foreclosure. XXXX, our servicer requested all the documentation, which we submitted for a deed in lieu or a short sale. They sent us a letter stating that our packet would be reviewed, and would take 90 days. Please see attached letter.
A few days later, XXXX assigned the servicing to Seterus. We called XXXX again. XXXX representative states they are working on the packet, it 's in the review process, another states they are within their rights to assign the servicing, and send the packet of information, which includes bank statements, taxes, paystubs, and all sorts of other information, to Seterus. XXXX did so without our express permission, or consent, we were never given the option to opt out or noticed that this would be done. That is our personal, private information being shared w/ unknown 3rd parties.
A few days later, we go to check on the property to find a sticker from XXXX pasted to the door. It stated the property " appeared abandon or vacant '' and stated '' we owe an alleged debt ''. First, to let the entire neighborhood know that the property may or may not be vacant puts not only or personal property at risk, but also our personal safety. All on top of announcing we may owe an alleged debt. XXXX XXXX was hired by Seterus a debt collector, meaning they should know announcing to neighborhood we may owe a debt is against Federal Consumer Protection Laws, and trespassing.
On Friday XXXX XXXX, 2017, we got a call from our Realtor, to tell us that the locks were being changed by a company named XXXX, again hired by Seterus.
Seterus has not spoken with us on any of these matters, no foreclosure action has been initiated, no legal action of any kind has been started. Yet they are changing locks, winterizing my property and posting notices on our property. We are still the owners, and have personal property inside of the home. We pay the heating bill, the electric bill, and have contracted with a Realtor to sell the property. Seterus has no rights to change locks or trespass on my property as this is akin to breaking and entering.
We want the locks changed back, and for Seterus a debt collector to pay strict adherence to the FDCPA. An assignment of " servicing '' does not give them any legal or lawful right to put us or our property in jeopardy, nor any right to change locks, or have some unknown company enter our property without our consent.

Complaint: Seterus continues to contact me after many months ago I notified them via the CFPB to stop contacting me until they can provide legal documentation regarding their servicing of the account. They have provide every document except anything that is any way legal and regarding the ownership and servicing of my mortgage. I have asked them several times to stop harassing me and have asked for the proper documentation multiple times as well and they continue to do nothing but harass me.
I would also like the add that I never provided anyone my cell phone number regarding this account. XXXX 'farmed ' the number but assured me via the CFPB that they had removed the number from the account so I would also like to know how Seterus acquired my well protected personal phone number?

Complaint: I fell behind XXXX payment XX/XX/XXXX, I applied for a home mod XX/XX/XXXX With XXXX XXXX XXXX XXXX XXXX XXXX sold the loan after we applied. We had to reapply again. XX/XX/XXXX the home mod was agreed upon. Then it was overturn by XXXX XXXX. I continue making my payments. My payment was rejected XX/XX/XXXX saying I had an escrow account. They told me I needed to pay XXXX. They would bring the account current. I sent the payment. I called to see why the account still had a problem they needed additional payment of XXXX. They miss applied the payment and increase the monthly payment.
I called trying to clear up the account each month it became more and more. So I paid an additional {$1000.00} for six months. I sent correspondence explaining that the property taxes they were collecting was incorrect. I was not able to get anyone to help me. XX/XX/XXXX I sent proof to their department call XXXX and cc the letter to Escrow.
XX/XX/XXXX I received a letter XX/XX/XXXX. Escrow had a shortage of XXXX and my payment was XXXX.
I received another letter XX/XX/XXXX escrow bal. of XXXX. I received the 3rd letter XX/XX/XXXX. My XX/XX/XXXX payment is now XXXX I am exhausted, I cant get Seterus to correct this problem. I need some help.

Complaint: My mortgage company does n't have all of my loan origination documents and they claim they are missing my original amortization schedule. I only know this because I called in to make sure PMI would automatically remove itself next month when my LTV hits 78 %, based on the original schedule. I am currently well below that. The company and their reps basically told me that since they do n't have the original amortization schedule that it would n't be removed. Per the PMI removal regulations ( " When the balance drops to 78 %, the mortgage servicer is required to eliminate PMI. '' ) I do n't feel that the company is meeting their requirement as a mortgage servicer.

Complaint: As property owners of XXXX XXXX XXXX XXXX, XXXX GA. XXXX, my wife and I decided to change our homeowner insurance policy from XXXX XXXX to XXXX XXXX XX/XX/XXXX. We submitted the documents that were asked of us. Then we trusted that the insurance company and mortgage company would act with our best interest, and had informed of us of all steps needed.
We released permission to Seterus ( the mortgage company ) to pay the new homeowner 's policy to XXXX XXXX. XXXX XXXX sent a letter to us on XX/XX/2016, stating that due to non-payment the homeowner 's insurance policy was cancelled.
Unknowingly to us, Seterus had paid XXXX XXXX on XX/XX/XXXX for the policy. Then, they paid XXXX XXXX as well for on XX/XX/XXXX. We did not receive notification from XXXX XXXX that the policy had been reinstated. Nor did we receive notice from Seterus that they had paid XXXX XXXX, and also paid XXXX XXXX. As the homeowner, we were unaware that we had XXXX policies on our home.
XX/XX/XXXX, Seterus sent a letter to us, stating that we owed approximately {$1900.00} for a deficit in our escrow account. When I called Seterus, they were not able to provide an explanation of why there is a deficit. The letter stated that we could either pay the {$1800.00}, or we they would increase our monthly house payment from {$740.00} to {$940.00}.
I became aware that there were XXXX insurance policies for XX/XX/XXXX when I received a renewal policy from for our homeowner 's insurance from XXXX XXXX for the XXXX year. I contacted XXXX XXXX on XXXX XXXX, XXXX, who confirmed that they are currently providing insurance coverage for the property of XXXX XXXX XXXX XXXX, XXXX Ga, XXXX. I then contacted XXXX XXXX on XXXX XXXX, XXXX, who confirmed that they are also currently providing insurance coverage for the property of XXXX XXXX XXXX XXXX, XXXX Ga, XXXX. I then contacted Seterus who confirmed that they also have on record that both, XXXX XXXX and XXXX XXXX are providing insurance policies on the property known as XXXX XXXX XXXX XXXX, XXXX Ga, XXXX. Paying for the XXXX policies out of our escrow account is causing my family punitive damages, for a situation that was out of our control.
I would like for Seterus to return the amount of {$610.00} to our escrow account and apply the additional monies paid each month above the {$740.00}, to the escrow account associated with the mentioned property.
