Complaint: I have never received monthly mortgage statements from SETERUS, Inc. SETERUS XXXX Inc. began servicing my mortgage in XXXX XXXX. I requested monthly mortgage statements via telephone in XXXX XXXX. I was told to make a written request to SETERUS. On or about XXXX XXXX, XXXX, I mailed a written request to SETERUS, Inc asking for monthly mortgage statements to be mailed to me and I requested an account payment history showing payments that I have made to SETERUS, inc. since they started servicing my mortgage. As of XXXX XXXX, XXXX, I have not received a payment history nor have I received a monthly mortgage statement as I previously requested in writing.

Complaint: I began a refinance process of my current mortgage back in XXXX of 2016 at that time the current rates were XXXX percent on a 30 yr fixed rate VA loan. There was a previous problem with the posting of my payments which I did not find out until I started my refinance process. I am now completeing my refinance and the current interest rates are XXXX. I believe that since the mortgage company has caused me to delay my mortgage process because of their mistake which took them over 8 months to correct it has cost me in my refinance. I would like for Setarus to pay the current mortgage company the difference to buy down my current rate to XXXX from XXXX. Or they can pay me the difference in the total payments for the next 30 years.

Complaint: 4 ) Seterus inc acct # XXXX was never late! The XX/XX/XXXX payment received by Seterus on XX/XX/XXXX was not posted to account until XX/XX/XXXX. No payment was reflected has been paid for XX/XX/XXXX and XX/XX/XXXX but I have paid every month since the origination of loan. Seterus claim that my payment of {$960.00} ( for over a year ) was a partial payment due to an increase in my monthly escrow! They claim they sent me a letter but I never receive an analysis or oppurtunity to pay the shortage upfront according to Consumer finance regulatio 12CPR part 1024.17 ( 1 )

Complaint: My mortgage loan is delinquent and I called in to Seterus, Inc to set up payments. I was informed by XXXX that they would not accept my payments. I told him that I am currently XXXX but wanted to keep my home and wanted to make the outstanding XXXX and XXXX payment. Even though we are still within the month of XXXX, XXXX would not accept my XXXX and XXXX payments, unless I also included the XXXX payment. I to him that he is forcing me into a foreclosure by not accepting my payment. He was very abusive and was using strong arm tactics to force me to set up an additional payment for XXXX. I asked was the conversation being recorded, because I wanted to have a record of this abusive behavior that Seterus is utilizing with people attempting to make their mortgage payments. They are forcing individuals into unnecessary foreclosures to keep their servicing record clean and receive additional fees from XXXX.

Complaint: I switched insurance companies so I received a check for the overage when XXXX cancelled. Then I called to see how to reapply the amount for the new insurance. The amount was applied to my monthly bill instead. I have called about XXXX times ( at least ) to ratify this issue. I sent my second check to apply to escrow and they AGAIN applied to my note. I even spoke with a supervisor last time to no avail. I give up. They keep reanalyzing my escrow and increasing my note because of the shortage. I do n't believe calling is helping anymore and need someone else to intervene.

Complaint: I purchased my home on XX/XX/XXXX and refinanced the original mortgage with XXXX XX/XX/XXXX. My loan was then sold to XXXX ( XXXX ) in XX/XX/XXXX. In mid XX/XX/XXXX, I was solicited by XXXX., for a mortgage modification. They claimed that for a fee of {$3500.00} they would be able to modify my mortgage. I employed them based on their promises and agreements and due to the fact that they were law firm. I was instructed at this time that in order to be eligible for a modification, I would need to stop making my mortgage payments. While this seemed illogical, I obeyed. This is where my 6 year journey for a loan modification began. After several different modification companies, attorneys, mulitple foreclosure attempts and 2 rescinded bankruptcies to stave off the foreclosures & sheriff sales, I was granted the loan modification by XXXX. Early in the process, I suffered multiple hardships which further justified the need for the modification but went ignored. It took 5 years before I was finally allowed to speak with my modification " manager '' at XXXX The modification added nearly {$150000.00} to the existing debt of {$220000.00}, with a new note of XXXX. My payment were nearly identical to my original payments, with a term of 40 years. After the trial period, my mortgage payment increased nearly {$500.00}. During this process, I felt misled and lied to by XXXX, various attorneys and XXXX. I feel I was deceived. My life for the last 6 years was consumed by this constant battle of financial XXXX warfare to save my home. Had I known then that the only outcomes were ruined credit, financial distress, near XXXX, relentless harassment and a massive increase to my debt, I would have never stepped foot down this path. I am now dealing with a new servicing company, Seterus, who is handling my mortgage post modification. I feel like I am right back in the middle of the modification with amount of harassing phone calls I receive from this company. For multiple months, I receive calls stating the payment information I provided is invalid. I provided them with the same information, which is kept on record, in their system. This is a recurring problem.

Complaint: I am extremely disturb of the way my loan has being handle by Seterus. I was offer a trial payment for the amount of {$2000.00} for XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. That is not acceptable because is higher than my regular mortgage payment. Therefore I am not able the make those trial payments. I was paying {$1100.00}. before I started to fall behind. I am in need of assistance for a better workout option. My home now has a sale date for XX/XX/2017. However Seterus never postponed my sale date even though I was approved for a trial. I am more than sure that Seterus is involve in fraudulent and deceptive practices in order for them to foreclose me. I have summited a complete modification packet since XX/XX/2017. Seterus was taking forever to cancel the current trial therefore my packet was not able to start the review. I am tired of the excuses I keep getting by Seterus a need a solution an a detail explanation of why my packet has not been review for a better workout.

Complaint: Seterus repeatedly told me the wrong foreclosure date for my house and inaccurately told me that it was postponing the foreclosure sale while it was reviewing me for a loan modification, which it never even did. If Seterus had given me accurate information, I could have gone to court and asked to postpone the sale. But because of Seterus 's misstatements about my foreclosure sale, I lost title to my house, even though my income qualifies me for a loan modification.
I was behind on my mortgage, but I did not know that a foreclosure action had started against me or that the court had entered a judgment of strict foreclosure with a law day of XX/XX/2017, the day after which I would lose title. ( See attached order of judgment of strict foreclosure ). I was trying to do a short sale, but I decided in XX/XX/2017 that I wanted to try to save my house.
On XX/XX/2017, I called Seterus to ask about a loan modification. " XXXX '' told me that a " foreclosure sale '' was scheduled for XX/XX/XXXX but that Seterus would halt the sale if I immediately sent in all of my documents for a loan modification.
On XX/XX/XXXX, I faxed Seterus my complete loan modification application. I called Seterus back, and they requested that I fax another XXXX, which I did. I called Seterus again, and the representative stated that my loan modification application had been received and was at the escalations department, who had the authority to halt the sale. Seterus sent me a XX/XX/XXXX letter stating my application was facially complete. ( Attached ). Each representative I spoke to said my " foreclosure sale '' was scheduled for XXXX.
On XX/XX/2017, I called Seterus and its attorneys several times. The attorneys did not give me any information. The first person at Seterus again told me there was a " foreclosure sale '' scheduled for XX/XX/XXXX and that my loan modification application was still under review. I asked the second person at Seterus whether the XX/XX/XXXX foreclosure sale could be postponed ; this person checked with a supervisor and stated that Seterus does not do sales on Saturdays, so therefore my sale would be postponed. I was told to call back on Monday.
I called Seterus again on Monday, XX/XX/XXXX. " XXXX '' stated that my foreclosure sale had been postponed and the underwriter reviewing my loan modification had requested additional information : another bank statement and a YTD amount on my employment letter. I faxed this information to Seterus.
But when I called Seterus back that day, I was told that my house had been sold at a foreclosure sale on XX/XX/XXXX. The representative told me that the previous Seterus representative who told me it had been postopned was mistaken and that Seterus was not going to modify my loan.
I have since learned that there was n't even a " foreclosure sale '' on XX/XX/XXXX, and that I lost title to my home at midnight on XX/XX/XXXX, which was my " law day. '' XX/XX/XXXX was the last day I could have gone to court to ask to postpone the foreclosure, but I did n't do this because Seterus ( 1 ) gave me the wrong foreclosure date, XX/XX/XXXX rather than XX/XX/XXXX, ( 2 ) told me it was postponing my foreclosure, and ( 3 ) inaccurately told me there was a " foreclosure sale '' rather than the judgment of strict foreclosure ordered by the court. Seterus further solicited a loan modification application from me and inaccurately told me it would postpone my foreclosure during its review, even though it had no intention of actually reviewing it.
If Seterus had given me accurate information, I could have taken measures to delay the foreclosure and protect my interest in my home, including by filing a motion to open judgment with the court. But because Seterus told me there was a " foreclosure sale '' on XX/XX/XXXX which it could and would postpone, I did n't do this ; as a result, I 've lost my home to foreclosure.

Complaint: On XX/XX/XXXX, XXXX, through counsel, submitted a complaint ( # XXXX ) to the CFPB asserting that Seterus, Inc., violated the Real Estate Settlement Procedures Act ( RESPA ) in failing to communicate with him as a " successor-in-interest '' to property subject to a mortgage loan serviced by XXXX and therefore also failed to mitigate its damages. XXXX ' late wife, XXXX, was the only person the note, but both XXXX and XXXX signed the mortgage defined as borrowers. The complaint asserted that XXXX and XXXX owned the property as " tenants by the entireties, '' and both prior to the complaint and within the complaint, XXXX provided Seterus a copy of the Warranty Deed to the property showing such ownership and a copy of XXXX ' Death Certificate. This evidence clearly showed that not only was XXXX a successor-in-interest to the property ( because he became the sole owner by operation of law ), but that he 's ALWAYS had an interest in the property at the same time XXXX had her interest in the property. This documentation unequivocally shows XXXX ' successor-in-interest status, and as such, Seterus should have been satisfied XXXX was indeed a successor-in-interest and it should have communicated with XXXX about the mortgage loan and offered loss mitigation options to him -- but Seterus did not do that.
Instead, Seterus responded ( through its representative, XXXX -- not clear whether she 's an attorney ) that it still wants " recorded documentation showing XXXX is the Executor, Personal Representative, or Administrator of the Estate of XXXX. '' With this response, Seterus is requiring XXXX to exert his own resources and judicial resources to put property through probate that is not required to go through probate for XXXX to obtain a legal interest in such property. Probating the property is not required because he always had an interest in the property, as evidenced by the RECORDED Warranty Deed, and because he became the sole owner of the property by operation of law when XXXX died.
Seterus ' response further said, " in lieu of the above-referenced documentation, XXXX may also contact me directly at the telephone number shown below and advise that he is authorized to pay the decedent 's debt from the assets of the estate, which will allow him authorization to speak to us regarding the loan. '' XXXX disagrees that calling XXXX to say the magic words she wants him to say in any way tends to prove he is a successor-in-interest to the property more than the recorded Warranty Deed and Death Certificate does, much less at all. Regardless, XXXX called XXXX on XX/XX/XXXX and XX/XX/XXXX. Both times he was forced to leave a message, and both times, XXXX failed to return his call. As such, Seterus continues to put up artificial barriers to XXXX being able to work out loss mitigation options to save his home from foreclosure.
Also, XXXX submitted a loss mitigation application, which was received by Seterus on XX/XX/XXXX As of today, XX/XX/XXXX, Seterus has failed to notify XXXX within 5 days of receiving the loss mitigation application that it acknowledged receipt of the application and that it determined the loss mitigation application is either complete or incomplete, as is required in Regulation X at 12 CFR 1024.41 ( b ) ( 2 ) ( i ) ( B ). Moreover, Seterus has failed, within 30 days of receiving XXXX ' loss mitigation application, to evaluate him for all loss mitigation options available to him and to provide him with a notice in writing stating its determination of which loss mitigation options, if any, it will offer him, as is required by Regulation X at 12 CFR 1024.41 ( c ) ( 1 ). So, Seterus continues to violate RESPA.

Complaint: i did a modification on my loan and was lied to saying i was getting a % reduced and a term extension. And a few years later when i wanted to sell my house Seterus ( who have a one star rating out of 5 ) they added {$48000.00} to my loan??? They never said anything on the phone about that at all??? And they say i signed for it that way. but, every time i ask them to send me the full contract for my lawyer to look at they do n't? Everybody i talk to that is in mortgage business never NEVER! heard of such thing. and when i get all my statements per via email its shows what i should owe on the house. never shows the amount with the extra {$48000.00}. weird. shows i owe {$100000.00} but when i call them they say i owe {$140000.00}

Complaint: I am having a problem with the current holder of my mortgage loan, Seterus Loan Servicing. I have dealt with rude customer service agents who refuse to look at my current financial situation or assign a designated contact to work with me. My loan is a government Fannie Mae loan and I know that there are some new programs available for homeowners like me who are struggling. I bought my home in XXXX and my loan was transferred to XXXX. I dutifully made my monthly payment until the recession hit and I lost my job after 16 years with the same company. I had issues trying to get set up for unemployment and after my savings were depleted I fell behind. Once I found work again I tried to engage with XXXX ( who now held the loan ) but they would not work with me unless I got caught up on the payments -- but I was too far behind at that point.
I finally got some traction in XXXX when the loan was transferred to Seterus and went through a review for a modification and was approved. The problem was that my payment went up nearly {$400.00} a month and my interest rate was 5.5 %. I was scared this was all I would ever receive from them so I accepted the offer and paid on it for as long as I could until it just did not work anymore. Since that time I have repeatedly tried to re-engage Seterus but have made no progress. I just heard about some new Fannie Mae modification programs that have been started and I believe that I fit into the rules for these programs. I have attempted to get Seterus to review me for these programs but continue to get poor customer service and deal with disinterested and rude agents. I do not think this is a good way to run a company and want to file a complaint against Seterus.
