Complaint: Seterus has mis applied payments which has distorted my credit rating and overstated my loan balance. This is obvious to a XXXX man. I have paid all real estate taxes and insurance, yet Seterus shows a credit balance in a fake escrow account of {$1100.00} while sending me letters that I owe {$2000.00} for past real estate taxes. I have provided them with cancelled checks.
How long can these people continue to distort my good credit rating. This is so obvious, they are brain dead and should not be allowed to be a credit collector

Complaint: I have the final payment amount for my 30 yr mortgage and the lien holder is demanding that I pay this amount via XXXX money order to a special account. Otherwise they will charge daily interest on any amount not received by the normal mortgage payment date.
I do not understand how they can change the rules on the final amount rather than accept the payment via routine authorized account withdraw as we have for the duration of the loan. This sounds like a trap to squeeze more money out of us. This loan was sold to Seterus who have hounded us ever since.
Resolution requested is to have them accept the final payment via the routine account withdraw.

Complaint: Our home is in a flood zone so flood insurance is required. We changed policies and sent the new XXXX to XXXX which is Seterus 's insurance agency. They have repeatedly sent more letters, yet we have sent a hard copy via the USPS, and have FAXed the XXXX page twice. Once on XX/XX/XXXX, and again on XX/XX/XXXX. We phoned their calling center, ( the only contact number they give ) and they have no clue why they are unable to record this info.

Complaint: My loan is being serviced by Seterus Inc. and over the past 2 months, I have been offered a loan modification 3 times and I 'm continually getting harassing phone calls which have escalated to personal attacks by each of the representatives on the call. I was in a loan modification last year but due to severe family medical issues, I was unable to continue to pay the mortgage after the 1st modification was approved. Again, they have offered me two times another loan modification only to retract the offer and try to force me to leave the home using pressure tactics. I do not believe that I 've been treated respectfully or with any intent whatsoever to keep the home and they have lied to me multiple times with what they are offering only to tell me that I should leave the home and let them proceed with foreclosure to completion. I went to court to explain my intent and was granted time to work something out with Seterus and I have until XXXX XXXX but they still tell me that I have to leave my home. The harassing phone calls and personal attacks each time the call me along with pressure tactics ( and psychological ) tactics have been very disturbing to me. I 'm looking to work out a payment arrangement so that I can stay in the home now that I 'm finally getting over my medical issues and with one of my family members. This servicer is brutal in it 's tactics. The lying and the escalation of personal attacks on me is taking it 's toll.

Complaint: Mortgage servicer was maintaining a rolling late fee accumulation while payments were being made on time. This resulted in the accumulation of {$2700.00} in late fees. There are XXXX occurrences of late fee charges that ranged from {$0.00} to {$860.00}. This accumulation began on or about XXXX of XXXX.
Mortgage servicer was negligent in maintaining a sufficient escrow account minimum and a monthly funding amount to prevent shortages. This resulted in numerous escrow advances to occur to cover shortages in paying property taxes and home owners insurance. In the process of repaying the escrow advances, the mortgage servicer misrepresented the distribution and allocation of regular monthly payments to repay these escrow advances thus resulting in classifying the mortgage payment as being short. This forced a suspension of remaining funds from the mortgage payment and a late fee to administered. There were XXXX different occurrences of escrow advance repayments processed totaling an amount of {$3500.00} from XXXX of XXXX to XXXX of XXXX.

Complaint: I got an approval on my request for a Loan Modification submitted on XXXX to my mortgage company SETERUS, they set a Trail Mod Payments starting in XXXX/XXXX/XXXX on the amount of {$900.00} All notices in regards to this approval I received over the phone, I never received any documents by mail, email or fax, neither my housing counselor.
On XXXX XXXX, XXXX I was requested by SETERUS to pay {$650.00}, until that moment no documents were received from SETERUS, not Trial Loan Mod approval, nor Permanent Loan Modification Agreement, as I expected after to fulfill my three trial payments on the full amount on time.
There were so many phone calls to SETERUS requesting for documents above mentioned, but always servicer stated that they will send the right documents to my address ( Principal Residence ) and never accomplished.
On XXXX/XXXX/XXXX SETERUS informed me that they will extend my trial loan mod for another three months, and they will continue debiting my checking account for {$900.00} In addition, servicer stated that day that I should submit Permanent Loan Modification Agreement not later than XXXX XXXX, otherwise they will reassume foreclosure procedures ; however, they still did not send any document to accept and sign!!!!!
This is a XXXX Investor mortgage, the reason why we already contacted investor and let them know about this unfair and illegal procedure.

Complaint: In XXXX of XXXX we had a water leak at our home. Upon investigation it was found to be water from a broken pipe in the wall and water overflowed the dishwasher. We hired a public adjustor. He settled both claims with our insurer. One claim was {$8300.00} and the second was XXXX. We had the public adjustor sign the checks as well as XXXX bank our second mortgage holder. We sent the two checks to Seterus, Inc our principle mortgage holder. Seterus had a series of steps they wanted us to do. We complied with all by XXXX of XXXX. They released the check for {$8300.00} but have been holding the second check for {$11000.00} for two years now. We complied with all paperwork needed and sent in notarized documents on several occasions. Each time we ask for the money they add another demand for more or different paperwork never before mentioned. They are nearly impossible to speak to on the phone. But we have been told several times the money would be released ( on calls they record ), only to find the money is still being held. We have the initial document they sent us with all of their requests. We have our paperwork showing compliance with all of those requests. We want the money released for repairs. We have already sent a notarized document to them approving them inspecting the work when finished to safeguard their interest. We would appreciate any help in getting this money.

Complaint: On XX/XX/XXXX my company transferred me to the state of XXXX from XXXX. I contacted my Mortgage company to inform them of this change and that I was unable to hold the property located in XXXX while living in XXXX and what would be my options. Since I would be unable to sell the property for what I owed due to the housing economy in XXXX that I would have to put my home up as a Short Sale. I have lived and owned this property for 10-years and the mortgage Company Seterus purchased my loan from XXXX a few years prior.
During the short-sale process, my realtor in XXXX was able to obtain a buyer for the property and a prices was agreed upon with Seterus. The closing date was scheduled for XX/XX/XXXX. As the closing date approached, I received a call from my Realtor stating the buyer fell through. I immediate called my mortgage company because since the closing was in early XX/XX/XXXX that I was told that I did not need to make XX/XX/XXXX payment since a purchasing sale was signed and a closing date was scheduled in early XX/XX/XXXX. Since it feel through - I placed a payment immediately via phone with Seterus to meet the grace period and avoid late fees. My bank statement showed the transaction was processed. Back to square 1 in locating a new potential buyer. Around XX/XX/XXXX I receive a letter from Seterus stating that I was late in my XXXX payment and that I need to contact them immediately to work out a payment plan. I was like what and furious - I contacted the mortgage company and gave them the transaction number from when they pulled the funds out of my account. They stated they had no record of the transaction and would need to do an investigation and required me to make XX/XX/XXXX payment or I would be charged late fees. I expressed to them that they pulled the $ 's out of my account and it was not like I would have these funds readily available and that as far as i was concerned payment was made and that they needed to investigate. XX/XX/XXXX arrived and I made XX/XX/XXXX payment and in turn they applied it to XXXX, making me 30 days late for XX/XX/XXXX. I did not know this until I receive another letter from the mortgage company stating that my XX/XX/XXXX payment was due immediately and that I needed to pay to avoid late fees. I contacted the company and at this point is when they informed me that the payment I sent for XX/XX/XXXX they applied it to XX/XX/XXXX, still unable to explain to me where my {$1100.00} payment they pulled in XX/XX/XXXX went and I was told they were still investigating this. I was unable to make another {$1100.00} payment since I had just made another payment for XX/XX/XXXX. Approximately XX/XX/XXXX I receive a letter from Seterus stating they had located the payment that was pulled out of my account in XX/XX/XXXX and that it was their error and had placed the payment to another account. I was relived that finally they had located the payment, but in the meantime they submitted to the credit bureau that I was 60 days late. I called them again upset and they told me that they were unable to remove that due to govern rules. I have been fighting with them ever since to get this removed from my credit. The property finally sold in XX/XX/XXXX and I have always made my payments on time prior and upto the day the property was sold. I believe this company intentionally made these mistakes which caused scared my good standings. I need to report this company their unethical behaviors.

Complaint: My name is XXXX XXXX and I have owned my home for 27 years. I am now facing a foreclosure sale date on XX/XX/XXXX because the company that is holding my mortgage loan Seterus is refusing to reopen a review of my current financial information in order to qualify for a modification of restructuring of this loan. My mortgage loan is backed by XXXX and I have found out that XXXX has several new programs they introduced that are designed to help struggling homeowners. I have been struggling after being laid off in XX/XX/XXXX from my primary job. I was able to hold things together with money from my XXXX and seasonal income XXXX but was not able to afford my mortgage. I applied for help and ended up getting approved for a new modification, but instead of lowering the interest rate or the payment it actually made it INCREASE. Based on the money I was earning at that time this was not affordable.
I have now been back working XXXX jobs for several months and my financial situation has improved. The problem is that Seterus has already closed my case, and refuses to give me another chance to be reviewed for modification programs and instead is trying to foreclose. There is no open case, no single point of contact etc. I thought that if your financial situation changes or improves that the lender is required to conduct a new review of the current information to determine what I could qualify for. I do n't think it is right or fair that Seterus is failing to offer me access to these government programs that I feel I qualify for. I am a XXXX veteran and working XXXX jobs to make ends meet. I have lived in this house since XX/XX/XXXX and have never had a problem paying my mortgage until the last two years. I feel that I deserve a fair shot and should be treated properly and given access to all available programs to try and save my home.

Complaint: Our mortgage statement indicates that there is no late payment until the XXXX of the month. XXXX, even though I make the payment before the XXXX we receive statements that are issued prior to the XXXX and indicate a past due payment. This adds to the overall cost of the mortgage. I called company about this and I was told that there are no additional costs to the mortgage just because the new statement does not include the latest payment. For example, I paid XX/XX/XXXX payment on XX/XX/XXXX. I paid current payment and added payment principal payment of {$150.00}. Statement dated XX/XX/XXXX ( attached ) and received on XX/XX/XXXX shows a past due balance.
Seterus consistently issues monthly statements prior to the XXXX of the month, causing the perception that the payment is late, thus allowing them to omit applying most recent payments and incurring a higher mortgage balance as a result. If there is no grace period and the payment is in fact late, why does the late fee begin after the XXXX. This policy has negated all of the extra principal payments we have made, although Seterus denies it, but simple math indicates otherwise.

Complaint: NOTICE OF ERROR AND REQUEST FOR CORRECTION XXXX This is in response to your letter dated XXXX regarding the inapplicability of the rescission of the alleged contracts that encumber my home.
Please make note of the following facts.
1. The written request to cancel and the refund my $ XXXX was delivered to and acknowledged by XXXX ( The Manager of XXXX that initiated the contracts ) on XXXX at XXXX.
2. The rescission of those contracts was effective as of XXXX on XXXX.
3. The rescission was proper, timely, and unchallenged by XXXX in " XXXX ''.
4. XXXX I put a copy of the same written request in the hands of XXXX of XXXX. XXXX did not challenge the rescission in XXXX.
6. These heavily flawed NOTES and DEEDS that have been continuously used to extort money from me since XXXX were rescinded and extinguished XXXX.
7. XXXX did not acquire servicing rights from XXXX on XXXX, as there were no loans to service. XXXX can not transfer the servicing of what it does not have.
8. The loan contracts initiated by XXXX against my property were effectively rescinded in XXXX and were not a part of XXXX receivership by the FDIC in XXXX.
9. XXXX 's attempt to rebrand what it knows to be a dead and yes fraudulent note with a NEW LOAN number by way of an " assignment of servicing '' to Seterus is unconscionable.
10. Seterus has created a new transaction and given it a new loan number that has nothing to do with my property. XXXX has no record of this loan of Seterus '. XXXX had a record of the loans with their corresponding numbers from XXXX from XXXX.
11. Seterus does not service or recognize the above listed Mortgage contract identified with ID # XXXX. XXXX must cancel that note and deed as it no longer has a balance to be repaid and has a cloud on my title.
12. XXXX needs to remove the deceptive assignments of Security Deed as XXXX did not acquire ownership to convey to XXXX. XXXX XXXX gained ownership of the defective paper in XXXX. Your erroneous and willfully deceptive assignments create a cloud on the title to my property.
13. No provision in that voided deed includes a right for the creation of a new loan ( and loan number ) with a transfer of servicing or the sale of a note. Section 20 provides for notification of change and the inclusion of the name and address of the new servicer and the address to which payments are to be made.
