Complaint: I have had a financial hardship and have filed for a loan remodification. Since I have filed for a loan remodification I have requested other information to be mailed and emailed that I have not received. I have also had problems every time I call them and can never get through to speak to someonethat is handling my case. My options are to leaves voicemail and wait for someone to call me back within 24 hours and i still do not receive a call and I 'm always having to call back and speak with someone that is not assigned to my case/loan, which is frustrating and time consuming. As of now I am facing foreclosure and am required to vacate my home within 5 days.

Complaint: In XXXX we entered into a Deed in Lieu contract with our mortgager, XXXX XXXX XXXX after an unsuccessful attempt to sell our home in a short sale. After complying with all the requirements of the DIL contract, to include vacating our home, XXXX took possession of the property. In XXXX XXXX, XXXX transferred service of our loan to Selene Finance. At that time we were told that because we were in the final stages of the DIL process, it was just a matter of Selene Finance completing the process and recording the DIL with the county where the property is located. Almost 2 years later this has still not happened. I have contacted Selene Finance over 60 times in the past 22 months and have only been allowed to speak with the customer service rep who answers the phone. I have spoken to my single point of contact 3 or 4 times ( he has only returned my phone calls once ). Customer service told me back in XXXX XXXX that they had the signed DIL from XXXX on file. In XXXX XXXX I was told by Selene Finance Reps that it would take about 45 to 60 days to complete the DIL. In XXXX XXXX, Selene Customer reps told me it was the county holding up the process, they were just waiting for the recorded documents ( I contacted the County and they reported they had not received anything regarding a deed change on the property ). In XXXX of XXXX Selene reps informed me the DIL had been completed as of XXXX/XXXX/XXXX and we were no longer the property owners. Next Selene reps told me they were waiting for XXXX to submit the original documents to them. In XXXX XXXX I was told by Selene reps that the DIL had been accepted and completed on XXXX and we should be receiving a release of debt in the mail. In XXXX XXXX I get a call from them telling me I am in active foreclosure, but then they verify that we intend to continue with the DIL. I 'm then told the DIL was accepted as of XXXX/XXXX/XXXX and was sent to " claims '' and the property was considered real estate owned. Each time I call I am told the file is in claims, and they are just waiting for their lawyers to send us a release letter. But the Customer service reps assure me they will send an email to " escalate '' my file. When I request to speak to someone in claims I am told they do not take outside calls. I have also attempted to email the resolution despite dept. but it bounced back. I have sent written correspondence and in XXXX of this year I had an attorneys office send a letter on our behalf. Selene 's response was they were awaiting clear title and they would have the DIL sent for recording. When I last contacted Selene Finance on XXXX/XXXX/XXXX a manager told me that the DIL was sent off to the attorneys for recording on XXXX/XXXX/XXXX. As I have been told this numerous times in the past by Selene reps I have little faith that they will rectify this situation any time soon. Their unwillingness to proceed in a timely manner or to even contact me with information or questions concerning the loan has caused much hardship and anguish in my living situation.

Payments are up to date and when told this, we are told they have no way of knowing this because the computer automatically generates the account as delinquent and they will continue to make the calls.

Complaint: This is probably my XXXX complaint on this same issue. We are on our XXXX bank because our loan continues to get sold. the complaint is with Selene Financial. We were working on a loan modification which would involve taking off the mortgage an ex wife and adding XXXX names onto the mortgage. It also involved reducing our mortgage to fair market value. After months and months of paperwork and waiting we finally made a deal and got the ex wife removed, and the mortgage reduced to {$270000.00}. This was the end of XXXX 2016. The stipulation was we have to make XXXX consecutive payments of {$2000.00} and after the XXXX payment the new loan would take effect. We made our payments as instructed and the day before the XXXX payment was due we were told our loan would be sold. When asking if they can get the modification done first I was told ( see attached ) the the new loan company would honor the agreement. That was the last I was able to communicate with our negotiator at Selene Financial. I had e mailed him and tried to call him numerous times after his last e mail because I wanted to make sure they sent over all the paperwork as there is no way we should have to do it all over again. We held up our end of the bargain now Selene needed to follow through with theirs. I found it interesting that they made the deal with us the same day the loan was sold even though we were not notified it sold until XXXX XXXX ... .This actually been a two year ordeal..the bank before Selene was horrifying as well and I had made a complaint to you about them. They conveniently sold our loan to Selene before ever doing a loan mod with us. I am just beside myself and fed up. All we want is a fair market loan, and a company to follow through with their promises. We called the new bank, XXXX and they said they do n't have everything and they still have the old mortgage and the original names. Meaning nothing of the new deal that Selene promised us is in their records. What I want is our loan Mod that Selene agreed to be in place ASAP with no more paperwork! It should have just transferred over since we did what we were supposed to do.

Complaint: Selene Finance LLC too over my mortgage from XXXX XXXX XXXX as of XXXX XXXX. I was approved by XXXX beginning XXXX/XXXX/XXXX for a loan modification and paid them {$740.00} every month until XXXX/XXXX/XXXX when Selene took over. Unbeknownst to me, the modification was rejected to a incorrect paperwork filed by XXXX but they did not inform me that there was a problem. XXXX did not fix the error with the paperwork nor with the balancing of my account. So when Selene took over the account, they sent me a notification that I was in arrears from XXXX and that I owed back payments. I had to send the approved modification document because they did not have the approved copy. I still continued to make the {$740.00} payment to Selene monthly as they said that they were still trying to update their records from XXXX. I received more collection letters XX/XX/XXXX and called to ask why. I was told that again it was because they did not have a copy of the modification and that according to the balance sheet they got from XXXX, it show that I was past-sue and not making the correct payments of {$940.00}. XXXX and I both sent a copy of the modification again. On XXXX/XXXX/XXXX, I received an Annual Escrow Acct Disclosure Stmt reflecting a surplus of {$1800.00} that was over-paid to my escrow account. I called Selene to find out if this was correct and was advised by XXXX, a CSR, that it was. I faxed a letter to them as instructed to apply the money to my XXXX, XXXX, and XXXX XXXX payment. I received a Letter of Intent dated XXXX/XXXX/XXXX from Selene stating that I was in default and had 30 days to pay {$16000.00} due from XXXX/XXXX/XXXX. I contacted them to ask why considering that XX/XX/XXXX I was with XXXX. I was told that there was no modification paperwork again and that was what I owed from XXXX and them. XXXX with XXXX and myself called Selene where she explained what had happened and that they did have all of the documents. Selene advised her that they were still trying to fix the account from taking it over. After they updated the systems, they showed that I owed {$3000.00}. When I would call the account rep, he would simply tell me that I was 6 months past due and that is what I owed. I still continued to make my {$740.00} payments every month. Finally in XXXX XXXX, a representative finally explained to me that I was given incorrect information regarding the Escrow over-payment and in fact owed the the money I took the credit for. He also explained that my monthly mortgage amount as of XXXX XXXX was {$720.00} not {$740.00}. I sent them a check dated for XXXX/XXXX/XXXX for {$3000.00} to bring my account current. My credit reports with the bureaus reflect that I still a past due amount of {$3600.00} and that my account has been past-due 180+ days past due as of XX/XX/XXXX. I have filed disputes with the credit bureaus however they refuse to correct the information. I have repeatedly contacted Selene who claims that they will research and correct the information. How could I have been 180+ days past-due in XXXX XXXX when they only had my account for 60 days. They last updated to XXXX XXXX/XXXX/XXXX not update anything. My account is current as of XX/XX/XXXX and was only behind due to being misinformed by THEIR representatives.

Complaint: To whom it may concern : XXXX XXXX and their attorney 's are attempting to steal my home.
An option ARM mortgage was taken on my condo in XX/XX/XXXX with XXXX XXXX and in XX/XX/XXXX due to financial hardship, XXXX XXXX gave me a trial payment for approximately {$900.00}. which I paid without fail for 1 yr instead of the 3 months I was originally told it would run before approving me for a loan modification. XXXX XXXX then acquired XXXX XXXX and not only returned my last payment, they canceled my payment plan even after submitting XXXX modification packages both denied by XXXX.
At some point XXXX XXXX contacted me saying they had taken over from XXXX and not only did I make a {$15000.00} payment to XXXX, I also submitted a XXXX loan modification package which was again denied.
Recently XX/XX/XXXX I received a letter from XXXX that Selene Financial would take over my loan account. Around the same time XXXX XXXX law firm XXXX XXXX, has been representing XXXX XXXX and who I had not received any notice from in over a year, sent a letter acknowledging the rescheduling of a court hearing! This took me totally by surprise because I would never disrespect the court by not appearing at any hearings. I became suspicious because at previous hearing, an attorney from this very same law firm threatened me outside of the court room saying he " was going to take me out because I 'm the hit man they call in at the end. '' and I immediately went back inside and told the judge. On a hunch I decided to go down to the court house to look up my file where I discovered that for over 1 yr XXXX XXXX and their attorneys have been lying to the judge and quietly pushing my case through the courts system by sending all appearance notices to addresses in Florida I 've never lived at or been to since XX/XX/XXXX giving the judge the false impression I was simply ignoring the hearing dates and was absent at all the hearings thereby giving the judge no choice but to rule against me and in favor of XXXX XXXX and their sneaky attorneys.
Every single loan modification document submitted, including paystubs, bank statements, real estate tax payments and common charge payments clearly show I 've been in New York at the same address in question SINCE XX/XX/XXXX! All of the sudden this same XXXX XXXX law firm XXXX XXXX do n't know where I am? My file is full of sworn affidavits of people/attorneys swearing they could n't find me anywhere so that 's why the just should just sign the orders being put in front of her.
Because I was fortunate enough to receive this most recent court notice at my correct and only address since XX/XX/XXXX, I was able to appear at the hearing and totally surprised the attorney from XXXX XXXX when I stood up during the calendar call. XXXX XXXX 's attorney became very upset when I insisted with the court clerk that I be allowed to see the judge that day to let her know of their deceit. The XXXX XXXX attorney then complained he did n't want to be " side swiped '' because he was n't even prepared to address my case. He came expecting a slam dunk signed order and that 's it. The court clerk then told me that I would not be able to see the judge that day because the calendar was not only full but I also needed to properly format and prepare my response or complaint so the judge could hear me out. I only agreed because I saw they were not going to let me see the judge. XXXX XXXX and their attorneys are not only trying to steal my home, they are misleading, cheating and lying to the judge, falsifying sworn affidavits and willfully, maliciously breaking every single settlement item they agreed to in the National Mortgage Servicing Settlement. XXXX XXXX and their attorneys should be punished and made to pay me including reducing my principal and instantly approving my modification.

Complaint: I got a mortgage in XXXX through XXXX XXXX, It was transferred to XXXX and then XXXX XXXX XXXX. I filed Chapter XXXX bankruptcy in XXXX XXXX. At that time XXXX was included to cover arrears. They were also paid interest on top of the arrears principle. I made all of my regular mortgage payments during the 5 years of the XXXX XXXX. The loan again transferred to Selene Finance who held the serving at the time of discharge of the XXXX plan which was in XXXX XXXX. It appears that they did not apply any of the monies they received to my mortgage. They sold the servicing to XXXX which is a collection company.
XXXX says I am 10 months behind on my Mortgage but I have made my payments each and every month.

Complaint: Selene Finance is the service my loan was transferred to, by XXXX XXXX. I spoke with XXXX at Selene today to indicate I was wanting to participate in the modification program that was offered to me in their letter dated XXXX/XXXX/2016, which I received on XXXX/XXXX/2016. He told me I was not allowed to participate in it because the house was already foreclosed on. The letter said I had until XXXX XXXX, 2016 to decide and have the paperwork to them by that date as specified in their letter. Why was this offered to me if they had no intention of allowing me to participate? Why did they inform me I had until XXXX XXXX, 2016 to get them the required documents?

Complaint: Selene Finance will not help me figure out why there are so many different amounts used for figuring out my payoff on my home and they are foreclosing even when I told them I was wanting to keep my home. The attached documents they sent me are for payoffs that they did on the same day and the one for XXXX XXXX payoff is higher than the one for XXXX XXXX because of their " XXXX Foreclosure Fees '' they charged. I wanted to know if that was the amount they were charging each month and XXXX at Selene told me he did n't know how the payment department figured out the payoffs for this and they did n't have a phone number or name of the person I should speak with for current payoff information. If I would have been able to get this information today, I would have had the payoff amount. My Aunt was in town and she was going to pay for my home and I was going to make her payments. Because of this conflicting information, and the lack of information I received when I called Selene, she decided against it because she said the amounts did not make sense and until I had that cleared up, she would not loan me the money. My house loan was for {$140000.00} in XXXX and I paid on it for 10 years at which time I needed help with payments and never was able to get it from XXXX XXXX. Now the amount owed is somewhere between $ XXXX - $ XXXX according to Selene and they do n't know where they got the amounts from. I was discharged from the loan in a chapter XXXX bankruptcy and now they are taking my home!

Complaint: Selene Financial has submitted a false credit report regarding my account, and still refuses to send me any statement of my account.
On XXXX XXXX, XXXX, XXXX sold my mortgage to Selene Finance. In the subsequent XXXX months, I have paid the mortgage by phone on the XXXX of each month. On XXXX XXXX, XXXX, Selene refused to take my payment until I signed their mortgage agreement. When the sale of my house became delayed for 60 days, I signed the loan papers and immediately paid the new mortgage amount.
Each time I have called in my payment, I have asked for a statement of my account. I still have not received any statement of any type. Fortunately, I have been sent receipts for my payments.
Last month, Selene submitted an entry to my credit report that I have made XXXX late payments on the account. This report is not only false, but the number of XXXX late payments seems somewhat arbitrary. This will be my second complaint with Selene since they took over my loan XX/XX/XXXX.

Complaint: About XX/XX/XXXX, my loan was " sold '' to Selene Finance by XXXX XXXX XXXX. At the time I began working with Selene to obtain a needed modification as I was unemployed and then return to work making less than before. Selene offered me a forbearance agreement that would result in a loan mod. The terms were a six-month trial payment plan which I agreed to along with their requirement for me to make my first payment via money order and the rest by ATF draft. The ATF draft form was sent to me along with the agreement package, pre-filled with my name, address, draft amount, etc. All I had to do was fill in my bank information, sign it and send it back with the other papers. Selene received the package and cashed the money order, but never started drafting the money out of my account. When they finally contacted me about my payments, they claimed the ATF form was not received. Then after further conversations and me submitting a copy of the signed form, they admitted that the form was in my file, however, the form was invalid because based on my particular agreement I never should have received an ATF form in the first place. I asked how was I supposed to know that since they sent me the form pre-filled. I argued I should n't be penalized for something that clearly was not my mistake, but to Selene it did n't matter and that I was now in default of the agreement. I sought help through a mortgage counselor who witnessed the difficulty and inconsistency in Selene 's communications. The counselor referred me on to an attorney. My only goal was to have Selene honor the original agreement as I feel they had no right to put me in default over their mismanagement. Now in XX/XX/XXXX, after all the attorneys and the back and forth, Selene offered me another forbearance agreement that was clearly a set-up for failure. The terms are vague with no guarantee of resolution to a modified mortgage. If I had signed, it would have been a no-win situation. I would have been at the mercy of Selene and still with the threat of foreclosure over my head which they made very clear was still on the table. So after several years of fighting this, this is where I am with seemingly very little recourse. Lastly, I learned through all this that Selene is a mortgage servicer. Another entity actually owns my mortgage.
