Complaint: In XX/XX/XXXX/XX/XX/XXXX my husband and I was hit with the XXXX XXXX. We immediately contacted XXXX XXXX XXXX ( mortgage Company ) asking for assistance so that we did not fall into delinquency. We were told to fill out a request for modification that could lower the payments. We gathered all the required documents and submitted them to XXXX. No response was ever decided that we were made aware of. Then in XX/XX/XXXX our loan was sold to a company called Selene FInance. It took about 30-45 days before we were contacted by Selene. We explained that we submitted the Loan Modification XXXX and had not received answers back. Selene informed us we would have to start over based on the loan being given to them. So we had to start totally over because the loan number was different and the documents need to be the most recent. All of the documents were submitted after a long back and forth of required documents that was misunderstood. ie..bank statements to include the last pages that were totally blank. Once all documents were sent in to be reviewed the process took over 30 days even though they said it would take no longer than 30 days. XX/XX/XXXX a letter was mailed out to us stating that they were in receipt of the loan request and that evaluations have been made as to which loss mitigation program they felt we qualified for. We were denied HAMP UP, Repayment Plan, Short-Term Forbearance. We were approved for the Standard Modification. The letter also stated that we needed to accept the offer sign and return it to Selene Finance LP or call and verbally accept by XX/XX/XXXX. We verbally accepted as well as sent the signed offer letter and returned by mail. Approximately a week later a XXXX package was sent to our home with numerous yellow sign here stickers were attached to the Loan Modification Agreement documents. We followed the directions that was the top sheet in the package of documents. XX/XX/XXXX we went to a XXXX store who had a notary onsite to get all the documents signed and notarized as stated in the instructions. We mailed all the forms back through the XXXX XXXX. There were some specific information that was conveyed to us and that was the unpaid would be rolled back into the new modified loan balance. We reached out to Selene to find out had they received the package back. The confirmed date that the package was received through the mail system was XX/XX/XXXX. On that day we asked when do we began to make the modified payment. The representative informed us they were swamped and that the actual in-processing of the package could take upto 30 days or more due to the volume of new accounts received from XXXX. We called back in XX/XX/XXXX and was advised that the office was really swamped and due to the holidays it probably was going to be when everyone was back from all the holidays. So the representative said to make the first payment XX/XX/XXXX because they would be back to full staff. We called back to setup online payments and was successful. So in XX/XX/XXXX an online payment was made for {$1600.00} which was the new modified payment amount. In XX/XX/XXXX another online payment was made for {$1600.00} the modified amount. In XX/XX/XXXXa third online payment of {$1600.00} was made for the modified payment amount. In XX/XX/XXXX the online showed there was an error logging in. So we called to find out maybe we were using the wrong password. We explained to the representative that we were trying to make the fourth online payment of {$1600.00}, but was unable. The representative placed us on hold and reset the password. The problem still was not corrected so we called back and then another representative answered the call and placed us on hold, then came back on the line and said we were locked out due to non-payment for the month of XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX. We explained that we were in constant contact asking to make the payment and was told the loan was not processed during those months. The representative explained that we had to make the entire amount or they would not be able to take a payment. In XX/XX/XXXX we received a letter stating that the Title was incorrectly done with the wrong County by Selene. A completely new XXXX package with the Modified Agreement documents inside just like before with all the yellow sticky attached where to sign. We refused to sign another agreement because we had not applied for a second Modification. We contacted Selene and explained that we were not asking for another modification. The representative explained that we needed to sign the documents the date that we originally signed. We absolutely was not in agreement for falsifying documents. As of today XX/XX/XXXX we have not been able to make the payments to Selene. The billing statements come by mail and it shows that a payment is due as of XX/XX/XXXX. As of today the account is showing that we are 19 payments behind. Selene was contacted on a monthly basis trying to rectify the issue. No one is trying to sit down and get to the bottom of this nightmare. We received a letter that explained the home was being auctioned off on the Courthouse steps XX/XX/XXXX. We immediately contacted a lawyer to see if there was anything we could do and the lawyer was retained and he represented us. Our lawyer wrote a letter that stated there were some policies that were not adhered to and therefore the Foreclosure had to be removed and cancelled. On XX/XX/XXXX we were informed that the Foreclosure Auction ( concerning our property ) was cancelled. I was told to contact the Veterans Affairs representative who was assigned to our home loan to find out what was next steps. Once we spoke with the VA rep she explained that we needed to get in touch with Selene. We contacted Selene and they advised that we need to fill out the Borrower Assistance Form. Immediately a squeal was released because this means that we are being asked to resubmit a completely new Loan Modification Request. We are now looking at over {$30000.00} in unpaid charges from Selene. They are saying that the modification was cancelled but the billing statements show that the modified agreement of {$1600.00} was due every month that they would not accept the monthly payment. Only until recently did the amount increase and that was only due to the increase in taxes that is needed to cover the loan which is {$1700.00}. Please help us from being railroaded.

Complaint: I spoke to a manager to figure out a way to get my mortgage back on track. We have a large lump sum of {$55000.00} to put down and we agreed to pay the rest in 3 months along with our mortgage payment and he was sending the paperwork in the mail. That was in the beginning of XXXX XXXX. He called me back a week later and said he was going to email it to me, I never got it, not in my spam, so I call like he said and left a message, still no call back from him or my representative and I 've left numerous messages. My first payment was supposed to be XXXX XXXX. I do n't know what else to due.

Complaint: I am an XXXX working per contract. Last year I had a hard time finding a new contract, so I run out of savings and I fell behind with my bills. Finally in XX/XX/XXXX I found a 6 month contract in XXXX XXXX TN, working for the XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX. We had a very tight schedule. We were working 7 days a week and over time. I received a letter from the mortgage company that my house was in foreclosure however they wanted to help and they were offering me several options. The first option was a repayment plan which I wanted to apply for. I am offering a 6 month repayment plan of XXXX dollars per month. The Bank refused the plan saying I have to pay the XXXX dollars at once. My question is why they offering me a repayment plan as a first option if they are not willing to go with it. On the other hand a 6 month plan is a reasonable plan that will solve the problem in a relatively short period of time. Instead, they prefer to drag me thru the foreclosure. They claim I have to modify the loan, but I say I do not want to do it because my mortgage has a lower interest than any modification. They want to get me on a higher rate so they can rip me off. Complaint: Our mortgage just recently got sold to Selene Finance from XXXX XXXX XXXX, when confronted with XXXX XXXX XXXX told us we have no say in the matter, that nothing will change on our contract on our modification when Selene takes it over, well here we are the second month they have sent us and our PMI insurance went from XXXX to now XXXX. When you call them you can not get connected to speak to anyone. Can you tell us what to do now, since we have been contacting you about this issue for the past 4 to 5 months.

Complaint: I have a government backed GSE Mortgage loan that is currently serviced by Selene Finance. Selene Finance has engaged in a pattern of systemic and serial obstruction of all attempts by me to be considered for mortgage modification or payment relief. I currently have an interest rate of 8.5 % and my monthly payment on a {$370000.00} loan is over {$4000.00} per month. I am a XXXX XXXX XXXX XXXX and my wife works as well. Although my business had a rocky period when the real estate and mortgage bubble burst, I am making a solid living now and between my wife and I we have the income to make a fair mortgage payment. The issue is not qualifying for help, the issue is being given the opportunity to receive help, because we have never actually gotten Selene Finance to conduct a review of our current and correct financial information. I know there are new programs offered for homeowners with GSE XXXX XXXX and XXXX XXXX loans and dont understand why Selene Finance continually changes contacts, loses paperwork and requests the same information over and over. This pattern began with XXXX and then continued when the loan went to XXXX and we are seeing the pattern repeated by Selene Finance. They have now set a foreclosure sale date on our home we have owned for 16 years on XX/XX/XXXX. Selene Finance did so without ever offering the option of mediation through the state of New Jersey, even though this is mandated by state law. I have worked in and XXXX XXXX XXXX XXXX XXXX for over 20 years and have owned the subject property for 16 years. Shortly after refinancing my home in XX/XX/XXXX the real estate market crashed and the bubble burst and took the air out of my business. I lost over half of my contracts and it was a struggle just to keep the business going. I lived off my savings for a time, but eventually fell behind on all bills and began missing my mortgage payment. At that time, I began trying to engage with XXXX to resolve this issue with a loan modification. It seemed like XXXX was purposely obstructing the process, constantly requesting the same documents over and over, then misplacing or losing documents that they claimed they had received. This continued and I began falling further behind on the loan. I continued to try and work this out but it was beyond frustrating and I must have sent over 5000 pieces of paper to XXXX yet could never actually get a decision on my application. When it finally seemed that I was making some headway the loan got transferred to XXXX. I ran into the same problem there. I am XXXX and provided all my financial information but repeatedly got spun in circles by XXXX and never actually was reviewed for any programs nor was a decision rendered. Just when it seemed that I was making some progress my loan got transferred to Selene Finance, and the obstruction has continued. As described, I am doing well with my XXXX XXXX and make a solid living. My wife works as well and with our combined incomes we can definitely afford a reasonable payment. My wife and I have been here for 16 years and live here with our XXXX boys, all age XXXX and younger. Losing our house to foreclosure is not an option. Selene Finance needs to play fair and give us a chance to be considered for all available government, state and internal programs as well as the new GSE programs that were introduced in XX/XX/XXXX. I know there is a way to fix this, the issue is that we have been blocked and obstructed every step of the way for several years. I am hoping that Selene Finance will begin working with us, rather than against us so we can find a workable resolution.

Complaint: Hello, I sent our Mortage Loan holder the following email. I do not understand why they can not waive the late fees. the fees are accumulating on our account and we can not do anything about it. i pay my mortgage every month but after the XX/XX/XXXX is there any other recourse i can take?? also, there was one month when i was out of work and i did not have the entire XXXX, so we sent in the principle only thinking they would credit our account. But instead they held the payment and put us in default and we were charged late fees, it took me months to finally pay the bal to get out of default. I am not sure that was even legal to do. Dear Selene, I am sending you this email regarding my mortgage loan and late fees. I have appealed to you before regarding the late fees you continue to charge my account. I had explained to you before, that we can not pay by theXX/XX/XXXX of the month because my husband is retired and his money comes at the end of the month. we do not have an addtional XXXX to send to you before the XX/XX/XXXX Before our mortage was acquired by you, we had XXXX XXXX XXXX, and they worked with us to waive the late fees. I pleaded to you to do the same. You pride yourself in helping your customers but i find this is not true. now the late fees are adding up and it is horrible. once again I ask that the late fees be terminated. we do pay each month but the end of the month. Selene Finance is being sued for insurance fraud by XXXX vs Selene XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX MN XXXX XX/XX/XXXX This Loan was originated XX/XX/XXXX with XXXX XXXX, now defunct, at 7.5 % 30 yrs. XXXX XXXX took over the mortgage from XXXX XXXX. XXXX XXXX was servicer from XX/XX/XXXX-XX/XX/XXXX, and here is where the loan payment discrepancy occurred. XXXX XXXX sold servicing rights to Selene Finance ( XXXX ) XXXX, who after zero missed payments, and no offer to modify this mortgage decided to stop receiving my monthly payments at the end of XX/XX/XXXX. I have been battling with Selene, and their Lawyer since XX/XX/XXXX. My mortgage is not foreclosed at this time, and I hope to refinance with another mortgage provider to a get start fresh. Complaint: My problem is with Selene Finance as they continue to try and conduct an illegal foreclosure to cover up the errors made by their own agents and those at XXXX XXXX ( previous servicer ). I can document this information and am currently dealing with the legal department at XXXX XXXX in an attempt to straighten this problem out. I filed a previous CFPB complaint and Selene Finance replied to me and the CFPB with a litany of falsehoods. Selene Finance seems to think that they can lie to a government agency and that you will sweep this under the rug, but I would urge your office to look deeper. In the response to my complaint XXXX, XXXX XXXX states that my permanent modification was denied because I did not provide a quit claim deed to XXXX XXXX. This is false, the documentation was provided in the submission and XXXX acknowledged receiving it. I am formally requesting that Selene Finance produce the package and information that was used to assess and grant the trial modification and all correspondence after that point. The agents at XXXX explained that since I had provided the Quit Claim deed and the Divorce Decree that my ex-wife would not need to sign any modification documents. This is another example of Selene Finance trying to cover their tracks and peddling falsehoods to me as well as a government agency. The fact of the matter is I made all of the trial modification payments, I jumped through every hoop and provided everything that was requested but XXXX lied to me through their blatant misrepresentations. Now that Selene is servicing the loan they own not just the asset but also the liability that comes with this instrument. Their continued advancement of these lies only increase the liability for Selene and should be cause for an investigation by your agency. The response letter from Selene confirms my initial allegation, that I had not received a deferment in the past, even though that was the reason that was repeatedly used to deny my modification request. However, even though this mistake was supposedly fixed, on XX/XX/2017 I received a phone call from XXXX XXXX who said that since I had a deferment in the past the investor would not allow me to be considered for a loan modification. This is a direct contradiction of the information that was sent to me and also the CFPB. Finally, Selene states that I cant be considered for a new loan modification, because they state that my income is not sufficient, and that when I submitted new financial information that the income was the same. This is yet another lie perpetrated by Selene Finance. My financial circumstances have changed and the most recent financial information that was submitted to Selene showed a substantial increase in income. Every time they respond they dig a deeper hole with the lies and misrepresentations. I want to resolve this matter.

Complaint: The lender has failed to postpone the sale date on this file during the review taking place for a loan modification - We were advised the decision will be made on XX/XX/XXXX - this is considered Dual tracking and is a violation of Reg X guidelines - the lender is also not allowing for an appeal period after the decision is made, which is another violation of Reg X. We also have been given incorrect information regarding the file and being serviced transferred as of XX/XX/XXXX which is the current Foreclosure sale date on the property. This review has been on going since the beginning of XX/XX/XXXX with no decision being made - 2 other complaints have been entered regarding this client 's file due to the poor review of this loan and the numerous requests for additional docs that have been satisfied through letter of explanation being submitted regarding the requested information. The reps we speak with also provide incorrect information pertaining to the review and handling of the file.

Complaint: I am filing a consumer complaint against my previous mortgage lender XXXX-XXXX ( XXXX ) for violation to the National Mortgage Settlement ( NMS ). This settlement prohibits lender abuse during the application process of applying for loan modification assistance. Somehow, my ex-wife XXXX XXXX XXXX, was allowed to complete a loan modification without my permission nor signature in or aroundXX/XX/XXXX. As a result of this negligence of XXXX, it appears that because my home loan was allowed to be modified without my consent, the new servicer Selene Finance ( SF ) now refuses to discuss loss mitigation options with me and will only speak with the co-borrower of the loan which just so happens to be my ex-wife XXXX XXXX XXXX. I feel that since XX/XX/XXXX, is still the owner of my loan it is their responsibility to correct the error. In fact XXXX, obtained a final judgement for foreclosure during the time that I was attempting to plead my case with SF, with regards to my rights to the home. First off, Ive provided copies of my recorded mortgage Note dated XX/XX/XXXX, in addition to this my name also appears on title for the property. See Exhibit A ( Mortgage Note dated XX/XX/XXXX ) Secondly, Ive sent copies of the Agreed Order from the divorce that was completed between XXXX XXXX XXXX and myself datedXX/XX/XXXX, which clearly indicates that XXXX XXXX XXXX has released all interest in the home and has no desire to be a part of the decision making process for loss mitigation nor any other subject matter relating to the property. This order releases all liability of XXXX XXXX XXXX and appoints myself as the sole responsible party. See Exhibit B ( Agreed Order Divorce datedXX/XX/XXXX ) Furthermore, both XXXX and SF also failed to adhere to a settlement conference, which is a face-to-face meeting with the lender to work out a foreclosure prevention agreement. ( Ind. Code 32-30-10.5 et seq. ) XXXX and SF have blocked me from the opportunity to satisfy the mortgage debt, instead SF and XXXX prefer to take advantage or abuse our homeowners rights in the same process which are deemed as direct violations to 'Real Estate Settlement Procedures Act ( RESPA ) ( 12 U.S.C. 2601 et seq. ) Regulation X.
