A late should not have been reported as no payment was due, and when payments resumed, all payments were made on time. Complaint: I was part of a repayment plan which I was paying XXXX dollars a month for my student loans with XXXX XXXX. Last year XX/XX/XXXX I lost my job so I fell shins on my loans I started working again in XX/XX/XXXX and XXXX I started to catch up and pay XXXX dollars twice a month to catch up on my loans. XX/XX/XXXX I was calling XXXX XXXX to set up 2 payments every month and the last time I spoke to someone was in XXXX and they told me that once I make these next two payments I would be current. After the 2 payments XXXX XXXX called me non stop 6 to 7 times a day when I called bck they told me I was behind on payments after I advised what I was told the last time they called they weee rude and not listening to anything Im saying. I sent letters out to XXXX XXXX advising that My family and I would no longer like any phone communication just mail communication. They continued to call and call and when i spoke to them on the phone they said I can call you as much as I want no respect at all. Complaint: I have received frequent calls-multiple times a day from the company. I have not contacted as I have a third party contacting them and they refuse to stop. Today XX/XX/18 I spoke with a representative and they stated they would not stop contacting me until I set up a payment plan. I informed them I would not be doing that as I had a third party company and they stated, they do not work with them and I would be wasting my time. Complaint: I have recently been in contact with XXXX XXXX on XX/XX/2018 and XX/XX/2018 in regards to a monthly payment increase on my student loans. The program that I was in and able to maintain was {$210.00} and has now increased to {$460.00}. I called XXXX XXXX to ask if the payment could be lowered to an amount that I could maintain being that I am the sole provider in our household due to my husband returning to school full time for an XXXX XXXX XXXX program. When I spoke XXXX at XXXX XXXX I was asked to provide my financial profile including monthly income from my job, expenses such as rent, car note/insurance, groceries, cable, and what I currently have in my checking and savings account. I was then told that XXXX XXXX would need to contact my co-signer who is a XXXX year old retired veteran, my grandfather was harassed about his monthly income and payments and was told that if he was not providing enough information. I was then asked by XXXX XXXX what are you willing to do to maintain your payment because based on your credit profile you are not able to maintain your payment. I was then informed by XXXX at XXXX XXXX that my request was denied to lower my monthly payment or offer an alternative method. I begged them and never once said that I was unwilling to make a payment, I simply asked to lower it so the loan would not be defaulted and I was denied. XXXX then asked for my routing and account number and stated that my interest rate would be lowered .25 % if I enrolled in automatic payments which did not lower the monthly payments.

Complaint: Hello : I have a personal loan with XXXX XXXX from my XXXX degree that I completed in XXXX. I recently went into repayment as of last year and XXXX XXXX failed to update my address and deliver the notice of repayment to me via either email or phone or even regular mail. I spoke with them on the phone about this when first noticed this and they admitted and acknowledged that it was indeed their fault and they would fix it on their end. In addition, they proceeded to immediately report me to credit bureau following the call for being delinquent on my student loan even though I made a payment during the call to make my account current and set up an automatic payment for the lifetime of the loan. I am currently in my XXXX. program in XXXX XXXX, XXXX. I submitted a dispute with the credit bureau to attempt to get this information removed from my report or at least a note added about the situation and it was denied after speaking to XXXX XXXX about everything even though I had documentation and proof that was provided about the situation. My credit score took a major hit because of this situation which I found highly upsetting as I was relocating to XXXX for my XXXX XXXX earlier this year during the summer. It was almost impossible for me to get approved for an apartment out here. Thankfully my father was willing to co-sign for me and as a result I have to live in student housing at age XXXX years old even though I can afford to live in a real apartment. So I currently reside in a studio apartment due to this issue with XXXX XXXX that has carried over all these years despite it not being my fault. Now, I am reaching out to you to attempt to resolve this issue. Possibly have them dismiss the entire debt because of this error in reporting on their part as I have suffered more than enough due to their incompetence and am tired of dealing with them. For the sake of reporting them to you, I attempted to log into the website and my user account could not be found even though I know the information like my own ssn but, of course the website was down. I was actually happy they sold my loans to navient the majority of them and excited about the letter received that notified me I currently had no business with XXXX XXXX back in XX/XX/XXXX. Complaint: When I started college there was little options when it came to student loans. Though I did receive a lot of financial aid I still in a lot of hardship. my mother was denied every year for the parent plus loan and I was told my the XXXX XXXX XXXX XXXX XXXX that private loans through XXXX XXXX was my best option for my needs. I was told that they would help me through XXXX XXXX and their Financial Aid office to make my loans manageable and they would only be a little higher than most. One XXXX degree later I am XXXX in student loan debt. XXXX of it is owed to XXXX XXXX. My Financial Aid officer did not even give me an exit meeting and how I was going to handle my repayment. I was left with one single option from XXXX XXXX which was their Graduated Repayment Plan. This plan is only a year of interest only payments. These payments are XXXX a month, this is more than I pay in rent. After the year is over my payments will go back to over 1200+ a month. there are no other options than deferment or the default. there is no help, even though the people are friendly, they give me no options to make sure I can continue my payments. I have 5 loans to XXXX XXXX and I can not combine them. this has put severe financial burden on me. I have gotten a job using my degree and is it no where near enough for my to afford these payments even though I make around 18hr and got this job 5 months after graduating.

Complaint: On XX/XX/18, I reached out to XXXX XXXX in regards to a charge-off that I noticed on my credit report. After waiting to hear back from a dispute that I opened through XXXX, it was noted that XXXX XXXX was not willing to budge on this. I first spoke with a gentleman named XXXX XXXX. When I was speaking with XXXX, I expressed the issue at hand. He first was upset that I did not update my address immediately with him. I expressed how due to personal issues, housing was not consistent and there was no address to update with him for a good period of time. Then, after hearing the amount due, I offered to make small monthly payments but they refused. I was told that if I do not pay the full amount due now, they would report it to a third party which would then in return not allow me to get future jobs of liscenures. I was then told that I need to ask family, friends, and coworkers to pay the amount. I told them I have no-one to ask and I then was hung up on. I then called back, spoke to a supervisor and was told I would get a call back. I then recieved a call back from a different supervisor and she again was unwilling to work with me on anything. I stated my situation and they refused to do anything with deferrment post dated. I was on XXXX, food stamps etc during this time, and they refuse to do anything. After speaking with University XXXX XXXX, they are not too sure why the loan was even taken out in the first place. I attempted to then call XXXX XXXX once more, but no answer or return call. The experience has been horrible. I am willing to do small monthly payments, but they refuse. I do not like the fact that I was threatened with my future livelihood, nor the fact that were entirely unwilling to work with me.

Complaint: I was XXXX years old when I applied for this loan, I was under the impression that this was the best loan for me because I was unable to qualify for federal student loans.
Once I started repaying my loan my repayment amount was about {$650.00} a month. I was unaware the payments would be so high because I was never told what the monthly repayments would be.
Due to financial hardships I spoke to the lender, XXXX XXXX, and was advised that my only options to repay the loan were to 1 ) defer the loan 2 ) declare bankruptcy I had to defer the loan 4 additional times because the payment amount kept rising. Complaint: Dear Sir or Madam : I am writing to you because I am having a problem with XXXX XXXX in that they have violated my rights within the Fair Credit Reporting Act.
XXXX XXXX XXXX XXXX XXXX XXXX, Delaware XXXX This correspondence is a request to have late payments removed from my credit score report. Since both of my loans were granted retroactive forbearance on XX/XX/2017 covering the periods of XX/XX/2017- XX/XX/2017, XXXX XXXX is obligated by the FTC to update previously reported information, therefore both of my loans should not be listed as 90 days late, failure to update these records is in violation of Section 623 ( a ) ( 2 ) of the FCRA .
I have attached an FTC advisory opinion which interprets Section 623 ( a ) ( 2 ) of the FCRA. The issue posed in the advisory opinion is how a lender is to handle a situation when subsequent information updates a report that was allegedly accurate when it was made but no longer is accurate in the present time ( i.e., the identical situation I am currently in ).
The advisory opinion states that the Section 623 ( a ) ( 2 ) of the FCRA addresses the duty to correct and update information by furnishers, or persons who furnish information to consumer reporting agencies ( CRA ) such as credit bureaus. In particular, this section requires a person that has furnished to a consumer reporting agency information that the person determines is not complete or accurate to promptly notify the consumer reporting agency of that determination and provide any information needed to make it complete and accurate. Thus, on its face, this provision requires a furnisher to provide corrected or updated information to the consumer reporting agency that it had reported to originally. This duty extends to all student loan accounts reported to CRAs, regardless of whether they were accurate at one point, because the section requires the furnisher both to update accounts as well as to correct.
After filing a dispute with all three credit bureaus, XXXX XXXXrepresentatives said that because the delinquent payments were accurately reported in those months that any subsequently initiated deferments would not allow for XXXX XXXX to update reports to CRAs to show that the payments were not late and actually in deferment.However, Section 623 ( a ) ( 2 ) clearly shows that the reports must be updated/corrected regardless of whether they were accurate at one point. * Again both of my XXXX XXXX accounts that were reported as 90 days late are now under deferment effective beginning XX/XX/2017 to XX/XX/2017 when I started making payments again so failing do update these records is a direct violation of the Fair Credit Reporting Act.
I am thus requesting that in compliance with Section 623 ( a ) ( 2 ) of the FCRA that my two loans XXXX XXXX XXXX XXXX XXXX XXXX - XXXX and XXXX XXXX XXXX XXXX XXXX XXXX - XXXX be updated and corrected to remove the 90 day late marks on my credit report.
I spoke with someone named XXXX in the Customer Advocate Office of XXXX who told me that they will not do anything further therefore disregarding my rights as outlined in Section 623 ( a ) ( 2 ) where furnishers i.e. XXXX, must UPDATE AND CORRECT information.
